My name is Jonathan Rosenfeld and I work with

Causes and Types of Car Accidents
Chicago is one of the busiest cities in the nation and it comes as no surprise that its roads are home over
200,000 accidents every year. Understanding the most common causes of accidents doesn’t only allow us
to represent our clients more effectively, but also helps us educate the public on the issues that impact the
safety of our roadways the most. It is likely that every single driver can improve his or her habits and reduce
the likelihood of being involved in an accident.
Distraction Among Most Common Causes of Accidents
Advances in technology have allowed us to connect with more people and bridge great distances and to
get more done throughout our busy lives. Unfortunately, this has come at the cost of safety and many of us
have become so dependent on our devices that we allow them to interfere with other aspects of our lives.
Studies have shown that you are less likely to get into an accident under the influence of alcohol than you
are while sending a text message behind the wheel. Next time you think about taking a phone call or
reading a text message, remember that the person on the other end can wait and will do so willingly if it
means you arrive at your destination unharmed.
Here are the most common causes of accidents for you to consider.
Î Driving while tired or fatigued. While this is a major concern with truck drivers, it also applies to
motorists who choose to take to the roads over long distances without giving themselves adequate
breaks or rest. There are many similarities between drunkenness and tiredness in that your vision,
ability to make decisions and reaction time are all impacted in a similar manner.
Î Driving while distracted. Talking on the phone, sending a text message, doing your makeup, eating
and drinking while behind the wheel are all examples of distracted driving and studies are finding that
distraction is becoming the cause of more accidents each year.
Î Influence of drugs or alcohol. One of the most irresponsible decisions you can make is to get
behind the wheel after consuming alcohol or controlled substances. It places yourself and
everyone else on the road at great risk. Alcohol is a factor in the majority of fatal accidents and
debilitating injuries, as drunken driving accidents tend to be much more violent and serious.
Î Weather conditions. Rain, ice and snow contribute to many accidents in Chicago each year, but our

Accidents do not always involve multiple drivers, but they may involve numerous passengers even if only
one car was involved. Examples of single vehicle accidents include when drivers lose control of their
vehicles and exit the road due to inclement weather or when drivers collide with a building or object while
trying to avoid an accident with another vehicle. If passengers are involved in the accident, they may suffer
injuries that the driver is liable for, and the owners of property that has been damaged in the incident are
entitled to compensation for their losses as well.
Accidents at Intersections
Misjudging distance and approach speed of oncoming traffic is one of the most common causes of auto
accidents. Other accidents occurring at intersections can be the result of drivers running red lights, failing to
yield to others or operating a vehicle while under the influence of drugs or alcohol. The injuries suffered in
these accidents can be extreme, due to the following factors.
Î Many accidents at intersections are T-bone collisions, which place the driver or passenger at
greater risk due to an impact from the side. Modern vehicles are designed to distribute the force
from a front or rear impact away from the driver or passenger, but a collision from the side can
cause severe trauma.
Î Accidents at intersections have the potential to become multi-accident events. The force from the
first collision can send one vehicle into another and create a chain event of collisions that place more
drivers and passengers at risk.
Î Speed is often a factor in these accidents. Drivers may misjudge the speed of oncoming traffic, or
the offending driver may be speeding up in order to make it through the intersection during a
yellow light. High speeds are linked to more severe injuries.
Rear-End Collisions
There are many causes for rear-end collisions, such as tailgating, not braking quickly enough or loss of
vehicle control due to inclement weather. Regardless of the cause, our lawyers recommend seeking a
comprehensive medical evaluation following any rear-end collision due to the possibility you’ve suffered an
injury to the brain, neck or spine. What makes rear-end collisions unique is that the force of impact often
throws the victims’ bodies forward and then back.
It is not uncommon for victims to strike their heads or to experience whiplash during these accidents. The
symptoms for these injuries may not present themselves immediately after the accident, however, and
many victims refuse medical treatment because they feel fine. Several weeks later, they may show
symptoms of a traumatic braininjury or whiplash, both of which can become debilitating and impact the
victim’s quality of life forever. Symptoms of an injury to the brain or neck can include the following.
Î Memory loss during the accident or at a later date during physical recovery.
Î The inability to focus or concentrate. This often feels like a haze or cloudy feeling.
Î Migraines occurring shortly after the accident and progressing in severity.
Î Severe stiffness in the back of the neck or back accompanied with the loss of motor function in the
arms.
Î Shooting pains in the arms, neck or shoulders.
Î Ringing in the ears, sudden changes in vision or dizziness.
Î Blackouts following the accident or at a later date.
Î Sudden changes in mood or mental state.
Low Speed Impacts
Accidents occurring in parking lots, side streets or as vehicles back out of their driveways may involve
speeds under ten miles per hour. These impacts can still be jarring enough to cause injury and damage
vehicles, however. It is tempting to just trade insurance information and go on your way, but you should
really make sure that you document the accident, take pictures and undergo a precautionary medical
evaluation just in case.
Commercial Vehicle Accidents
Some of the most devastating and catastrophic car accidents involve commercial vehicles. These large
vehicles can include charter buses, delivery vehicles and large semi-tractors. Negligent drivers can cause
incredible damage to property and serious injuries when their actions result in an accident. Their
employers’ actions may also be a factor in the accident, which makes the process of determining liability
more involved. The following must be considered if you’ve been involved in an accident with a
commercial vehicle.
Î If the commercial driver was in violation of traffic or work laws, he or she can be held liable for his or
her actions. It is the responsibility of employers to screen their employees, however, so ifthe driver
has a reckless driving history or repeated violations, the employer may share responsibility.
Î Many commercial vehicles are in poor condition. Bus and truck companies are notorious for cutting
corners and trying to force their drivers to shoulder the responsibility for maintenance concerns. If
mechanical failures or poorly maintained equipment is afactor, the party responsible for
maintaining the vehicle can share liability.
