WHEREAS, Section 9, Article XIII of 1987 Constitution provides that the “State
shall by law, and for the common good undertake, in cooperation with the private sector,
continuing program of urban land reform and housing which will make available at
affordable cost decent housing and basic services to underprivileged and homeless citizens in
urban centers and resettlement areas”;
WHEREAS, Section 17, Republic Act 7160, otherwise known as the Local Government
Code of 1991 provides that “LGUs shall endeavor to be self-reliant and shall continue exercising
the powers and discharging the duties and functions currently vested upon them.xxx as are
necessary, appropriate or incidental to efficient and effective provision of basic services and
facilities enumerated herein xxx (viii) Programs and projects for low-cost housing and other
mass dwelling, except those funded by the SSS, GSIS and the HMDF;
WHEREAS, RA 9435 otherwise known as the Charter of the City of El Salvador the
“SangguniangPanlungsod, as the legislative body of the City, shall enact Ordinances, approve
resolutions and appropriate funds for the general welfare of the City and its inhabitants
pursuant to Section 16 of the Local Government Code and in the proper exercise of the
corporate powers of the City as provided under Section 22 of the Local Government Code;

WHEREAS, in response to RA 7279, the City Government acknowledged the need to
provide the constituents with affordable and descent housing project;
NOW,THEREFORE,after due deliberation on the Matter and On Motion of Hon. Felipe R.
Lim, Jr., Unanimously Seconded, it was
RESOLVED,this Body hereby resolves to pass an Ordinance.

PROVINCEOFMISAMISORIENTAL”
BE IT ORDAINED, by the Sangguniang Panlungsod of the City of El Salvador in
session assembled that:
SECTION 1. Declaration of Policy. – It is hereby the policy of the City Government
of El Salvador to undertake a comprehensive and continuing program which shall uplift the
conditions of the underprivileged and homeless citizens in urban, rural and in public lands by
making available to them decent housing and basic services at affordable cost.
SECTION 2. Definition of Terms. – For purposes of understanding and guidance, the
terms herein used shall be defined as follows:
1. Beneficiary - Any person/persons who meet the requirements set forth in this
Ordinance or as provided for in the RA 7279, otherwise known as Urban Development
and hOusing Act of 1992 is qualified or entitled to acquire either a house and lot or lot
only.
2. Surveyed Household – Any household who is included in the profiling of the would-be
beneficiaries as determined by the Selection Committee.
3. Household – A group of persons who lives in the same dwelling unit and have a
common arrangement for the preparation and consumption of food.
4. Household Head – The legitimate and head of the family with at least one dependent
entitled to a support within a structure.
5. Resettlement Areas – Refer to areas identified by the appropriate national agency or by
local government unit with respect to areas within its territorial jurisdiction, which shall
be used for the relocation of the would-be beneficiaries.
6. Socialized Housing – Refers to the housing program and projects covering house and
lot or homelot only undertaken by the government or the private sector for the
underprivileged and homeless citizens which shall include sites and services
development, long term financing, flexible terms on interest payments, and such other
benefits in accordance with the provisions of R.A. 7279.
7. Underprivileged and Homeless Citizens – Refer to the beneficiaries of the R.A 7279 and
to individuals or families residing in urban and rural areas, whose income or combined
household income fails within the poverty threshold as defined by the National Economic

and Development Authority (NEDA) and who do not own housing facilities. This shall
include those who live on makeshift dwelling units and do not enjoy security of tenure.
8. Affordable Price - Refers to the most reasonable price of land and shelter based on the
needs and financial capability of would-be beneficiaries and appropriate financing
schemes.
9. Joint Venture – Refers to the commitment or agreement entered into by and between
two (2) or more persons to carry out a specific or single business enterprises for their
mutual benefit to which purpose they combine their funds, land resources, facilities and
services.
10. Amortization Payments – A regular instalment to be collected by the City Treasury
Office from the beneficiary –awardee of the housing program.
11. Infrastructure Cost/Development Cost – The expenses incurred in the construction of
roads, footpaths, alleys, drainage, bridges, public utilities and other physical horizontal
facilities in the project site.
12. Land Acquisition Cost – The expenses incurred in the purchase of lots to be developed
as housing sites.
13. Transfer of Rights Through Succession – Means that in case of death of beneficiary-
awardee, the surviving spouse shall succeed both the rights and obligations of the
deceased spouse. However, in case of death or permanent incapacity of both parents,
the legal successor in interests of both parents shall be considered as successor.
SECTION 3. Beneficiary Selection and Lot Allocation. – Any qualified beneficiary
shall only be entitled to one lot.
In the awarding and allocation of residential lots, the beneficiaries are as follows:
1. Households affected by the implementation of infrastructure and development effort of
the City.
2. Those affected by natural and man-made calamities, and those provided under RA
7279.
3. Households who are living in Environmentally Critical Areas (ECA) such as but not
limited to esteros, landslide prone, garbage dump, riverbanks, shorelines, waterways,
sidewalks, roads, parks, playgrounds and other public places.
4. Households issued with court ejectment orders for demolition and those qualified under
RA 7279.
5. Landless City Hall employees.
6. Must not be a professional squatter or a member of squatting syndicates.
SECTION 4. Priority in the Awarding of Housing Unit or Home Lot. – In
awarding the Housing Unit or Home Lot, or both, the following shall be given preference:
a. First Priority – Paragraphs 1 and 2, Section 3 of this Ordinance shall apply.
b. Second Priority – Paragraphs 3 and 4, Section 3 of this Ordinance shall apply.
c. Third Priority – Paragraph 5, Section 3 of this Ordinance shall apply.
SECTION 5. Basic Qualification of a Beneficiary. - To qualify as beneficiary, he or
she must have the following qualifications:
1. A Filipino citizen of legal age;
2. Head of the family with at least one (1) dependent living within a structure;
3. Must be an underprivileged and homeless citizen, as defined in Section 3 of R.A. 7279;
4. Must not be a beneficiary of any housing project and/or lot acquisition program from the
government or any private entity;
5. Must not be a professional squatter or a member of squatting syndicates;
6. Is a bonafide citizen or has permanent residence of El Salvador City;

7. Those occupants under existing resettlement project are not covered by the above
qualifications.
SECTION 6. Prohibitions and Limitations:
1. House and lot or lots awarded including improvements therein shall not be transferable
except on the following circumstances:
a. Succession.
b. After five (5) years upon full payment of the amortization, such lot may be
transferred to the next beneficiary.
c. Execution of final transfer of ownership shall only be made after full payment of
purchase price.
2. No transfer by onerous or gratuitous manner shall be allowed within the prohibition
period. Any transfer or assignment made is null and void.
3. Sell, transfer or dispose of beneficiary’s right is hereby strictly prohibited.
SECTION 7. Project Cost. – Awardee or beneficiary shall be charged for project cost
from which they derived specific benefits.
Costs shall include the following:
1. Cost of land.
2. Land development cost to include the onsite infrastructure like construction of roads,
footpaths, alleys, drainage, bridges, public utilities, technical supervision,
administrative/management cost and collection charges of the total cost and the like.
SECTION 8. Unit Cost. – The actual price per square meter shall be determined by
dividing the recoverable investment by the total saleable area for the lot only, while for the
housing component, it shall be determined by the total house cost without inflation rate. The
detailed total cost and monthly amortization to be paid by the beneficiary shall be indicated in
the contract agreement between the City Government of El Salvador and the identified
beneficiary.
SECTION 9.Construction. – The type of unit construction will be determined by the
City Housing Board.
SECTION 10. Collection and Default. – The City Treasurer has the sole responsibility
for the collection of amortization payments and other revenue which may be generated under
this project, and as per Updated Local Revenue Code.
A qualified awardee/beneficiary shall pay to the City Treasury a down payment of at
least Three Percent (3%) of the total selling price upon the execution of the contract and
immediately thereafter. The amortization shall be paid within the first five (5) days upon due
date.
A penalty of Two Percent (2%) per month shall be imposed for late payment. Failure to
pay three (3) consecutive monthly amortization. Including the surcharges thereof shall make
the whole amount and demandable which shall be paid within one (1) month from the time of
demand.
SECTION 11. Priorities in the Acquisition of Land. – Lands for socialized housing
shall be acquired in the following order:
a. Those owned by the Government or any of its subdivision, instrumentalities, or agencies,
including government-owned or controlled corporations and their subsidiaries;
b. Alienable lands of the public domain;
c. Unregistered or abandoned and idle lands;

d. Those within the declared Areas for Priority Development, Zonal Improvement Program sites,
and Slum Improvement and Resettlement Program sites which have not yet been acquired;
e. Bagong Lipunan Improvement Sites and Services or BLISS sites which have not yet been
acquired; and
f. Privately owned lands.
SECTION 12. Implementation. – The City of El Salvador Housing and Urban
Development Office (CESHUDO) shall be primarily responsible for the effective implementation
of the provisions of this Ordinance.
SECTION 13. Effectivity. – This Ordinance shall take effect upon its approval.

