FAR contains many requirements concerning Green products and services. FAS effectively manages the rapid changes in regulation and product availability as well as emerging commercial trends. Ordering these through GSA vehicles means ordering products and services that meet FAR requirements; thereby helping your agency meet its FAR obligations. Part 4, Administrative Matters – Requires contractors to submit paper documents on 30 percent recycled content paper, printed or copied double-sided. Part 7, Acquisition Planning – Requires that acquisition plans and market research efforts include all applicable Federal acquisition requirements for green products and services when describing agency needs. FOCUS PARTICULARLY ON FAR PART 8 Part 8, Required Sources of Supplies and Services , deals with the acquisition of products and services from or through Government supply sources. FAR 8.4 outlines procedures for orders placed against GSA Multiple Award Schedule (MAS) contracts. FAR 8.4 prescribes ordering offices to consider environmental and energy efficiency considerations, among other factors, when making a best value determination – discuss Best Value/Price Review with participants the different ways in which FAS assists them. For example, Green products are grouped in special sections on both GSA Advantage! and GSA Global Supply System to make them easy to find and order. The GSA Environmental Products site provides a central clearing house of information on Green products and services. Part 10, Market Research , establishes procedures for conducting market research to reach the best means for acquiring products and services. Agencies are required to use market research to maximize the use of products that contain recovered materials and/or meet energy efficiency standards. FAR Part 11, Describing Agency Needs , requires agencies to establish requirements for the procurement of green products and services and consider environmental considerations in the development of source-selection factors. FAR Part 12, Acquisition of Commercial Items, Subpart 12.3 provides standard solicitation provisions and contract clauses for the acquisition of commercial items that the contracting officer can use to make FAR Part 23 requirements applicable as long as the contractor officer is consistent with limitations contained in FAR 12.302. FAR Part 23, Environment, Energy and Water Efficiency, Renewable Energy Technologies, Occupational Safety, and Drug-Free Workplace, Establishes the requirement to purchase environmental products and services. This includes those that contain recovered materials, energy efficient products and services, products and services that use renewable energy technology, biobased products, and environmentally preferable products and services consistent with efficiency and cost effectiveness.
OMB/Administration are monitoring compliance with Green purchasing and agency effectiveness Like the scorecards used to evaluate agency progress in implementing the President’s Management Agenda, these scorecards define standards for success for specific elements. The Environmental Stewardship scorecard rates Federal agencies in terms of their compliance and progress toward compliance with environmental mandates and stewardship initiatives. Establishing an agency GPP is required in order to obtain a green rating on the OMB Environmental Stewardship Scorecard, highlighting the importance of the GPP.

suggesting a product is “green” based on a single environmental attribute (e.g., paper is green because it has high level of recycled content) claim that cannot be substantiated by easily accessible supporting information, or by a reliable third-party certification claim so poorly defined or broad that its real meaning is likely to be misunderstood by intended consumer (“non-toxic”, “all natural”, “green”) claim that may be truthful but is unimportant and unhelpful for consumers seeking environmentally preferable products (“CFC-free”) environmental claims that are simply false (shampoos claiming to be certified organic, ENERGY STAR qualified caulk) “ green” claims that may be true within the product category, but risk distracting consumer from greater environmental impacts of product category (organic cigarettes, “green” lawn insecticides) gives impression of 3 rd -party endorsement where no such endorsement exists (aluminum foil with certification -like images with name of company’s own in-house environmental program without further explanation)

(a) Unless exempt as provided at 23.204 — (1) When acquiring energy-consuming products listed in the ENERGY STAR® Program or Federal Energy Management Program (FEMP)— (i) Agencies shall purchase ENERGY STAR® or FEMP-designated products; and (ii) For products that consume power in a standby mode and are listed on FEMP’s Low Standby Power Devices product listing, agencies shall— (A) Purchase items which meet FEMP’s standby power wattage recommendation or document the reason for not purchasing such items; or (B) If FEMP has listed a product without a corresponding wattage recommendation, purchase items which use no more than one watt in their standby power consuming mode. When it is impracticable to meet the one watt requirement, agencies shall purchase items with the lowest standby wattage practicable; and (2) When contracting for services or construction that will include the provision of energy-consuming products, agencies shall specify products that comply with the applicable requirements in paragraph (a)(1) of this section. Environmentally preferable means products or services that have a lesser or reduced effect on human health and the environment when compared with competing products or services that serve the same purpose. This comparison applies to raw materials, manufacturing, packaging, distribution, use, reuse, operation, maintenance, and disposal. Environmentally preferable products (EPP) possess more than one environmental attribute characteristic. Electronic Product Environmental Assessment Tool (EPEAT) registered products fall under the category of an EPP because EPEAT registered products are not only energy-efficient but also have other environmental attributes, such as recycled content components or the elimination of toxic components. EPEAT is primarily overseen by the EPEAT Board of Advisors, an unpaid 12-person advisory board whose membership is a balanced representation of the stakeholders who developed EPEAT: environmental advocates, institutional purchasers, manufacturers, government policy professionals, researchers, and electronics recyclers. The current members of the EPEAT Board of Advisors are identified below. The EPEAT Board of Directors has legal authority over EPEAT but they are substantially guided by the recommendations of the EPEAT Board of Advisors. The Board of Advisors operates on a consensus decision-making basis.
