Following studies in the United States and the Netherlands, Erik Wilbers was a research fellow at the Max Planck Institute for Intellectual Property Law.
Before joining the World Intellectual Property Organization (WIPO), he practiced with the law firm of Clifford Chance, was on the legal staff of the Iran-
United States Claims Tribunal, and headed a division of the Compensation Commission of the United Nations Security Council. At the WIPO Arbitration
and Mediation Center, Erik is engaged in the creation and operation of policies and facilities that enhance the effectiveness and efficiency of intellectual
property dispute resolution, including on the Internet.

MOCK WIPO CASE-UDRP ARBITRATION SCENARIO ON DOMAIN NAME DISPUTES

Factual Background
The Complainant, “Compart AG,” was founded in Germany in 1992 and has been providing services in the field of
“software projects / document output and management.” It carries on business in 31 countries and has annual sales of
over EUR 6 million.
The Complainant registered the trademark COMPART in 1984 in Germany in classes 09, 16 and 42. The trademark is
currently registered in the name of the Complainant in numerous countries
The Domain Name was registered by the Respondent on June 4, 2005 when it purchased it from its previous owner.
The Respondent is using the Domain Name in connection with a domain parking website offering links to third parties’
products, including software products.
Parties’ Contentions
A. Complainant
The Complainant alleges that;
• The Complainant was founded in 1992 as Compart Systemhaus GmbH. Since 2000 the company has focused on
document output and management and has evolved into an international enterprise group comprising the parent
company, Compart AG, and three regional subsidiaries in Germany, North America and Spain/Portugal. The
Complainant has trademark registrations for COMPART in numerous countries worldwide including:
o German trademark number 1086545 registered as of September 11, 1984 in classes 9, 16 and 42;
o German trademark number 30546409.4 registered as of August 3, 2005 in classes 9 and 42;
o German trademark number 30546410.8 registered as of August 3, 2005 in classes 9 and 42;
o International registration number 884004 registered as of February 3, 2006 with effect in Switzerland, Romania,

Norway, Turkey, USA, and the European Community in classes 9 and 42.
• The Domain Name was first registered in 1996 in the name of Comp Art Associates of Louisville, USA and was used
in connection with graphic design, marketing and advertising services until 2001 when the company was renamed.
The Domain Name was registered by Domain Deluxe in Hong Kong in 2001. On or after July 19, 2004 the public
WhoIs data for the Domain Name was protected by a privacy shield. The Respondent in this proceeding is Vertical
Axis, Inc., a company known for trying to make money by registering third parties’ trademarks as domain names.
Vertical Axis, Inc. has been a respondent in at least 27 UDRP proceedings; in 12 of those proceedings, the panel
found in favour of the Complainant and ordered transfer of the domain names at issue.
• The Respondent is using the Domain Name in connection with a domain parking website offering links to third
parties’ products, including software products.
• The Complainant offered to pay the Respondent US$7,000 for the transfer of the domain name in September
2008. That offer was rejected. In February 2009, the Complainant received further emails from
DomainBrokers.com on behalf of the Respondent in which it offered to transfer the domain name for the sum of
US$48,000.
• The Domain Name is confusingly similar to the Complainant’s marks since it consists entirely of the highly
distinctive term COMPART. The Complainant relies on a number of decisions under the UDRP in which it was held
that the fact that the marks relied upon by the Complainant contain additional design elements does not prevent
a finding of confusing similarity under the Policy.
• The Respondent is using the Domain Name to divert Internet users to a website which contains information on
various products, including “software”. The website available at the disputed Domain Name provides links to
websites of third parties. The website at <www.compart.com> is used to earn PPC revenues for redirecting
Internet users to third parties’ websites and thus capitalizing on the Complainant’s mark. Such use is not a bona
fide use.
• The Respondent has no right or legitimate interest in the Domain Name. The Complainant has not licensed or
otherwise permitted the Respondent to use any of its trademarks and has not permitted the Respondent to apply
for or use any domain name incorporating the trademark COMPART.
• The Respondent is using the Domain Name to divert Internet users to a website which contains information on
various products, including “software”. The website available at the disputed Domain Name provides links to
websites of third parties. The website at “www.compart.com” is used to earn PPC revenues for redirecting
Internet users to third parties’ websites and thus capitalizing on the Complainant’s mark. Such use is not a bona
fide use pursuant to paragraph 4(c) (i) of the Policy.
• The Respondent is not making a legitimate non-commercial use of the Domain Name. There is no evidence that
the Respondent trades under the domain name or the name COMPART or that it is commonly known by the
Domain Name or the name COMPART.
• Furthermore, the website available at the Domain Name contains links and ads referring to direct competitors of
the Complainant, including <nextag.co.uk>, <software4students.co.uk>, <31touchdownloads.com>,
<ascentive.com>.
• It is inconceivable that the Respondent without knowledge of the Complainant would have placed content on the
website which is related to software products, as the Domain Name has no inherent connection to such products.
• The Respondent should have researched the Complainant or the Complainant’s trademark while registering the
Disputed Domain Name even if the Respondent did not specifically know of the Complainant or of its trademark
rights As stated in Champagne Lanson v. Development Services/MailPlanet.com, Inc., (WIPO Case No. D2006-0006,
<lanson.com>) wilful blindness is a proof of bad faith.
The Complainant submitted evidences and consequently requested the Disputed Domain Name to be transferred.
B. Respondent

