eing the second pillar of the constitution, the
Bjudiciary plays a vital role in ensuring that each
sector of the government knows and follows
the limits of their power. It also protects civil rights. The
Supreme Court of India, particularly, has the power to
ensure that the laws do not violate the constitution of
the country. In case it does, the Supreme Court has the
right to cross out such laws.
The supreme judicial body of the country, the Supreme
Court of India not only shoulders the enormous
responsibility of delivering justice but also has the
powers of judicial review. The judgements passed by
the Supreme Court are followed in all the courts of law.
Resultantly, the onus of the lawyers of Supreme Court
are also massive. Only lawyers who are registered with
the Supreme Court are permitted to appear for cases
and plead for their clients in the court. Lawyers who are
designated as senior lawyers by the Supreme Court
can appear for their client along with a registered
lawyer.
The Supreme Court takes up verdicts of the High
Courts and other courts to settle disputes between
governments or people and government. The lawyers
serving in such a court of law therefore needs to be
well-versed with the uniform laws, the laws of the
states, minority and other laws and the case that they
would be representing. Besides, there are certain
etiquettes that lawyers must follow.

DELIVERY OF
JUSTICE
Advocacy is considered as a noble profession and
looked up to. The most challenging task for lawyers is
to have the client’s interest in mind while arguing the
case while at the same time following the ethics
crafted for lawyers. Maintaining the decorum of the
court and presenting himself/herself in a dignified
manner irrespective of the case that the lawyer is
arguing or the person he is cross-questioning needs lot
of patience, self-control, and balance.
The lawyer must uphold the dignity of the court, his
opponent/colleague, the judge and all the concerned
parties. Thus, the lawyer’s duty is not just towards the
client or the court but towards himself, the opponent,
the accused, and the judge. Through their arguments
and findings, they also aid in quick disposal of the case
and consequently quicker judgements.

For Mr. Jayprakash, every case is
equally fascinating. No matter if
it is a bail case or an insolvency case, he is uniformly
dedicated to each of them. He says, "The sections and
matter at hand might be the same, but every case has its
distinct identity". Hence, in every case, he puts equal
efforts.
For him, law is not a routinized profession; he believes that
in every case, lawyers come across unique facts, which are
essential. He states, "Cases may fall under the same section,
but the facts are completely different".
Surmounting all Odds Confidently
Mr Jayprakash says that the profession of law is not filled
with roses. There are many challenges which he had to
overcome. Speaking about one of his cases, he tells, "Once
a poor woman approached to fight her case. Her opponents
were very influential and strong. They contacted me to lose
the case. They offered me money, but I rejected".
Consequently, he received numerous threats, but he never
backed down.
Furthermore, he took up the poor client's case at a very less
fee. Sharing his experience of this case, Mr Jayprakash
states that even though the opposite party offers lucrative
rewards or threatens a lawyer, they should not give up and
fight for truth and justice.
Overcoming the Pandemic with a Game Face
According to Mr Jayprakash, the Supreme Court is
efficiently tackling the challenges imposed by the COVID-
19 pandemic. It is working towards providing justice to the
right party, in the right way. The court does not remain
closed even for a single day. Depending on the seriousness
of the case, the court remains open even on Sundays. It also
operates during late nights to deliver speedy justice.
With the pandemic impacting lives and societies greatly, the
Supreme Court has also started functioning virtually.
However, speaking of the challenges of virtual courts, Mr
Jayprakash states that it becomes difficult to train new
lawyers. He says, "It is feasible to attend courts and learn
from the senior lawyers face to face is feasible in physical
courts. The same cannot be achieved through virtual
courts." Accordingly, it becomes difficult for budding
lawyers to virtually learn from any ongoing case.
However, he states that hybrid court hearings have started,
which is a combination of physical and virtual hearings.
Advocates will get the opportunity to opt for either physical
or virtual hearing, or an amalgamation of both. Mr
Jayprakash emphasizes on using both virtual and physical
courts for smooth functioning of the legal system.

Throughout his stellar career of delivering justice and
upholding the law, Mr. Jayprakash has made various
accomplishments. He has received numerous awards owing
to his dedicated endeavours in the field of law. These

· Mr. Jayprakash has written the book 'Supreme Court of
India's Leading Case Laws on Insolvency & Bankruptcy
Code 2016'. This book is related to the Supreme Court of
India's 35 leading case laws on insolvency and
bankruptcy code 2016. It contains relevant sections, case
notes, facts of the case, findings of the Hon'ble apex court,
ratio decidendi if any and citations are given for each
case.
· Mr. Jayprakash was recognized by Guru Shree Shantivijai
College for Women for conducting a special program on
"Opportunities in global and foreign trade”
· He received an award from Mahakal Chamber of
Commerce and Industry on its golden jubilee
· He received recognition from Shri Ramdeobaba College
of Engineering and Management
· He was recognized by Bhartiya Jain Sangathana, Indore

