3. ๏ ยง 163.387(6), Florida Statutes
(a) Administrative and overhead expenses necessary or incidental to the implementation of
a community redevelopment plan adopted by the agency.
(b) Expenses of redevelopment planning, surveys, and financial analysis, including the
reimbursement of the governing body or the community redevelopment agency for such
expenses incurred before the redevelopment plan was approved and adopted.
(c) The acquisition of real property in the redevelopment area.
(d) The clearance and preparation of any redevelopment area for redevelopment and
relocation of site occupants within or outside the community redevelopment area as
provided in s. 163.370, F.S. (Note โ Expansive reach includes capital improvements.)
(e) The repayment of principal and interest or any redemption premium for loans,
advances, bonds, bond anticipation notes, and any other form of indebtedness.
(f) All expenses incidental to or connected with the issuance, sale, redemption, retirement,
or purchase of bonds, bond anticipation notes, or other form of indebtedness, including
funding of any reserve, redemption, or other fund or account provided for in the ordinance
or resolution authorizing such bonds, notes, or other form of indebtedness.
(g) The development of affordable housing within the community redevelopment area.
(h) The development of community policing innovations.
4. ๏ TIF funds must be:
โฆ Expended within the geographic extent of the TIF district
โฆ Used to carry out community redevelopment objectives
Liberal construction of the Community Redevelopment Act
โฆ Directly targeted to specific objectives contained in a
redevelopment plan
๏ TIF funds cannot be used on general government
operating expenses unrelated to the planning and
carrying out of a community redevelopment plan.
๏ There is a lack of case law on permissible uses of TIF
from redevelopment trust funds.
5. ๏ AGO 2010-40:
โฆ Promoting the use of a redeveloped area is acceptable
Paying entities which generally promote tourism generally is not
Nor is creating a grant program geared towards non-profits that lack a
redevelopment purpose, even if socially beneficial
๏ AGO 2009-32:
โฆ Relocation expenses for construction outside of a CRA is not
acceptable, even when new construction would benefit the CRA
Cannot expend TIF outside of the district
May use TIF to relocate site occupants displaced from a CRA to a new
location within or outside of CRA boundary
๏ AGO 1986-41:
โฆ Authorized to purchase real property located within the CRA under a
redevelopment plan for public parking
If such use is determined to constitute a community redevelopment
purpose
6. ๏ AGO 1982-18:
โฆ Area wide improvements (e.g., improvements to or the provision of
sidewalks and utilities within a CRA) are "undertakings and activities"
which constitute elements of community redevelopment projects
Must be in accordance with an approved redevelopment plan
๏ AGO 1981-02:
โฆ Permissible to move houses into a community redevelopment area,
rehabilitate such houses, and dispose of them at their fair value
Fair value available to municipality
7. Any county or municipality, to the greatest extent it determines to be
feasible in carrying out the provisions of this part, shall afford
maximum opportunity, consistent with the sound needs of
the county or municipality as a whole, to the rehabilitation or
redevelopment of the community redevelopment
area by private enterprise. Any county or municipality shall
give consideration to this objective in exercising its powers under this
part, including the formulation of a workable program; the
approval of community redevelopment plans,
communitywide plans or programs for community
redevelopment, and general neighborhood redevelopment plans;