WHEREAS, Section 5, Article II of the 1987 Philippine Constitution provides that “The
maintenance of peace and order the protection of life, liberty and property, and the promotion
of the general welfare are essential for the enjoyment by all the people of the blessings of
democracy”. Consistent with this policy the government established jails and detention centers
for the safekeeping of those awaiting trial, convicted felons and offenders for the protection of
the general public;
WHEREAS, Sec. 16 of RA 7160 otherwise known as the Local Government Code of 1991
mandates that “Every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its

efficient and effective governance, and those which are essential to the promotion of the
general welfare”;
WHEREAS, Section II (a) Article IV of RA 9435 also known as the Charter of the City of
El Salvador provides in part that, “The Sangguniang Panlungsod, as the Legislative Body of the
City, shall enact ordinances, approve resolutions and appropriate funds for the general welfare
of the City and its inhabitants pursuant to Section 16 of the Local Government Code and in the
proper exercise of the corporate powers of the City as provided for under Section 22 of the
Local Government Code;
WHEREAS, the Bureau of Jail Management and Penology (BJMP) was created pursuant
to Sec. 60 to 65 of Chapter V, Republic Act No. 6975. The BJMP is mandated to supervise and
control the administration and operation of all district, city and municipal jails nationwide with
pronged tasks of safekeeping and development of inmates;
WHEREAS, there is a need to adopt an Ordinance regulating entry of illegal
paraphernalia at the BJMP premises;
NOWTHEREFORE, after thorough deliberation on the Matter and on Motion of Hon. Nilo
T. Pates, Unanimously Seconded, it was

BE IT ORDAINED by the Sangguniang Panlungsod of the City of El Salvador in regular
session assembled, that
SECTION 1. Title. This Ordinance shall be known as “An Ordinance Prohibiting the
Bringing into, Sneaking, Using and Carrying any form of Contraband inside Jails and Detention
Places in the City of El Salvador, Province of Misamis Oriental and providing penalties for
violation thereof”.
SECTION 2. Purpose. This Ordinance is enacted for the following purpose:
a. To strengthen the implementation of security measures imposed by jails and
detention places.

b. To prevent the occurrence of deaths, riots, hostage taking and escape of inmates by
prohibiting the possession and entry of deadly and bladed weapons.
c. To prevent the inmates from coercing, intimidating, threatening complainant/s and
witness/es or order retaliation, orchestrate crimes and organize rescue plan by prohibiting a
possession and entry of cellular phones and other electronic gadgets for used for
communication.
d. To prevent the inmates from bribing jail officers or custodians by prohibiting the
possess of excessive amount of money in cash or check inside the jails detention places, and
e. To safeguard public health and well-being of the inmates by penalizing the possession
and entry of illegal drugs, cigarette and tobacco.
SECTION 3. Definition of Terms. As used in this Ordinance the following shall be
construed to mean as follows:
3.1. Jail and Detention Places – Refers to a place of confinement for persons under
arrest awaiting for the filing of formal charge in court or those awaiting trial or serving
sentence. This term also includes rehabilitation centers, lockups, kalasag, juvenile homes,
hospitals and other facilities ordered by the court to be the place of the inmates/prisoners
temporarily confinement.
3.2.Contraband – Refers to items specifically prohibited by the jail and detention
management to be brought in or inside the facility. For purposes of the applicability of this
Ordinance the term “Contraband” shall only be limited to the following items:
1. Deadly and bladed weapons/firearms or any parts thereof, improvised explosive
device and any possible components such as electric wires, batteries, fertilizers, etc.
and ammunition;
2. Metal cutting saw or blades and digging tools not permitted by the jail/detention;
3. Cigarette, E-Cigarette and other tobacco products;
4. Match and lighters;
5. Liquor, beer, coconut wine and other intoxicating beverages;
6. Prohibited dugs and paraphernalia;
7. Cash which is more than prescribed allowable, to include checks;
8. Mobile phones and electronic communication devices;
9. Pornographic materials;
10. Gambling paraphernalia, and;
11. Other items or products that prohibited by the Jail and Detention Place
Management.

3.3. Deadly and Bladed Weapon – Refers to any object which in the manner used is
capable of producing death, or of inflicting great bodily injury, or seriously wounding.
3.4. Prohibiting Drugs and Paraphernalia – Refers to the prohibited drugs and
paraphernalia defined under Republic Act No. 9165 or the “Comprehensive Dangerous Drug Act
of 2002”.
3.5.Mobile Phone – Also known as cellular phone, cell phone or hand phone; refers to
device that can make and receive telephone calls/communication by connecting to a cellular
network allowing access to the public telephone network. It supports a wide variety of other
services such as text messaging, MMS, email, internet access, short range wireless
communications (infrared, Bluetooth), business applications, gaming and photography.
3.6. Electronic Communication Device – Includes any computer, personal digital
assistant, cellular telephone, digital camera or camcorder, pager, two-way radio, or other
similar thereto.
3.7. Pornographic Materials - Refers to any publication, images, either in printed or
digital form mainly focusing on obscene image of intimate body parts, either directly or
implicitly, making it sexually explicit and contrary to public policy, public order, good customs
and moral standards.
3.8. Gambling Paraphernalia – Refers to equipment used for the game or
cockfighting, jueteng, bookies (jai-alai or horse raising to include game fixing) and other
lotteries, cara y cruz or pompiang and the like, black jack, lucky nine, pusoy or Russian Poker
monte, baccarat and other card games, plaque domino, mahjong, high and low, roulette,
pinball and other mechanical inventories or devices, seven-eleven dice games and the like.
3.9. Pat Search – Consist of the removal of outer protective clothing, the emptying of
pockets, the physical search, screening by device which does not require disrobing and the
inspection of papers, bags, books, or other items being carried.
3.10. Person – Any Juridical or Natural persons also applies to Persons Deprived of
Liberty (PDL) and those entering jail and detention cell as guest/visitor.
SECTION 4. Prohibited Acts. Any person who willfully possess, sneak/carry/use
attempt to sneak/carry or cause or attempt to cause to be brought into the jail/detention
place/s any contraband as defined by Section 3, Sub-paragraph 3.2 of this Ordinance.
SECTION 5. The same prohibition and penalties shall apply to BJMP Officials and
Personnel found to be in cahoots with inmates or proven to aid or have aided the sneaking-in
and smuggle of contraband inside the BJMP Jail Facility and or have aided the escape of an
inmate or inmates.
Any BJMP Personnel found guilty of violating this Ordinance or when evidence of guilt is
strong against the BJMP Personnel shall be placed immediately or preventive suspension and be
subjected to necessary summary dismissed proceedings as provided for in the rules of the BJMP
charter.
SECTION 5. Penalties. Violation of the preceding section shall be meted the following
penalties, viz:

5.1. First Offense – Fine amounting to Php 2,500.00 and Six (6) months imprisonment.
5.2. Second Offense – Fine amounting to Php 5,000.00 and imprisonment for One (1)
Year.
5.3. Third Offense – Fine amounting to Php 5,000.00 and perpetual ban of visiting
privilege and imprisonment for One (1) Year at the discretion of the court.
SECTION 6. Accessory Penalty. All Contrabands confiscated in the enforcement of
this Ordinance shall be forfeited in favor of the government.
SECTION 7. Enforcement. All jails and detention places are mandated to conduct pat
search on any person, including organic or non-organic personnel entering their facilities.
All Jails and Detention places are mandated to post a notice in a conspicuous place the
items defined and penalized in this Ordinance as contraband.
Prior to the conduct to the of pat search, the person entering the jail shall be given
opportunity or advised to surrender or removed from their possession or belongings any item
considered contraband. Upon declaration that he or she has no more items to surrender or be
removed the jail/detention personnel shall search the person and his/her belongings and
considered found in him/her or his/her belongings shall be presumed willfully possessed.
SECTION 8. Separate and Independent Offense. Violation of the Ordinance shall
not be absorbed by any other crime or felony committed as consequence and shall be treated
as a separate and independent criminal act whose penalties shall be imposable without
prejudice to any other criminal liability provided for other applicable penal laws.
SECTION 9. Repealing Clause. All Ordinances or any part thereof, which are contrary
to or inconsistent with the provisions of this Ordinance are repealed or amended accordingly.
SECTION 10. Separability Clause. If any part or provision of this Ordinance is
declared unconstitutional or invalid, the other provisions not so declared and not affected by
such declaration shall remain in full force and effect.
SECTION 11. Effectivity Clause. This Ordinance shall take effect after publication in
a newspaper of general circulation or posting in three conspicuous public places in the City.