Î The manufacturer is often considered liable in the event that commercial vehicle equipment failure or
defects cause the driver to lose control of his or her vehicle. This provides an additional avenue of
recovering compensation if it is needed.
Side Swipe Accidents
Side swipes often occur when drivers merge into traffic or change lanes without checking their blind spots.
Speed plays a large role in these accidents— especially when drivers occupy merging lanes while others
are attempting to enter a highway. The damage can vary in degree depending on the speed and angle of
impact. These accidents can cause a chain of events if one vehicle is pushed into another and the vehicles
spin out of control at high speeds.
Understanding the type of accident you’ve been involved in can help when evaluating your symptoms and
determining what types of tests are required to ensure that you receive the right treatment. Each accident
has unique circumstances and mechanics which may influence the type and severity of injuries suffered.
Even if you haven’t suffered severe physical injury, you may have experienced the loss of a vehicle that you
depend on to maintain your independence.
Head-On Collisions
Head-on collisions are among the most dangerous forms of auto accidents and are responsible for
numerous fatalities every year. It is our primary goal to help each of our clients obtain the care that they
need to be able to move forward with their lives and to ensure that they will not need to be subjected to
the burden of expensive medical bills and out of pocket expenses by holding the people responsible for
their injuries liable.
Secret Service Crash is a High Profile Example of the Dangers of
Head-on Collisions
On December 29, 2015, a man died after he crossed into oncoming traffic and collided with a vehicle
carrying four secret service agents. He was transporting two passengers, who were both transported to
the hospital with all four of the agents in the other vehicles. The secret service agents were reported to
have suffered very serious, but non-life-threatening injuries.
Further investigation revealed that the at fault driver had an extensive criminal record and did not have a
valid driver’s license at the time of the accident. While the accident highlights some of the dangers that
secret service agents must encounter on a regular basis, it also underscores how serious head-on
collisions can be and how rapidly things can go wrong when a driver exits his or her lane of traffic and
moves toward an oncoming vehicle.
The Causes and Types of Head-on Accidents
Our lawyers have noticed that while there are variable factors that contribute to every accident, about nine in ten
accidents are the fault of at least one of the drivers involved. If so many accidents can be prevented, then it is the
responsibility of every driver to do whatever is necessary to keep the roads safe for others. Following are the main
causes and types of head-on collisions.
Î Adverse road conditions. Weather can make the roads more difficult to travel, reduce visibility and throw
debris into the path of unsuspecting drivers. Potholes, poor lighting, inadequate or non-existent lane
markings and poorly designed medians and guardrails can also contribute to accidents.
Î Accidents at intersections. There are a variety of factors that can contribute to accidents that take place in
the middle of intersections. A traffic light may be malfunctioning, a driver may misjudge the distance and
speed of an incoming vehicle prior to turning left, or a hurried driver may make a turn without making sure it
is safe to do so.
Î Driver distraction. Technology is quickly becoming one of the leading causes of serious accidents. Too many
motorists are attempting to multitask behind the wheel and despite advances in safety technology; more
drivers are being killed or seriously injured in accidents. The data is showing a link between the rise in texting
and talking behind the wheel and increases in collisions.
Î Multi-car accidents. In these accidents, one car may force another car into the opposing lane where it strikes
an oncoming vehicle. This is common at intersections when a left turner is rear ended or when a vehicle
entering the path of another is struck in the intersection and sent in the direction of oncoming traffic.
Î Sleep deprivation. Commercial truck drivers are often overworked and under-rested. While this groups
receives the greatest amount of attention for fatigued driving, others can slip behind the wheel on a
minimal amount of sleep as well. Nobody who is overly tired and has difficulty concentrating on the road
should operate a vehicle until he or she has rested.
Î The influence of drugs and alcohol. Many head-on collisions are the fault of drunk drivers or motorists who
are driving under the influence of adrug or controlled substance. There is simply no excuse for the reckless
behavior of operating a vehicle while under the influence of a mind altering substance and these drivers
should be held accountable to the fullest extent of the law.
Accidents at Intersections
Accidents at intersections always have the potential to cause very serious injuries to everyone involved, especially
when the at fault driver disobeys a traffic control device or move into the path of an oncoming vehicle. Studies have
shown that as many as nine out of ten auto accidents that have occurred could have been prevented and it is for
this reason that reckless and irresponsible drivers should be held liable for the harm caused by their actions.
Accidents at Intersections are common and Deadly
Collisions occurring at intersections are highly common, especially among elderly drivers who have diminished
depth perception and reaction times. The number of left turn accidents resulting in serious injuries has even
prompted some cities to implement the use of traffic circles in the planning of their roadways in order to limit the
number of left turns motorists will be forced to make. Left turns are not the only cause of collisions at intersections,
however. Other causes include the following.
Î Motorists running red lights or not obeying traffic control devices. When combined with excessive speeds,
these violations can result in very serious accidents that threaten the lives of innocent victims that
happened to be in the wrong place at the wrong time.
Î Multi-car accidents. Fender benders at intersections have the potential to become destructive and
devastating to the numerous motorists involved. If the car that was initially struck is pushed into the
intersection, it can collide with other vehicles and set off a chain reaction of accidents.
Î Distracted driving. When drivers choose to text or talk on the phone while driving, they are unaware of how
they are jeopardizing the safety of those around them. A simple glance away from the road can cause the
driver to miss a stop sign, run a light or head into oncoming traffic at an intersection.
Î The influence of drugs and alcohol. There is no excuse for drunk driving,
but many drivers are unaware of how the medications they take impact
their driving. Cough syrup and allergy medicines can cause drowsiness or
delay reaction time. Some cold medications even contain alcohol. It is
important that drivers take responsibility for what they put in their bodies
prior to getting behind the wheel of a vehicle.
