Presumed Innocent
Innocent until proven guilty has been an important mantra in US law. The burden of proof remains on the prosecution to prove beyond a reasonable
doubt that the accused is guilty. This principle guides the premise that wrongly accusing the incident is a greater harm than not punishing the guilty,
and sets a clean slate to build on in the minds of the Judge and jury. Additionally, this principle protects from unreasonable accusations assuming that
significant evidence must be present first.
Opposite of this philosophy would be guilty until proven innocent. In societies following this philosophy the accused must jump through hurdles to
prove they are indeed innocent. Imagine, for example, you come home after a long day, flop down on the couch and fall asleep watching TV.
Suddenly, bursting into the room comes the police, arresting you for robbing the convenience store down the street. You were there, you were asleep,
but how do you prove this, the clerk said you did it. How do you proceed? Unjustly charged, potentially punished, having the presumption of innocence
would have protected you.
While Presumed Innocent is the mantra in the courts, it rarely is practiced in the court of public opinion. As seen in the movie "Presumed Innocent"
the lead character, Rozat Sabich, was charged with a highly publicized murder. Being a public figure in the midst of an election, his arrest was

The
one blanket that the jailor had given to me was not enough to keep me warm in a place so
cold. The privacy I had was very little. The shower and toilet was located in the corner of
the cell but they were not isolated enough to where the other inmates could not see me.
I undressed and dressed inside the shower to have some privacy. I even tried to have
privacy by hanging up a blanket from one corner of a wall stand to another but I got in
trouble by the jailor. All of these things just seemed so horrible and degrading to me.
My first few nights being in the cell called J–1 was scary. There were three other
woman in the cell that was always yelling or fighting over ridiculous things like the
television. Around the corner I could hear the accused killer "Cowboy Mike" always
singing the country songs that he liked so much or the banging of his coffee cup against
the bars of the cell when he was angry. One time he even used the shower curtain rod to
try to escape from his line cell. Even further down the line there was an accused rapist
and of course he had to put his two cents in by always screaming that the devil was
coming after him. All I could think is how scary this was and I wanted out. Not two
days from now nor thirty days I wanted out right then!
I was separated from the outside unable to touch or hold the people that were so

Dangers And Disadvantages Of Right To Counsel
The Right to Counsel was not established until 1923 when the United States Supreme Court realized in Powell v. Alabama; defendants filed an appeal
claiming they should have been provided, counsel. (Hall, 2014) However, the right to counsel was not founded upon the Sixth Amendment to be exact
it was the Fourteenth Amendment. The Court reasoned the absence of counsel deprives a person of a fair trial. Courts have rules and laws that the
average person does not understand; nonetheless, why represent yourself if you lack the education of law? In 1975, the first case to establish the right
to self–representation was Faretta v. California 422 U.S. 806. "The Supreme Court recognized that the assistance of trained legal counsel is essential
to preparing and presenting a defense" (Hall, 2014, p.572). Therefore, a defendant who chooses to act as his or her own counsel (pro se) increases the
probability of a conviction. Therefore, a defendant who chooses to represent themselves, a judge may appoint a standby counsel to take over if
necessary during a trial. The Sixth Amendment gives a person the right to counsel, and it is not the only constitutional provision assuring counsel, the
Fifth and Fourteenth Amendments in some circumstances does as well. (Hall, 2014) "A defendant must be made aware of the dangers and

We as American's have certain rights available to us as citizens of the United States of America. These rights are known as our civil rights. Civil
Rights are enforceable right or privilege, which if interfered with by another gives rise to an action for injury. According to Wikipedia, "Civil and
Political Rights are a class of rights that protect individual's freedom from infringement by government, social organizations and private individuals."
(Wikipedia) It is also describes how far we have come, with equality for all people no matter what sex, age, religion, or race you are. Civil Rights may
have different meanings to certain people, but it was made for one purpose. That purpose was so that all of us would be treated equally, but the chain of
events lately has raised questions that our civil rights are being taken away from certain groups of Americans. Here in the U.S.A civil rights have led to
the African American Civil Rights movement as well as the American Indian Movement. They have added new amendment's to our civil rights that
have included the enactment of the Thirteenth and Fourteenth Amendment's. The Thirteenth Amendment abolished slavery, but some states enacted
"black codes" that were intended to limit newly freed slaves civil rights. Then in 1868 the Fourteenth Amendment countered these "black codes", to