Submissions by the Respondent are as follows
• This is a case of reverse domain name hijacking.
• The Complainant only initiated these proceedings after it was unable to purchase the Domain Name through a
series of negotiations culminating in an offer of US$20,000 which the Respondent did not accept. Contrary to the
Complainant’s suggestion that it merely offered $7,000 for the immediate transfer of the domain name, there
were back-and-forth offers and counter-offers, with Complainant raising its offer to US$12,000 and again to
US$20,000. The Respondent has a legitimate interest in the Domain Name because it incorporates the common
dictionary word “compart,” which means “to separate and mark out in parts; to subdivide.”
• The Respondent uses the Disputed Domain Name via HitFarm.com which provides “domain parking services.”
Contrary to the indications in the Complaint, no ads referring to competitor software companies’ software and
other products are included in the website at the Disputed Domain Name. In order to prove this, the Respondent
presented evidence showing links to automobile products and generic goods and services.
• The Respondent uses the Disputed Domain with the domain name parking service HitFarm.com, which displays
pay-per-click (“PPC”) advertising links on the web site. Contrary to the suggestion in the Complaint, the
Respondent has not used the Domain Name to display ads for software or other goods and services competitive
with the Complainant’s. A review of the archive.org print-outs annexed to the Complaint, as well as additional
web page screenshots from DomainTools.com, supports Respondent’s position that it has not used the Domain
Name in connection with software but, rather, with respect to auto parts, related automobile products, and
generic goods and services.
• The Respondent presented evidences demonstrating a Google search result of 899,000 hits in order to prove that
the word COMPART is used by 3rd parties. Additionally, there are numerous trademark registrations incorporating
the word COMPART in Germany and the U.S.
• The Respondent has not engaged in bad faith registration or use. A common word domain name is only registered
in bad faith where the purpose of the registration is to profit from a trademark. There is no such evidence here.
The Respondent registered the Domain Name solely because it incorporates the common word “compart.” The
Respondent had absolutely no knowledge of Complainant when it acquired the registration of the Domain Name
on June 4, 2005, nor was there a basis for such knowledge. The Complainant did not file its trademark application
for COMPART in the U.S. until February 3, 2006, which is eight months after the Respondent acquired the Domain
Name. Although the Complainant had a German registered trademark when the Respondent registered the
Domain Name, it is well-established that a respondent does not need to search the trademark registries in every
country in the world.
The Respondent submitted evidences and consequently requested refusal of the Complainant’s request.

sitelere link (bağlantı) veren bir “alan adı park sitesi - domain parking website” olarak kullanılmaktadır.

