is an independent part of the Ministry of Economy
Development and Technology with its own:
– Financial Department (cut budget)
– Human Resources (limit)

Responsible for monitoring compliance in more than
180 areas:
• 55 national acts in different areas
• 126 executive regulations
• several European regulations (764/2008, 765/2008,
305/2011, etc)

Methods of Solving Cases
Measures
• When a law is violated, we can use administrative
measures and penalties.
• In the area of administrative measures we either instruct
elimination of defects or forbid the trade with the product or
service.
• Since January 2005, we have been acting as
misdemeanours judges and have started issuing penalties.
Depending on the violation, we either issue a fine, or give
a reminder or warning.

preventive measures for keeping
order in the market and for the
satisfaction of individuals and of the
wider community.

 not to penalize companies but to stabilize the market
 to try to imply “softer“ measures
But
• if companies do not accept legal proposals and take
voluntary actions, we have to take stricter measures.

  • 4. Market Inspectorate of the Republic of Slovenia is an independent part of the Ministry of Economy Development and Technology with its own: – Financial Department (cut budget) – Human Resources (limit) 4
  • 6. Scope of Activity Responsible for monitoring compliance in more than 180 areas: • 55 national acts in different areas • 126 executive regulations • several European regulations (764/2008, 765/2008, 305/2011, etc) 6

Business Plan • We take into consideration – irregularities in recent years – changes in the legislation – present and future changes in the internal market – proposals on common surveillance from other inspections – proposals on common surveillance from different EU bodies – best practices from other member states • We invited participation from – Ministries – Chamber of Commerce – Chamber of Crafts – Consumer Organizations – Inspection Council – Laboratories 11

Measures • When a law is violated, we can use administrative measures and penalties. • In the area of administrative measures we either instruct elimination of defects or forbid the trade with the product or service. • Since January 2005, we have been acting as misdemeanours judges and have started issuing penalties. Depending on the violation, we either issue a fine, or give a reminder or warning. 13
  • 14. The Mission … is to carry out efficient inspection and supervision, which ensures preventive measures for keeping order in the market and for the satisfaction of individuals and of the wider community. 14
  • 15. Our mission is …  not to penalize companies but to stabilize the market  to try to imply “softer“ measures But • if companies do not accept legal proposals and take voluntary actions, we have to take stricter measures. 15