WHEREAS, Section 3, Art. IX of the 1987 Philippine Constitution mandates that “ The
Civil Service Commission, as the central personnel agency of the Government, shall establish a
career service and adopt measures to promote morale, efficiency, integrity, responsiveness,
progressiveness, and courtesy in the civil service xxx”;
WHEREAS, Section 11 Art. IV of RA 9435 otherwise known as the “Charter of the City
of El Salvador provides that “Powers, Duties, Functions and Compensation (a) The Sangguniang
Panlungsod, as the Legislative Body of the City, shall enact ordinances, approved resolutions
and appropriate funds for the general welfare of the City and its inhabitants pursuant to Section
16 of the Code xxx”;
WHEREAS, on November 8, 2018, the Hon. Edgar S. Lignes, City Mayor has endorsed to
the Sangguniang Panlungsod the proposed creation of positions, viz: One (1) Engineer II, Item
No. 34, SG-16 under the Office of the City Engineer; Two (2) Nursing Attendant II, Item Nos.
45 & 46, SG-6 under the City Health Office; Two (2) Driver I, Item Nos. 34 & 35, SG-3 under
the City Mayor’s Office; One (1) Bookbinder III, Item No. 12, SG-7 and One (1) Data Controller
III, Item No. 5, SG-11 under the Office of the City Accountant; One (1) Senior Environmental
Management Specialist, Item No. 1, SG-18 and One (1) Environmental Management Specialist
II, Item No. 2, SG-15 under the City Environment and Natural Resources Office and One (1)
Associate Professor IV, Item No. 16, SG-22 under the City College of El Salvador and its
appropriation to be included in the Annual Budget FY- 2020 of the City Government of El
Salvador, Province of Misamis Oriental, for legislative action;
WHEREAS, there is a need to approve the submitted newly created positions being vital
in the operation of the City Government of El Salvador for an efficient and effective local
governance ;
NOW THEREFORE, after thorough deliberation on the Matter and on Motion of Hon.

WHEREAS, Section 3, Art. IX of the 1987 Philippine Constitution mandates that “ The
Civil Service Commission, as the central personnel agency of the Government, shall establish a
career service and adopt measures to promote morale, efficiency, integrity, responsiveness,
progressiveness, and courtesy in the civil service xxx”;
WHEREAS, Section 11 Art. IV of RA 9435 otherwise known as the “Charter of the City
of El Salvador provides that “Powers, Duties, Functions and Compensation (a) The Sangguniang
Panlungsod, as the Legislative Body of the City, shall enact ordinances, approved resolutions
and appropriate funds for the general welfare of the City and its inhabitants pursuant to Section
16 of the Code xxx”;
WHEREAS, on January 22, 20120 the Hon. Edgar S. Lignes, City Mayor has endorsed to
the Sangguniang Panlungsod the request for the creation of positions under the Office of the
City Planning and Development, for legislative action;
WHEREAS, there is a need to approve the submitted newly created positions being vital
in the operation of the City Government of El Salvador for an efficient and effective local
governance ;
NOW THEREFORE, after thorough deliberation on the Matter and on Motion of Hon.
Mark William U. Tan, Duly Seconded by Hon. Felipe R. Lim, Jr., it was

InfectiousDiseases(IATF-EID)issue ResolutionNo.11. S-2020 raisedthe alert level Code Red Sublevel 2.
President Duterte approved the imposition of Stringent Social Distancing Measures in the National
Capital Region (NCR) for thirty (30) days from March 15 to April 14, 2020, and placed the entire NCR

WHEREAS, under the Enhanced Community Quarantine, strict home quarantine is
implemented in all households; mass public transportation facilities are suspended; provision for food
and essential healthservices is regulated and heightened presence of uniformed personnel to enforce
quarantine procedures;
WHEREAS, during a pandemic or epidemic of infectious diseases which are air-borne or
transmittedbyrespiratorydroplets,one of the precautionarymeasures to prevent its spread aside from
personal hygiene is reverse isolation like the use of face-masks as a self-protection measure and
community protection;

BE IT ENACTED, by the Sangguniang Panlungsod in session assemble, that:
Section 1. TITLE. –This Ordinance shall be known as the Face Mask Wearing Ordinance of
2020 of the City of El Salvador, Province of Misamis Oriental.
Section 2. DEFINITION. –Whenever used in this Ordinance, the following terms shall be construed to
mean as follows:
a) Face Mask refers to a barrier device or protective mask covering the nose and mouth either
reusable, washable, improvised, customized or disposable.
b) Public places mean all places, fixed or mobile, that are accessible of open to the public or
places for collective use, regardless of ownership or right to access, including but not limited to,
establishments that provide food and drinks, accommodation, merchandise, professional services,
entertainment or other services. It also includes outdoor spaces where facilities are available for the
publicor where acrowd of people wouldgather,suchas,butnot limitedtoplaygrounds,sportsgrounds

or centers, church ground, health/hospital compounds, transportation terminals, markets, parks,
resorts, walkways, waiting areas and the like.
Section3. REQUIREMENT. –During publichealthemergency,epidemicorpandemicand when there is a
declaration of community quarantine, any person entering the territorial jurisdiction of the City of El
Salvador and public places in the City is hereby mandated to wear a face mask.
Section4. PENALTY. –Anypersonfoundnotwearinga face mask as mandatedhereinshallbe subjected
to a penalty of (community service) to be administered by the City Mayor or the Barangay Captain
where the violation was committed, in accordance hereof, to wit:

Section5. SEPARABILITY CLAUSE. –All ordinances,rulesorregulations in conflict with the provisions of

Section6. REPEALING CLAUSE.–Any existingordinance orregulationinconsistentwiththe provisions of
this Ordinance are hereby deemed repealed.
Section 6. EFFECTIVITY. –This Ordinance shall take effect immediately.

Disease 2019 (Covid-19) andthe Code AlertSystemforCOVID-19wasraisedto Code Red Sub-Level Two
(2) in accordance with the recommendation of the Department of Health (DOH) and the Inter-Agency
Task Force for EmergingInfectiousDiseases(IATF).Further,Presidential Proclamation No. 929, Series of
2020 was issued declaring a State of Calamity throughout the Philippines due to Covid-19;
WHEREAS,since the emergence of COVID-19 we have seen instances of public stigmatization
among persons who have contracted the disease including PUIs and PUMs, and the rise of harmful
stereotypes.Thismeansthatpeople are beinglabeled,stereotyped,separatedand/orexperience lossof
status and discrimination because of a potential negative affiliation with the disease. Stigmatization
coulddrive people tohide the illnesstoavoiddiscriminationorpreventpeoplefromseekinghealth care
immediately and discourage them from adopting healthy behaviors;
WHEREAS,the Departmentof Health(DOH) recentlywarned the public against discrimination
against persons reported to have contracted COVID-19 as well as PUIs, PUMs including health workers
and emergency workers who are among those in the frontlines of the battle against the rapidly
spreadingCOVID-10.The DOH statedthatwiththe worldconfrontedwithavirus with little information
known, it is human to be afraid. But we must not allow hysteria and paranoia to result in irrational
treatment of people;
WHEREAS, there have been several reported incidents of people being evicted out of their
residences or after having recovered from the illness were prevented from returning back to their
residences, while some were even doused with water and were refused services in eateries or
transportationsoverfearsof infection;Some were shunned by local stores, boarding houses, and even
theirownbarangaysand homes.Several falseandinaccurate social media posts even circulated online
spreading names of people alleged to have been infected with COVID-19;
WHEREAS, considering the gravity of the situation, there is an urgent need to combat this
pervasive stigmatization on the basis of one’s medical condition; There is a need for the City to bring
normalcyand orderamidstthe crisis,andprotectits constituencyfromunjustdiscriminationbroughton
by fear and panic by public;
WHEREAS, it is at this trying times, families who are affected by this pandemic suffer severe
anxiety and social humiliation. Hence, it is the policy of the City Government of El Salvador to act as
parents patria during this trying times by showing compassion, empathy and tolerance towards its
affected constituents;

