Standard Bidding Documents
 India has large number of construction
organizations under the Central Government, State
Governments and other public bodies in addition to
the private bodies. Each organization has its own
bidding document.
 Standard Bidding documents, enable understanding
of the conditions by the parties for reacting uniformly
and expeditiously, making them know the
responsibilities, duties and risks involved
clearly. The same facilitates training of personnel
also.
Standard Bidding Documents
 FIDIC conditions of contract are universally
used as standard bidding documents
throughout the world. In India, however, these
have become prevalent only in the past 2–3
decades, which needs to be taken further.
FIDIC is the French acronym for the “International Federation of
Consulting Engineers”
FIDIC, founded in 1913, to promote professional interests of the
member associations & to disseminate information on contract
conditions
Today FIDIC membership includes associations of consulting
Engineers from 80 countries

International competitive bidding has become a norm in Indian
infrastructure project development
Familiarisation with international contract conditions is important
for all concerned
FIDIC has developed many standard conditions of contract for
construction & project development
Document universally accepted
World Bank, ADB insist on FIDIC for Indian jobs
Suitable for Domestic Contracts as well.

SECTION I -- INSTRUCTIONS TO
BIDDERS
 This Section provides relevant information to
help Bidders prepare their bids. Information is
also provided on the submission, opening, and
evaluation of bids and on the award of
Contracts. Section I contains provisions that
are to be used without modification.

Section II. Bid Data Sheet (BDS)
 This Section consists of provisions that are
specific to each procurement and that
supplement the information or requirements
included in Section I, Instructions to Bidders.

Section III. Evaluation and
Qualification Criteria
 This Section contains the criteria to determine
the lowest evaluated bid and to ascertain the
continued qualification of the Bidder to perform
the contract.

Section IV: Bidding Forms
 This Section contains the forms which are to
be completed by the Bidder and submitted as
part of his Bid.

Section V. Eligible Countries
 This Section contains information regarding
eligible countries.
 Section VI. Works Requirements
 This Section contains the Specification, the
Drawings, and supplementary information that
describe the Works to be procured.

Section VII. General Conditions
(GC)
This Section contains the general clauses to
be applied in all contracts. The text of the
clauses in this Section shall not be modified.
 Section VIII. Particular Conditions
(PC)
 This Section consists of Part A, Contract Data,
which contains data, and Part B, Specific
Provisions, which contains clauses specific to
each contract. The contents of this Section
supplement the General Conditions and shall
be prepared by the Employer.

General
(Important Clauses)
 “Corrupt practice” means offering, giving, receiving, or
soliciting to influence action in procurement process or in
contract execution 3.1
 “Fraudulent practice”
is any act or omission, including a misrepresentation,
that knowingly or recklessly misleads, or attempts to
mislead, a party to obtain a financial or other benefit or
to avoid an obligation;

 ―collusive practice‖ is an arrangement
between two or more parties designed to
achieve an improper purpose, including to
influence improperly the actions of another

 ―coercive practice‖ is impairing or harming, or
threatening to impair or harm, directly or
indirectly, any party or the property of the party
to influence improperly the actions of a party

deliberately destroying, falsifying, altering or
concealing of evidence material to the investigatio
or making false statements to investigators in orde
to materially impede a Bank investigation into
allegations of a corrupt, fraudulent, coercive or
collusive practice; and/or threatening, harassing o
intimidating any party to prevent it from disclosing
its knowledge of matters relevant to the
investigation or from pursuing the investigation

  • 3. Standard Bidding Documents  India has large number of construction organizations under the Central Government, State Governments and other public bodies in addition to the private bodies. Each organization has its own bidding document.  Standard Bidding documents, enable understanding of the conditions by the parties for reacting uniformly and expeditiously, making them know the responsibilities, duties and risks involved clearly. The same facilitates training of personnel also.
  • 4. Standard Bidding Documents  FIDIC conditions of contract are universally used as standard bidding documents throughout the world. In India, however, these have become prevalent only in the past 2–3 decades, which needs to be taken further.

  • 10. SECTION I -- INSTRUCTIONS TO BIDDERS  This Section provides relevant information to help Bidders prepare their bids. Information is also provided on the submission, opening, and evaluation of bids and on the award of Contracts. Section I contains provisions that are to be used without modification. 10

The contents of this Section supplement the General Conditions and shall be prepared by the Employer.

  • 17. 17 General (Important Clauses)  “Corrupt practice” means offering, giving, receiving, or soliciting to influence action in procurement process or in contract execution 3.1  “Fraudulent practice” is any act or omission, including a misrepresentation, that knowingly or recklessly misleads, or attempts to mislead, a party to obtain a financial or other benefit or to avoid an obligation; 3.1
