2. NARCOTIC DRUG AND PSYCHOTROPIC
SUBSTANCE ACT - 1985
 HISTORY
 The statutory control over narcotic drug was being excercised under
the optium act, 1857,the optium act, 1878 and the dangerous drug
act, 1930
 India had no legislation regarding narcotics until 1985.cannabis
smoking in India has been known since atleast 2000 BC and is first
mentioned in the Atharvaveda, which dates back a few hundred year
BC.

3. OBJECTIVE
 To consolidate and amed the existing law relating to narcotic drug
 To make stringent provision for control and regulations of operation
relating to narcotic drugs and psychotropic substance.
 To considerably enhance penalties particularly for trafficking offenses.
 To make provision for implementation of international convention
relating to narcotic drugs and psychotropic substance to which India is
party.

5. DEFINITION
Chapter 1,section 2
CANNABIS
 Cannabis means
 Charas, that is seperate resin in whatever form, Whether
crude or purified, obtained from the cannabis plant and
also includes concentrate preparation and resin know as
hashish oil or liquid hashish.
 Ganga, that is, the flowering or fruiting tops of the
cannabis plant, by whatever name they may be know or
designeted.

6. COCA DERIVATIVES
 Crude cocaine, that is,, any extract of coca leaf which
can be used, directly or indirectly, for the manufacture
of cocaine
 Ecgonine and all the derivatives of Ecogonine from
which it can be recovered.
 Cocaine, that is, methyl ester of benzoyl- ecgonine and
it’s salt and
 All preparation containing more than 0.1 percent of
cocaine.

7. Manufacture
In relation to narcotic drugs or psychotropic
substance, includes –
1. All processes other than production by which
such drugs or substances may be obtained
2. Refining or transformation of such drugs or
substance.
3. Making of preparation with or containing such
drugs or substances.

8. MANUFACTURED DRUG
 Manufactured drug means –
 All coca derivatives, medicine cannabis, opium
derivative and poppy straw concentrate.
 Any other narcotic substance or preparation which the
central government may having regard to the available
information as to it’s nature or to a decision if any,
under any international convention, by notification in
the official gazette, declare to be a manufactured
drug.

9. MEDICINAL CANNABIS
 Medical cannabis that is medicinal hemp, means
any extrract or tincture of cannabis
 Narcotics commissioner means the narcotics
commissioner appointed under section 5
 Narcotic drug means coca leaf, cannabis, opium,
poppy straw and includes all manufactured drugs.

10. OPIUM AND DERIVATIVES
 Medicinal opium
 Prepared opium
 Phenanthrene alkoids such as morphine, codeine,
thebain and their salts
 Diacetyl morphine and it’s salts.
 All preparation containing more than 0.2% of
morphine or any amount of diacetyl morphine.

11. OPIUM POPPY
 The plant of the species papaver somniferum
 The plant of nay other species of papaver from which opium
or any phenanthrene alkaloid can be extracted and which the
central government may by notifications in the official
gazette, declare to be opium poppy for the purposes of this
act
 POPPY STRAW means all the parts of the opium poppy after
harvesting whether in their original from or cut, crushed or
powered and whether or not juice has been extracted from
other.
 PSYCHOTROPIC SUBSTANCE means any substance natural or
synthetic, or any natural material or any sakta or preparation
of such substance or material included in the list of
psychotropic substance specified in the schedule.