SECTION 1. SHORT TITLE. –This Ordinance shall be known as “Anti Covid-19” Discrimination
Ordinance of 2020 of the City of El Salvador, Province of Misamis Oriental”.
SECTION 2. DEFINITIONS. –Persons infected, Patients Under Investigation (PUIs) and Persons
Under Monitoring (PUMs) are those defined by the protocols and guidelines of the Department of
Health a recently called the Probable Patients.
Healthworkersare those who deliver care and services to the sick and ailing, either directly or
indirectly. Health workers include, among others, doctors, nurses, hospital and clinic aides, and
laboratory technicians.
Frontliner include officers and members of the PNP, AFP, PCG and instrumentalities of the
government rendering emergency frontline services, border control and other critical services.
Frontliners also include service workers who are working in private establishments providing basic
necessities and such activities related to food and medicine, i.e. public markets, supermarkets,
groceries,convenience stores,hospitals,medical clinics, pharmacies and drug stores, food preparation
and delivery services, water-refilling stations, manufacturing and processing plants of basic food
productsand medicines,banks,moneytransferservices,power,energy,telecommunications and water
supplies and other related facilities.
SECTION 3. UNLAWFULACTS. –It shall be unlawful for any person, whether natural or juridical,
to commit any act or make utterances which cause or tend to cause stigma, disgrace, shame,
humiliation,harassment or otherwise discriminating against a person infected, under investigation or
monitoring due to Covid-19, health worker or frontliner as defined under his Ordinance.
If any publicofficerrefusesorfailstogive assistance toa personinfected,underinvestigationor
monitoringdue toCovid-19,healthworkerorfrontlinerwho intends to return to his place or residence

or domicile,afterobtainingclearanceof the Covid-19infectionfrom the proper health officials, he/she
shall be equally liable under this section.
Anypersonwhoshall publicly claim, post on social media, spread or announce that a person is
infected, is under investigation or monitoring due to Covid-19 whether or not the same has been
confirmedorvalidatedfromthe listgivenbyauthorized proper health officials, agency or department,
shall alsobe liable underthissection.If the personviolatingisapublicofficer,the penaltyimposedshall
be in its maximum and can also be a ground for filing of an administrative case against said official.
Except,whenthe patientconcernedwaivedhis/herrightto privacy and for purposes of contract tracing
and other medical purposes.
SECTION 4. PENALTIES. –Any person violating this Ordinance shall suffer the following:

Juridical Person –If committedbya juridical person,the President,General Manager,Corporate
Secretaryor personwithrelatedinterestin the Corporation or Partnership or Association shall be held

provision of this Ordinance shall be held unconstitutional or invalid, other parts or provisions
hereof, which are not affected thereby, shall continue to be in full force and effect.

endeavor to be self - reliant and shall continue exercising the powers and in charging duties
and functions currently voted upon them xxx and shall likewise exercise such other powers
and discharge such as other functions and responsibilities as are necessary, appropriate, or
incidental. To efficient and effective provision of the basic services and facilities enumerated
herein which for the City (4) includes (ii) support for education, police and fire services and
facilities;
WHEREAS, the Department of Education (DepEd) launches Brigada Eskwela as its
annual school maintenance program aimed to engaged all education stakeholders to contribute
their time, effort, expertise and resources to ensure that the school campus will be safe for the
school-children as they go back to school;
WHEREAS, this distinctive way of engaging the community is pursuant to the saying “it
takes a whole village to train and nurture a child” and is expected to improve not only the
school itself but also the students who will be inspired to be active and productive citizens of
the society in return;
WHEREAS, the program hereby ensures that public facilities will be safe and ready for
the school-children in time for start of classes;

BEITORDAINED,as it is hereby Ordained by the Sangguniang Panlungsod of the City of
El Salvador, Province of Misamis Oriental in session duly assembled:
SECTION 1. Title. –This Ordinance shall be known as the “Brigada Eskwela
Ordinance”.
SECTION 2. Purpose. – It is the purpose of this Ordinance for the City Government of
El Salvador to assist the public schools in keeping school-children by making the start of classes
exciting and as safe as possible.
SECTION 3. Coverage. – This Ordinance shall apply to all public schools within the
territorial jurisdiction of the City Government of El Salvador.
SECTION 4. Definition of Terms. – As used in this Ordinance, the terms below have
the meanings ascribed to them in this section. Any words or terms not defined shall be given
their plain and customary meanings, unless the context requires otherwise, and shall be
interpreted in a manner consistent with the purpose and spirit of this Ordinance.
a. Brigada Eskwela – refers to the annual school maintenance program of the
Department of Education.
b. Community Participation – refers to widest support of the Barangay residents
through the Barangay Council members, Purok Officials, Non-government and People’s
Organizations, Civil Society Organizations, including cooperatives, accredited or recognized by
the Sangguniang Panlungsod, actively participating in Brigada Eskwela activities.
c. MSGC – is an acronym of Multi-Sectoral Governance Council represented by various
sectors of society organized as partner of the City Government of El Salvador.
d. Public Schools – refer to schools operated by the Department of Education within
the jurisdiction of the City of El Salvador.
e. Task Force Brigada Eskwela – a group of individuals representing the Department
of Education, City Government of El Salvador, Association of Barangay Captains/Councils,
Community Parents and Teachers Association, with support staff and Secretariat from the Dep
Ed herein created with specific duties and functions.
SECTION 5. Support to Brigada Eskwela. – The City Government shall allocate
annually a reasonable amount to the Department of Education – El Salvador City Division for
the Brigada Eskwela Program . This amount may be increased, upon recommendation of the
Task Force Brigada Eskwela herein created, and subject to availability of funds as certified by
the Local Finance Committee. In the same matter, the Office of the Sanggunian shall
appropriate ample amount for this purpose charged to the sanggunian members Legislative
Social Funds, amount shall be upon the discretion of each legislators in support to the program.
SECTION 6. Availment of Support. – For purposes of availing the support
abovementioned, the activity design shall be prepared by the Task Force Brigada Eskwela
through the Secretariat chosen by the Department of Education as to the utilization of the

amount allocated for approval and release by the City Government of El Salvador, subject to
accounting and auditing rules and regulations.
SECTION 7. Creation of Task Force. There is hereby created the Task Force Brigada
Eskwela with the composition, duties and functions as follows:

Members:
-Division Federation of Parents – Teachers Association (DFPTA) President
-President, Association of Barangay Captains
-President, El Salvador Chamber of Commerce
-President, Multi-Sectoral Governance Council

-Brigada Ekswela Division Coordinator
-Chairman, Committee on Education of the Sannguniang Panlungsod
-Secretary, City Scholarship Advisory Council (SCAC)
DUTIES AND FUNCTIONS:
a) Prepare Activity Design containing, among others, the specific activities sought o be
undertaken for Brigada Eskwela, and the materials to be procured;
b) Strategize full community participation in every barangay;
c) Facilitate the conduct of Search for Best Community Participation in Brigada Eskwela
Program;
d) Monitor and evaluate of implementation;
e) Recommend policy changes to enhance Brigada Eskwela program for appropriate
action by the DepEd and City Government of El Salvador;
f) Submit annual post-activity report to the City Government through the Office of the
City Mayor, Sangguniang Panlungsod and the Department of Education – El Salvador City
Division, showing, among others, how the support funds were used, extent of community
participation, and the same shall be posted in three (3) conspicuous places in the City.
g) Perform such other related functions and those may be assigned by the City Mayor
and Division Superintendent.
SECTION 8. Community Empowerment Policy. – For a more participatory and
institutional implementation of Brigada Eskwela program, aside from financial support of the
City Government of El Salvador under Section 6 hereof, any and all participating schools are
encouraged to campaign for wider participation of their respective CPTAs and the whole
community under the concept of self-help and self-reliance in improving their respective schools
before the start of classes. For this purpose, any further solicitations shall be minimized and
discouraged.

