administrative duties of the Donated Leave Program to the Personnel Merit System and
for other purposes

1 Be it enacted by the Legislature of the Virgin Islands:
2 SECTION 1. Title 3 Virgin Island Code, chapter 25, section 583b is amended as
3 follows:
4 1. By striking “Commissioner of Finance” wherever it appears in this section
5 and inserting “Director of the Division of Personnel”;
6 2. In subsection (a) (3) by striking the period at the end and inserting “while
7 absent on approved sick leave”;
8 3. In subsection (b) after the word, “designee”, insert the phrase, “within 90
9 days after the enactment of this Act”;
10 4. In subsection (c) (1) strike the words “verification from a physician or
11 other licensed health care provider concerning the nature and anticipated duration of the

1 disability resulting from serious health condition or injury” and insert “a notarized letter
2 consenting to the exact amount of time to be donated and a medical verification from a
3 physician or other health care provider which states the time given off from work”; and
4 5. In subsection (c) renumber paragraph (2) as paragraph (3) and insert a new
5 Paragraph (2) to read:
6 (2) “The Director of Personnel must approve a leave request within 48
7 hours after the leave donor has complied with the requirements in subsection (c)
8 (1)”.
9 BILL SUMMARY
10 This bill amends title 3 Virgin Islands Code, chapter 25, section 583 to confer
11 administrative and implementation duties on the Division of Personnel and relieves the
12 Commissioner of Finance therefrom. In addition section 583 is further amended to set
13 guidelines for donors and to safeguard medical privacy rights of the recipients.