Şikayetçi şikayet dilekçesinde;
• Şikayetçi 1992 yılında Compart Systemhaus GmbH ticaret unvanı ile kurulmuştur.
• 2000 yılından bugüne dek Almanya, Kuzey Amerika, İspanya/Portekiz olmak üzere 3 bölgesel coğrafyada iştirakleri
ile var olan COMPART AG adı altında “doküman yönetimi” işlerini yürütmektedir.
• Şikayetçi; COMPART markasını
o Almanya’da 1086545 numara ile Eylül 11, 1984 in tarihinde 09, 16 ve 42. sınıflarda;

• Şikayetçi COMPART markasını ayrıca çok sayıda ülkede tescil ettirmiştir.
• Uyuşmazlık konusu alan adı ilk kez 1996 yılında Comp Art Associates of Louisville, USA tarafından tescil (kayıt)
edilmiş ve şirket unvanının değiştiği 2001 yılına kadar “grafik tasarım, pazarlama ve reklam tanıtım” hizmetleri için
kullanılmıştır.
• Alan adı 2001 yılında Domain Deluxe in Hong Kong tarafından tescil edilmiş, 19 Temmuz 2004 tarihinden sonra
WhoIs veri tabanında “gizlilik kaydı - privacy shield” koyulmuştur.
• Şikayet Edilen taraf olan Vertical Axis, Inc., 3. kişilere ait marka ve alan adlarını tescil ettirerek para kazanmak
amacında olan bir firma olarak bilinmektedir ve daha önce 27 kez alan adı uyuşmazlığı prosedürlerinde şikayet
edilen olarak yer almış ve 12 dava lehine sonuçlanmıştır.
• Şikayet Edilen, uyuşmazlığa konu “Compart.com” alan adını, üçüncü kişilerin “yazılımlar da dahil olmak üzere
ürünleri”ni içeren sitelere link (bağlantı) veren bir “alan adı park sitesi - domain parking website” olarak
kullanmaktadır.
• Şikayetçi, Eylül 2008’de Şikayet Edilene, alan adının kendisine transferi için 7,000 USD teklif etmiş, bu teklif
reddedilmiş, Şubat 2009’da Şikayetçi DomainBrokers.com’dan Şikayet Edilen adına alan adının transferi için 48,000
US$ talep edildiği mesajını almıştır.
• Uyuşmazlığa konu alan adı/“Compart.com”, yüksek ayırt ediciliği olan COMPART ibaresini içeren Şikayetçi markası
ile karıştırılma ihtimali yaratacak şekilde benzerdir. Şikayetçi “markada ilave şekil unsurlarının bulunmasının” alan
adı ile marka arasındaki karıştırılma ihtimalini, dolayısıyla, benzerliği ortadan kaldırmaya yeterli olmadığına ilişkin
birçok UDRP karar örneği sunmuştur.
• Şikayet Edilenin uyuşmazlık konusu alan adını kullanmak için herhangi bir hakkı ya da yasal menfaati yoktur.
Şikayetçi, Şikayet Edilene COMPART markasını kullanmak için lisans veya izin ya da COMPART markası veya onunla
ilişkili bir ismin alan adı olarak tescil edilmesine yönelik olarak herhangi bir izin vermemiştir.
• Şikayet Edilen, uyuşmazlık konusu alan adını “yazılımlar da içeren çeşitli ürünlere ait bilgileri” arayan internet
kullanıcılarına yönelik olarak 3. kişilerin web sitelerine linkler vermek suretiyle her tuşlamada (clik) belirli miktarda
para kazandıran bir site olarak kullanmaktadır. Bu kullanım Politika’nın 4 (c) (i) maddesi uyarınca iyi niyetli bir
kullanım olarak kabul edilemez.
• Şikayet Edilenin, Şikayetçinin yüksek ayırt ediciliği olan ve geniş çevrelerce bilinen COMPART markasını uyuşmazlık
konusu alan adında kullanması için hukuki ve ticari olan veya olmayan herhangi bir iş faaliyeti de sözkonusu
değildir. Dolayısıyla, Şikayet Edilen kötü niyetlidir.
• Bunların yanısıra uyuşmazlık konusu alan adı altındaki site, Şikayetçinin rakiplerinin sitelerine örneğin
<nextag.co.uk>, <software4students.co.uk>, <31touchdownloads.com>, <ascentive.com> sitelerine bağlantı
vermekte ve reklamlarını içermektedir.
• Şikayet Edilen, Şikayetçi veya Şikayetçinin markası hakkında bilgisi olmasaydı şikayetçinin rakibi olan yazılım
firmalarının yazılım ürünlerine sitesinde yer vermezdi.
• Şikayet Edilen, uyuşmazlık konusu alan adını tescil ettirirken Şikayetçiyi veya Şikayetçinin markasını özellikle
bilmiyor olsaydı dahi araştırması gerekir idi. Champagne Lanson v. Development Services/MailPlanet.com, Inc.,
WIPO Case No. D2006-0006, <lanson.com>) kararında da belirtildiği gibi “bilerek göz yumma - willful blindness”
kötü niyetin göstergesidir.

