• Treaty is a tool for us to achieve self-government so
we can be in charge of our own destinies.
• Once we ratify the Treaty we will have to start Nation
Building – planning our self government and building
a better life
To do this we implement the Nation Building Plan

• The Nation Building Plan covers four
categories:
– Government and Administration
– Economic Development
– Land, Resources and
Capital Infrastructure
– Social Development
These are the pillars for
rebuilding our Nation

Strategic Plan for Self Government
• A strategic plan provides guidance and
accountability for self-government – sets the stage
for everything else
• Long term, shared vision with short term goals and
strategies to achieve that long term vision
– Shared vision will be defined by community
– Members will have input in defining the vision and values

Institution Building
• Governing institutions are set out in a Constitution
– The Constitution is defined and voted on by
members
• The Constitution sets out the political structure,
governing institutions and rules
– Every Nation government we ever elect post
treaty will have to follow the Constitution

• Our Constitution will shape
every other aspect of our
governance and policies,
including decisions about any
of the other pillars

Government Organization
• Different government organizations (Treaty office,
band offices) will come together under a new
structure
– New Structure will be based on new responsibilities and
roles needed to fulfill those responsibilities
• Consolidate delivery of services
– Consolidate existing staff, and hire new staff
• Based on skills
– Capacity building & Staff Training Plan
– Create Policies for a productive and healthy working
environment

Legislative Plan and Drafting
• Under self-government we will have law making
authority over a range of matters.
– It will take time to develop the laws, and the institutions
and revenue to administer and enforce our laws.
• The Legislative Plan will help us plan the order,
timing and process for making our laws
– Identify which laws and regulations to make and when
– Process for drafting laws
– Identify an approval process
• We will establish a Legislative Review Committee to
draft the Legislative Plan

Operational Plan and Budget
• Our Operational Plan and Budget will help us be
accountable to members on our operations and
spending.
– Allocate a budget to meet the goals set out in the
Strategic Plan
• The planning will include joining of managing
processes, which are currently different across each
organization
• Appropriate budgeting tools and capacity to use
those tools
– Training for staff on new tools and process

Dispute Resolution Process
• On Effective Date we will need a process to review
and appeal of administrative decisions made.
• Dispute resolution must be independent of other
processes.
– We will be guided by our constitution when
creating the dispute resolution process
– We will learn from other First Nations
• We will need to train people to serve on this
committee

Court Services and Enforcement
• After Effective Date In-SHUCK-ch will be responsible
for enforcing laws.
• We will have to decide how we work with Canada,
BC or their agencies to enforce our laws on our
behalf.

Transition Plan
• Building up all these institutions and processes, and
transitioning to self-government is a lot of work!
– We will need to a have framework to ensure we
didn’t forget anything  A Transition Plan
• Many activities in a short time frame, many
legal details
• We will need to look at community issues,
transitioning reserves and bands into Nation Land
and local governments, closing plan, survey of Treaty
Land and other issues.

Cultural Protocol
• If you look at the Indian Act you will see it has
no reference to our cultural values.
• With self-government we can make sure
cultural values and practices are incorporated
into our government
– We will need to identify how to bring this cultural
protocols into our governance procedures
– it not only for ourselves but also show others
what our culture means.

Conclusion
• The Constitution will shape the way we govern
– No future Nation government will be able to do
anything that goes against the constitution
– Members will have a say and vote on the
Constitution
• There will be quite a bit of work to be done and you
need to think of how you wish to be involved.
– Part of the involvement could include training for
positions so we can employ our own members.

The Nation Building Plan • Treaty is a tool for us to achieve self-government so we can be in charge of our own destinies. • Once we ratify the Treaty we will have to start Nation Building – planning our self government and building a better life To do this we implement the Nation Building Plan A BETTER LIFE Life Under the Indian Act Self Government Treaty

  • 5. The 4 Pillars of the Nation Building Plan • The Nation Building Plan covers four categories: – Government and Administration – Economic Development – Land, Resources and Capital Infrastructure – Social Development These are the pillars for rebuilding our Nation

Strategic Plan for Self Government • A strategic plan provides guidance and accountability for self-government – sets the stage for everything else • Long term, shared vision with short term goals and strategies to achieve that long term vision – Shared vision will be defined by community – Members will have input in defining the vision and values 1

Institution Building • Governing institutions are set out in a Constitution – The Constitution is defined and voted on by members • The Constitution sets out the political structure, governing institutions and rules – Every Nation government we ever elect post treaty will have to follow the Constitution 2
  • 9. • Our Vision will help shape our Constitution; • Our Constitution will shape every other aspect of our governance and policies, including decisions about any of the other pillars 1 2 7 8 9 4 5 6 3