In Snow Falling on Cedars by David Guterson Kabuo Miyamoto is being charged with the murder of a local fisherman. This novel starts with Kabuo's
trial, "The accused man, Kabuo Miyamoto, sat proudly upright with a rigid grace, his palms placed softly on the defendant's table– the posture of a
man who has detached himself insofar as this is possible at his own trial"(3). The use of the word proudly makes me already believe that Kabuo is

the eighth amendments that give specifics on how the process should go and how the arrested person is to go through it. In the amendment they even

Before a person is arrested the police usually need a probable cause to arrest them, or a solid reason to arrest someone. The same goes with the police

Another study that could follow up this study could be to see if men, from different sports backgrounds, have the same rapport with the media/fans.
For example, we could take the case of many, many NFL players being charged with DUI or caught smoking marijuana and not having to go through
the same process as Phelps yet, they could keep their jobs, fans, or even sponsorships. The main objective would be to see if the public reacts the same
depending on the sports background of male athletes. First, I would go to google and research male athletes who are accused of the same, or similar
crimes–whether that be drug offenses, DUI, or a domestic dispute. To avoid any biases in my conclusion, I would need to go to different locations to
ask diverse races, genders, ages these questions. To begin the survey process, I would start with basic questions to grasp the gist of how much the
participant knows/cares about sports with their age, sports knowledge, and teams there are fans of. I would take 3 men with similar offenses, if not
identical, and survey the public to see how they reacted when the story broke–whether or not they are still a fan, whether they believe they will not do

Before I end my placement, I would like to have more to do with clients before their matters reach trial. From my perspective as a CLE student, I have
found that doing my placement with a criminal barrister has its limitations. The main one being that the 'groundwork', such as the initial interview, has
already been done prior to the matter before it reaches Nick because he is briefed by solicitors, and sometimes by the Commonwealth or State DPP. Of
course I understand the issues surrounding liability so I cannot conduct the interviews myself, but I was disappointed to have so little do with the
clients prior to reaching trial. The extent of the client contact that I have had is the police interview, and another occasion at the District Court in an
area where the accused stayed and spoke with Nick, not at any great length. This is something that I should have considered before deciding to do my
placement at Wright Chambers, and it's something that I regret. While I haven't had the pressure of dealing with emotional clients, and making sure
that I've provided the correct legal advice to those clients, I have missed out on a great opportunity for my professional development, specifically

The Accused: The Boston Massacre
On March 5th, 1770, Colonists were angry about all Townshend acts. They were aggressive and started throwing snowballs and stones. One
soldier was injured in that situation. Then, there was a shooting in Boston in a crowd where many people were injured and killed. Our British

Similarities And Differences Between The Crucible And Mr Hale
In the play, The Crucible, by Arthur Miller, there are some similarities and differences between Mr. Hale and I. Mr. Hale is a Reverend from
Beverly, who's called to Salem by Reverend Parris to help wake his daughter, Betty, who fell ill after being caught in the woods "summoning" the
devil. While dealing with accusations of witchcraft, Mr. Hale acts a certain way which can define his character. When he first arrives in Salem he
remains hopeful. Towards the middle of the play he tries to help more by getting involved with the court trials, which ends up causing bigger
problems. At the end of the play, Mr. Hale notices the good in those who are in jail and goes out of his way to help them. Overall, Mr. Hale's
character is considered optimistic and valuable, which relates to myself. When Mr. Hale was first introduced in the play, he maintained a positive
attitude and remained hopeful. After he arrived in Salem and heard rumors of witches and the devil flying around, he informed the community that he'll
control the situation and destroy the devil. "Have no fear now–we shall find him out if he has come among us, and I mean to crush him utterly if he has
shown his face!" (39). By hoping to clear up this mess, Mr. Hale reads from his books with hope that it'll break Betty away from the devil and
assuage the situation entirely. I'm like Mr. Hale in this case because when the worst may be brought upon me, I remain hopeful that I can push
through it. We both won't quit when we're faced with a tough decision that doesn't have a clear solution, but instead we put our effort into solving
whatever the problem may be, before it gets any worse. As the play perseveres, more similarities and differences between Mr. Hale and I surface.
Quickly after Mr. Hale's arrival in Salem, the situation regarding witchcraft escalates. Mr. Hale gets sucked into the middle of something which didn't
impact his life personally in the first place. As rumors of the devil spread around, more names known to be "seen" with him are mentioned in the court.
Mr. Hale takes it upon himself to visit the houses of those who are accused of involvement in witchcraft. "No– no, I come of my own, without the