law, Mr Jayprakash states that today, there is an abundance
of career opportunities for students pursuing law. They can
enter the corporate sector and can also pursue career in
cyber laws, insolvency and bankruptcy law, and many
more. He is of the opinion that young lawyers can also try
their mettle in Indian law services such IPOs and so on.
Mr Jayprakash states that no matter which profession an
individual chooses, they should perform it with utmost
dedication. He says, "Law is a very interesting subject.
There is not a single day where I get bored studying about
new laws". He further adds, "When I used to be a student, I
used to gather new information a day. This would help me
to enhance my knowledge."
Mr Jayprakash further says that in monetary terms, legal
field is very lucrative. It is an excellent arena to explore
one's potential and evolve as a professional. He adds,
"When you grow, then clients are ready to pay more. When
they see your talent, when they see your dedication, they
are always ready to provide you with suitable
remuneration."

Talking about his future plans, Mr. Jayprakash said that he

wants to provide law students and emerging lawyers with
updated information regarding different laws and aspects of
the Indian legal system.
Mr Jayprakash's ambition is to publish videos on each law,
so that every newcomer in the legal arena can learn about
changing laws.
Advice for the Lawyers of Tomorrow
Mr Jayprakash advises the budding lawyers to dedicate
three to four years in mastering themselves in the legal
profession. He says that young lawyers should abstain from
taking bribes. He advises them to read and stay updated
with procedural laws. Furthermore, reading one judgment
of high court and one judgment of supreme court on a
regular basis will sharpen their knowledge. Mr Jayprakash
says that this will help them to excel in their profession.

Digitalization is constantly growing every other
day. We can see major impacts of digitalization all
over the world. Advent of internet brought
advancements in mobile phones, social media, and other
applications.
Digitalization has boosted globalization, bringing together
people from different countries. Now it has become a
hassle-free task to do things which were once a complicated
task. This is mainly because services have shaped them-
selves drastically. People can buy goods, connect with
people, fill forms online, etc. The tasks now done on the
internet are effortless and this has been possible because the
world is connected.
There are some areas where digitalization is not very
advanced. The people stuck in court cases cannot finish
their cases in time. The advent of the pandemic has caused
the legal industry to freeze its functioning. A lot of cases are
still pending in the legal organizations. Digitalization in the
legal issues is fragile in India. The attorneys and the parties
have to be present in the court for proceedings of the case.

of litigations. There is a need for social distancing to
eliminate the risk to get hold of the deadly Covid-19
pandemic. There is a way to attend hearings, trials virtually.

such as the attorney, judge, and the parties, can go further
by attending virtual video meets to resolve the issues. This
is safe yet effective mode of communication to bypass the
disease and simultaneously getting the work done.

1) AI Judgements
As the artificial intelligence industry is in enormous

cases. As the laws, ordinances, rules, regulations, code of
conduct, guidelines can be found on the internet, it can act
as resolving conflicts between parties and deriving a final
conclusion. AI can develop and alter its decisions according
to the existing laws. It can be a moral tool to disintegrate
disputes. The judgements produced by AI can be accom-
plished in the long run.
2) Legal Assistance Applications
Applications can be developed where there will be an input
of the legal database, with all the laws and ordinances that
are formed by the government. To acknowledge the
audiences and make them aware about the effects of
wrongdoing in the society. This can be a dictionary of
lawful activities where the parties can find solutions if they
are experiencing conflicts with other party.

Please brief our audience about your law firm, its
values, vision, and mission.
Chambers of S.S. Ahluwalia is a chamber litigation
practice. Mr. Ahluwalia is a third-generation lawyer. His
father Mr. A.P.S Ahluwalia is a designated Senior Advocate,
and his grandfather, Mr. Kuldeep Singh Ahluwalia too was
an advocate in the pre-independence era. Being one of the
oldest and established law practices, it is known for
professionalism, ethics, pragmatic, and cost-effective legal
advice. Mr. Ahluwalia has successfully represented both
domestic and multinational companies, banks, government
and charitable organizations, high profile individuals
including those from weaker sections of society and jail
inmates; on various legal issues across all lower courts (in
Delhi NCR), the Delhi High Court and the Supreme Court
of India, appellate tribunals, and other quasi-judicial bodies.

