  • If at the time of the meeting of the board, any member isABSENT or a VACANCY exists- members present shall call upon the SUBSTITUTE fromthe roll of substitutes listed by the DepEd to perform theduties of absent member. If none is available, the members present shall appointany NON-PARTISAN REGISTERED VOTER of the precinctnot otherwise disqualified, to temporarily fill up saidvacancy until the absent member appears or the vacancyis filled.In case there are only two members present, they shallact jointly.

  • BEI members shall:1. ACCOMPLISH THE OATH OF OFFICE (A30) in three (3) copies2. AFFIX THEIR SIGNATURES and IMPRINTS of their right thumbs onthe OATH of Office before the Election Officer prior to theirassumption of office as BEI members.3. COPIES OF THE APPOINTMENT AND OATH (A30/A31) shall bedistributed as follows:i. FIRST COPY – retained by EO for his file.ii. SECOND COPY – retained by EO to be attached to the payrollfor payment of honorarium of BEI.iii. THIRD COPY – issued to the chairman and members of BEI.
  • Board shall enter/record in the MINUTES OFVOTING AND COUNTING OF VOTES (A11):ACT or REQUIRED DATA as they occur or becomeavailable during VOTING, COUNTING, CONSOLIDATING,and TRANSMISSION of votes.Copies of Minutes in sealed envelopes distributed asfollows FIRST COPY to the Election Officer, who shall transmit itto the ERSD in Manila SECOND COPY to be deposited inside the ballot box forvalid ballots.

  • 1. Conduct the VOTING in the polling place.2. Administer the ELECTRONIC COUNTING of votes.3. Print the ELECTION RETURNS4. TRANSMIT VOTES electronically through the PCOS, theelection results to the: City/Municipal Board of Canvassers; Dominant majority party, dominant minorityparty, accredited citizens arm; and Central Server5. ACT AS DEPUTIES of the Commission in the conductof the elections;6. MAINTAIN ORDER within the polling place and itspremises;7. ENFORCE OBEDIENCE to its lawful order andPROHIBIT the use of camera and cellular phonewith camera by the voters.8. Perform such OTHER FUNCTIONS prescribed by thelaw or by the rules and regulations promulgated bythe Commission.VEETAMEPO
  • I. BOARD MEETINGS shall be PUBLIC and in POLLINGPLACE designated by the Commission.II. BOARD acts through the chairman and shalldecide by MAJORITY VOTE without delay.
  •  Avail of Local Absentee Voting privilege when not registeredin the precinct where they are assigned. The voter can onlyvote for National and Local Elections up to Party-ListRepresentatives Vote in their precinct provided their absence is less than 20minutes.ONLY ONE BEI MEMBER AT A TIME!
  • BEI MEMBERS SHALL NOT:1. ENGAGE IN ANY PARTISAN POLITICAL ACTIVITY;2. TAKE PART IN THE ELECTION, EXCEPT TO DISCHARGETHEIR DUTIES AND TO VOTE

  • PUBLIC SCHOOLS TEACHERS, PRINCIPALS ORSUPERVISORS AS SUPERVISORS FOR TENCLUSTERED PRECINCTS OR FRACTION THEREOF. HONORARIA OF THREE THOUSAND PESOS(P 3,000.00) PER PERSON. SERVICE CREDITS FOR 3 DAYS OF SERVICE(MAY 12, 13, 14, 2013)SUPPORT STAFF HONORARIA OF ONE THOUSAND FIVEHUNDRED PESOS (P1,500.00) PERPERSON. SERVICE CREDITS FOR 3 DAYS OF SERVICE(MAY 12, 13, 14, 2013) P 1,500.00 PER PERSON.
  • Other Benefits: The Comelec shall allocate theamount of THIRTY MILLION PESOS(P 30,000,000.00) for election-related death or injuries that maybe sustained by DepEd employeesin the performance of electionduties. Provided that in case ofdeath while in the performance ofelection duties, the heirs of thedeceased official/employee shall begiven the amount of TWOHUNDRED THOUSAND PESOS (P200,000.00)