Common Injuries
Our auto injury lawyers have helped many clients recover compensation for
the treatment of many different types of injuries. Accidents at intersections
have the potential to result in life threatening injuries or to leave victims
with physical or mental impairments they must live with for the rest of their
lives. Some of the common and serious injuries suffered in these accidents
include the following.
Î Traumatic brain injuries. Recent studies have uncovered a strong link
between serious neurological disorders and untreated trauma to the
head. Many of the injuries that the brain suffers go asymptomatic for a
long time before the first effects begin to manifest themselves. Loss of
cognitive function, speech, memory and motor skills are some of the long
term effects of these injuries.
Î Injuries to the spine or neck. Depending on the severity, a spinal injury
can be the cause of a lot of pain and limit the ability of the victim’s
mobility. In the most serious cases, the victim may suffer temporary or
permanent paralysis.
Î Lacerations, puncture wounds and disfigurement. Metal, glass and debris can cut deep into the skin
and cause deep tissue damage. These wounds can leave unsightly scars or become infected, forcing
doctors to amputate the affected limb in order to save the patient. In other cases, the wounds may
make it impossible for doctors to repair or restore the affected limb or digits.
Î Broken or shattered bones. The massive force and power that are displaced during an accident can
greatly damage the human body. It is not uncommon for accident victims to suffer one or more
fractures through the course of an accident. Fractures vary in severity and form and may require
extensive care to set back in place so that the bones will heal.
Rear End Collisions
Rear end collisions are extremely common on the streets and highways of Chicago, which are traveled by
millions of drivers every year. These types of accidents most often occur at low speeds, but can still cause
very serious and often debilitating injuries that require extensive therapy to recover from. It is also nearly
impossible for the victims in these accidents to do anything to avoid being hit or to mitigate the severity of
the damage. Fortunately, determining fault in these accidents is pretty cut and dry and it is possible for you
to recover the compensation you deserve.
Rear End Collisions Cause Serious and Nagging Injuries
You wouldn’t suspect that a rear end accident could cause such serious injuries, but victims are often
caught completely off guard when an automobile slams into their rear bumper. The impact of being
bucked forward and back again due to restrain systems can have a unique effect on the body and injuries
to the neck and back are quite common. Here are some of the injuries that often result from this type of
accident.
Î Whiplash, which results from damage to the cervical vertebrae when the neck snaps forward and
then back in the motion one would crack a whip.
Î Injuries to the back or spine. The same motion that results in whiplash may also injure the lower
back or the spine, resulting in the dislocation or rupturing of discs, commonly referred to as
herniated discs. The impact of these injuries can vary from intense pain when bending or moving to
partial paralysis of areas of the body that rely on the nerves in that area of the spine.
Î Traumatic brain injury. Studies have shown that sudden acceleration and deceleration can cause
the brain to move inside of the skull, often resulting in swelling when the brain collides with the
skull. Traumatic braininjuries are especially concerning because they may not present symptoms
for weeks or months following an injury. Our Chicago auto accident lawyers recommend that you
request special tests for a TBI following any accident, even if you feel fine.
Î Injuries to the knee or legs. When it is evident that a collision is imminent, most people tense their
legs and try to brace themselves before impact. This tension is counterproductive and causes
injuries rather than prevents them.
Î Injuries to the wrists and hands. Just as many people tense their legs prior to an accident, they
may place their hands in front of their body or head as an instinctive response to protect
themselves.
Î Injuries to the face or head due to airbag deployment or striking the back of a seat. While airbags do
save lives, they often deploy with enough force to cause moderate injuries to the face and head. Rear
seat passengers often strike the back of the front seat as well, resulting in injuries of varying severity.
Most Rear End Collisions are Preventable
Chicago traffic tends to frustrate drivers, who react irresponsibly by breaking traffic laws and taking ill-
advised risks for the sake of saving a few seconds. Others are often distracted by their phones or attempt to
multitask while behind the wheel, reducing their awareness of their surroundings and reaction time. Rowdy
passengers may also influence drivers and increase the risk of an accident. It is the responsibility of every
driver to place his or her focus on the road ahead and to follow all applicable traffic laws, however, and the
failure to do so makes them liable for any bodily harm and property damage that
they cause.
Speeding Accidents
Speeding is a major factor in the number of accidents and serious injuries that occur on Chicago’s streets
every year and drivers who are in a rush often fail to realize the ramifications their actions can have.
I have represented the needs of countless individuals whose injuries could have been less severe or
prevented entirely if not for the excessive speeds by with the at fault driver operated his or her vehicle.
The risks that you take when speeding are not worth the several minutes that you save getting to your
destination.
Motivation for Speeding
Speeding greatly increases the chance of severe injuries in a car crash, so why do so many drivers blatantly
disregard the posted speed limit? While it is impossible to speak on behalf of every driver in the Chicago
area, many of the drivers caught breaking speeding laws are doing so for similar reasons. Some of the
motivations for speeding include the following.
Î The driver is in a hurry. Whether late to work or
an appointment, many drivers feel that they
can make it to their destinations quicker if they
speed and weave in and out of traffic. If
you’ve ever noticed, traffic lights often stop
these speedsters in their tracks and they
only ever save a few seconds at a time
between each red light.
Î The driver is unaware of his or her speed.
Have you ever looked down at your
speedometer and instantly hit the brake
upon noticing how fast you were going?
Too many drivers have become distracted
by phones and other devices while driving
and it can cause us to speed without even
realizing it. Best to pay attention to your
driving and handle everything else when you are stopped.
Î Young drivers attempt to show off or seek thrills on the road. Teenagers take risks that adults
wouldn’t due to the need to impress others or to feel a rush. Unfortunately, this contributes to
many teen deaths each year.
Speeding Increases the Severity of Injuries
Our injury lawyers cannot recount all of the times in which a client’s injuries would have been minor if the
other driver had been traveling at the posted speed limit. Speed is linked to life altering and ending
injuries and the risk of these injuries increases as the needle on the speedometer rises. Some of the
injuries attributed to speeding include the following.
