An overview of the New CLA
Higher Education Licence

UUK Copyright Working Group
Now includes digital to digital copying alongside
scanning and photocopying (resolved British Library
issue)
Extension to the repertoire: new territories and
publishers (ha!)
Digital element also now covers websites
New user guidelines and new higher education
website
The New Licence
For most institutions there is an increase in the price
Small decrease for those on Comprehensive licence
£7.04 per FTE (fixed apart from RPI)
Small increase on fee charged for staff funded from
commercial income
RPI is capped and collared
Fixed three year term but two working groups will
continue to meet
Surveys and Data Working Group
Licence Operation Working Group
The fee
A series of unresolved issues between both sides are covered in
a Side Letter that accompanies the licence including:
RPI (replace with CPI or should there be one?)
Overseas distance learners
NCB students and how the data is collected
Disembedded images
Retention of digital copies – if works appear on the excluded list
part way through the term of licence – currently have to remove,
but reviewing
Extent limits (for items such as poems and anthologies)
These are to be discussed during the licence and where possible
solutions sought
Unresolved issues
Spreadsheet remains (as modified by SDWG)
Very little changes if you use Packtracker or other
reporting tools
From 2014 there will be sample reporting – so
institutions will report annually on new items only
Every 3 years will do a full report to include renewals
as well as new scans
New reporting requirements
Amended definition of ‘authorised persons’
Need to restrict access to the scans by ‘appropriate
controls’ not technical means
Digital component coverage of US publishers is opt in
Scanning and photocopying is opt out so lists are
different
Adding cover sheets to digital originals – not required
if already have a ‘copyright notice’
CLA Look up tool and reliability issues

  1. Copies have been sent out to all HEIs – so if yours has no received it, please contact CLA! The full new licence can be found on the CLA website along with new and updated support material. There is only one licence – this now includes digital to digital copying alongside scanning and printing.   2. So what follows from the move to ‘one licence’ is that is that there will be an increase in the licence fee for those on the ‘basic licence’. Small decrease for those who were on the Comprehensive licence. Prices – For the former a 15 pence increase for per FTE. New Fee per FTE £7.04 – this is fixed for three years but will go up annually because of RPI. (There is also an increase to the amount charged for “the full time equivalent number of staff funded from the commercial income of the licensee” see 6.1.2 of licence)  RPI will be added, but capped and collared so it can’t go above 4%, but can’t fall below 2%.(The licence fee is also subject to VAT)Fixed three year term to licence, so it is not intended there will be major negotiations on the licence shape during this period nor price, but that said:There are still the License Operation working group and SDWG continuing to meet to discuss on going issues.
  3. Spreadsheet will remain and if you use Packtracker and other reporting tools they will no doubt take into account these changes – output will change very little. (CLA have just announced that “If you previously had the Basic Licence it is exactly the same spreadsheet but you now have the option to use source code ‘D’ for digital re-use; if you had a CDL licence it is identical to the previous CDL digital copy record form.”)Reporting annually on new items only (not renewals)Every 3 years to do a full report (sampling so you may have to do a full report this year)