Government Organization • Different government organizations (Treaty office, band offices) will come together under a new structure – New Structure will be based on new responsibilities and roles needed to fulfill those responsibilities • Consolidate delivery of services – Consolidate existing staff, and hire new staff • Based on skills – Capacity building & Staff Training Plan – Create Policies for a productive and healthy working environment 3

Legislative Plan and Drafting • Under self-government we will have law making authority over a range of matters. – It will take time to develop the laws, and the institutions and revenue to administer and enforce our laws. • The Legislative Plan will help us plan the order, timing and process for making our laws – Identify which laws and regulations to make and when – Process for drafting laws – Identify an approval process • We will establish a Legislative Review Committee to draft the Legislative Plan 4

Operational Plan and Budget • Our Operational Plan and Budget will help us be accountable to members on our operations and spending. – Allocate a budget to meet the goals set out in the Strategic Plan • The planning will include joining of managing processes, which are currently different across each organization • Appropriate budgeting tools and capacity to use those tools – Training for staff on new tools and process 5 1

Dispute Resolution Process • On Effective Date we will need a process to review and appeal of administrative decisions made. • Dispute resolution must be independent of other processes. – We will be guided by our constitution when creating the dispute resolution process – We will learn from other First Nations • We will need to train people to serve on this committee 6
  • 14. Court Services and Enforcement • After Effective Date In-SHUCK-ch will be responsible for enforcing laws. • We will have to decide how we work with Canada, BC or their agencies to enforce our laws on our behalf. 7
  • 15. Transition Plan • Building up all these institutions and processes, and transitioning to self-government is a lot of work! – We will need to a have framework to ensure we didn’t forget anything  A Transition Plan • Many activities in a short time frame, many legal details • We will need to look at community issues, transitioning reserves and bands into Nation Land and local governments, closing plan, survey of Treaty Land and other issues. 8

Cultural Protocol • If you look at the Indian Act you will see it has no reference to our cultural values. • With self-government we can make sure cultural values and practices are incorporated into our government – We will need to identify how to bring this cultural protocols into our governance procedures – it not only for ourselves but also show others what our culture means. 9

Conclusion • The Constitution will shape the way we govern – No future Nation government will be able to do anything that goes against the constitution – Members will have a say and vote on the Constitution • There will be quite a bit of work to be done and you need to think of how you wish to be involved. – Part of the involvement could include training for positions so we can employ our own members.

  2. This is another look of the Nation Building plan we talked about in November.
  3. As we discussed in November, we will start implementing the Nation Building Plan once we ratify Treaty Remember, Nation building is the process of rebuilding our government, our institutions, and our society to reflect the vision we want for our Nation.
  4. The Golden Apple is the state where we have all the things we need to have happy, healthy lives and communities. It is made up of all the aspects that people identified during the community sessions in whistler, where people talked about what was important to them. Some of these aspects of our vision ro a better life relate to Government and Administration (shown in blue)
  5. Each will be needed to be a real Nation so we will discuss them as the only(main?) topic at a meeting.
  6. The first pillar will be Gov’t and Administration. As you can see there are many parts to it.
  7. To make sure we have everything in it we will plan for everything including accountability. We are not going to develop a plan then tell you about it but get your input while writing it.
  8. The Constitution will set our rules the members, our government and other will have to follow.
  9. What will our government look like and what will a chart showing us who to talk to with concerns must be included. Identify positions for admin. See if current admin follows what membership has identified in constitution. Develop a plan to cover capacity for admin
  10. Our nation building must stand up in court as legal so we will write it with legal assistance. Other laws will deal with how we are to decide on laws and gives authority to members to develop laws
  11. Who will be doing what and what will the costs be will need to be written out for all to know and follow. (band offices and treaty offices have different processes for operations and budget, so we will have to establish a way forward that works for the new structure
  12. What if someone has a problem with a decision our government made? They will need a place to go to for answers and work out the problem. We need to decide the process before there is a problem, so that every review and appeal is dealt with in a fair and consistent manner. There will be different levels depending on how serious the issue is.
  13. We look forward to having our own court system to deal with our issues. Canadian Law will still apply but the penalty might be different. With our own laws we could have our own police and penalties. It is expensive to have our own court system. We can contract existing agencies to enforce our laws. We use their resources and expertise, but the laws are ours (not theirs).
  14. All our planning will be useless if we are not ready to take on parts of the jurisdiction. Getting ready will need to start now rather than just taking things because we can.
  15. We will be sure to involve our culture in any planning or solution to issues.
  16. As you can see we will have our work cut out for us all. How you want to be involved is up to you so if wish please start getting necessary education to be ready.