Î Paralysis due to extreme spinal injury. Not only is it emotionally traumatic to be told you will never
walk again, but the cost of caring for a quadriplegic can exceed $2 million over the rest of his or her
lifetime.
Î Deep lacerations, disfigurement and loss of limb. Metal fragments, debris, glass and other sharp
objects can cause severe injury at high speeds and result in unsightly scars, disfigurement or even the
loss of alimb either due to the injury itself or an infection brought on by foreign bodies entering the
body through the wound.
Î Traumatic brain injury. When you come to an abrupt stop, your brain still has momentum inside of
your skull and an internal collision with the skull can result in massive swelling. High speed
collisions can result in brain damage or less noticeable brain trauma that becomes worse over time
when undiagnosed, leaving the victims with serious neurological disorders.
Î Death. There is an undeniable link between high speed collisions and fatalities and many of these
deaths can be prevented if drivers were to act more responsibly behind the wheel.
Pedestrian Accidents
Less than ten minutes from reading this, another person will be injured in a pedestrian accident within
Chicago or its surrounding suburbs. Your life can change in the blink of an eye due to another person’s
irresponsible actions, but you can rest assured that we will go to work for you to ensure you receive every

An Alarming Number of Pedestrian Injuries
There are 70,000 accidents every year that result in the injury of a pedestrian and an unfortunate 5,000
people are killed in these accidents. As a pedestrian, you have absolutely no means to protect yourself
when a driver fails to yield or speeds through the city streets in a hurry to get to work. It is for this reason
that pedestrian injuries tend to be so severe and often require ongoing therapy or care for years following
the incident. The types of injuries our Chicago pedestrian accident attorneys often encounter include the
following.
Î Fractures and complex bone and joint injuries. Most people are oblivious to just how powerful their
vehicles are and the potential they carry to cause bodily harm. When a pedestrian is struck, he or she
may experience multiple fractures, shattered bones or severe injuries to critical joints.
Î Internal bleeding and organ damage. Whether via laceration of blunt trauma, there are many ways
the internal organs can be damaged during these types of accidents. Broken ribs can puncture the
lungs, metal and glass fragments can cut into the abdomen or deep internal contusions can result in
unchecked internal bleeding.
Î Degloving injuries. If you’ve been dragged along the pavement or caught in between objects, it is
possible for your skin to be pulled away. The term comes from the way the victim’s hand is left
without any skin, as if the skin was pulled off like a glove and may require multiple corrective
surgeries to address.
Î Injuries to the head, neck and back. Severe internal trauma can result from being pinned between
objects or when your head strikes the ground. When the brain begins to swell inside of the skull,
it can result in permanent neurological disorders and injuries to the neck or spine may result in
paralysis from the point of injury downward.

Î Death may result from any combination of the aforementioned injuries and it is your right as a
family member of the deceased to seek compensation when your loved one has been killed by a
negligent driver.
Failure to Yield Cited in Many Accidents
A study of pedestrian car accidents revealed that 48% of incidents were the result of the driver’s failure to
yield to the pedestrian. Even more concerning is the fact that 33% of the drivers fled the scene for fear of
the repercussions of hitting a pedestrian. The city of Chicago has responded to this data by strengthening
its crosswalk laws, requiring all drivers to stop at all crosswalks, whether located at an intersection or not.
Left turning vehicles are also involved in many accidents involving people crossing the streets and
turning accidents accounted for half of all pedestrian injuries.
Uninsured Motorists
It can feel horrible to not only be in an accident, but also to learn that the driver who has caused your
injuries does not have insurance or has fled the scene. It is normal to feel lost, frustrated and angry if an
uninsured driver caused you harm, but you can also take some measure of comfort in knowing that you
can still receive the damages you are entitled to.
How an Understanding of Your Insurance Policy Will Help Your Claim
About 15% of the accidents that occur in Chicago involve uninsured motorists and nearly one in six drivers
do not have coverage. These statistics are very worrisome considering that all drivers are required to have
liability insurance so they may cover the cost of
others’ medical bills if they are found at fault for an
accident. Many people who are involved in

has coverage that is insufficient to cover the cost of

Î The blunt force exerted on the chest or sternum during an accident may result in serious internal
injuries such as a collapsed or punctured lung, internal bleeding or damage to the heart. Internal
bleeding can be difficult to detect without diagnostic testing, which is yet another reason always to
seek medical attention following an accident to rule out all potential concerns.
Î Broken bones and injuries to joints and ligaments. Our instincts cause our bodies to move into the
worst possible positions prior to an accident when we realize acollision is unavoidable. We tense our
legs, place our hands in front of our face and try to brace ourselves upon impact and this can result in
torn muscles, joint damage and complex fractures.
Î Disfigurement and lost limbs. Most often due to lacerations from broken glass or metal debris,
these injuries can result in severe infections as well, which threaten the patient with septic shock.
Waking up to realize you’ve lost a limb is shocking enough without having to worry about
additional medical concerns.
An auto accident can also result in emotional trauma and make it difficult for the victim to ride in or drive a
vehicle again. The financial impact may cause undue stress on the family as well, especially when medical
bills mount while the victim is forced to stay home from work.

Our Results
Following are examples of past settlements and judgments we have earned on behalf of people just like
you. It is important to understand that every case is different and I am unable to estimate the value of your
case until I have had the opportunity to give it a fair evaluation.
$1,000,000 — Car accident. Paid to the family of a deceased 23-year-old woman who was a backseat
passenger involved in a high-speed rear-end impact with a pickup truck. The woman died at the scene.
$570,000 — A motorcyclist was thrown off his bike when a car attempted to pass in a no pass zone. Our
client, a 41-year-old computer technician, sustained an injury to his peroneal nerve and was eventually
diagnosed with drop foot. The case was vigorously disputed by the other driver’s insurance company. They
retained a doctor who opined that the injury was pre-existing.
