Згідно з попередньою програмою ІІІ Всеукраїнської школи з ІТ- та Інтернет-права мав
виступати , тож автор вирішив не відступати від “тренду” і

9. Умови недобросовісності доменного імені за UDRP
(п.4(а) Uniform Domain Name Dispute Resolution Policy):
(i) domain name is identical or confusingly similar to a trademark or service mark in which the
complainant has rights; and

Article 16
6.The exclusive right of a proprietor of a certificate to prohibit the use of the registered mark by
other persons without his permission does not extend to: exercising of any right acquired
before the date of filing the application or, if the application priority was claimed,
before the priority date;

знак не поширюється на: здійснення будь-якого права, що виникло до дати подання заявки або, якщо було

preparation (the previous user right).

Protection of rights to a well-known mark
Article 25.
1. The protection of rights to a well-known mark is provided according to Article 6-bis of the Paris
Convention for the Protection of Industrial Property and the present Law and is based on the
recognition of the mark as a well-known mark by the Appellate Chamber or the court. The mark
can be recognized as well-known irrespective of its registration in Ukraine.
1. Охорона прав на добре відомий знак здійснюється згідно з статтею 6 bis Паризької конвенції про охорону промислової
власності та цим Законом на підставі визнання знака добре відомим Апеляційною палатою або судом. Знак може
бути визнаний добре відомим незалежно від реєстрації його в Україні

Позивач 09.07.2014 року звернувся з позовом до Товариства з обмеженою відповідальністю «Хостинг-Україна», ОСОБА_2,
Державної служби інтелектуальної власності України про визнання торговельної марки «ІНФОРМАЦІЯ_1» добре відомою в Україні
та припинення порушення прав інтелектуальної власності на добре відому торговельну марку «ІНФОРМАЦІЯ_1».
В обґрунтування позовних вимог позивач зазначав, що надані ним докази свідчать про те, що станом на 31.10.2011 року торговельна
марка «ІНФОРМАЦІЯ_1» вже була добре відомою в Україні для товарів 16 класу МКТП «канцелярські товари», тому
реєстрація доменного імені ІНФОРМАЦІЯ_2, яке містить у своєму складі позначення «ІНФОРМАЦІЯ_1», здійснена із
порушенням вимог чинного законодавства України.
З урахуванням наявності підстав для визнання знака для товарів і послуг «ІНФОРМАЦІЯ_1» добре відомим в Україні станом на
31.10.2011 року для товарів 16 класу МКТП …. суд вважає такою, що підлягає задоволенню позовну вимогу про зобов'язання
Державної служби інтелектуальної власності України здійснити публікацію про визнання знаку для товарів і послуг
«ІНФОРМАЦІЯ_1» добре відомим в Україні станом на 31.10.2011 року для товарів 16 класу МКТП …
Судом встановлено, що 26.02.2014 року відповідачем ТОВ «Хостинг-Україна» в українській зоні всесвітньої мережі Інтернет на
ім'я відповідача ОСОБА_2 було зареєстроване доменне ім'я ІНФОРМАЦІЯ_2.
Висновком судової експертизи, який суд оцінює в якості належного та допустимого доказу у справі, позначення «ІНФОРМАЦІЯ_1»,
використане у доменному імені ІНФОРМАЦІЯ_2, визнане схожим настільки, що його можна сплутати зі знаком «ІНФОРМАЦІЯ_1»,
який позивач просить визнати добре відомим в Україні.
… суд приходить до висновку про обґрунтованість вимог позивача в частині заборони використання відповідачу
ОСОБА_2 позначення «ІНФОРМАЦІЯ_1» в доменному імені ІНФОРМАЦІЯ_2, оскільки, як встановлено судом,
вказане позначення є схожим настільки, що його можна сплутати з добре відомою торговельною маркою позивача.
… суд визнає обґрунтованими позовні вимоги позивача про припинення делегування доменного імені ІНФОРМАЦІЯ_2. з урахуванням
того, що спірне доменне ім'я порушує права позивача на добре відому торговельну марку, реєстрація вказаного доменного імені
відповідачем ТОВ «Хостинг-Україна», яке хоча і не мало обов'язку щодо перевірки правомірності використання відповідачем
ОСОБА_2 при здійсненні реєстрації спірного доменного імені, призвела до порушення прав інтелектуальної власності позивача на
добре відому торговельну марку «ІНФОРМАЦІЯ_1».

