3. Purpose
• Establish harmonised conditions for access and sharing
INSPIRE spatial data and services
– From Memeber states MS to Community institutions and bodies
– Within the MS
„Searching the ballance“
Restrictions should not be seen as all or nothing
– Although restrictions can be neccessary, INSPIRE aims to
improve sharing
– MS or involved stakeholders should quote under which
conditions is possible to grant access to restricted data and
services (e.g. removal of sensitive information, generalisation, etc)
– Possible restriction exemptions (forest fire near a military base)
– Support for wide access to data & services to stimulate added
value generation potential
4. • INSPIRE Directive (2007/2/EC)
• Implementing rules (Commission
Regulation on INSPIRE data and services
sharing)
• Guidance on access to spatial data sets
and services of the Member States by
Community institutions and bodies under
harmonised conditions
• Examples of good practice in data and
service sharing from various countries.
Requirements Recomendations
Analysis of requirements
6. Analysis of requirements
• Harmonised conditions should :
– Improve access and sharing for INSPIRE spatial data
and services
– Make more transparent and where possible eliminate
the possible restrictions for access and sharing
• Role of:
– Metadata
– Transparency
– Response times (20 days)
– Acknowledgement of intellectual property rights
– Emergency access and use
– Public access
7. Licensing framework
• Requirements for licences:
– Any arrangements concerning access to
spatial data sets and services shall be fully
compatible with the requirements of the
Regulation
– Definitions laid down in Article 3 of Directive
2007/2/EC shall be used in any arrangements
concerning access to spatial data sets and
services
8. Licensing framework
• Type of INSPIRE licences:
– Prepared in advance before the need for the execution:
• INSPIRE Framework Agreement
– Prepared either in advance, but mainly at the moment of need for
the execution:
• The Basic INSPIRE Agreement:
Access to data and services in INSPIRE context without any
restrictions, or conditions and free of charge:
– Basic INSPIRE Licence for spatial data sets
– Basic INSPIRE Service Level Agreement for spatial data services
• Specific INSPIRE Agreement
Access to data and services, allowing to address specific harmonised
rights and responsabilities and where needed charging conditions.
– Specific INSPIRE Licence for spatial data sets)
– Specific INSPIRE Service Level Agreement for spatial data services
9. Licencing framework
• Licences classifications
– Scope
• One dataset/service
• More datasets/services
– Involved parties
• Bilateral level
• Framework level
– Form
• e-mail;
• non-transactional statement on website
• click-licence on-line
• Machine-readable licences
– Multilinguality
• SK mandatory
• EN recomended
10. SK State of play
•Organisation
– Individual ad hoc licences/agreements
– Non harmonised structure of the agreements
– Absence of licence registry (overview of
agreements defining conditions for spatial data
and services access and use)
– Emergency situations covered by Ministry of
Interior (Civil protection)
• Requirements to create and maintain
organisational structure allowing effective spatial
data and services access and use (Including
appropriate processesand tools)
11. Implementation scenarios
• Aim: Fullfillment of requirements on data sharing:
– Licensing framework (Legal and technical (suportive) dossier);
– Processes allowing access, sharing and use
• Possible scenarios:
– Individual decentralised agreements (Close to current status): Low level of harmonisation
– Centralised licensing framework (Full centralised control of INSPIRE data and services sharing):
Difficulties to implement because of heterogenity of environment
– Combined scenario (Allowing flexibility, whilst ensuring minimal level of harmonisation):
• Licensing framework – (step wise implementation):
• Definition of NSDI license policy
– Methodological/strategic document sumarising conditions of licensing framework for SK NSDI,
experience identified in the process of implementation and providing recomendations for further
development in area of legislation (harmonisation with relevant initiatives eGov, Emergency activities)
as well as in the area of practical implementation (eg. Machine readable licenses).
• Preparing SK localisation of INSPIRE license templates:
– Benefits: Partial level of licenses structure harmonisation, fast implementation
– Limitations: Relatively still high level of admin burden, still relatively time consuming mainly from the
coordination point of view.
• Framework agreement preparation – delineating generic harmonised framework for data
and services provision for EU as well as national level:
– Benefits: High level of harmonisation of licence structure and overal coordination, increased speed in
processing of data and services access requests, clear rules and processes
– Limitation: Higher time needed in order to achieve the consensus on national level (heterogenic
spectrum of requirements and expectations)
12. Licensing framework: License policy
• Possibility of implementation of license policy of NSDI
– NSDI Licence policy
Defining frame for transparent and consistent exchange of digital
spatial data and services:
• Preamble
• Legislation framework
• Terms definitions
• Principles
• Subject matter and scope
• Objectives
• Data and services provision
• Access to and redistribution of data and services
• Agreements/Licenses register
• Warranty
• Quality
• Review
• Annex(es): license templates

15. Licensing framework: Framework agreement
• NSDI Framework agreement
Delineation of generic, but flexible enough
framework allowing harmonised access and
exchange of spatial data and services on Eu and
national level:
• Licensing
• Duration and renewal
• Openness
• Private Participation / Partnership
• Stepwise implementation
• + where needed articles from INSPIRE license
templates
16. Processes allowing access, sharing and use
• Possible scenarios to deploy relevant processes:
– Centralised
• Central national licensing coordination (Ministry of
Environment, MSCP, Coordination Group ?)
• Agreement achieved with all involved stakeholders in order
to ensure consistent communication and sharing of digital
spatial content on national level
• Following that central coordination authority will initiate
agreement/s with relevant EU authority(ies).
– Distributed
• Each stakeholder will sign agreement individually on
national and international level, following agreed rules for
harmonised data sharing.
– Combined
•Combination of above scenrios
17. Remaining open issues
• Detailed work to be initiated via Specific WG
on Data sharing
• Provision for SK implementation roadmap
• Identification of most suitable licence
framework
• Selection of suitable process to ensure
access and exchange of digital spatial content
in context of INSPIRE
• Improve awareness raising
