1996, aims at uniformity of the law
applicable to alternatives to paper-
based methods of communication and
storage of information. It encourages
states to adopt its rules while drafting
their national laws.

• “Originator” of a data message means a
person by whom, or on whose behalf, the
data message purports to have been sent
or generated prior to storage, if any, but it
does not include a person acting as an
intermediary with respect to that data
message.

13. UNCITRAL: Main rules
• Legal recognition of data messages:
“Information shall not be denied legal
effect, validity or enforceability solely
on the grounds that it is in the form of a
data message”.
‫• اإلعتراف القانونً برسائل البٌانات: ال تفقد المعلومات‬
‫مفعولها القانونً أو صحتها أو قابلٌتها للتنفٌذ لمجرد أنها‬
.‫فً شكل رسائل بٌانات‬

14. UNCITRAL: Main rules
• Carriage of Goods: including but not limited to:
(a) (i) furnishing the marks, number, quantity or weight of goods;
(ii) stating or declaring the nature or value of goods;
(iii) issuing a receipt for goods;
(iv) confirming that goods have been loaded;
(b) (i) notifying a person of terms and conditions of the contract;
(ii) giving instructions to a carrier;
(c) (i) claiming delivery of goods;
(ii) authorizing release of goods;
(iii) giving notice of loss of, or damage to, goods;
(d) giving any other notice or statement in connection with the performance
of the contract;
(e) undertaking to deliver goods to a named person or a person authorized
to claim delivery;
(f) granting, acquiring, renouncing, surrendering, transferring or negotiating
rights in goods;
(g) acquiring or transferring rights and obligations under the contract.

E-transaction processing is the technology that enables
advanced e-business. It permits the intelligent
integration of complete business processes.

.‫ألكترونٌة. وتسمح من الحصول على عملٌات تجارٌة بطرٌقة ذكٌة‬
- Similar to Jordan, EAE, Oman, and Lebanon, Palestine
Has recently drafted a complete e-transactions law.

17. The aims of
Draft e-transactions Law
• Facilitating e-transactions by using accountable electronic data.
• Removing uncertainties related to writing and signature,
enhancing the basic legal structure for secured e-transactions.
• Facilitating the transfer of e- documents and subsequent
amendments to such messages.
• Minimizing counterfeiting and defrauding of electronic messages
and subsequent alterations.
• Setting up unified rules, regulations, and standards of
authenticating electronic messages and records.
• Consolidating the public trust in the safety and authenticity of the
e-transaction, messages, and records.
• Reinforcing the development of the e-transaction by using the e-
signature.

20. Legal Effect
‫اآلثار القانونٌة‬
• The draft law gives the electronic transactions and
signatures the same legal effect as written
documents.
‫• منح مشروع القانون المعامالت والتواقٌع األلكترونٌة الحجٌة فً األثبات‬
.‫واأللزامٌة ذاتها للوثائق المكتوبة‬
• The draft law regulate the criterion in which one
can decide if the e-document is identical to the
original written one. As did the UNCITRAL Model
Law and the e-transactions law of Jordan
.‫نجح المشروع فً وضع شروط قبول مطابقة الوثٌقة االلكترونٌة لألصل‬

21. Offer and Acceptance
‫األٌجاب والقبول‬
• An electronic message considered by the draft
law a valid mean of declaration of will regarding
offer and acceptance for contractual purposes.
‫• ٌجوز التعبٌر عن االٌجاب والقبول بواسطة رسائل الكترونٌة‬
• The draft called for the establishment of the
“General Commission for Electronic
Authentication” but left the its mandate to be
regulated by a bylaw.
‫• دعى مشروع القانون إلى تأسٌس الهٌئة العامة للمصادقة‬
‫األلكترونٌة، لكن ترك تحدٌد الصالحٌات إلى الئحة تصدر عن‬
.‫مجلس الوزراء‬

22. Transferable Electronic Note
‫السند األلكترونً القابل للتحوٌل‬
• The draft considered the transferability
of electronic notes.

• The same consideration for the transfer
of funds.

23. Electronic Signature
ً‫التوقٌع األلكترون‬
• The draft regulated the electronic signature. The draft
needs more consideration for this section.
The Jordanian law stipulates that “For the purpose of
verifying that an electronic record has not been altered
as of a specific date, the record shall be considered a
secure electronic record as of the date of its verification,
provided such verification is conducted according to
secure procedures that are accredited, or commercially
acceptable, or mutually agreed upon by the pertinent
parties”. no a similar provision in the Palestinian law.

24. Electronic Signature

• The draft law failed to regulate when a
security certificate shall be deemed
accredited. Such as: It is issued by a
licensed or competent entity, issue by a
governmental department.
ً‫• فشل المشروع فً بٌان متى تكون شهــــادة التوثٌــق الت‬
‫تبٌن رمز التعرٌف معتمـدة، مثل أن تكون صادرة عن جهة‬
‫مرخصة او معتمدة أو صادرة عن دائرة حكومٌة او‬
.‫مؤسسة او هٌئة مفوضة قانونا بذلك‬

26. Summary
• Palestine lacks a law governs e-commerce.
‫• فلسطٌن تفتقد إلى تشرٌع ٌنظم التجارة األلكترونٌة‬
• Like in other Arab countries, the Palestinian Policy
makers decided to adopt e-transaction law, the draft is
expected to be endorsed by the President.
‫• كما هو الحال فً العدٌد من الدول العربٌة راسم السٌاسة الفلسطٌنٌة قرر قانون‬
.‫متعلق بالمعامالت المالٌة‬
• The UNCITRAL model law is a good guide for national
legislation
.‫• ٌعد القانون النموذجً لألنسترال دلٌال جٌدا للبلدان التً ترٌد تبنً تشرٌعا وطنٌا‬
• The draft law on e-transactions is a very good step
forward, but some of its rules are vague and needs some
minor revisions.