  • WHO ARE ENTITLED TO TWO WATCHERS IN EVERY POLLING PLACE?1. EACH INDEPENDENT CANDIDATE.2. REGISTERED POLITICAL PARTY OR COALITION OF POLITICAL PARTIES DULYREGISTERED WITH THE COMMISSION FIELDING CANDIDATES IN THEELECTION.3. DULY ACCREDITED CITIZEN’S ARM.THE TWO WATCHERS SHALL SERVEALTERNATELY, IN EVERY POLLING PLACE.
  •  CANDIDATES FOR SENATOR, BOARD MEMBER ANDCOUNCILORS OF SAME TICKET/ SLATE SHALLCOLLECTIVELY BE ENTITLED TO ONE WATCHER.If, BECAUSE OF LIMITED SPACE, all watchers cannot beaccommodated in the polling place, preference shall begiven to the watchers of: the dominant majority party dominant minority party citizen’s arm.
  • Other civil, professional,business, service, youthand any other similarorganizations shall beentitled to COLLECTIVELYappoint ONE WATCHER inevery polling place, uponprior authority of theCommission.WATCHERBUSINESSYOUTHCIVILSERVICEPROFESSIONAL
  • 1. REGISTERED VOTER of the city ormunicipality comprising the precinctwhere he is assigned.2. Of GOOD REPUTATION.3. Has not been CONVICTED BY FINALJUDGMENT of any election offense orany crime.4. Knows how to READ and WRITEFilipino, English or a local dialect.5. Not related with FOURTH CIVILDEGREE OF CONSANGUINITY ORAFFINITY to the BEIs in the pollingplace where he seeks appointment aswatcher.
  • NOT LATER THAN APRIL 28, 2013,independent candidates, registered parties,organizations or coalitions authorized by theCommission shall SUBMIT to the ElectionOfficers concerned: names and signatures of theirrepresentatives authorized to appointwatchers in the city or municipality.
  • 1. Deliver their appointments to BEI chairman uponentering the polling place. The chairman shall RECORD the names in theminutes with a notation under their signatures thatwatcher is not disqualified.2. Not to speak to the BEI or a voter, or among themselves,which will disturb the proceedings of the BEI.3. IF AVAILABE, affix their signatures and thumb marks inthe ERs, in the case of watchers representing: Dominant majority party Dominant minority party Citizen’s arm
  • 1. WITNESS and INFORM themselvesof the proceedings of the BEI.2. TAKE NOTE of what they may see orhear.3. TAKE PHOTOGRAPHS of the : proceedings and incidents, ifany, during the voting andcounting of votes generated election returns ballot boxesNOTE:CANNOT takephotographs ofballots in possessionof voters.
  •  File a protest against any irregularity orviolation of law which they believe mayhave been committed by: the BEI any BEI member or any person Obtain from the BEI a certificate as tothe filing of such protest and theresolution thereof
  •  BEIs shall get the forms,documents and supplies earlyin the morning of election day. EXCEPT IN CASE OFEARLY DELIVERY asauthorized by COMELEC City/Municipal Treasurersshall distribute the specificforms, documents andsupplies per precinct/clustered precincts.

  • The poll clerk shall, without delay,prepare a two (2) COMPLETE LISTCONTAINING VOTERS’ NAMESconsecutively listed.A listed voter who is notpresent will be called (3)times, after which, will nolonger be allowed to vote.List of Voters shall besubmitted to the EO.

  • BEI SHALL IDENTIFY the voter in the EDCVL,through his/her:Photographfingerprint orspecimen signaturesIn the absence of the above-mentioned proof ofidentity:any BEI member may identify under OATH ofa voter and such act shall be reflected in theMinutes.
  • A VOTER or WATCHER may challenge any personoffering to vote on the ground that he:1. Received or expects to receive, paid, offeredor promised to pay, contributed, offered orpromised to CONTRIBUTE MONEY or ANYTHINGOF VALUE as consideration for his vote or forthe vote of another; or2. Made or received a promise toINFLUENCE THE GIVING OR WITHHOLDINGof any such vote; or3. Made a BET or is interested directly orindirectly in a bet that depends upon theresults of the election.
  • To be able to vote,challenged voter shall TAKE ANOATH before the BEI that hehas not committed any of theacts alleged in the challenge.If voter REFUSES to take anoath, the challenge shall besustained and the voter shallnot be allowed to vote.
  • BEI shall record in theMinutes:All CHALLENGES andOATHS taken inconnection therewith.DECISION of BEI ineach case
  • 5. The ballot box shall REMAIN LOCKED duringvoting.1. Voters shall vote in the ORDER OF THEIR ARRIVAL inthe polling place.2. No watcher shall ENTER THE PLACE RESERVED for thevoters and the BEI, nor MINGLE AND TALK with thevoters.3. Persons CARRYING FIREARMS OR DEADLY WEAPONSshall not enter the polling place, except those expresslyauthorized by the Commission.4. There shall be NO CROWDING OF VOTERS andDISORDERLY BEHAVIOR inside the polling place.

