A bill to be entitled1
An act relating to family law; amending s. 61.13,2
F.S.; creating a presumption that approximately equal3
time-sharing by both parents is in the best interest4
of the child; revising a finite list of factors that a5
court must evaluate when determining whether the6
presumption of approximately equal time-sharing is7
overcome; requiring a court order to be supported by8
written findings of fact under certain circumstances;9
prohibiting the modification of a determination of10
parental responsibility, a parenting plan, or a time-11
sharing schedule unless certain determinations are12
made; providing an effective date.13

Be It Enacted by the Legislature of the State of Florida:15

Section 1. Subsection (3) of section 61.13, Florida17
Statutes, is amended to read:18
61.13 Support of children; parenting and time-sharing;19
powers of court.—20
(3) For purposes of establishing or modifying parental21
responsibility and creating, developing, approving, or modifying22
a parenting plan, including a time-sharing schedule, which23
governs each parent’s relationship with his or her minor child24
and the relationship between each parent with regard to his or25
her minor child, the best interest of the child shall be the26
primary consideration.27
(a) Approximately equal time-sharing with a minor child by28
both parents is presumed to be in the best interest of the29

child. In determining whether the presumption is overcome, the30
court shall evaluate the evidence based on A determination of31
parental responsibility, a parenting plan, or a time-sharing32
schedule may not be modified without a showing of a substantial,33
material, and unanticipated change in circumstances and a34
determination that the modification is in the best interests of35
the child. Determination of the best interests of the child36
shall be made by evaluating all of the factors affecting the37
welfare and interests of the particular minor child and the38
circumstances of that family, including, but not limited to:39
1.(a) The demonstrated capacity or and disposition of each40
parent to facilitate and encourage a close and continuing41
parent-child relationship, to honor the time-sharing schedule,42
and to be reasonable when changes are required.43
2.(b) The anticipated division of parental responsibilities44
after the litigation, including the extent to which parental45
responsibilities will be delegated to third parties.46
3.(c) The demonstrated capacity and disposition of each47
parent to determine, consider, and act upon the needs of the48
child as opposed to the needs or desires of the parent.49
4.(d) The length of time the child has lived in a stable,50
satisfactory environment and the desirability of maintaining51
continuity.52
5.(e) The geographic viability of the parenting plan, with53
special attention paid to the needs of school-age children and54
the amount of time to be spent traveling to carry out effectuate55
the parenting plan. This factor does not create a presumption56
for or against relocation of either parent with a child.57
6.(f) The moral fitness of the parents.58

7.(g) The mental and physical health of the parents.59
8.(h) The home, school, and community record of the child.60
9.(i) The reasonable preference of the child, if the court61
deems the child to be of sufficient intelligence, understanding,62
and experience to express a preference.63
10.(j) The demonstrated knowledge, capacity, or and64
disposition of each parent to be informed of the circumstances65
of the minor child, including, but not limited to, the child’s66
friends, teachers, medical care providers, daily activities, and67
favorite things.68
11.(k) The demonstrated capacity or and disposition of each69
parent to provide a consistent routine for the child, such as70
discipline, and daily schedules for homework, meals, and71
bedtime.72
12.(l) The demonstrated capacity of each parent to73
communicate with the other parent and keep the other parent74
informed of issues and activities regarding the minor child, and75
the willingness of each parent to adopt a unified front on all76
major issues when dealing with the child.77
13.(m) Evidence of domestic violence, sexual violence,78
child abuse, child abandonment, or child neglect, regardless of79
whether a prior or pending action relating to those issues has80
been brought. If the court accepts evidence of prior or pending81
actions regarding domestic violence, sexual violence, child82
abuse, child abandonment, or child neglect, the court must83
specifically acknowledge in writing that such evidence was84
considered when evaluating the best interests of the child.85
14.(n) Evidence that either parent has knowingly provided86
false information to the court regarding any prior or pending87