Why GUI (graphical user interface) is so important?
The object of an industrial design may be the shape, picture, or coloration, or their combination,
which define the appearance of an industrial product and are intended to satisfy aesthetic
and ergonomic demands.

37. Webfont: for your website or web application
A webfont license allows you to embed the font into your website, so that it can be displayed on any browser.
You will be serving the webfont kit for your own site and linking it in the CSS.
Webfonts can be used across multiple websites/domains as long as the websites/domains all belong to the
single License Owner, and the pageviews are not exceeded. Agencies responsible for multiple clients’
websites, for example web design agencies or hosting providers, may not share a single webfont license
across multiple clients’ websites.
Every time the webpage using the webfont kit is loaded (i.e, the webfont kit CSS which holds the @font-face
rule is called) the counting system counts a single pageview for each webfont within the webfont kit.
If the font file itself won’t be embedded in the website (for example, when the font is used in a static graphic
image such as a logo) you should purchase a Desktop license instead.
You get a monthly pageview allowance for your webfonts. This license does not need to be renewed.
For example, if you purchase a license that covers 10,000 monthly pageviews, you will remain within your
license as long as you do not get more than 10,000 views per month.
If the website starts getting more traffic, simply place a new purchase for the additional monthly
pageviews you require, as Pay Once webfont purchases are cumulative.

On the other hand, where a clickable link makes it possible for users of the site on which that link
appears to circumvent restrictions put in place by the site on which the protected work appears

accordingly constitutes an intervention without which those users would not be able to access the
works transmitted, all those users must be deemed to be a new public, which was not taken
into account by the copyright holders when they authorised the initial communication, and

the case, in particular, where the work is no longer available to the public on the site on which it
was initially communicated or where it is henceforth available on that site only to a restricted
public, while being accessible on another Internet site without the copyright holders’

storage at the direction of a user of material that resides on a system or network controlled or operated
by or for the service provider, if the service provider—(A)(i)does not have actual knowledge that the
material or an activity using the material on the system or network is infringing;
(ii)in the absence of such actual knowledge, is not aware of facts or circumstances from which
infringing activity is apparent; or
(iii)upon obtaining such knowledge or awareness, acts expeditiously to remove, or disable access
to, the material;
(B) does not receive a financial benefit directly attributable to the infringing activity, in a case in
which the service provider has the right and ability to control such activity; and
(C)upon notification of claimed infringement as described in paragraph (3), responds expeditiously to
remove, or disable access to, the material that is claimed to be infringing or to be the subject of
infringing activity.
(2)DESIGNATED AGENT.—The limitations on liability established in this subsection apply to a service
provider only if the service provider has designated an agent to receive notifications of claimed
infringement described in paragraph (3), by making available through its service, including on its website
in a location accessible to the public, and by providing to the Copyright Office, substantially the following
information:(A)the name, address, phone number, and electronic mail address of the agent.
(B)other contact information which the Register of Copyrights may deem appropriate.
The Register of Copyrights shall maintain a current directory of agents available to the public for
inspection, including through the Internet, and may require payment of a fee by service providers to
cover the costs of maintaining the directory.

использованию материала из системы или сети составляет нарушение;
(ii) При такой фактической неосведомлённости он не знал о фактах или обстоятельствах, при которых такие
правонарушающие действия очевидны;
Или (iii) при получении таких знаний или осведомлённости он совершает быстрые действия, чтобы удалить
материал или блокировать доступ к нему;
(B) Не получает материальной выгоды, непосредственно относимой на счёт правонарушающих действий, в

Article 14
1. Where an information society service is provided that consists of the storage of
information provided by a recipient of the service, Member States shall ensure that the
service provider is not liable for the information stored at the request of a recipient of
the service, on condition that:
(a) the provider does not have actual knowledge of illegal activity or information and,
as regards claims for damages, is not aware of facts or circumstances from which the
illegal activity or information is apparent; or
(b) the provider, upon obtaining such knowledge or awareness, acts expeditiously to
remove or to disable access to the information.
2. Paragraph 1 shall not apply when the recipient of the service is acting under the
authority or the control of the provider.
3. This Article shall not affect the possibility for a court or administrative authority, in

