Case details ENSA (Distributor) v ATRIA (Generator) • Exemption from the notice period for regulated users who migrate to the free market • Period: 2016 - 2019 SEAL (Distributor) v ATRIA (Generator) • Exemption from the notice period for regulated users who migrate to the free market • No requirement to install equipment to regulate the power of energy to users who migrate to the free market • Period: 2016 - 2020
• Dominance of the distribution companies by a legal monopoly III. Related markets and dominance Case Relevant market Affected market ENSA • Supply of electricity to regulated users with annual power demand between 0.2 MW and 2.5 MW within ENSA's concession area • Supply of electricity to regulated users who decide to switch to free users within ENSA's concession area SEAL • Supply of electricity to regulated users with annual power demand between 0.2 MW and 2.5 MW within SEAL's concession area • Distribution of electricity to users with power demand between 0.2 MW and 2.5 MW within SEAL’s concession area • Supply of electricity to regulated users who decide to switch to free users within SEAL's concession area
IV.Assessment of the effects Case Effects Causal nexus ENSA • Increasing share of free users captured by ENSA in the period (from 29% to 60%) • Increasing share in the power demanded by new users by ENSA in the period (from 43% to 58%) • ENSA's price higher than that of competitors in the free market (+ 36.6%) • Differential treatment encouraged ENSA’s regulated users to continue later as free users with ENSA • Fulfilled the contract : • 57% of users opted for a generator • Users who left ENSA obtained lower prices (-41%) SEAL • Increasing share of free users captured by SEAL in the period (from 54% to 72%) • Increasing share in the power demanded by new users by SEAL in the period (from 42% to 80%) • SEAL's price higher than that of competitors in the free market (+ 24.1%) • Differentiated treatment encouraged SEAL’s regulated users to continue later as free users with SEAL • Fulfilled the contract : • 59% of users opted for a generator • Users who left SEAL obtained lower prices (-21.7%)

Main arguments of the defendants Case Main arguments ENSA • The exemption provided by law seeks to protect distribution companies • Recover investments and competitive factor • To mitigate losses from user migration • Limits to renegotiate contracts with generators • Absence of an appreciable exclusionary effect in the free market • ENSA assumes risks that generators do not assume SEAL • The exemption allows balancing the competitive advantage that generators have over SEAL • The right of exemption has been recognized by the sector regulator (Osinergmin) • SEAL has relaxed the obligation to install equipment, not its exemption
