1. POLITICAL CONSENSUS
between
Representatives of the August 30, 2021 Agreement for a Haitian Solution to the Crisis
and
Group of the National Protocol Agreement (PEN or Pwotokòl Antant Nasyonal) Modified
1- The general context of the consensus
For several years, a crisis of governance has disrupted the country, preventing the establishment of
political stability and the State from coping with the economic, social and environmental crises that are
ravaging the Republic. The political teams that have taken power in recent years have dragged the country
into a real chaos where criminals, legal bandits and drug dealers have taken control of the state.
Corruption, injustice and impunity have intensified while the problems of hunger, unemployment and
insecurity have become more prevalent in the country.
Following the assassination of former President Jovenel Moïse, the situation in Haiti has deteriorated.
Armed gangs have seized control of the country, and in unspeakable terms in the metropolitan area of
Port-au-Prince. No one can move freely. Kidnappings and assassinations have become commonplace.
Almost all important economic and social activities have slowed down considerably, when they are not
outright blocked.
The population is beleaguered. All those who practice politics in the country and abroad, seeking a
peaceful coexistence, ask themselves: how can a nation under international tutelage find itself in such a
dire general situation?
In the face of this crisis, a group of civil society actors set up a Commission in early 2021 to seek a Haitian
solution to the country's crisis. Over a period of seven months, Commission members met, consulted and
negotiated with the country’s major political, economic and social actors. It is this process of dialogue and
negotiation that culminated in the August 30, 2021 Agreement that many call the Montana Accord.
Despite all these efforts, several important actors in the society who were in discussion with the
Commission did not sign the Agreement, such as: the Catholic Church, the State University, a majority of
private sector associations, PEN, PHTK and allies, the remaining One Third of the Senate, etc. That is why
while the Agreement Monitoring Office (BSA or Biwo Swivi Akò) is implementing the agreement, it
continues to consult and negotiate with these key actors to reach a national political compromise to pull
the country out of its current state of affairs.
While much work is being done to find a genuine local solution to the crisis, Haitian society found itself
in the face of a de facto government installed in power. After more than five (5) months in power, this
government has yet to show any sensitivity for the suffering of the population and the situation is
worsening every day.
In the political dialogue carried out with the main Haitian actors who did not sign the August 30
Agreement and with the most influential international actors in the country, only PEN submitted to the
BSA a proposal for a political consensus. Today, the National Transitional Council (KNT or Konsèy
Nasyonal Tranzisyon) is installed. KNT is beginning to work towards holding the proxy election to put the
Transitional Governance in place.
2. The dynamism of this dialogue allowed Representatives (women and men) of the August 30 Agreement
and Representatives (women and men) of PEN Modified to find essential consensus elements on the
following points that are in alignment with the foundations of the August 30, 2021 Agreement for a
Haitian solution to the crisis.
2- The political consensus reached
2.1- The objective
The main objective of the negotiations is to find a national political compromise to remove the country
from its current bad state of affairs, to allow:
1. The rapid resolution of the profound crisis of the country to enable social peace and political
stability;
2. The rapid establishment of a Consensual Governance that has social legitimacy and brings
together credible personalities, who inspire public confidence behind a realistic program and a
roadmap that addresses the most pressing fundamental problems of the State and society;
3. Following the decision to hold the national conference, to take all necessary measures, to
amend or to change the 1987 constitution; seek to establish or strengthen on a consensual basis
the Republican institutions that are the foundation of democracy and good state administration;
revise the electoral system, so that the Transition can pave the way for the country to take
another path that will lead it to quality sovereign, democratic and participatory elections to
prevent the mafia from continuing to rule the country;
4. This transition will take place over a maximum of 2 years.
2.2- A consensual governance
The Consensual Governance is based on a Bicephal Executive (two heads), with a Prime Minister and a
President. As part of the political consensus, the presidency takes the form of a Presidential College. The
college allows for better compromise between the different actors involved in the changes the
population is demanding. This also ensures their full responsibility.
2.2.1- Transition steering body
A Presidential College with five (5) representatives, "quintet", which will include at least one woman. It
shall consist of the following representatives:
1. A representative -female or male- from the mechanism provided for in the Agreement of August
30, 2021;
2. A representative -female or male- from PEN Modified who meets the criteria set forth in the
political consensus;
3. A representative -female or male- from the current political authorities in power, and who
meets the criteria defined in the political consensus;
3. 4. Two representatives – female or male- from other important sectors of civil society that the
political consensus validates according to the defined criteria and presented to the KNT with the
right of motivated reserves.
Political dialogue and negotiations with other stakeholders will enable an agreement on the coordination
and operation of the Presidential College to be established.
2.2.2- The Transitional Government
A head of government – female or male - will be appointed under the mechanisms of the Montana
Agreement. It will be him or her who will coordinate the planning and execution of government actions.
The head of government in consultation with the Presidential College and according to the roadmap will
constitute the government. Members of the government will come from various sectors that have signed
the national political consensus, but all must meet the criteria defined in that political consensus. The
cabinet will be reduced, and must have the validation of the CNT before it can take office.
2.2.3-Transition Control Organization
The National Transitional Council (KNT) after completing its mission and validating the roadmap and the
cabinet will be transformed into the Transitional Control Body (OCT). To complete the OCT, the political
consensus will select 2 delegates per department and 3 delegates from the diaspora. These delegates will
be appointed according to the criteria defined in the political consensus. The mandate and role of the OCT
are defined in the Agreement of August 30, 2021.
2.3-Transition Government Roadmap
The fact sheet is fundamentally based on the programmatic axis and the Accord sheet of August 30, 2021.
The transitional power has a series of strategic interventions that it must undertake to create the
conditions for social peace, political stability and a better country. The road map will be delineated and
developed, but it is normal that the most important aspects are clarified by the political consensus. Follow
some of the most urgent and necessary actions:
1. Take all the most urgent and important steps in the ministries and autonomous bodies of the
State to put order and put in place the reforms necessary to enable the Government to take
control of the public administration and to ensure better living conditions for the population;
2. Reorganize and strengthen public security to systematically combat organized crime and
banditry so as to place the armed gangs in a situation where they cannot do harm and where
they will be demobilized throughout the country;
3. Reorganize the justice system to combat corruption and impunity by first seeking to shed light
on massacres and blood and financial crimes;
4. Reorganize public finances to enable the State to acquire the financial means necessary to
make the necessary investments and improve the living conditions of the population;
4. 5. Organize the sovereign national conference to lay the foundations for political, economic and
social stability by establishing republican institutions on a shared and consensual basis;
6. Reform the national identification system and the electoral system to ensure sovereign and
democratic elections in the country.
The Transitional Government Roadmap must be validated by the KNT before it can be implemented.