SECTION 9. Support of the Barangays. – All Barangays shall be required to allocate
funds in support to the implementation of Brigada Eskwela program in their respective
barangas. For this purpose, the Local Finance Committee of the City of El Salvador is hereby
directed to include in the initial review of the Annual Budget of every barangay compliance with
the provision of this Section to form part of its comments and recommendation to the
Sanngguniang Panlungsod.
SECTION 10. Joint Implementation. – To carry out the purpose of this Ordinance,
the City Mayor is hereby authorized to issue appropriate orders, including the determination of
members of the Task Force Brigada Eskwela to represent the City Government. The Division
Superintendent is likewise authorized to designate Dep Ed representative to Task Force Brigada
Eskwela and the Secretariat.
SECTION 11. Collective Undertaking. – The City Government and the Department
of Education shall strengthen their joint efforts and to engage widest community participation
particularly the barangay residents through their Barangay Council, Purok Officials, Non-
Government and People’s Organizations, Civil Society Organizations, cooperatives, to actively
participate in Brigada Eskwela program.
SECTION 12. Repealing Clause. – All ordinances, resolutions and related issuances
or measures that are contrary to or inconsistent with this Ordinance are hereby repealed or
modified accordingly.
SECTION 13. Separability. – If any part or provision of this Ordinance is declared
unconstitutional or invalid, the same shall not affect the validity and effectivity of the other
parts or provision thereof.
SECTION 14. Effectivity Clause. – This Ordinance shall take effect upon approval.

WHEREAS, Section 17, of RA 7160 otherwise known as the Local Government Code of
1991, mandates that “Basic Services and facilities(a) provides that Local Government Unit Shall
endeavor to be self - reliant and shall continue exercising the powers and in charging duties
and functions currently voted upon them xxx and shall likewise exercise such other powers
and discharge such as other functions and responsibilities as are necessary, appropriate, or
incidental. To efficient and effective provision of the basic services and facilities enumerated
herein which for the City (4) includes (ii) support for education, police and fire services and
facilities;
WHEREAS, the City Government of El Salvador created and established a City College to
effectively support industrialization, poverty alleviation and economic growth within the
Cagayan-Iligan Corridor, developing higher order of human resource, skills and competencies;
hence, give emphasis to education by strengthening and aligning technical, vocation skills and
higher education programs anchored to the requirements of the local industries;
WHEREAS, this academic institution shall ensure that the disadvantaged groups have
access to educational opportunities, local government scholarship program and national
government funded scholarship/ assistance program; it shall promote the values of self-
employment;
WHEREAS, on June 18, 2020, the Sangguniang Panlungsod has adopted Ordinance No.
13-S. 2018 entitled “AN ORDINANCE CONFIRMING AND RATIFYING THE TERMS AND
CONDITIONS OF THE APPROVED LOAN WITH THE LAND BANK OF THE PHILIPPINES IN THE
TOTAL AMOUNT OF ONE HUNDRED THIRTY MILLION EIGHT HUNDRED TWENTY THOUSAND
PESOS ONLY (P 130,820,000.00) TO PARTIALLY FINANCE THE CONSTRUCTION OF SCHOOL

BUILDING AND ACQUISITION OF VARIOUS SCHOOL FACILITIES FOR THE PROPOSED CITY
COLLEGE OF EL SALVADOR AND GRANTING FULL POWER AND AUTHORITY TO THE LOCAL
CHIEF EXECUTIVE TO ENTER INTO SUCH AGREEMENTS, CONTRACTS AND DEEDS”.
WHEREAS, on May 7, 2020, the Hon. Edgar S. Lignes, City Mayor has endorsed to the
sanggunian a request to amend the herein Ordinance to compliment with the opening of the
school year since the new normal will require social distancing; hence, additional appropriation
is very vital;
WHEREAS,there is a need to amend the aforementioned Ordinance for public welfare;
NOW THEREFORE, after due deliberation on the Matter and on Motion of Hon. Mark
William U. Tan, duly Seconded by Hon. Eduardo A. Ayunting, it was

BE IT ENACTED, as it is hereby enacted, the Sangguniang Panlungsod of the City of El
Salvador, in session assembled that:
Section I.-That Sec. V, Ordinance No. 13 –S. 2020 entitled “AN ORDINANCE
CONFIRMING AND RATIFYINGTHE TERMS AND CONDITIONS OF THE APPROVED LOAN WITH
THE LAND BANK OF THE PHILIPPINES IN THE TOTAL AMOUNT OF ONE HUNDRED THIRTY
MILLION EIGHT HUNDRED TWENTY THOUSAND PESOS ONLY (P 130,820,000.00) TO
PARTIALLY FINANCE THE CONSTRUCTION OF SCHOOL BUILDING AND ACQUISITION OF
VARIOUS SCHOOL FACILITIES FOR THE PROPOSED CITY COLLEGE OF EL SALVADOR AND
GRANTING FULL POWER AND AUTHORITY TO THE LOCAL CHIEF EXECUTIVE TO ENTER INTO
SUCH AGREEMENTS, CONTRACTS AND DEEDS” shall be amended, particularly Loan Facility II:
Term Loan 4 in the total amount of THIRTY MILLION EIGHT HUNDRED TWENTY THOUSAND
PESOS (P 30, 820,000.00) intended for the acquisition of various school facilities for the
proposed City College of El Salvador with seven (7) years loan with inclusion of six (6) months
grace period on principal.
Section II.-That the purpose of the aforementioned loan shall be amended and
itemized as follows:

a) TWENTY MILLIONPESOS (P 20,00,000.00) – To augment for the construction of the
City College Building.
b) TEN MILLION EIGHT HUNDRED TWENTY THOUSAND PESOS ONLY (P
10,820,000.00) – For the acquisition of the various school facilities.
Section III. Separability Clause.- If for any reason, any Section or Provision of this
Ordianance is declared invalid or unconstitutional, the remaining section or provisions thereof
not affected thereby shall continue to be in full force and effect.
SectionIV. Repealing Clause. – All Ordinances contrary to or inconsistent with this
Ordinance are hereby repealed or amended accordingly.
Section V. Effectivity. – This Ordinance shall take effect immediately upon approval.

WHEREAS, Sec. 458 (a) of RA 7160 otherwise known as the Local Government Code of 1991

approve resolutionsandappropriate fundsforthe general welfare xxx; that (2) Generate and maximize
the use of resourcesandrevenuesforthe development plans, program objectives and priorities of the
city xxx”;
WHEREAS, Sec. 11 (2) (i) of RA 9435 otherwise known as the Charter of the City of El Salvador
mandates the Powers, Duties, Functions of the Sanggunian which provides that “Approve the annual
and supplemental budgetsof the citygovernmentandappropriate fundsforspecificprograms,projects,
services and activities of the City or for other purposes not contrary to law, in order to promote the
general welfare of the City and its inhabitants”;
WHEREAS, on May 26, 2020, the Hon. Edgar S. Lignes, City Mayor has endorsed to the
Sangguniang Panlungsod the Supplemental Budget No. 04 FY-2020 of the General Fund of the City

Noble City Councilor RESOLUTIONNO.081-A–S.2019 “ARESOLUTIO0NTOPASSANORDINANCEESTABLISHINGTHEGUIDELINESINTHE ADMINISTRATIONANDIMPLEMENTATIONOFALLRESETTLEMENTANDSOCIALIZED HOUSINGPROGRAMOFTHECITYOFELSALVADOR, PROVINCEOFMISAMISORIENTAL” WHEREAS, Section 9, Article XIII of 1987 Constitution provides that the “State shall by law, and for the common good undertake, in cooperation with the private sector, continuing program of urban land reform and housing which will make available at affordable cost decent housing and basic services to underprivileged and homeless citizens in urban centers and resettlement areas”; WHEREAS, Section 17, Republic Act 7160, otherwise known as the Local Government Code of 1991 provides that “LGUs shall endeavor to be self-reliant and shall continue exercising the powers and discharging the duties and functions currently vested upon them.xxx as are necessary, appropriate or incidental to efficient and effective provision of basic services and facilities enumerated herein xxx (viii) Programs and projects for low-cost housing and other mass dwelling, except those funded by the SSS, GSIS and the HMDF; WHEREAS, RA 9435 otherwise known as the Charter of the City of El Salvador the “SangguniangPanlungsod, as the legislative body of the City, shall enact Ordinances, approve resolutions and appropriate funds for the general welfare of the City and its inhabitants pursuant to Section 16 of the Local Government Code and in the proper exercise of the corporate powers of the City as provided under Section 22 of the Local Government Code; Republic of the Philippines Province of Misamis Oriental CITY OF EL SALVADOR -oOo- OFFICE OF THE SANGGUNIANG PANLUNGSOD