$175,000 — 25-year-old husband and wife were rear-ended while waiting for a left-turn signal at an
intersection by a teenage driver who was talking on the phone. The couple received soft tissue injuries and
significant scrapes to their arms and legs. After emergency room care, the couple saw an orthopedist and
received approximately three months of physical therapy.
$667,000 — Pedestrian accident with car. A 34-year-old man was crossing the middle of a busy street (not
in the crosswalk) when a construction company employee driving a private car struck the man. We
successfully argued that the company was responsible for our client’s injuries as the driver was in the
course of his employment.
$599,900 — Auto accident. A 55-year-old teacher was on her way to work when she was hit head-on by a
distracted driver texting on his phone. Our client had fractures to her sternum and ankle.
$200,000 — Our client was struck while preceding through an intersection when a person driving a pickup
truck blew a stop sign. The impact resulted in a crush injury to the motorcyclist’s leg and knee. An MRI
revealed a torn meniscus, which was repaired surgically. This settlement represents the maximum insurance
coverage available for this claim.
$3,000,000 — Motor vehicle / trucking accident. A disabled man was crossing a street with his blind cane
when a garbage truck making a right turn collided with him in the intersection. The man suffered bilateral
femur fractures and de-gloving injuries, which required extensive surgeries and rehabilitation.
$250,000 — Uninsured motorist claim for a businessman involved in a hit-and-run bicycle accident.
Incidentally, the man was a manager at a bicycle shop. The recovery was made through his own
insurance policy.
$616,772 — Four friends were on their way home from dinner when a truck ignored a traffic light and t-
boned them. The impact was so significant that rescue workers needed to remove them from their
vehicle with the Jaws of Life. Two of the passengers were released from the hospital the following day.
The other two spent approximately one week in the hospital before receiving outpatient care.
$449,000 — Our client, the front-seat passenger in a friend’s car, was thrown into the windshield when
the driver swerved to avoid an oncoming vehicle. Our client had numerous facialand head injuries from
the impact with the glass. A subdural hematoma was identified at the emergency room and
bleeding was surgically drained. This settlement was entered into by the defendant’s insurance company
despite the fact that the expert neuropsychologist that they hired testified that our client’s cognitive
impairments were not objectively measureable.
$350,000 — After leaving work after an afternoon shift at a hospital lab, our client was crossing a street to
take the bus home from work. While crossing the street and in the intersection, a taxicab making a left-hand
turn struck the woman. The impact resulted in a fractured tibia and fibula that required surgical repair. The
case was settled prior to litigation.
$250,000 — Uninsured motorist policy limits paid to a mother who was rear-ended by another vehicle on
a suburban street. Our client sustained a shatter patella that required surgery. An extensive search
revealed the other driver’s insurance lapsed prior to the crash.
$250,000 — Bicycle accident. The driver failed to yield to cyclists on a busy city street during rush hour.
The cyclist had damage to the knee and required arthroscopic surgery. Policy limits of at fault driver were
tendered within 60 days of our involvement.

  • 4. Causes and Types of Car Accidents Chicago is one of the busiest cities in the nation and it comes as no surprise that its roads are home over 200,000 accidents every year. Understanding the most common causes of accidents doesn’t only allow us to represent our clients more effectively, but also helps us educate the public on the issues that impact the safety of our roadways the most. It is likely that every single driver can improve his or her habits and reduce the likelihood of being involved in an accident. Distraction Among Most Common Causes of Accidents Advances in technology have allowed us to connect with more people and bridge great distances and to get more done throughout our busy lives. Unfortunately, this has come at the cost of safety and many of us have become so dependent on our devices that we allow them to interfere with other aspects of our lives. Studies have shown that you are less likely to get into an accident under the influence of alcohol than you are while sending a text message behind the wheel. Next time you think about taking a phone call or reading a text message, remember that the person on the other end can wait and will do so willingly if it means you arrive at your destination unharmed. Here are the most common causes of accidents for you to consider. Î Driving while tired or fatigued. While this is a major concern with truck drivers, it also applies to motorists who choose to take to the roads over long distances without giving themselves adequate breaks or rest. There are many similarities between drunkenness and tiredness in that your vision, ability to make decisions and reaction time are all impacted in a similar manner. Î Driving while distracted. Talking on the phone, sending a text message, doing your makeup, eating and drinking while behind the wheel are all examples of distracted driving and studies are finding that distraction is becoming the cause of more accidents each year. Î Influence of drugs or alcohol. One of the most irresponsible decisions you can make is to get behind the wheel after consuming alcohol or controlled substances. It places yourself and everyone else on the road at great risk. Alcohol is a factor in the majority of fatal accidents and debilitating injuries, as drunken driving accidents tend to be much more violent and serious.