• Şikayetçi, taraflar arasında bir dizi görüşme sonunda varılan 20,000 US$ olan teklifi kabul etmeyip alan adını satın
almasının mümkün olamayacağını anladığı zaman bu davayı açmıştır. Şikayetçi, şikayet dilekçesinde 7,000 US$ ilk
tekliften sonra, kendisinin 12,000 US$ ve tekrar 20,000 US$ teklifler verdiğini dilekçesinde belirtmemiştir.
• COMPART kelimesini içeren alan adı genel sözlük anlamı itibariyle “seçip ayırmak, kısımlara ayırmak” anlamında
olduğundan Şikayet Edilenin bu adı kullanmasında meşru bir menfaati vardır.
• Şikayet Edilen, uyuşmazlık konusu alan adını “alan adı park hizmeti” veren HitFarm.com vasıtasıyla kullanmaktadır.
Şikayette belirtilenin aksine; şikayet edilen uyuşmazlık konusu alan adı altındaki sitede, Şikayetçinin rakiplerinin
yazılım ve diğer ürünlerinin reklamlarına yer verilmemektedir. Şikayet Edilen bunu kanıtlamak üzere daha çok
otomobil ürünleri ve genel mal ve hizmetler sunan linkleri gösteren deliller sunmuştur.
• Şikayet Edilen COMPART kelimesinin 3. kişiler tarafından kullanıldığını göstermek üzere google’da 899,000 hit
sonucunu gösteren deliller sunmuştur. Buna ek olarak Almanya ve ABD’de COMPART kelimesini içeren çok sayıda
marka tescili bulunmaktadır.
• Şikayet Edilen uyuşmazlık konusu alan adının tescili ve kullanımında kötü niyetli değildir. Tasviri bir kelime eğer bir
markadan kazanç sağlamak amacıyla tescil edilir ise o zaman kötü niyetten bahsedilebilir. Burada bu durumu
kanıtlayan herhangi bir delil yoktur. Zira Şikayet Edilen COMPART ismini genel bir kelime olduğu için tescil
ettirmiştir. Şikayet Edilen alan adını tescil ettirdiği tarih olan 4 Haziran 2005 tarihinde Şikayetçiden hiçbir şekilde
haberdar değildir. Şikayetçi ABD’de COMPART marka tescil başvurusunu 3 Şubat 2006 yani şikayet edilenin alan
adını tescil ettirmesinden 8 ay sonra gerçekleştirmiştir. Şikayet Edilenin alan adını tescil ettiği tarihte Şikayetçi’nin
Almanya’da tescilli markası olmasına rağmen, Şikayet Edilenin dünyanın her ülkesinde marka tescili olup
olmadığını araştırmasının gerekmeyeceği çok iyi bilinmektedir..
savunmalarını ifade etmiş, deliller sunmuş ve sonuç olarak Şikayetçi tarafın taleplerinin reddedilmesini talep etmiştir.