  • The Board, BY MAJORITY VOTE, orderthe detail of policemen or peaceofficers for:1.PROTECTION of the BEI’s and thePCOS Machine.2.PROTECTION of electiondocuments and paraphernalia.3.Maintenance of PEACE ANDORDER.Note: They must be in properuniform and shall stay outside nearenough to be easily called by theboard.
  • 1. BRING the ballot, secrecy folder and pencil outside of thepolling place.2. SPEAK with another voter or watcher.3. PREPARE his ballot without using the secrecy folder or EXHIBITits contents.4. FILL his ballot accompanied by another, except illiterate ordisabled person.5. ERASE any printing from the ballot ,or PUT any distinguishingmark thereon.6. USE MEANS of making a copy of the contents of the ballot, orOTHER SCHEME to identify his vote, including the use ofdigital cameras, cellular phones or similar gadgets7. INTENTIONALLY TEAR or DEFACE the ballot8. DISRUPT the normal operation of the PCOS.UNLAWFUL CONDUCTS WHILE VOTING
  • Assistance in the Preparation of BallotA voter is not allowed to vote as illiterate ordisable UNLESS SUCH FACT IS INDICATED in theEDCVL or VRR or when HIS DISABILITY ISAPPARENT.The ASSISTOR shall prepare the ballot in thepresence of the illiterate or disabled person.The assistor shall bind himself in writing andunder oath to FILL THE BALLOT STRICTLY inaccordance with the instructions of the voter andNOT TO REVEAL THE CONTENTS thereof, byaffixing the signature in the appropriate space inthe Minutes.PREPARATION OF BALLOTS FOR ILLITERATE ANDPERSON WITH DISABILITY/DISABLED VOTERS
  • Assistance in Using the PCOSA person who is UNABLE TO FEED HIS BALLOT into the PCOS may beassisted by a member of the Board.The assistor shall ensure that the contents of the ballot are NOT DISPLAYEDDURING THE FEEDING of the same into the PCOS.PREPARATION OF BALLOTS FOR ILLITERATE ANDPERSON WITH DISABILITY/DISABLED VOTERS
  • In both cases, the poll clerk shall:First VERIFY from the illiterate or disabled personwhether he had authorized the assistor to help him tocast his voteThe Assistor can ONLY ASSIST THREE (3) Illiterate or disabledvoters, except the member of the BEI.Assistor must be of legal age and:a relative within the FOURTH CIVIL DEGREE ofconsanguinity or affinity;any PERSON OF HIS CONFIDENCE who belongs to thesame household; ora MEMBER of the BEI.PREPARATION OF BALLOTS FOR ILLITERATE ANDPERSON WITH DISABILITY/DISABLED VOTERS
  • WHEN FEASIBLE, All polling places of theprecincts where there are persons withdisability/disabled voters shall be located at theground floor of the voting centers. For thispurpose, the Election Officer shall coordinatewith the proper school or building officials.PREPARATION OF BALLOTS FOR ILLITERATE ANDPERSON WITH DISABILITY/DISABLED VOTERS
  • During voting, no member of the BEI shall makeANY ANNOUCEMENT as to:Whether a certain registered voter has alreadyvoted or notAs to how many have already votedAs to how many so far have failed to voteAny other fact tending to show or showing thestate of the pollsAny statement at any time, except as witnessbefore a court or body as to how many personsvotedPREMATURE ANNOUNCEMENT OFVOTING
  • ARTICLE VI SECTION 44
  • • SEC. 44 Preliminaries to thevoting. – The BEI shall:a) Meet at the polling place atsix o’clock in the morning ofElection Day;b) Ensure that the PCOS boxand the ballot box are insidethe polling place;PRELIMINARIES OF VOTING
  • c) Set-up or arrange the polling place inaccordance with, whenever practicable,the Lay-out of Polling Place provided inAnnex “E”;d) Post one (1) copy of the PCVL of eachprecinct in the cluster, near or at the doorof the polling place, preferably thepages/sheets are spread out to give freeaccess to voters who are checking theirnames in the list, if there is space;PRELIMINARIES OF VOTING
  • e) For precinct/clustered precinct withpersons with disability (PWD)/detainee voters (DV) and withestablished special polling places forPWDs/DVs, the BEI of the said regularpolling places shall, using the EDCVL –PWD and/or EDCVL-DV:1) Annotate the PWDs’/DVs’ names inthe EDCVL with “PWD/DV”2) Affix his initial beside the annotationPRELIMINARIES OF VOTING