  • 5. Î Weather conditions. Rain, ice and snow contribute to many accidents in Chicago each year, but our Chicago auto accident lawyers have also noticed the impact of the sun on driving accidents. The morning or early evening sun can cause blinding glare and make it difficult for drivers to see traffic lights or the taillights of the cars in front of them. Î Speeding and reckless driving. Speeding is a major factor in many accidents and negligent drivers are often in ahurry and found in violation of multiple traffic laws. This makes them liable for any property damage or personal injury that results from their poor decisions. Millions of drivers find themselves involved in auto accidents every year in the United States and these collisions cost drivers billions of dollars in property damage, medical bills and lost financial opportunity. The Most Common Types of Auto Accidents There are many unique types of auto accidents— all of which occur under a special set of circumstances. Most of these accidents can be grouped into six categories that have their own set of causes and consequences. The most common types of car accidents include the following. Î Single Vehicle Crashes Î Accidents at Intersections Î Rear-End Collisions Î Low Speed Impacts Î Commercial Vehicle Accidents Î Side Swipe Accidents Accidents do not always involve multiple drivers, but they may involve numerous passengers even if only
  • 6. one car was involved. Examples of single vehicle accidents include when drivers lose control of their vehicles and exit the road due to inclement weather or when drivers collide with a building or object while trying to avoid an accident with another vehicle. If passengers are involved in the accident, they may suffer injuries that the driver is liable for, and the owners of property that has been damaged in the incident are entitled to compensation for their losses as well. Accidents at Intersections Misjudging distance and approach speed of oncoming traffic is one of the most common causes of auto accidents. Other accidents occurring at intersections can be the result of drivers running red lights, failing to yield to others or operating a vehicle while under the influence of drugs or alcohol. The injuries suffered in these accidents can be extreme, due to the following factors. Î Many accidents at intersections are T-bone collisions, which place the driver or passenger at greater risk due to an impact from the side. Modern vehicles are designed to distribute the force from a front or rear impact away from the driver or passenger, but a collision from the side can cause severe trauma. Î Accidents at intersections have the potential to become multi-accident events. The force from the first collision can send one vehicle into another and create a chain event of collisions that place more drivers and passengers at risk. Î Speed is often a factor in these accidents. Drivers may misjudge the speed of oncoming traffic, or the offending driver may be speeding up in order to make it through the intersection during a yellow light. High speeds are linked to more severe injuries. Rear-End Collisions There are many causes for rear-end collisions, such as tailgating, not braking quickly enough or loss of vehicle control due to inclement weather. Regardless of the cause, our lawyers recommend seeking a comprehensive medical evaluation following any rear-end collision due to the possibility you’ve suffered an injury to the brain, neck or spine. What makes rear-end collisions unique is that the force of impact often throws the victims’ bodies forward and then back.
  • 7. It is not uncommon for victims to strike their heads or to experience whiplash during these accidents. The symptoms for these injuries may not present themselves immediately after the accident, however, and many victims refuse medical treatment because they feel fine. Several weeks later, they may show symptoms of a traumatic braininjury or whiplash, both of which can become debilitating and impact the victim’s quality of life forever. Symptoms of an injury to the brain or neck can include the following. Î Memory loss during the accident or at a later date during physical recovery. Î The inability to focus or concentrate. This often feels like a haze or cloudy feeling. Î Migraines occurring shortly after the accident and progressing in severity. Î Severe stiffness in the back of the neck or back accompanied with the loss of motor function in the arms. Î Shooting pains in the arms, neck or shoulders. Î Ringing in the ears, sudden changes in vision or dizziness. Î Blackouts following the accident or at a later date. Î Sudden changes in mood or mental state. Low Speed Impacts Accidents occurring in parking lots, side streets or as vehicles back out of their driveways may involve speeds under ten miles per hour. These impacts can still be jarring enough to cause injury and damage vehicles, however. It is tempting to just trade insurance information and go on your way, but you should really make sure that you document the accident, take pictures and undergo a precautionary medical evaluation just in case.
  • 8. Commercial Vehicle Accidents Some of the most devastating and catastrophic car accidents involve commercial vehicles. These large vehicles can include charter buses, delivery vehicles and large semi-tractors. Negligent drivers can cause incredible damage to property and serious injuries when their actions result in an accident. Their employers’ actions may also be a factor in the accident, which makes the process of determining liability more involved. The following must be considered if you’ve been involved in an accident with a commercial vehicle. Î If the commercial driver was in violation of traffic or work laws, he or she can be held liable for his or her actions. It is the responsibility of employers to screen their employees, however, so ifthe driver has a reckless driving history or repeated violations, the employer may share responsibility. Î Many commercial vehicles are in poor condition. Bus and truck companies are notorious for cutting corners and trying to force their drivers to shoulder the responsibility for maintenance concerns. If mechanical failures or poorly maintained equipment is afactor, the party responsible for maintaining the vehicle can share liability. Î The manufacturer is often considered liable in the event that commercial vehicle equipment failure or defects cause the driver to lose control of his or her vehicle. This provides an additional avenue of recovering compensation if it is needed.
  • 9. Side Swipe Accidents Side swipes often occur when drivers merge into traffic or change lanes without checking their blind spots. Speed plays a large role in these accidents— especially when drivers occupy merging lanes while others are attempting to enter a highway. The damage can vary in degree depending on the speed and angle of impact. These accidents can cause a chain of events if one vehicle is pushed into another and the vehicles spin out of control at high speeds. Understanding the type of accident you’ve been involved in can help when evaluating your symptoms and determining what types of tests are required to ensure that you receive the right treatment. Each accident has unique circumstances and mechanics which may influence the type and severity of injuries suffered. Even if you haven’t suffered severe physical injury, you may have experienced the loss of a vehicle that you depend on to maintain your independence.
  • 10. Head-On Collisions Head-on collisions are among the most dangerous forms of auto accidents and are responsible for numerous fatalities every year. It is our primary goal to help each of our clients obtain the care that they need to be able to move forward with their lives and to ensure that they will not need to be subjected to the burden of expensive medical bills and out of pocket expenses by holding the people responsible for their injuries liable. Secret Service Crash is a High Profile Example of the Dangers of Head-on Collisions On December 29, 2015, a man died after he crossed into oncoming traffic and collided with a vehicle carrying four secret service agents. He was transporting two passengers, who were both transported to the hospital with all four of the agents in the other vehicles. The secret service agents were reported to have suffered very serious, but non-life-threatening injuries. Further investigation revealed that the at fault driver had an extensive criminal record and did not have a valid driver’s license at the time of the accident. While the accident highlights some of the dangers that secret service agents must encounter on a regular basis, it also underscores how serious head-on collisions can be and how rapidly things can go wrong when a driver exits his or her lane of traffic and moves toward an oncoming vehicle.
