Name of Witness: Justin/Justine Cook
Specific Statements:
o “I met Alex for the first time when I called him/her into my office in
November because I was concerned about his/her poor attendance and
grades. When I asked Alex about them, at first he/she shrugged his/her
shoulders and said he/she was playing too many video games.”
o “If C.J. got in trouble for this, it would be the same as me assigning
detention to someone for not making their bed at home!”
Evidence to be entered through testimony:

o Meeting with Billings in November

Name of Witness: Brendon/Brenda Li
Specific Statements:
o “[anti-bullying policy] covers conduct ranging from “offensive” to
causing “fear of physical harm” and “emotional distress.”
o “Our anti-bullying is consistent with federal civil right laws…”
o “Pearson’s treatment may have made Alex Billings uncomfortable, but it
was not discriminatory. It was not based on traits protected by federal civil
rights laws –race, color, national origin, gender, or disability.”
o “The proper avenue for solving the problem was for Alex to get a
Temporary Restraining Order (TRO) from a judge. This is how bullying
outside of school should be handled…”

Name of Witness: C.J. Pearson
Specific Statements:
o “I have a good life except Billings is ruining it by dragging me into court.”
o “My parents told me they are going broke to pay the lawyer’s bills, and I
am really afraid this is going to impact my chances to get into a good
college someday.”
2. o “This lawsuit is being covered by the newspapers! It’s so humiliating.”

Name of Witness: Alex Billings
Specific Statements:
o “I acted like it didn’t bother me, but really I wanted all the talk and teasing
to stop.”
o “I don’t want anyone to make a big deal about this, but when I stayed
home from school, I’d usually meet up with friends, and we would play
video games.”
o “It’s a great school. I have made some really nice friends, and I love it
there. I can’t wait to spend the rest of high school studying there. I have all
A’s, and I haven’t missed a day yet.”
Evidence to be entered through testimony:
o How Billings handled a conflict when Pearson or a classmate would make
fun of him/her
o Activities Billings took part in instead of being in school
o Billings’s opinion of SJA

Name of Witness: Francis Billings
Specific Statements:
o “However, as I understand it, as soon as my kid walks through the school
doors, the school administration is responsible for supervising them and
ensuring their well-being.”
o “I was blaming Alex’s problems on video games.”
o “They didn’t even know he/she wasn’t there…”
o “They should have been concerned…”

Name of Witness: Dr. Gabriel/Gabriella Rodriguez
Specific Statements:
o “…and I have a PhD in school psychology from the University of Santa
Fe, which I attained through an online PhD program.”
o “I am the school psychologist at Saint Joseph Academy, and I was
recently promoted to the head of the recruitment committee.”
o “I also believe that the PTSD stems not only from Pearson’s harassment,
but also from the way Alex was treated by the KHS administration.”
Evidence to be entered through testimony:
o Lack of credibility
o Mixing two job responsibilities that should not be intermixed
o Need for exclusion of the first PTSD test