ASP/dunn10072019 WHEREAS, in response to RA 7279, the City Government acknowledged the need to provide the constituents with affordable and descent housing project; NOW,THEREFORE,after due deliberation on the Matter and On Motion of Hon. Felipe R. Lim, Jr., Unanimously Seconded, it was RESOLVED,this Body hereby resolves to pass an Ordinance. ORDINANCENO.01-A-S.2019 ANORDINANCEESTABLISHINGTHEGUIDELINESINTHEADMINISTRATIONAND IMPLEMENTATIONOFALLRESETTLEMENTANDSOCIALIZEDHOUSINGPROGRAMOFTHE CITYOFELSALVADOR, PROVINCEOFMISAMISORIENTAL” BE IT ORDAINED, by the Sangguniang Panlungsod of the City of El Salvador in session assembled that: SECTION 1. Declaration of Policy. – It is hereby the policy of the City Government of El Salvador to undertake a comprehensive and continuing program which shall uplift the conditions of the underprivileged and homeless citizens in urban, rural and in public lands by making available to them decent housing and basic services at affordable cost. SECTION 2. Definition of Terms. – For purposes of understanding and guidance, the terms herein used shall be defined as follows: 1. Beneficiary - Any person/persons who meet the requirements set forth in this Ordinance or as provided for in the RA 7279, otherwise known as Urban Development and hOusing Act of 1992 is qualified or entitled to acquire either a house and lot or lot only. 2. Surveyed Household – Any household who is included in the profiling of the would-be beneficiaries as determined by the Selection Committee. 3. Household – A group of persons who lives in the same dwelling unit and have a common arrangement for the preparation and consumption of food. 4. Household Head – The legitimate and head of the family with at least one dependent entitled to a support within a structure. 5. Resettlement Areas – Refer to areas identified by the appropriate national agency or by local government unit with respect to areas within its territorial jurisdiction, which shall be used for the relocation of the would-be beneficiaries. 6. Socialized Housing – Refers to the housing program and projects covering house and lot or homelot only undertaken by the government or the private sector for the underprivileged and homeless citizens which shall include sites and services development, long term financing, flexible terms on interest payments, and such other benefits in accordance with the provisions of R.A. 7279. 7. Underprivileged and Homeless Citizens – Refer to the beneficiaries of the R.A 7279 and to individuals or families residing in urban and rural areas, whose income or combined household income fails within the poverty threshold as defined by the National Economic
  • 3. ASP/dunn10072019 and Development Authority (NEDA) and who do not own housing facilities. This shall include those who live on makeshift dwelling units and do not enjoy security of tenure. 8. Affordable Price - Refers to the most reasonable price of land and shelter based on the needs and financial capability of would-be beneficiaries and appropriate financing schemes. 9. Joint Venture – Refers to the commitment or agreement entered into by and between two (2) or more persons to carry out a specific or single business enterprises for their mutual benefit to which purpose they combine their funds, land resources, facilities and services. 10. Amortization Payments – A regular instalment to be collected by the City Treasury Office from the beneficiary –awardee of the housing program. 11. Infrastructure Cost/Development Cost – The expenses incurred in the construction of roads, footpaths, alleys, drainage, bridges, public utilities and other physical horizontal facilities in the project site. 12. Land Acquisition Cost – The expenses incurred in the purchase of lots to be developed as housing sites. 13. Transfer of Rights Through Succession – Means that in case of death of beneficiary- awardee, the surviving spouse shall succeed both the rights and obligations of the deceased spouse. However, in case of death or permanent incapacity of both parents, the legal successor in interests of both parents shall be considered as successor. SECTION 3. Beneficiary Selection and Lot Allocation. – Any qualified beneficiary shall only be entitled to one lot. In the awarding and allocation of residential lots, the beneficiaries are as follows: 1. Households affected by the implementation of infrastructure and development effort of the City. 2. Those affected by natural and man-made calamities, and those provided under RA 7279. 3. Households who are living in Environmentally Critical Areas (ECA) such as but not limited to esteros, landslide prone, garbage dump, riverbanks, shorelines, waterways, sidewalks, roads, parks, playgrounds and other public places. 4. Households issued with court ejectment orders for demolition and those qualified under RA 7279. 5. Landless City Hall employees. 6. Must not be a professional squatter or a member of squatting syndicates. SECTION 4. Priority in the Awarding of Housing Unit or Home Lot. – In awarding the Housing Unit or Home Lot, or both, the following shall be given preference: a. First Priority – Paragraphs 1 and 2, Section 3 of this Ordinance shall apply. b. Second Priority – Paragraphs 3 and 4, Section 3 of this Ordinance shall apply. c. Third Priority – Paragraph 5, Section 3 of this Ordinance shall apply. SECTION 5. Basic Qualification of a Beneficiary. - To qualify as beneficiary, he or she must have the following qualifications: 1. A Filipino citizen of legal age; 2. Head of the family with at least one (1) dependent living within a structure; 3. Must be an underprivileged and homeless citizen, as defined in Section 3 of R.A. 7279; 4. Must not be a beneficiary of any housing project and/or lot acquisition program from the government or any private entity; 5. Must not be a professional squatter or a member of squatting syndicates; 6. Is a bonafide citizen or has permanent residence of El Salvador City;
  • 4. ASP/dunn10072019 7. Those occupants under existing resettlement project are not covered by the above qualifications. SECTION 6. Prohibitions and Limitations: 1. House and lot or lots awarded including improvements therein shall not be transferable except on the following circumstances: a. Succession. b. After five (5) years upon full payment of the amortization, such lot may be transferred to the next beneficiary. c. Execution of final transfer of ownership shall only be made after full payment of purchase price. 2. No transfer by onerous or gratuitous manner shall be allowed within the prohibition period. Any transfer or assignment made is null and void. 3. Sell, transfer or dispose of beneficiary’s right is hereby strictly prohibited. SECTION 7. Project Cost. – Awardee or beneficiary shall be charged for project cost from which they derived specific benefits. Costs shall include the following: 1. Cost of land. 2. Land development cost to include the onsite infrastructure like construction of roads, footpaths, alleys, drainage, bridges, public utilities, technical supervision, administrative/management cost and collection charges of the total cost and the like. SECTION 8. Unit Cost. – The actual price per square meter shall be determined by dividing the recoverable investment by the total saleable area for the lot only, while for the housing component, it shall be determined by the total house cost without inflation rate. The detailed total cost and monthly amortization to be paid by the beneficiary shall be indicated in the contract agreement between the City Government of El Salvador and the identified beneficiary. SECTION 9.Construction. – The type of unit construction will be determined by the City Housing Board. SECTION 10. Collection and Default. – The City Treasurer has the sole responsibility for the collection of amortization payments and other revenue which may be generated under this project, and as per Updated Local Revenue Code. A qualified awardee/beneficiary shall pay to the City Treasury a down payment of at least Three Percent (3%) of the total selling price upon the execution of the contract and immediately thereafter. The amortization shall be paid within the first five (5) days upon due date. A penalty of Two Percent (2%) per month shall be imposed for late payment. Failure to pay three (3) consecutive monthly amortization. Including the surcharges thereof shall make the whole amount and demandable which shall be paid within one (1) month from the time of demand. SECTION 11. Priorities in the Acquisition of Land. – Lands for socialized housing shall be acquired in the following order: a. Those owned by the Government or any of its subdivision, instrumentalities, or agencies, including government-owned or controlled corporations and their subsidiaries; b. Alienable lands of the public domain; c. Unregistered or abandoned and idle lands;