  • 11. The Causes and Types of Head-on Accidents Our lawyers have noticed that while there are variable factors that contribute to every accident, about nine in ten accidents are the fault of at least one of the drivers involved. If so many accidents can be prevented, then it is the responsibility of every driver to do whatever is necessary to keep the roads safe for others. Following are the main causes and types of head-on collisions. Î Adverse road conditions. Weather can make the roads more difficult to travel, reduce visibility and throw debris into the path of unsuspecting drivers. Potholes, poor lighting, inadequate or non-existent lane markings and poorly designed medians and guardrails can also contribute to accidents. Î Accidents at intersections. There are a variety of factors that can contribute to accidents that take place in the middle of intersections. A traffic light may be malfunctioning, a driver may misjudge the distance and speed of an incoming vehicle prior to turning left, or a hurried driver may make a turn without making sure it is safe to do so. Î Driver distraction. Technology is quickly becoming one of the leading causes of serious accidents. Too many motorists are attempting to multitask behind the wheel and despite advances in safety technology; more drivers are being killed or seriously injured in accidents. The data is showing a link between the rise in texting and talking behind the wheel and increases in collisions. Î Multi-car accidents. In these accidents, one car may force another car into the opposing lane where it strikes an oncoming vehicle. This is common at intersections when a left turner is rear ended or when a vehicle entering the path of another is struck in the intersection and sent in the direction of oncoming traffic.
  • 12. Î Sleep deprivation. Commercial truck drivers are often overworked and under-rested. While this groups receives the greatest amount of attention for fatigued driving, others can slip behind the wheel on a minimal amount of sleep as well. Nobody who is overly tired and has difficulty concentrating on the road should operate a vehicle until he or she has rested. Î The influence of drugs and alcohol. Many head-on collisions are the fault of drunk drivers or motorists who are driving under the influence of adrug or controlled substance. There is simply no excuse for the reckless behavior of operating a vehicle while under the influence of a mind altering substance and these drivers should be held accountable to the fullest extent of the law.
  • 13. Accidents at Intersections Accidents at intersections always have the potential to cause very serious injuries to everyone involved, especially when the at fault driver disobeys a traffic control device or move into the path of an oncoming vehicle. Studies have shown that as many as nine out of ten auto accidents that have occurred could have been prevented and it is for this reason that reckless and irresponsible drivers should be held liable for the harm caused by their actions. Accidents at Intersections are common and Deadly Collisions occurring at intersections are highly common, especially among elderly drivers who have diminished depth perception and reaction times. The number of left turn accidents resulting in serious injuries has even prompted some cities to implement the use of traffic circles in the planning of their roadways in order to limit the number of left turns motorists will be forced to make. Left turns are not the only cause of collisions at intersections, however. Other causes include the following. Î Motorists running red lights or not obeying traffic control devices. When combined with excessive speeds, these violations can result in very serious accidents that threaten the lives of innocent victims that happened to be in the wrong place at the wrong time. Î Multi-car accidents. Fender benders at intersections have the potential to become destructive and devastating to the numerous motorists involved. If the car that was initially struck is pushed into the intersection, it can collide with other vehicles and set off a chain reaction of accidents. Î Distracted driving. When drivers choose to text or talk on the phone while driving, they are unaware of how they are jeopardizing the safety of those around them. A simple glance away from the road can cause the driver to miss a stop sign, run a light or head into oncoming traffic at an intersection.
  • 14. Î The influence of drugs and alcohol. There is no excuse for drunk driving, but many drivers are unaware of how the medications they take impact their driving. Cough syrup and allergy medicines can cause drowsiness or delay reaction time. Some cold medications even contain alcohol. It is important that drivers take responsibility for what they put in their bodies prior to getting behind the wheel of a vehicle. Common Injuries Our auto injury lawyers have helped many clients recover compensation for the treatment of many different types of injuries. Accidents at intersections have the potential to result in life threatening injuries or to leave victims with physical or mental impairments they must live with for the rest of their lives. Some of the common and serious injuries suffered in these accidents include the following. Î Traumatic brain injuries. Recent studies have uncovered a strong link between serious neurological disorders and untreated trauma to the head. Many of the injuries that the brain suffers go asymptomatic for a long time before the first effects begin to manifest themselves. Loss of cognitive function, speech, memory and motor skills are some of the long term effects of these injuries. Î Injuries to the spine or neck. Depending on the severity, a spinal injury can be the cause of a lot of pain and limit the ability of the victim’s mobility. In the most serious cases, the victim may suffer temporary or permanent paralysis.
  • 15. Î Lacerations, puncture wounds and disfigurement. Metal, glass and debris can cut deep into the skin and cause deep tissue damage. These wounds can leave unsightly scars or become infected, forcing doctors to amputate the affected limb in order to save the patient. In other cases, the wounds may make it impossible for doctors to repair or restore the affected limb or digits. Î Broken or shattered bones. The massive force and power that are displaced during an accident can greatly damage the human body. It is not uncommon for accident victims to suffer one or more fractures through the course of an accident. Fractures vary in severity and form and may require extensive care to set back in place so that the bones will heal.
  • 16. Rear End Collisions Rear end collisions are extremely common on the streets and highways of Chicago, which are traveled by millions of drivers every year. These types of accidents most often occur at low speeds, but can still cause very serious and often debilitating injuries that require extensive therapy to recover from. It is also nearly impossible for the victims in these accidents to do anything to avoid being hit or to mitigate the severity of the damage. Fortunately, determining fault in these accidents is pretty cut and dry and it is possible for you to recover the compensation you deserve. Rear End Collisions Cause Serious and Nagging Injuries You wouldn’t suspect that a rear end accident could cause such serious injuries, but victims are often caught completely off guard when an automobile slams into their rear bumper. The impact of being bucked forward and back again due to restrain systems can have a unique effect on the body and injuries to the neck and back are quite common. Here are some of the injuries that often result from this type of accident. Î Whiplash, which results from damage to the cervical vertebrae when the neck snaps forward and then back in the motion one would crack a whip. Î Injuries to the back or spine. The same motion that results in whiplash may also injure the lower back or the spine, resulting in the dislocation or rupturing of discs, commonly referred to as herniated discs. The impact of these injuries can vary from intense pain when bending or moving to partial paralysis of areas of the body that rely on the nerves in that area of the spine.
