  1. Do you have a scanner? Well this company can sue you and threaten you to pay up, or else face legal action.   3. Software patents must be abolished for the good of innovation, smooth software use, and to kill patent trolls. Ever try to watch a video, or a program doesn't work correctly on your computer? Chances are a software patent prohibited the developer from implementing the software correctly. Instead of starting from ground zero, it's much more efficient to take something that already exists and improve upon it, thus springing innovation. Lastly, Software patent trolls can cause an entire industry to fold over onto itself, such as if newegg had never won its shopping cart case.
  4. Without software patents, you will notice a drastic amount of innovation happen overnight. Want to have a toaster with its own operating system? It could happen. No longer will companies need to ask each other wether using bits of code is okay, they can simply build upon what others have done without needing to, without fearing legal action. New technologies such as Aero(the over the air streaming service) wouldn't be in the situation they are today if software patents were abolished. Patent trolls, who are companies that exist to absorb patents and litigate people they think may be infringing them in the most minute way(an online “shopping cart” as an example) would also cease to exist, at least on the software front.
  5. I simply bring a viewpoint among thousands of other viewpoints. I'm just a normal person who reads this in the tech news every day, and sees innovation stifled because of big business and even trolls patenting every little thing, trying to make a buck off of litigation, rather than actual work. Chances are you didn't know what software patents were before you came here, so I hope to enlighten you at least a little bit.
  6. If software patents are abolished, Many things could come to light that would never be seen otherwise. A 14 year old improving apple's iOS tenfold, making everyone using an iphone even faster in their daily lives. This could only happen without software patents, because in the world we live in today, that 14 year old would have been sued into the dirt, and penniless for the rest of his life. Companies would freely innovate without needing to worry if someone has the patent for the specific feature they are trying to implement. They could just do it, causing production time to be even faster.

Abolishing software patents can increase innovation, one reason being that companies no longer need to fear litigation if they are using portions of others work to blend with their own, to create something new. What if apple's multitouch could be refined and then used for any phone OS? That could be the case if software patents weren't around anymore.
  9. Slide to unlock, it's something all iphones have, but no others do. Why? Because they patented it, and nobody else can use it. Now when I think of unlocking a phone, slide to unlock seems like a great solution, I can think of a ton of other ways, but none as instinctive and easy to use as slide to unlock. Without software patents, all phones could use this feature, rather than thinking of other ways to get around it and do the same thing yet being “different,” essentially wasting time on something that was already solved.
  10. The pettiness patents provide. As an outsider, looking at some patent cases I can't think of anything other than companies being petty. You can only design an interface to work smoothly so many ways, with so many shapes. Oh, your interface uses a 9x9 grid? Well I patented that one so you're going to need to use an 8x8 or 10x10 grid instead, effectively wasting hours that could be spent actually innovating and making the current technology better.

Companies that exist only to buy patents, and then try to make money by suing companies that implement software that vaguely resembles the patents they have, and make deals with the companies, because it would be cheaper to pay off the trolls than litigate and win your case. and set up Supporting Point Two

The troll in question claims it owns podcasting, and is even trying to sue regular podcasters for use of the medium they believe they own. More things like this can and will happen, unless software patents go by the wayside.

The patent was over the fact that it owned the concept of the “virtual shopping cart,” which as many of you know, almost every online retailer uses. Luckily, newegg won this, but stories like this aren't common, sadly.

Imagine you are a tech-savvy programmer, and you can not believe a company would program their egg timer app they way they have done it, because it sucks, it never works, and half the time it stops working halfway through. What can you do about it right now? Not much. You can build your own, but you'd need graphical assets and everything else if you didn't want it to be nothing but numbers on a screen. Without these patents, you could take that app, and simply change it to your tastes if you were knowledgeable enough, even release your version for everyone else to use.
  16. Now, imagine you are a programmer for a big company. You're creating a program that is a web browser. But you have to create it from scratch. Why? Because if you didn't, you'd be litigated into the dirt because you “Stole” someone elses browser. All browsers work virtually the same, yet instead of taking a browser that already works and improving on it, you have to start from square one to make the thing first.
  17. think of these when you read about software patents, trolls, or whatnot in the news. Write your senators, even your surpeme court justices. Software patents are hopefully starting to come to light in how bad they are not only for business, but the general public as well. Even Washington is starting to notice. Take your time and write them, and explain some of the reasons you think software patents are bad.

  20. In a world without software patents, almost anything is possible. Will your iphone suddenly work ten times faster then it ever did before? Will you be able to watch TV on your toaster while waiting for it to toast your bread? How about being able to play video games that require DirectX on mac or linux platforms? One can dream, but inevitably it will be the cries of the people that make things like this a reality. And without awareness, it simply won't happen. Make yourself heard, write to your senators, congressman, or judges, make sure software patents get the burial they deserve.
