Florida Law: Child Custody Basics
Each state has its own particular regulations relating to child custody.
Under Florida regulation, child custody is determined by the courts
according to what’s in the most effective passions of the child as each
the Uniform Child Custody Jurisdiction and Enforcement Act. These
laws take care of both the lawful and bodily care of youngsters whose
parents are separating or for parents that have actually never ever
been married.
Child custody describes the treatment, command, and upkeep of a
minor. Child custody legislations in Florida aid figure out which moms
and dad obtains legal and bodily custody. A parent with legal custody
of a child can make instructional, spiritual, medical, and punishing
decisions. Through these laws, the courts will certainly also choose
who acquires bodily custody. The courts determine that gets physical
custody to set up where a child will certainly live.
Florida Law: Child Custody Basics
There are 2 kinds of custody arrangements in the state of
Florida. Child custody could be awarded to one moms and dad
(understood as sole custody) or to both moms and dads
(called shared custody).
With single custody, one parent gets bodily and legal custody
of a child. In a joint custody scenario, both parents share legal
and bodily child custody. In Florida, joint custody is called
shared parental responsibility, and both parents should accept
all decisions connected to the child. In this scenario, one
parent is called the primary joint protector and the various
other moms and dad is provided visiting so the child has a key
home, college, and a marked main doctor.
Child Support Tampa and Alimony Lawyers
If you are a Florida resident, the divorce law provides for
both child and spousal support. Spousal support is also
referred to as alimony. Although there are guidelines
provided for calculating the payment amounts, it is
advisable to consult with your divorce attorney in Tampa to
ensure that you are either paying or receiving the correct
remuneration.
Child Support Considerations
Although the State of Florida provides child support guidelines
to help determine calculations, it is important to include all
expenses that you are incurring to support your children. This
is necessary to ensure that you receive a fair outcome. The
Law Offices of Steven Glaros & Associates ensures that our
clients include the following if applicable:
• Number of children
• Cost of Health insurance
• Day care costs and/or private school tuition
• Amount of time allowed to spent with your children
• Music lessons, sports activities and summer camp
These are included in a number of issues that can determine
the amount of child support that you will either receive or pay.
Alimony Considerations
In the state of Florida, there are several types of alimony
provided depending upon your personal circumstances. The
alimony alternatives range from temporary to permanent,
as well as rehabilitative. You can also either pay or receive
a lump sum of money. Your specific circumstances will
determine the type of alimony and amount paid. To
determine the fairest settlement, the judge will consider the
following:
• The length of the marriage
• What each person contributed to the marriage
• Who was at fault in the marriage's dissolution
• One party's need for support
• The other party's ability to make support payments
Are Alimony Payments Subject to Change?
If circumstances change, an alimony award may be
modified. For example, if alimony payments have not been
made, a modification to the agreement may be possible.
Additionally, Florida law prohibits individuals from receiving
alimony if they are living with a person who supports them.
If this occurs, the paying party can seek a modification of
the amount of the alimony payments.
Obtaining the Correct Information
When calculating either child support or alimony payments,
it is critical to document all the available assets. As your
Tampa divorce lawyer, The Law Offices of Steven Glaros &
Associates works to uncover financial records, bank
accounts, and credit card information. If necessary, to
ensure fairness, we use forensic accountants to uncover
any hidden or non-disclosed property. Additionally, in case
of alimony disputes, vocational evaluators may be
consulted to discover whether an individual is capable of
being employed, as well as their income potential.