One specific case would be Gideon Vs. Wainwright in 1962. In this case Clarence Earl Gideon was convicted and didn't have enough money to
obtain a lawyer. He asked for an Attorney, but he didn't get one because the court denied his request. They considered the question if this violated
Gideon's right, so they unanimously decided that Gideon should be appointed an Attorney, and he was given one. This case is an example of the
Sixth Amendment right of getting an Attorney if you cannot afford one ("Rights of the Accused", np). The Criminally Accused are given a public

why. That is also the reason that you have a trial by jury. They determine if you are guilty or not guilty by the evidence presented at trial. They also
have the power to acquit an accused if it believes that he is accused of violation an unjust law (Hornberger, np). When you are arrested, if you aren't
given you Miranda Rights, then questioning after an arrest, can be inadmissible at trial ("Advisement of Rights", np). That is part of what Due
Process is. Due Process is the right that you have to be given all of your rights and the court has to execute all of your rights before you can be

equal, this has become less and less over time but it still exist at this very moment. In the movie "The Accused", Sarah Tobias (Jodie Foster) is ruthlessly
assaulted by three men in a bar while individuals watch and cheer. A district Attorney Kathryn Murphy (
Kelly McGillis) takes the case, however, allows
the rapists to receive a mild sentence. A distraught Sarah decides to seek punishment for the men who witnessed and encouraged the assault. To get
justice, Sarah must take the stand and revisit the night of her attack in this drama based on true events. In this essay, I will dive into the film The
Accused then explain what the feminist theory really means and its background and lastly, apply the theory to the film to better understand how it

the 1957 Sydney Lumet film, The Twelve Angry Men, 12 jurors decided the fate of an 18–year boy, who was accused of killing his own father. The
situation gradually transitioned from conflicting to agreeable and jurors' characters changed from vindictive to considerate. The movie circled around
the arguments on how people take a decision on innocence versus guilt in our democratic society. The increasing angst among the men was due to their
different family backgrounds, personal differences, and the extremely inconvenient environment they are in.
What made the movie more interesting was the jurors' family background was so diverse. Putting them all together in one room can be difficult and
explosive. The unique personalities of the characters added more drama into scenes and the whole movie would have been awfully dull if not for the
strong and persuasive dialogues and remarks they threw at each other. Jurors
number 3, 10 and 7 were the most critical and mean. Anyone can say that they grew up in a harsh environment with authoritarian parents. They were
the men who made very demeaning remarks and made a direct attack on the boy's personality. If jurors based their judgment on personal predispositions
and prejudices, anybody who is on trial will not stand a chance of a fair hearing. Of course, it is impossible to have all the jurors come with the same

The burden of proof remains on the prosecution to prove beyond a reasonable doubt that the accused is guilty. This principle guides the premise that wrongly accusing the incident is a greater harm than not punishing the guilty, and sets a clean slate to build on in the minds of the Judge and jury. Additionally, this principle protects from unreasonable accusations assuming that significant evidence must be present first. Opposite of this philosophy would be guilty until proven innocent. In societies following this philosophy the accused must jump through hurdles to prove they are indeed innocent.