  • n) Break the plastic fixed length seal of the printercover of the PCOS;o) Open the printer cover and the Chairman shall takeout the iButton security key;p) Ensure that the roll of the official thermal isproperly installed;q) Close the printer cover;PRELIMINARIES OF VOTING
  • r) Connect the power adaptor to the PCOS AC powerport (20VAC) and plug the other end to theelectrical outlet. There shall be no passage betweenPCOS and its power outlet. A perimeter must bemaintained on the sides and at the back of thePCOS, if space permits/is available.s) Connect the battery to the PCOS DC power port (12VDC). A message“PLEASE ENTER SECURITY PIN” will be displayed in the screen.2) Enter the Security PIN3) Wait until the message “BEI SECURITY KEY VERIFIED” appearson the PCOS screen.   • 4) Select “YES” if the date and time is correct, andenter such fact in the Minutes.5) Select “NO” if the date and time is incorrect. Thescreen will display “SET YEAR”. Press “+++” if theyear displayed is less than 2013 or press “---” if yearis more than 2013, then press enter. The PCOS willthen display the “SET MONTH” then “SET DAY” then“SET DATE,HOUR,MINUTE”. Just press either “+++” toincrease or “---” to decrease the month, day, hourand minute then press “ENTER”. After correction ofthe date and time has been effected, enter such factin the Minutes.PRELIMINARIES OF VOTING
  • 6) Wait until the MAIN MENU is displayed.u. The certified IT-capable member of the BEI shall perform thefollowing procedures:1) Select “OPEN VOTING” from the main menu. The PCOS shallthen:i. Ask the PIN of the poll clerk who will then enter his PIN,and press ENTER;ii. Ask for the second PIN from the third member who willthen enter his PIN , and press ENTER;iii.   • 4) After printing the Initialization Report, the PCOS willdisplay the message, “WOULD YOU LIKE TO PRINTMORE COPIES OF THE ZERO TAPE?”, with “YES and NO”options. Press “NO”. Now, the PCOS is ready toaccept ballots.w) Detach the Initialization Report, affix their signaturesto thereon including those of the representatives of thepolitical parties, candidates or citizens arms present;andx) The Chairman shall then place the Report inside theenvelope (CEF No. A18-A) for submission to the EOafter the voting.PRELIMINARIES OF VOTING

