OnMarch14,2013,theVirginiaGeneralAssemblyapprovedChapter382
requiringtheVirginiaStateCorporationCommissiontoconductarenewable
energypilotprogramforthird-partypowerpurchaseagreementsandto
establishcertainguidelinesregardingitsimplementation.
PURPOSE
SCCmustestablishguidelinesconcerning(i)informationtobeprovidedin
writtennoticesand(ii)proceduresforcollectingandpostinginformation
derivedfromsuchnoticestotheCommission’swebsite.
APPLICABILITY
Applicabletoanyowneroroperatorofasolar-poweredorwind-powdered
electricgenerationfacilitylocatedonpremisesownedorleasedbyaneligible
customer-generator.Suchafacilityshallhavegenerationcapacityof50kWto
1MW.Aneligiblefacilityshallprovideelectricitytoonlyonecustomer.
Theowner-operatorshallbepermittedtoselltheelectricitygeneratedfrom
suchfacilityexclusivelytosucheligiblecustomer-generatorunderapower
purchaseagreementtoprovidesucheligiblecustomer-generatorthird-party
financingofthecostsofsucharenewablegenerationfacility.
Thepilotprogramislimitedto50MW.

Alltold,Dominionexpectstoinvestabout$3billioninvarioussolarprojects–inVirginia
andbeyond–with$700millionslatedforprojectsthatwillgeneratepowerforitscustomers.
Planscallfordevelopingmultiple,large-scalesolarprojectstotaling400megawattsof
generatingcapacity.Theseprojectsshouldbeoperationalby2020andbecapableof
producingenoughpowertosupplyabout100,000homes.

energydevelopmentandtofacilitatewidespreaddevelopmentofcommunity-basedrenewnableenergyprojects
throughoutMinnesota.”
-TheC-BEDTariffprovidesthateachpublicutilityinMinnesotaisrequiredtofilewiththeMinnesotaPublicUtilities
Commissiontocreatea20-yearpowerpurchaseagreementforcommunity-ownedrenewableenergyprojects.
-TheC-BEDtariffratemustbehigherinthefirst10yearsofthePPAthanthefinal10years.
-2009legislationrequiresallutilitiestofilestandardcontractswiththeCommissionforthepurchaseofelectricityfrom
projectswitharatedcapacityof5MWorless.

orinthecaseofaprojectlocatedwithintheboundariesofareservation,thetribalcouncilforthatreservation;and
-(4)allownersofpropertytraversedbytransmissionlinesservingtheprojectmustbegiventheopportunitytoinvest.

-NewYork’sCommunitySolarProgram:
-AspartoftheNYSUNInitiative,aimedatstimulatingNewYork’ssolarmarket,theNewYorkPublicService
CommissionintroducedtheNY-SUNIncentiveProgramtohelpreducethecostsofinstallingsolarsystemsin
NewYork.
-Aspartofsuchefforts,theNYCommissionrecentlylaunchedCommunitySolarNY,aprogramwhichseeks
tomakesolareasierandmoreaffordablethroughcommunity-driveninitiatives.Moreparticularly,the
SharedRenewablesinitiative(alsoknownasCommunityDistributedGenerationorCommunityDG)provides
opportunitiesforcustomerstoparticipatedirectlyinoff-siterenewableprojectsthroughnetmetering.
-CommunityDGwasenabledbytheNYCommissionthroughitsJuly2015Order(Case15-E-0082).
-Phase1ofCommunityDGbeganonOctober19,2015andallowsprojectstointerconnectifthey:
-ArelocatedinthenewCommunityDGOpportunityZonesdesignedbytheutilities;or
-Includelow-incomeresidentialcustomers,definedasacustomerparticipatinginaStateorutilityenergyassistance
program,asatleast20%oftheprojectmembership.

-NewYork’sCommunitySolarProgram,continued:
-Eachprojectmusthaveasponsor,whoownsoroperatestheproject,organizesthemembershipandcollaborates
withtheutility.
-Thesponsorwillprovidetheutilitywithalistofthemembersandtheirpercentallocationoftheproject’snet
meteringcreditspriortointerconnection.
-Eachprojectmusthaveatleast10members,andeachmembermustbeallocatedatleast1,000kWhperyear(not
toexceedtheirhistoricaverageannualconsumption);provided,however,nomorethan40%oftheCommunityDG
host’sexcessgenerationmayservememberswithanaveragemonthlypeakdemandof25kWorgreater.
-ThetermsoftheCommunityDGmembership(e.g.,paymentstructure)aregovernedbytheagreementbetweenthe
sponsorandmembers.

SUMMARY
InJune2011,DominionfiledwiththeSCCanapplicationtoamendandreissue
certificatesofpublicconvenienceandnecessityforapprovaltoconvertthreeelectric
coal-firedgenerationfacilitiesintobiomass-burningfacilities.Theconversionwould
decreasethenetcapacityratingforeachfacilityfrom63MWto51MW,but
increaseexpectedenergyproduction.
TheestimatedconstructioncostoftheConversionsisapproximately$165.8million,
excludingfinancingcosts.Pursuantto§56-585.1A6oftheCodeofthe
Commission’sRulesGoverningUtilityRateApplicationsandAnnualInformational
Filings,theCompanyseeksapprovalofarateadjustmentclause,designatedRider
B,fortherecoveryofcostsassociatedwiththeConversions.
Altavista,Hopewell,andSouthamptonPowerStationwereconventionalsteam
unitswithcoalstokerboilersandassociatedequipment.Thestationswere
convertedtoburnvirginbiomass,requiringmajorconversions:
Thestationfuelhandlingequipmentwaschangedoutinitsentiretyto
accommodatethedelivery,processing,anddistributionoffueltothe
boilerstobeburned.
Combustionsystemsandcomponentswerechanged/convertedto
accommodatethenewfuel.

-Thesecriteriaincluderequirementssuchascertificationbythegoverningbodyofthelocalitywheretheprojectwillbelocatedthat
theprojectcomplieswithallapplicablelanduseordinances,acopyofthefinalinterconnectionagreement,acertificationsignedby
aprofessionalengineerlicensedinVirginiathatthemaximumgenerationcapacityoftheprojectdoesnotexceed100megawatts,an
analysisofthebeneficialandadverseimpactsoftheproposedprojectonnaturalresources,acertificationthattheapplicanthas
appliedforallnecessaryenvironmentalpermits,etc.
-Theregulationsfurtherprovidethatwithin90daysofreceivingalloftherequireddocumentsandtheappropriatefee,
DEQshalldetermine(afterconsultationwithotheragenciesintheSecretariatofNaturalResources)whetherthe
applicationiscompleteandwhetheritmeetstherequirementsoftheregulations.IfDEQdeterminesthatitdoes,then
DEQ“shallnotifytheapplicantinwritingthatheisauthorizedtoconstructandoperateasmallsolarenergyproject.”