  • 17. Î Traumatic brain injury. Studies have shown that sudden acceleration and deceleration can cause the brain to move inside of the skull, often resulting in swelling when the brain collides with the skull. Traumatic braininjuries are especially concerning because they may not present symptoms for weeks or months following an injury. Our Chicago auto accident lawyers recommend that you request special tests for a TBI following any accident, even if you feel fine. Î Injuries to the knee or legs. When it is evident that a collision is imminent, most people tense their legs and try to brace themselves before impact. This tension is counterproductive and causes injuries rather than prevents them. Î Injuries to the wrists and hands. Just as many people tense their legs prior to an accident, they may place their hands in front of their body or head as an instinctive response to protect themselves. Î Injuries to the face or head due to airbag deployment or striking the back of a seat. While airbags do save lives, they often deploy with enough force to cause moderate injuries to the face and head. Rear seat passengers often strike the back of the front seat as well, resulting in injuries of varying severity.
  • 18. Most Rear End Collisions are Preventable Chicago traffic tends to frustrate drivers, who react irresponsibly by breaking traffic laws and taking ill- advised risks for the sake of saving a few seconds. Others are often distracted by their phones or attempt to multitask while behind the wheel, reducing their awareness of their surroundings and reaction time. Rowdy passengers may also influence drivers and increase the risk of an accident. It is the responsibility of every driver to place his or her focus on the road ahead and to follow all applicable traffic laws, however, and the failure to do so makes them liable for any bodily harm and property damage that they cause.
  • 19. Speeding Accidents Speeding is a major factor in the number of accidents and serious injuries that occur on Chicago’s streets every year and drivers who are in a rush often fail to realize the ramifications their actions can have. I have represented the needs of countless individuals whose injuries could have been less severe or prevented entirely if not for the excessive speeds by with the at fault driver operated his or her vehicle. The risks that you take when speeding are not worth the several minutes that you save getting to your destination.
  • 20. Motivation for Speeding Speeding greatly increases the chance of severe injuries in a car crash, so why do so many drivers blatantly disregard the posted speed limit? While it is impossible to speak on behalf of every driver in the Chicago area, many of the drivers caught breaking speeding laws are doing so for similar reasons. Some of the motivations for speeding include the following. Î The driver is in a hurry. Whether late to work or an appointment, many drivers feel that they can make it to their destinations quicker if they speed and weave in and out of traffic. If you’ve ever noticed, traffic lights often stop these speedsters in their tracks and they only ever save a few seconds at a time between each red light. Î The driver is unaware of his or her speed. Have you ever looked down at your speedometer and instantly hit the brake upon noticing how fast you were going? Too many drivers have become distracted by phones and other devices while driving and it can cause us to speed without even realizing it. Best to pay attention to your driving and handle everything else when you are stopped. Î Young drivers attempt to show off or seek thrills on the road. Teenagers take risks that adults wouldn’t due to the need to impress others or to feel a rush. Unfortunately, this contributes to many teen deaths each year.
  • 21. Speeding Increases the Severity of Injuries Our injury lawyers cannot recount all of the times in which a client’s injuries would have been minor if the other driver had been traveling at the posted speed limit. Speed is linked to life altering and ending injuries and the risk of these injuries increases as the needle on the speedometer rises. Some of the injuries attributed to speeding include the following. Î Paralysis due to extreme spinal injury. Many drivers feel that they are okay to drive, only to come to the startling realization later that they have seriously injured another person in a preventable accident. One out of every three fatal car accidents involves a drunk driver or pedestrian. Our client had fractures to her sternum and ankle. $200,000 — Our client was struck while preceding through an intersection when a person driving a pickup truck blew a stop sign. The impact resulted in a crush injury to the motorcyclist’s leg and knee. An MRI revealed a torn meniscus, which was repaired surgically. This settlement represents the maximum insurance coverage available for this claim. $3,000,000 — Motor vehicle / trucking accident. A disabled man was crossing a street with his blind cane when a garbage truck making a right turn collided with him in the intersection. The man suffered bilateral femur fractures and de-gloving injuries, which required extensive surgeries and rehabilitation.
  • 52. $250,000 — Uninsured motorist claim for a businessman involved in a hit-and-run bicycle accident. Incidentally, the man was a manager at a bicycle shop. The recovery was made through his own insurance policy. $616,772 — Four friends were on their way home from dinner when a truck ignored a traffic light and t- boned them. The impact was so significant that rescue workers needed to remove them from their vehicle with the Jaws of Life. Two of the passengers were released from the hospital the following day. The other two spent approximately one week in the hospital before receiving outpatient care. $449,000 — Our client, the front-seat passenger in a friend’s car, was thrown into the windshield when the driver swerved to avoid an oncoming vehicle. Our client had numerous facialand head injuries from the impact with the glass. A subdural hematoma was identified at the emergency room and bleeding was surgically drained. This settlement was entered into by the defendant’s insurance company despite the fact that the expert neuropsychologist that they hired testified that our client’s cognitive impairments were not objectively measureable. $350,000 — After leaving work after an afternoon shift at a hospital lab, our client was crossing a street to take the bus home from work. While crossing the street and in the intersection, a taxicab making a left-hand turn struck the woman. The impact resulted in a fractured tibia and fibula that required surgical repair. The case was settled prior to litigation. $250,000 — Uninsured motorist policy limits paid to a mother who was rear-ended by another vehicle on a suburban street. Our client sustained a shatter patella that required surgery. An extensive search revealed the other driver’s insurance lapsed prior to the crash. $250,000 — Bicycle accident. The driver failed to yield to cyclists on a busy city street during rush hour. The cyclist had damage to the knee and required arthroscopic surgery. Policy limits of at fault driver were tendered within 60 days of our involvement.