action regarding domestic violence, sexual violence, child88
abuse, child abandonment, or child neglect.89
15.(o) The demonstrated capacity or disposition of each90
parent to perform or ensure the performance of particular91
parenting tasks customarily performed by the other each parent92
and the division of parental responsibilities before the93
institution of litigation and during the pending litigation,94
including the extent to which parenting responsibilities were95
undertaken by third parties.96
16.(p) The demonstrated capacity and disposition of each97
parent to participate and be involved in the child’s school and98
extracurricular activities.99
17.(q) The demonstrated capacity and disposition of each100
parent to maintain an environment for the child which is free101
from substance abuse.102
18.(r) The capacity and disposition of each parent to103
protect the child from the ongoing litigation as demonstrated by104
not discussing the litigation with the child, not sharing105
documents or electronic media related to the litigation with the106
child, and refraining from disparaging comments about the other107
parent to the child.108
19.(s) The developmental stages and needs of the child and109
the demonstrated capacity and disposition of each parent to meet110
the child’s developmental needs.111
20. The amount of time-sharing requested by each parent.112
21. The frequency that a parent would likely leave the113
child in the care of a nonrelative on evenings and weekends when114
the other parent would be available and willing to provide care.115
22.(t) Any other factor that is relevant to the116

determination of a specific parenting plan, including the time-117
sharing schedule.118
(b) A court order must be supported by written findings of119
fact if the order establishes an initial permanent time-sharing120
schedule that does not provide for approximately equal time-121
sharing.122
(c) A determination of parental responsibility, a parenting123
plan, or a time-sharing schedule may not be modified without a124
determination that such modification is in the best interest of125
the child and upon a showing of a substantial, material, and126
unanticipated change in circumstances.127
Section 2. This act shall take effect October 1, 2016.128

Florida Shared Parenting Laws Enacted October 1st, 2016 - Florida Statutes Chapter 61

A bill to be entitled1 An act relating to family law; amending s. 61.13,2 F.S.; creating a presumption that approximately equal3 time-sharing by both parents is in the best interest4 of the child; revising a finite list of factors that a5 court must evaluate when determining whether the6 presumption of approximately equal time-sharing is7 overcome; requiring a court order to be supported by8 written findings of fact under certain circumstances;9 prohibiting the modification of a determination of10 parental responsibility, a parenting plan, or a time-11 sharing schedule unless certain determinations are12 made; providing an effective date.13 14 Be It Enacted by the Legislature of the State of Florida:15 16 Section 1. Subsection (3) of section 61.13, Florida17 Statutes, is amended to read:18 61.13 Support of children; parenting and time-sharing;19 powers of court.—20 (3) For purposes of establishing or modifying parental21 responsibility and creating, developing, approving, or modifying22 a parenting plan, including a time-sharing schedule, which23 governs each parent’s relationship with his or her minor child24 and the relationship between each parent with regard to his or25 her minor child, the best interest of the child shall be the26 primary consideration.27 (a) Approximately equal time-sharing with a minor child by28 both parents is presumed to be in the best interest of the29

In determining whether the presumption is overcome, the30 court shall evaluate the evidence based on A determination of31 parental responsibility, a parenting plan, or a time-sharing32 schedule may not be modified without a showing of a substantial,33 material, and unanticipated change in circumstances and a34 determination that the modification is in the best interests of35 the child. Determination of the best interests of the child36 shall be made by evaluating all of the factors affecting the37 welfare and interests of the particular minor child and the38 circumstances of that family, including, but not limited to:39 1.(a) The demonstrated capacity or and disposition of each40 parent to facilitate and encourage a close and continuing41 parent-child relationship, to honor the time-sharing schedule,42 and to be reasonable when changes are required.43 2.(b) The anticipated division of parental responsibilities44 after the litigation, including the extent to which parental45 responsibilities will be delegated to third parties.46 3.(c) The demonstrated capacity and disposition of each47 parent to determine, consider, and act upon the needs of the48 child as opposed to the needs or desires of the parent.49 4.(d) The length of time the child has lived in a stable,50 satisfactory environment and the desirability of maintaining51 continuity.52 5.(e) The geographic viability of the parenting plan, with53 special attention paid to the needs of school-age children and54 the amount of time to be spent traveling to carry out effectuate55 the parenting plan. This factor does not create a presumption56 for or against relocation of either parent with a child.57 6.(f) The moral fitness of the parents.58