Those within the declared Areas for Priority Development, Zonal Improvement Program sites, and Slum Improvement and Resettlement Program sites which have not yet been acquired; e. Bagong Lipunan Improvement Sites and Services or BLISS sites which have not yet been acquired; and f. Privately owned lands. SECTION 12. Implementation. – The City of El Salvador Housing and Urban Development Office (CESHUDO) shall be primarily responsible for the effective implementation of the provisions of this Ordinance. SECTION 13. Effectivity. – This Ordinance shall take effect upon its approval. APPROVED. Lopez City Councilor RESOLUTIONNO.095-A–S.2019 “RESOLUTIONTOPASSANORDINANCEPROHIBITINGTHEBRINGINGINTO,SNEAKING, USINGANDCARRYINGANYFORMOFCONTRABANDINSIDEJAILSANDDETENTIONPLACES INTHECITYOFELSALVADOR,PROVINCEOFMISAMISORIENTALANDPROVIDING PENALTIESFORVIOLATIONTHEREOF” WHEREAS, Section 5, Article II of the 1987 Philippine Constitution provides that “The maintenance of peace and order the protection of life, liberty and property, and the promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy”. Consistent with this policy the government established jails and detention centers for the safekeeping of those awaiting trial, convicted felons and offenders for the protection of the general public; WHEREAS, Sec. 16 of RA 7160 otherwise known as the Local Government Code of 1991 mandates that “Every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its Republic of the Philippines Province of Misamis Oriental CITY OF EL SALVADOR -oOo- OFFICE OF THE SANGGUNIANG PANLUNGSOD

ASP/dunn10072019 efficient and effective governance, and those which are essential to the promotion of the general welfare”; WHEREAS, Section II (a) Article IV of RA 9435 also known as the Charter of the City of El Salvador provides in part that, “The Sangguniang Panlungsod, as the Legislative Body of the City, shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the City and its inhabitants pursuant to Section 16 of the Local Government Code and in the proper exercise of the corporate powers of the City as provided for under Section 22 of the Local Government Code; WHEREAS, the Bureau of Jail Management and Penology (BJMP) was created pursuant to Sec. 60 to 65 of Chapter V, Republic Act No. 6975. The BJMP is mandated to supervise and control the administration and operation of all district, city and municipal jails nationwide with pronged tasks of safekeeping and development of inmates; WHEREAS, there is a need to adopt an Ordinance regulating entry of illegal paraphernalia at the BJMP premises; NOWTHEREFORE, after thorough deliberation on the Matter and on Motion of Hon. Nilo T. Pates, Unanimously Seconded, it was RESOLVED,as this Body hereby resolves to approve and adopt the following Ordinance. ORDINANCENO.03-A-S.2019 Authored By: Hon. Nilo T. Pates “ANORDINANCEPROHIBITINGTHEBRINGINGINTO,SNEAKING,USINGANDCARRYINGANY FORMOFCONTRABANDINSIDEJAILSANDDETENTIONPLACESINTHECITYOFEL SALVADOR,PROVINCEOFMISAMISORIENTALANDPROVIDINGPENALTIESFORVIOLATION THEREOF” BE IT ORDAINED by the Sangguniang Panlungsod of the City of El Salvador in regular session assembled, that SECTION 1. Title. This Ordinance shall be known as “An Ordinance Prohibiting the Bringing into, Sneaking, Using and Carrying any form of Contraband inside Jails and Detention Places in the City of El Salvador, Province of Misamis Oriental and providing penalties for violation thereof”. SECTION 2. Purpose. This Ordinance is enacted for the following purpose: a. To strengthen the implementation of security measures imposed by jails and detention places.
  • 8. ASP/dunn10072019 b. To prevent the occurrence of deaths, riots, hostage taking and escape of inmates by prohibiting the possession and entry of deadly and bladed weapons. c. To prevent the inmates from coercing, intimidating, threatening complainant/s and witness/es or order retaliation, orchestrate crimes and organize rescue plan by prohibiting a possession and entry of cellular phones and other electronic gadgets for used for communication. d. To prevent the inmates from bribing jail officers or custodians by prohibiting the possess of excessive amount of money in cash or check inside the jails detention places, and e. To safeguard public health and well-being of the inmates by penalizing the possession and entry of illegal drugs, cigarette and tobacco. SECTION 3. Definition of Terms. As used in this Ordinance the following shall be construed to mean as follows: 3.1. Jail and Detention Places – Refers to a place of confinement for persons under arrest awaiting for the filing of formal charge in court or those awaiting trial or serving sentence. This term also includes rehabilitation centers, lockups, kalasag, juvenile homes, hospitals and other facilities ordered by the court to be the place of the inmates/prisoners temporarily confinement. 3.2.Contraband – Refers to items specifically prohibited by the jail and detention management to be brought in or inside the facility. For purposes of the applicability of this Ordinance the term “Contraband” shall only be limited to the following items: 1. Deadly and bladed weapons/firearms or any parts thereof, improvised explosive device and any possible components such as electric wires, batteries, fertilizers, etc. and ammunition; 2. Metal cutting saw or blades and digging tools not permitted by the jail/detention; 3. Cigarette, E-Cigarette and other tobacco products; 4. Match and lighters; 5. Liquor, beer, coconut wine and other intoxicating beverages; 6. Prohibited dugs and paraphernalia; 7. Cash which is more than prescribed allowable, to include checks; 8. Mobile phones and electronic communication devices; 9. Pornographic materials; 10. Gambling paraphernalia, and; 11. Other items or products that prohibited by the Jail and Detention Place Management.
  • 9. ASP/dunn10072019 3.3. Deadly and Bladed Weapon – Refers to any object which in the manner used is capable of producing death, or of inflicting great bodily injury, or seriously wounding. 3.4. Prohibiting Drugs and Paraphernalia – Refers to the prohibited drugs and paraphernalia defined under Republic Act No. 9165 or the “Comprehensive Dangerous Drug Act of 2002”. 3.5.Mobile Phone – Also known as cellular phone, cell phone or hand phone; refers to device that can make and receive telephone calls/communication by connecting to a cellular network allowing access to the public telephone network. It supports a wide variety of other services such as text messaging, MMS, email, internet access, short range wireless communications (infrared, Bluetooth), business applications, gaming and photography. 3.6. Electronic Communication Device – Includes any computer, personal digital assistant, cellular telephone, digital camera or camcorder, pager, two-way radio, or other similar thereto. 3.7. Pornographic Materials - Refers to any publication, images, either in printed or digital form mainly focusing on obscene image of intimate body parts, either directly or implicitly, making it sexually explicit and contrary to public policy, public order, good customs and moral standards. 3.8. Gambling Paraphernalia – Refers to equipment used for the game or cockfighting, jueteng, bookies (jai-alai or horse raising to include game fixing) and other lotteries, cara y cruz or pompiang and the like, black jack, lucky nine, pusoy or Russian Poker monte, baccarat and other card games, plaque domino, mahjong, high and low, roulette, pinball and other mechanical inventories or devices, seven-eleven dice games and the like. 3.9. Pat Search – Consist of the removal of outer protective clothing, the emptying of pockets, the physical search, screening by device which does not require disrobing and the inspection of papers, bags, books, or other items being carried. 3.10. Person – Any Juridical or Natural persons also applies to Persons Deprived of Liberty (PDL) and those entering jail and detention cell as guest/visitor. SECTION 4. Prohibited Acts. Any person who willfully possess, sneak/carry/use attempt to sneak/carry or cause or attempt to cause to be brought into the jail/detention place/s any contraband as defined by Section 3, Sub-paragraph 3.2 of this Ordinance. SECTION 5. The same prohibition and penalties shall apply to BJMP Officials and Personnel found to be in cahoots with inmates or proven to aid or have aided the sneaking-in and smuggle of contraband inside the BJMP Jail Facility and or have aided the escape of an inmate or inmates. Any BJMP Personnel found guilty of violating this Ordinance or when evidence of guilt is strong against the BJMP Personnel shall be placed immediately or preventive suspension and be subjected to necessary summary dismissed proceedings as provided for in the rules of the BJMP charter. SECTION 5. Penalties. Violation of the preceding section shall be meted the following penalties, viz:

Second Offense – Fine amounting to Php 5,000.00 and imprisonment for One (1) Year. 5.3. Third Offense – Fine amounting to Php 5,000.00 and perpetual ban of visiting privilege and imprisonment for One (1) Year at the discretion of the court. SECTION 6. Accessory Penalty. All Contrabands confiscated in the enforcement of this Ordinance shall be forfeited in favor of the government. SECTION 7. Enforcement. All jails and detention places are mandated to conduct pat search on any person, including organic or non-organic personnel entering their facilities. All Jails and Detention places are mandated to post a notice in a conspicuous place the items defined and penalized in this Ordinance as contraband. Prior to the conduct to the of pat search, the person entering the jail shall be given opportunity or advised to surrender or removed from their possession or belongings any item considered contraband. Upon declaration that he or she has no more items to surrender or be removed the jail/detention personnel shall search the person and his/her belongings and considered found in him/her or his/her belongings shall be presumed willfully possessed. SECTION 8. Separate and Independent Offense. Violation of the Ordinance shall not be absorbed by any other crime or felony committed as consequence and shall be treated as a separate and independent criminal act whose penalties shall be imposable without prejudice to any other criminal liability provided for other applicable penal laws. SECTION 9. Repealing Clause. All Ordinances or any part thereof, which are contrary to or inconsistent with the provisions of this Ordinance are repealed or amended accordingly. SECTION 10. Separability Clause. If any part or provision of this Ordinance is declared unconstitutional or invalid, the other provisions not so declared and not affected by such declaration shall remain in full force and effect. SECTION 11. Effectivity Clause. This Ordinance shall take effect after publication in a newspaper of general circulation or posting in three conspicuous public places in the City. APPROVED. But we must not allow hysteria and paranoia to result in irrational treatment of people; WHEREAS, there have been several reported incidents of people being evicted out of their residences or after having recovered from the illness were prevented from returning back to their residences, while some were even doused with water and were refused services in eateries or transportationsoverfearsof infection;Some were shunned by local stores, boarding houses, and even theirownbarangaysand homes.Several falseandinaccurate social media posts even circulated online spreading names of people alleged to have been infected with COVID-19; WHEREAS, considering the gravity of the situation, there is an urgent need to combat this pervasive stigmatization on the basis of one’s medical condition; There is a need for the City to bring normalcyand orderamidstthe crisis,andprotectits constituencyfromunjustdiscriminationbroughton by fear and panic by public; WHEREAS, it is at this trying times, families who are affected by this pandemic suffer severe anxiety and social humiliation. Health workers include, among others, doctors, nurses, hospital and clinic aides, and laboratory technicians. Frontliner include officers and members of the PNP, AFP, PCG and instrumentalities of the government rendering emergency frontline services, border control and other critical services. Frontliners also include service workers who are working in private establishments providing basic necessities and such activities related to food and medicine, i.e. public markets, supermarkets, groceries,convenience stores,hospitals,medical clinics, pharmacies and drug stores, food preparation and delivery services, water-refilling stations, manufacturing and processing plants of basic food productsand medicines,banks,moneytransferservices,power,energy,telecommunications and water supplies and other related facilities. SECTION 3. UNLAWFULACTS. –It shall be unlawful for any person, whether natural or juridical, to commit any act or make utterances which cause or tend to cause stigma, disgrace, shame, humiliation,harassment or otherwise discriminating against a person infected, under investigation or monitoring due to Covid-19, health worker or frontliner as defined under his Ordinance. Purpose. – It is the purpose of this Ordinance for the City Government of El Salvador to assist the public schools in keeping school-children by making the start of classes exciting and as safe as possible. SECTION 3. Coverage. – This Ordinance shall apply to all public schools within the territorial jurisdiction of the City Government of El Salvador. SECTION 4. Definition of Terms. – As used in this Ordinance, the terms below have the meanings ascribed to them in this section. Any words or terms not defined shall be given their plain and customary meanings, unless the context requires otherwise, and shall be interpreted in a manner consistent with the purpose and spirit of this Ordinance. a. Brigada Eskwela – refers to the annual school maintenance program of the Department of Education. b. Community Participation – refers to widest support of the Barangay residents through the Barangay Council members, Purok Officials, Non-government and People’s Organizations, Civil Society Organizations, including cooperatives, accredited or recognized by the Sangguniang Panlungsod, actively participating in Brigada Eskwela activities. c. MSGC – is an acronym of Multi-Sectoral Governance Council represented by various sectors of society organized as partner of the City Government of El Salvador. d. Public Schools – refer to schools operated by the Department of Education within the jurisdiction of the City of El Salvador. e. Task Force Brigada Eskwela – a group of individuals representing the Department of Education, City Government of El Salvador, Association of Barangay Captains/Councils, Community Parents and Teachers Association, with support staff and Secretariat from the Dep Ed herein created with specific duties and functions. SECTION 5. Support to Brigada Eskwela. – The City Government shall allocate annually a reasonable amount to the Department of Education – El Salvador City Division for the Brigada Eskwela Program . This amount may be increased, upon recommendation of the Task Force Brigada Eskwela herein created, and subject to availability of funds as certified by the Local Finance Committee. In the same matter, the Office of the Sanggunian shall appropriate ample amount for this purpose charged to the sanggunian members Legislative Social Funds, amount shall be upon the discretion of each legislators in support to the program. There is hereby created the Task Force Brigada Eskwela with the composition, duties and functions as follows: COMPOSITION: Chairperson: City Mayor Co-chair: Schools Division Superintendent Members: -Division Federation of Parents – Teachers Association (DFPTA) President -President, Association of Barangay Captains -President, El Salvador Chamber of Commerce -President, Multi-Sectoral Governance Council Secretariat: -Brigada Ekswela Division Coordinator -Chairman, Committee on Education of the Sannguniang Panlungsod -Secretary, City Scholarship Advisory Council (SCAC) DUTIES AND FUNCTIONS: a) Prepare Activity Design containing, among others, the specific activities sought o be undertaken for Brigada Eskwela, and the materials to be procured; b) Strategize full community participation in every barangay; c) Facilitate the conduct of Search for Best Community Participation in Brigada Eskwela Program; d) Monitor and evaluate of implementation; e) Recommend policy changes to enhance Brigada Eskwela program for appropriate action by the DepEd and City Government of El Salvador; f) Submit annual post-activity report to the City Government through the Office of the City Mayor, Sangguniang Panlungsod and the Department of Education – El Salvador City Division, showing, among others, how the support funds were used, extent of community participation, and the same shall be posted in three (3) conspicuous places in the City. g) Perform such other related functions and those may be assigned by the City Mayor and Division Superintendent. SECTION 8. Community Empowerment Policy. – For a more participatory and institutional implementation of Brigada Eskwela program, aside from financial support of the City Government of El Salvador under Section 6 hereof, any and all participating schools are encouraged to campaign for wider participation of their respective CPTAs and the whole community under the concept of self-help and self-reliance in improving their respective schools before the start of classes. For this purpose, any further solicitations shall be minimized and discouraged.

Support of the Barangays. – All Barangays shall be required to allocate funds in support to the implementation of Brigada Eskwela program in their respective barangas. For this purpose, the Local Finance Committee of the City of El Salvador is hereby directed to include in the initial review of the Annual Budget of every barangay compliance with the provision of this Section to form part of its comments and recommendation to the Sanngguniang Panlungsod. SECTION 10. Joint Implementation. – To carry out the purpose of this Ordinance, the City Mayor is hereby authorized to issue appropriate orders, including the determination of members of the Task Force Brigada Eskwela to represent the City Government. The Division Superintendent is likewise authorized to designate Dep Ed representative to Task Force Brigada Eskwela and the Secretariat. SECTION 11. Collective Undertaking. – The City Government and the Department of Education shall strengthen their joint efforts and to engage widest community participation particularly the barangay residents through their Barangay Council, Purok Officials, Non- Government and People’s Organizations, Civil Society Organizations, cooperatives, to actively participate in Brigada Eskwela program. SECTION 12. Repealing Clause. – All ordinances, resolutions and related issuances or measures that are contrary to or inconsistent with this Ordinance are hereby repealed or modified accordingly. SECTION 13. Separability. – If any part or provision of this Ordinance is declared unconstitutional or invalid, the same shall not affect the validity and effectivity of the other parts or provision thereof. SECTION 14. Effectivity Clause. – This Ordinance shall take effect upon approval. APPROVED.
