RESOLUTION AUTHORIZING THE CHAIR TO ENDORSE AN ADDENDUM TO
THE EMPLOYMENT AGREEMENT WITH THE COUNTY ATTORNEY
WHEREAS, on September 2, 2008, the Board of Supervisors entered into
an Employment Agreement with Edwin N. Wilmot, County Attorney; and
WHEREAS, on October 3, 2017, the Board of Supervisors decided to
modify that Employment Agreement pursuant to the attached Addendum.
NOW, THEREFORE, BE IT RESOLVED that the Gloucester County
Board of Supervisors agrees to the modifications set forth in the attached
Addendum, and authorizes the Chair to endorse the Addendum to the
Employment Agreement with Edwin N. Wilmot, County Attorney.

2. ADDENDUM
This ADDENDUM, made this 3RD day of October, 2017, to the Employment
Agreement (“Agreement”), dated September 2, 2008, by and between the Board of
Supervisors of Gloucester County, Virginia, (“Board”) and Edwin N. Wilmot (“County
Attorney”). That in exchange for the mutual covenants and obligations pursuant to both the
Agreement and this Addendum, and for other good and valuable consideration, the Board
and the County Attorney mutually agree that the Employment Agreement shall be modified
as follows:
Section 5. Salary shall be amended, effective July 1, 2017, to provide an
additional Five Thousand Dollars ($5,000.00) in deferred compensation
annually.
Section 7. Paid Time Off shall be amended, effective July 1, 2017 to increase
annual leave by four (4) hours per month and increase the cap on accumulation
of annual leave from 336 hours to 600 hours.
Section 10. Health Insurance shall be amended to include the following: The
Board agrees that the County Attorney, during annual open enrollment, has the
option to select the High Deductible Health Plan (HDHP) for himself and his
eligible dependent(s). If the County Attorney elects the HDHP, for each month
coverage is effective, the County will contribute 1/12 of the maximum allowable
annual contribution, including eligible catch-up contribution, to the County
Attorney’s Health Savings Account (HSA). In the event that the HSA maximum
allowable annual contribution or the catch-up contribution amount set forth by
the IRS for a calendar year increases within the calendar year, within 60 days
of the IRS’ issuance of such revised guidance, the County will make an
additional contribution to the County Attorney’s HSA account in an amount
reflecting retroactive application of the revised maximum allowable contribution
amount to January 1 of the then current calendar year.
In all other respects, the Agreement, as amended May 18, 2010, August 6, 2013, and
November 1, 2016 shall remain in and of full force and effect.
IN WITNESS WHEREOF, the Board and the County Attorney have executed this
Addendum, in accordance with the authorization of the Board of Supervisors on October 3,
2017.