1. Якщо надається послуга в інформаційному суспільстві, яка полягає у зберіганні
інформації, яка надається одержувачем послуги, Сторони гарантують, що постачальник
послуги не несе відповідальності за інформацію, яка зберігається за вимогою одержувача
послуги, за умови, що:
а) постачальнику фактично не відомо про незаконну діяльність або інформацію і, стосовно
позову про відшкодування збитків, і не відомо про факти або обставини, з яких випливає

The operator plays such a role when it provides assistance which entails, in particular,
optimising the presentation of the offers for sale in question or promoting them.
Where the operator of the online marketplace has not played an active role within the meaning
of the preceding paragraph and the service provided falls, as a consequence, within the scope of
Article 14(1) of Directive 2000/31, the operator none the less cannot, in a case which may result
in an order to pay damages, rely on the exemption from liability provided for in that provision if
it was aware of facts or circumstances on the basis of which a diligent economic
operator should have realised that the offers for sale in question were unlawful and,

of the Council of 29 April 2004 on the enforcement of intellectual property rights must be
interpreted as requiring the Member States to ensure that the national courts with
jurisdiction in relation to the protection of intellectual property rights are able to order
the operator of an online marketplace to take measures which contribute, not
only to bringing to an end infringements of those rights by users of that marketplace, but

within the home page and internal pages alike;

The court concluded that Megavideo's activities could not be considered that of a passive

the judges found that the sole responsibility lies with individual uploaders, even

In the digital environment, in particular, the services of intermediaries may increasingly be
used by third parties for infringing activities. In many cases such intermediaries are best
placed to bring such infringing activities to an end. Therefore, without prejudice to any
other sanctions and remedies available, rightholders should have the possibility of applying for
an injunction against an intermediary who carries a third party's infringement of a
protected work or other subject-matter in a network. This possibility should be available even
where the acts carried out by the intermediary are exempted under Article 5. The conditions
and modalities relating to such injunctions should be left to the national law of the Member
States.

1. Article 8(3) of Directive 2001/29/EC of the European Parliament and of the Council of 22 May
2001 on the harmonisation of certain aspects of copyright and related rights in the information society
must be interpreted as meaning that a person who makes protected subject-matter available to
the public on a website without the agreement of the rightholder, for the purpose of Article 3(2) of that
directive, is using the services of the internet service provider of the persons accessing that
subject-matter, which must be regarded as an intermediary within the meaning of Article 8(3)
of Directive 2001/29.
2. The fundamental rights recognised by EU law must be interpreted as not precluding a court
injunction prohibiting an internet service provider from allowing its customers access to a
website placing protected subject-matter online without the agreement of the rightholders
when that injunction does not specify the measures which that access provider must take and
when that access provider can avoid incurring coercive penalties for breach of that injunction by
showing that it has taken all reasonable measures, provided that (i) the measures taken do not
unnecessarily deprive internet users of the possibility of lawfully accessing the information available
and (ii) that those measures have the effect of preventing unauthorised access to the protected
subject-matter or, at least, of making it difficult to achieve and of seriously discouraging internet
users who are using the services of the addressee of that injunction from accessing the subject-matter
that has been made available to them in breach of the intellectual property right, that being a matter
for the national authorities and courts to establish.

основания;
5) указание на отсутствие разрешения правообладателя на размещение на сайте в сети "Интернет"

Use of protected content by information society services storing and giving acces to large amounts of
works and other subject- matter uploaded by their users
1. Information society services that store and provide to public access to large amounts of works or other
subject-matter uploaded by their users shall, in cooperation with right holders, take appropriate and
proportionate measures to ensure the functioning of agreements concluded with rightholders and to
prevent the availability on their services of works or other subject-matter not covered by such
agreements, including through the use of effective content identification technologies. The services
shall provide rightholders with adequate information on the functioning and the deployment of the
measures, as well as, when relevant, adequate reporting on the identification and use of the works and
other subject-matter.
2. Member States shall ensure that the services referred to under paragraph 1 put in place complains
and redress mechanisms that are available to users in case of disputes over the application of the
measures referred to in paragraph 1
3. Member States shall facilitate where appropriate the cooperation between the information society
services and rightholders through stakeholder dialogues to define best practices, such as appropriate
and proportionate content identification technologies, taking into account, inter alia, the nature of the
services, the availability of the technologies and their effectiveness in light of technological
developments

він створив технологічну можливість та умови для
