Powers of Attorney - Definitions & Details
• What is Power of Attorney (POA)?
To give someone else the power to act on one’s behalf
• Durable Power of Attorney
Always submit to Homesale Settlement Services for review
• Homesale Settlement Services can create the POA
May only be used for a specific transaction

Broker’s Fee, paid by Buyer to Broker, is as follows:
In a purchase transaction:
• with a seller represented by a real estate broker the fee is ____% of the
purchase price OR $_________ , whichever is greater, AND $________.
It is Broker’s policy to accept compensation offered by the listing broker. If
the amount received from the listing broker is less than the amount in
Paragraph 2(B)(1), Buyer will pay Broker the difference, unless seller
agrees to pay the difference as a term in the agreement of sale.

Standard of Practice 16-16
REALTORS®, acting as subagents or buyer representatives,
shall not use the terms of an offer to purchase to attempt to
modify the listing broker’s offer of compensation to
subagents or buyer representatives nor make the submission
of an executed offer to purchase contingent on the listing
broker’s agreement to modify the offer of compensation.

Form CBC can be used for three purposes:
• Confirm compensation offer in the MLS
• Negotiate compensation where listing broker
is not a member of the MLS, or where the
property is not listed in an MLS
• Renegotiate an offer of compensation in the
MLS.
Cooperating broker compensation should be settled between
the brokers before the submission of an offer by a buyer

• The purpose of the CAS form is to ask the
seller to directly pay a certain amount of
money to be applied towards the
compensation of the buyer agent.
• This is a negotiated issue between buyer
and seller – not brokers
• Think about the use of form is to view it as
a type of seller assist

and negotiated with other terms in the agreement