  • 6. In the absence of proof of identity, a MEMBEROF THE BEI or a REGISTERED VOTER of theprecinct/cluster precinct may identify under oatha voter, and such act shall be reflected in theMinutes.7. If the BEI or support staff is satisfied with hisidentity, the name of the voter shall beDISTINCTLY ANNOUNCED in a tone loud enoughto be heard throughout the polling place.8. OTHERWISE, the voter shall be directed toLEAVE the polling place after informing him thereason thereof.
  • 9. If the voter is not challenged, or having beenchallenged, the QUESTION HAS BEEN DECIDED IN HISFAVOR, the voter shall be directed to the chairman ofthe BEI.10. Before giving the ballot to the voter, the chairmanof the BEI shall CHECK IF ANY OF THE FINGERNAILS ofthe voter has already been stained with indelible ink.11. If stained, it shall be a CONCLUSIVE PRESUMPTIONTHAT HE HAS CAST HIS VOTE. As such, the voter shallbe directed to leave the polling place after informinghim the reason thereof
  • 12. This FACT, INCLUDING THE NAME and PRECINCT ofthe voter, shall be recorded by the Poll Clerk in theMinutes .13. After verifying that no fingernail has been stained,the voter shall AFFIX HIS SIGNATURE in the EDCVL;14. The Chairman shall AUTHENTICATE THE BALLOT BYAFFIXING HIS SIGNATURE at the designated space atthe front thereof.The failure to authenticate a ballot shall NOTINVALIDATE THE BALLOT but shall constitute anELECTION OFFENSE.
  • 14. Instruct the voter on HOW TO FILL-UP THE BALLOTPROPERLY.15. Insert the ballot in the secrecy folder in such aMANNER THAT ITS FACE IS COVERED, except theportion where his signature in the ballot appears, andgive the ballot to the voter.ONLY THE CHAIRMAN shall issue the officialballots, and NOT MORE THAN ONE (1) BALLOTshall be issued at one time.16.Require the voter to AFFIX HIS SIGNATURE on theproper space in the EDCVL.
  • VOTING shall be conducted in the followingmanner:1. The voter shall FILL HIS BALLOT BY FULLYSHADING THE OVAL besides the names of thecandidates of his choice, using the secrecy folderand marking pen.2.The voter shall then APPROACH THE PCOS,INSERT HIS BALLOT in the ballot entry slot andwait until the ballot is dropped into the ballotbox.3. The BEI shall MONITOR the PCOS screen tomake sure that the ballot was successfullyaccepted.
  • 4. Thereafter, the voter SHALL RETURN the ballotsecrecy folder and marking pen to the chairman.5. The chairman shall APPLY INDELIBLE INK atthe base and extending to the cuticle of the rightforefinger nail of the voter, or any other nail ifthere be no forefinger nail.6. The voter shall then LEAVE THE POLLINGPLACE.
  • 1. Voter will LOOK FOR HIS NAME in thePCVL posted near the door of the votingcenter and DETERMINE HIS PRECINCT ANDSEQUENCE NUMBER.2. Voter will APPROACH THE BEI OR THESUPPORT STAFF OR IN-CHARGE OF THEPRECINCT.3. The voter will GIVE HIS SEQUENCENUMBER IN THE PCVL,NAME ANDADDRESS and other data concerning hisperson.
  • 4. The BEI or the support staff shall VERIFY IFTHE NAME OF THE VOTER IS IN THE EDCVL.5. Issue a CERTIFICATION to the voter ,stating that he is a registered voter of theprecinct but there are NO MOREAVAILABLE BALLOTS FOR USE.6. RECORD such facts in the Minutes7. Request the Third Member toACCOMPANY the voter to the NEXTPRECINT belonging to the same councilordistrict, where he shall cast his vote.
  • The CHAIRMAN OF THE PRECINT where thevoter is directed to vote shall:Require the voter CERTIFICATIONissued by the Chairman of his precinct.Record the followingNAME of the VoterPRECINCT NUMBERFact that a CERTIFICATION thatthere are no available ballotsWrite the name of the voter in theEDCVL OPPOSITE HIS NAME HISPRECINCT NUMBERBefore issuing the ballot, observe Stepa) to f) of section 34 and provision ofSection 35.
  • Ballots may be rejected by the PCOS during scanning.There are THREE TYPES OF MESSAGES if the ballot isrejected.a. “AMBIGUOUS MARK”Let the voter REVIEW HIS BALLOT andENSURE that the ovals opposite the names ofcandidate/party voted for are FULLYSHADED.Let the voter RE-FEED the ballotb. “MISREAD BALLOT”Let the voter RE_FEED the ballot in FOURDIFERENT ORIENTATIONS.
  • c. “ invalid ballot”VERIFY if the ballot belongs to theprecinct,If the ballot BELONGS TO ANOTHERPRECINCT, the voter shall RETURN theballot to the Chairman who shall:Mark the back of the ballot asREJECTEDAll members of BEI shall SIGN atthe back there of and place insidethe envelope for rejected ballots.
  • d. In all cases, if the PCOS rejects a ballot, the voter shall return theballot to the chairman who shall:1. Distinctly mark the back thereof as REJECTED;2. Require all members of the BEI to sign at the backthereof; and3. Place the rejected ballot inside the Envelope for RejectedBallots (A15)e. No replacement ballot shall be issued to a voter whose ballot isrejected by the PCOS;f. Any party objecting to the rejection of the ballot shall reduce hisobjection in writing, which the BEI shall attach to and note in theMinutes.
  • 1. In the event of a rejected ballot, the votershall be ALLOWED TO RE-INSERT THE BALLOT.2. If the PCOS still rejects the ballot, the votershall RETURN THE BALLOT TO THE CHAIRMAN,who shallDISTINCTLY MARK the back thereof as“REJECTED.”Require ALL MEMBERS OF THE BEI TOSIGN AT THE BACK THEREOF, and placeinside the envelope (A15) and seal with aserially numbered paper seal.PROCEDURE:
  • The Chairman, in the presence of BEI shall1. RECORD in the MINUTES the QUANTITY OFUNUSED BALLOTS.2. CUT the unused ballots in half LENGTHWISE.3. PLACE ½ of UNUSED BALLOTS in the envelope(A15), and submit to the EO for safekeeping.4. PLACE THE OTHER HALF in another envelope(A15), and deposit it inside the compartment of theballot box for valid ballots.PROCEDURE:NOTE: One person is entitled to oneballot.
