A summary of eBay's User Agreement Policy and Privacy Policy. NET23 - SP3 -2009

1. An eBay user?.... or new to eBay?

2. With “..more than 125 million [users] worldwide today.” (McKay, 2005)

3. I’m sure all of eBay’s members have read the User Agreement and the Privacy Policy?

6. But let’s sum some of it up.

8. eBay users ACKNOWLEDGE and AGREE..

9. That eBay IS NOT involved in the actual transaction between buyers and sellers.

10. That eBay cannot ensure and do not guarantee that a member of eBay’s Site will actually complete a transaction or act lawfully.

13. The truth or accuracy of the listing

15. As an eBay member, the user is responsible for ALL of their actions (however they arise). Even if the member’s account becomes hijacked and misused.

16. In most cases when an item has been sold, the buyer has created a legally binding contract with that other member.

17. Protection for others!A person who provides a free email account (Hotmail, Gmail) upon registration, MUST either provide a PayPal account or Credit Card details as additional information

18. As a member, the user is considered by eBay to have accepted the changes in terms in any policy change just by logging in (whether they are aware of these changes or not!)

19. Any products and content that are listed must be the members own work or work that the member is legally entitled to use.

22. Under 18’s do not qualify to use eBay’s services

23. But IF the user is under 18 years old, the user CANstill use eBay providing they are supervised by their parents or guardian

25. ...as the internet is faceless, it allows for users to lie or provide a somewhat different identity other than that in reality (Pinnelli, 2002).

26. and eBay admit it.

27. Will this stop unsupervised under 18’s from creating an account?.....probably not.

28. Privacy Policy

29. eBay can collect, use, and in some cases, disclose information about members to third parties.

30. eBay do not sell or rent any personal information about their members to any third party.

31. eBay share all personal data with PayPal

33. coming from Gmail.. Gmail eBay eBay can collect websites you have just come from (not just within eBay)E.G. John just checked his Gmail Inbox, now he has navigated and signed into eBay.eBay now know John just came from checking his Gmail Inbox

34. going to.. Other Site eBay eBay can collect websites you have just gone to (not just pages within eBay)E.G. John just checked the finishing time left on a bid he has been watching. With 3 hours left, he navigates away from eBay to look at some pornography at www.porno.com. eBay now know John has gone to www.porno.com to look at some pornography.

35. If eBay merge or were to be bought by another business, members’ information is more than likely to be shared

36. If an eBay member is under investigation, eBay will hand over all of that member’s person information to law enforcement or other government officials.

37. In the event the member ends their account with eBay, don’t expect eBay to remove all of their personal details from eBay’s database. This is due to “technical constraints” and that eBay back-up all data.

42. Due to technical limitations, eBay can not ensure that all of its members’ personal data will never be disclosed.

43. In the end.....

44. If the user is caught for not obeying these terms or just disagrees with them...

45. eBay has every right to temporarily suspend, indefinitely suspend or terminate that users membership
