Payment of Gratuity Act, 1972
SECTION
HEADING

PROVISION

5.1 Nominations

(Form F) Employees required to submit nominations in duplicate
(Form H) Change in nominations

5.2 Amount

*@15 days wages per completed year of service for employees completing 5 years or
more; not to exceed Rs. 10,00,000/*Wages include all emoluments including DA, but does not include bonus, commission,
HRA, overtime wages and any other allowance

5.3 Period

Payment of gratuity within 30 days of its becoming applicable

5.4 Display

*notice specifying name of the officer with designation, authorized to receive notices under
the Act or rules;
*an abstract of the Act and Rules in Form U

Penalty:S.No.

Details of Violation

Penalty

1

For avoiding any payment knowingly
makes any false statement or
representation

Shall be punishable with imprisonment upto
6 months or fine upto Rs. 10,000 or both.

2

Failure to comply with any provision of the
Act or Rules

Shall be punishable with imprisonment upto
1 year but will not be less than 3 months or
with fine, which will not be less than Rs.
10,000 but may extend upto Rs. 20,000 or
with both.

3

Any offence relating to non-payment of
gratuity under the Act

Employer shall be punishable with
imprisonment for a term which shall not be
less than 6 months but may extend to 2
years, unless the court for reasons recorded
decides for a lesser term of imprisonment or
a fine, which would meet

Compliance List Payment of Gratuity Act, 1972 SECTION HEADING PROVISION 5.1 Nominations (Form F) Employees required to submit nominations in duplicate (Form H) Change in nominations 5.2 Amount *@15 days wages per completed year of service for employees completing 5 years or more; not to exceed Rs. 10,00,000/*Wages include all emoluments including DA, but does not include bonus, commission, HRA, overtime wages and any other allowance 5.3 Period Payment of gratuity within 30 days of its becoming applicable 5.4 Display *notice specifying name of the officer with designation, authorized to receive notices under the Act or rules; *an abstract of the Act and Rules in Form U Penalty:S.No. Details of Violation Penalty 1 For avoiding any payment knowingly makes any false statement or representation Shall be punishable with imprisonment upto 6 months or fine upto Rs. 10,000 or both. 2 Failure to comply with any provision of the Act or Rules Shall be punishable with imprisonment upto 1 year but will not be less than 3 months or with fine, which will not be less than Rs. 10,000 but may extend upto Rs. 20,000 or with both. 3 Any offence relating to non-payment of gratuity under the Act Employer shall be punishable with imprisonment for a term which shall not be less than 6 months but may extend to 2 years, unless the court for reasons recorded decides for a lesser term of imprisonment or a fine, which would meet Presented By: - CS Shalu Saraf
