In EU : Life of author + 70 years
If the copyright is shared by several co-
authors, it will expire 70 years after the

Economic rights –
Right of reproduction;
Right of performance, broadcasting and
communication to the public & making
available; Rights of translation & adaption
Moral rights – Right of attribution; Right of
integrity

What is copyright infringement?

Any use or production of copyright protected
material without permission of copyright holder.

In EU, as regards infringement of copyrights is
concerned , a comprehensive level of harmonization is
provided for in Directive 2001/29/EC (“Information
Society Directive”) .
EU member states to provide for civil and criminal
remedies under national laws for copyright
infringement.

Copyright holder can claim:
1. Injunctive relief
2. Recall or restitution of infringing goods.
3. Unjust enrichment
4. Damages:
- Actual damages
- Loss of profits due to infringement
- Reasonable royalties
5. Losing party has to reimburse the winning party’s lawyer’s fees.
Unlawful exploitation of copyrighted works- Max. imprisonment of 3
years or fine.
Unlawful exploitation of copyrighted works on a commercial scale -
Max. imprisonment of 5 years or fine.