CS for SB 250 First Engrossed 2016250e1 Page 3 of 5 CODING: Words stricken are deletions; words underlined are additions. 7.(g) The mental and physical health of the parents.59 8.(h) The home, school, and community record of the child.60 9.(i) The reasonable preference of the child, if the court61 deems the child to be of sufficient intelligence, understanding,62 and experience to express a preference.63 10.(j) The demonstrated knowledge, capacity, or and64 disposition of each parent to be informed of the circumstances65 of the minor child, including, but not limited to, the child’s66 friends, teachers, medical care providers, daily activities, and67 favorite things.68 11.(k) The demonstrated capacity or and disposition of each69 parent to provide a consistent routine for the child, such as70 discipline, and daily schedules for homework, meals, and71 bedtime.72 12.(l) The demonstrated capacity of each parent to73 communicate with the other parent and keep the other parent74 informed of issues and activities regarding the minor child, and75 the willingness of each parent to adopt a unified front on all76 major issues when dealing with the child.77 13.(m) Evidence of domestic violence, sexual violence,78 child abuse, child abandonment, or child neglect, regardless of79 whether a prior or pending action relating to those issues has80 been brought. If the court accepts evidence of prior or pending81 actions regarding domestic violence, sexual violence, child82 abuse, child abandonment, or child neglect, the court must83 specifically acknowledge in writing that such evidence was84 considered when evaluating the best interests of the child.85 14.(n) Evidence that either parent has knowingly provided86 false information to the court regarding any prior or pending87

CS for SB 250 First Engrossed 2016250e1 Page 4 of 5 CODING: Words stricken are deletions; words underlined are additions. action regarding domestic violence, sexual violence, child88 abuse, child abandonment, or child neglect.89 15.(o) The demonstrated capacity or disposition of each90 parent to perform or ensure the performance of particular91 parenting tasks customarily performed by the other each parent92 and the division of parental responsibilities before the93 institution of litigation and during the pending litigation,94 including the extent to which parenting responsibilities were95 undertaken by third parties.96 16.(p) The demonstrated capacity and disposition of each97 parent to participate and be involved in the child’s school and98 extracurricular activities.99 17.(q) The demonstrated capacity and disposition of each100 parent to maintain an environment for the child which is free101 from substance abuse.102 18.(r) The capacity and disposition of each parent to103 protect the child from the ongoing litigation as demonstrated by104 not discussing the litigation with the child, not sharing105 documents or electronic media related to the litigation with the106 child, and refraining from disparaging comments about the other107 parent to the child.108 19.(s) The developmental stages and needs of the child and109 the demonstrated capacity and disposition of each parent to meet110 the child’s developmental needs.111 20. The amount of time-sharing requested by each parent.112 21. The frequency that a parent would likely leave the113 child in the care of a nonrelative on evenings and weekends when114 the other parent would be available and willing to provide care.115 22.(t) Any other factor that is relevant to the116

CS for SB 250 First Engrossed 2016250e1 Page 5 of 5 CODING: Words stricken are deletions; words underlined are additions. determination of a specific parenting plan, including the time-117 sharing schedule.118 (b) A court order must be supported by written findings of119 fact if the order establishes an initial permanent time-sharing120 schedule that does not provide for approximately equal time-121 sharing.122 (c) A determination of parental responsibility, a parenting123 plan, or a time-sharing schedule may not be modified without a124 determination that such modification is in the best interest of125 the child and upon a showing of a substantial, material, and126 unanticipated change in circumstances.127 Section 2. This act shall take effect October 1, 2016.128
