Murder trials are tough; custody battles are tougher - each custody trial has its own dynamic. The focus must always be what is best for the child. The test is not what is best for either parent. Of greatest import is the relationship dynamic between each parent and the child. In most high-conflict custody cases, the family dynamic that prevailed in the home before separation finds its way into the courtroom. How the parties argued during the relationship, how the parties implicitly negotiated their marital and relationship roles, or how the parties raised and interacted with their child(ren) are all factors that find their way into the courtroom. Not surprisingly, courts are presented with two different movies, so to speak. Political correctness has no part in what is best for children.

The literature on Post Traumatic Stress Disorder (PTSD) over the past decade has expanded the concept of PTSD to include symptoms reported from extensive studies on bullying in the workplace done in the UK and Australia, ongoing research into Legal Abuse Syndrome, and the various conditions treated by the Department of Veterans’ Affairs. Current thinking is converging on the expanded concept of Complex PTSD. Complex PTSD refers to symptoms of PTSD that, untreated, may last a lifetime resulting from prolonged, negative stress profoundly affecting the quality of a person’s life. Van der Kolk’s research clearly demonstrates that no one greets a traumatic event in a vacuum. Early childhood trauma causes vulnerability toward succumbing to critical events by developing PTSD. It is important to note that all people experiencing the same event do not become equally symptomatic. This means any life altering, negative, prolonged stress can and does create hormonal, emotional, mental, and physical symptoms. This includes stress from litigation. It involves all the parties concerned with the problem hence encouraging different forms of creating thinking like group solutions, and brainstorming among others[footnoteRef:1]. In the past, I have been involved in numerous situations that required creative problem-solving. I realized that creative problem solving plays a crucial role in the process of making sure employees are able to address the issues they face as they discharge their work obligations. In such situations, I could engage all the employees and ensure they all participate in the process of coming up with the best solution. This could entail employees having representatives because all employees could not be engaged. The representatives would give their opinions concerning the best way to address the problem. I remember one day we had issues with increased costs of operating and the organization had to come up with strategies that could help in enhancing efficiency. All the staff members in my department were engaged to suggest their solutions to the problem. This is the time I realized the power of working in groups when addressing a problem affecting all the employees. In the decision-making process, giving the parties involved the chance to give their opinions concerning the problem makes others gain some more insights concerning the issue at hand. Engagement in problem-solving provides the opportunity for the members affected by the problem to share on the best strategies that can be embraced to address the issue. The different solutions can be analyzed and evaluated with the aim of settling on the best solution that is innovative and creative. [1: Proctor, Tony. Routledge, 2014.] I consider creative problem solving to be an important way of helping the decision makers to think outside the box. This entails thinking outside confines of what is acceptable to obtain the best solution for the problem. Being innovative in analyzing and evaluating possible solutions leads to the most creative solutions[footnoteRef:2]. For example, horizontal and vertical thinking are major modes of thinking that can help one to think outside the box. Thus far, it has been a wonderful experience and I am grateful for all the opportunities that are brought forth with my new career position. There is great leadership demonstrated at my job that allows the company to run smoothly. Each department has a team lead as well as a supervisor, although, you would not know it because they are reserved and treat everyone equally as if everyone is on the same management level. Puccio, Mance, and Murdock (2011) says “employee performance is more important than seniority, and the behavior of IDEO leadership consistently demonstrates that flexibility is “in” and rigid rules are “out” ” (Puccio, Mance, and Murdock, 2011, pp. 3-4). Our leaders are not strict on us and permit us the freedom to take risks, make mistakes, and learn from them. There are rules and regulations presented, however, our leaders provide an environment that is not just easy to work in, but comfortable and safe to work in. Our work environment is surrounded by each individual having their own cubicle desk amongst their own team. Some but not all of the supervisors have their own office. Due to the open space that everyone has, it encourages everyone to mingle by communicating with each other, learning from each other, and sharing creative ideas with one another for the success of the company. The work environment is crucial at my organization mainly because of everyone not being able to have their own individual offices with having doors for privacy. “IDEO has learned that having the right size workspace makes a difference. A Synopsis of the Best Practices in Making Recommendations and Developing Course of Action The Client According to Rudy and Levinson (2008), the best practice approach is identifying and evaluating the effectiveness of meeting the client’s needs. A good attribute in the course of action process is to consider the client as a whole person and create a plan of action that recognizes that one problem can affect, influence or bring more troubles. Woodside and McClam (2015), suggest some professionals do not understand their client expectations. Having knowledge the client expectations is a good method of establishing and growing the client-professional helping relationship (Woodside & McClam, 2015). One best practice approach is to have a clear understanding of the client needs, client expectations, and a clear plan of how to meet the client’s needs and expectations. It’s easy for professionals to take over the multidisciplinary process without including the client. Therefore, client participates in the multidisciplinary 4-step process is a vital best practice. The client should never feel abandoned during any part of the multidisciplinary process, and the collaborative team should make modifications to the recommendation and action plan if obstacles arise. The Professional Meek & Newell (2005), suggest working together as a team can bring different perspectives to building each step of the framework, as the collaborative team works on shaping the best course of action and suitable recommendations. A collaborative teamwork helps professionals impart their knowledge and maximize their creativity, which helps each professional to focus on own professional disciplines. Bronstein (2003), suggest recommending a model for interdisciplinary collaboration between human services professionals, which includes five key components : Interdependence - which emphasizes teamwork, Newly created professional activities - which refer to the creation of new processes, Flexibility - which empowers team spirit and efficiency, Collective ownership of goals , Reflection on process -sharing and feedback which strengthens the relationship. Leaders and employees agree on the need for empathy in the workplace, yet crucial gaps remain between intentions and implementation. To bridge these gaps, empathy practice in organisations needs to be understood, implemented and studied. In this Ebook we introduce Empathic Intervision, a structured peer-to-peer method to apply empathy in organisation routines. We introduce intervision, combining work and learning, to handle situations, questions and problems with an intent to learn from each other, improve expertise and co-evolve insights and outcomes. We describe how Empathic Intervision supplements the advantages of intervision with five layered empathic capacities: self-empathy, kinesthetic, reflective, imaginative empathy as well as empathic creativity, to aid deeper hearing and understanding and consideration of each other’s perspectives. We contextualize this method within the emergence of practices such as human-centric design, agile self-organizing teams and co-creation with the aim to bridge silos, cross barriers and offer a hands-on practice for organisational development.