Brief us on how you have made an impact in the Indian
legal sector through your services?
Belonging to a family of lawyers, Mr. Ahluwalia was
fortunate to witness the changing landscape of litigation in
India. While it has always been shared and echoed that
there should be "right of equal access to justice for all" but
it is also very evident that at times it is not accessible to
certain deserving one/s sections of the economy. Without a
doubt lawyers' time is very valuable and he must work for
his clients, yet as one of the important members and
custodian of the society, he must act to create a balance to
ensure justice and fairness.
Therefore, the profession demands putting aside some time
for providing legal aid to the deserving one/s who cannot
afford legal help. It is with this notion of doing his bit
towards the betterment of the society, Mr. Ahluwalia has
been associated with the Delhi High Court Legal Aid
Services Committee (DHCLSC) providing legal assistance
before the Hon'ble High Court. He has been appearing as
Amicus Curae before Hon'ble High Court and also as a
mediator at the Delhi High Court mediation center. Though
it may not be much, but any bit of legal service helps the
system of the country.
Brief us about yourself and your journey in the legal
industry.
'My father repeatedly reminds me that youth of lawyer is
lost at his table'.
Post his LL.M. from Cardiff University, Mr. Ahluwalia
started his career as a corporate lawyer at JSA. Having
worked for couple of years and given the growing fondness
for litigation (courtesy family practice), started taking
interest in adversarial matters.
Having understood the commercial interests of clients (as a
corporate lawyer), assessing legal risks / potential
disputable clauses and charting a way forward for minimum
disruptions started getting easier. Having said so, moving
from the comforts of corporate lawyer and joining the
litigation practice was not easy for Mr. Ahluwalia.
As a third-generation lawyer and being the son of senior
advocate, the expectation of client has always been very
high for Mr. Ahluwalia and even the court takes note of
performance.
Mr. Ahluwalia narrates that as a litigation lawyer one must
face the judge, opposite lawyer, and the client. So, lawyer's
job is not only to argue the case but also to built-up a case
as per law. Evenings are spent in preparation of briefs and
updating with legal reporters. He reads seven daily
reporters, to remain updated.
From his initial days till now, he has more than 50
judgments reported in his name, in a career spanning 17
years. For upcoming lawyers, he advises that the initial
years as litigation lawyer are tough. Learning has a cost,
and the initial remuneration says it all. However, with
experience and knowledge, it does tend to pay off. Since
every day is not green, hence one must also learn to save
for the rainy days.
What were the challenges you came across when you
decided to start a venture that catered to the legal
services sector?
Mr. Ahluwalia's entry to the profession was easy - being a
third-generation lawyer; and given that the basic
infrastructure and connections were already in place.
However, he emphasizes that the biggest challenge and a
fundamental requirement for a successful career, is to earn
the trust of the client. For building trust, a lawyer needs to
deliver desired results for his clients. It can only be earned
through hard work, ethics, knowledge gained through
experience, and the results achieved for the clients. For Mr.
Ahluwalia, the immediate challenge was to first build a
client base and then retain them – both took time. In

addition to the above, he believes that in this competitive
profession, it is not enough to have high billings; being
genuine, compassionate, and approachable is equally
important for a more fruitful and longer career. Despite his
achievements, he feels that creating a legacy like his father
will require him to strike a balance on the above.
Taking into consideration, the current pandemic, and its
impact on global economies, how are you driving your
firm to sustain operations and ensuring safety of your
employees at the same time?
With a series of lockdowns and non-functional courts,
Covid-19 probably presented the biggest challenge to the
lawyers, particularly the litigators. All business sectors
including the legal sector were deeply impacted. The initial
phase was very tough with a complete lockdown, poor cash
flows, increasing costs and a lot of uncertainties. Having
understood the importance and dependency on technology,
Mr. Ahluwalia erected the required infrastructure for virtual
office for supporting and seamlessly communicating with
clients. Anticipating a possible surge in arbitration works,
he further utilized his time to complete an online course on
International Arbitration from the Eiden University.
Team is very important for running a successful litigation
practice and throughout the lockdown, he ensured that the
team is engaged (in other knowledge building activities,
creating an IT enabled repository of all data/ information
available in the office, ensuring its safety, security, and
availability) and well taken care of.
This period allowed him to concentrate on some thought
leadership initiatives including penning down a few articles
which got published across legal publications and
organizing a few webinars including those on ICSID and
Force Majeure.
With passage of time and relaxation on the restrictions, Mr.
Ahluwalia focused on employment and compliance related
advisory work from our existing clients across sectors. He
further collaborated with few other firms from south and
western India to source work and develop sharable
knowledge through online initiatives.
No office can function without the effective support of the
staff. Despite all hardships he continued to support his
junior colleagues and court clerks with sufficient salary and
monthly allowance for grocery in order to meet their ends
comfortably. The pandemic has helped him to evolve as a
more compassionate, accommodating, independent and tech
savvy lawyer.
What would be your advice to budding entrepreneurs
who aspire to venture into the legal services sector?
Mr. Ahluwalia echoes his dad's thoughts, which says
"Goodwill flows faster than the water". Lawyers willing to
make a name for themselves must invest in building their
goodwill through hardwork, perseverance, patience, and
above all via continued legal education. Money and profits
cannot be the focus. The lawyer lives on his goodwill and
goodwill lives farther than the lawyer. Every senior lawyer
is always known because of his goodwill.
Where do you envision your firm to be in the long run
and what are your future goals?
To Mr. Ahluwalia "Success is both relative and seasonal" –
i.e. it is different for different people and changes over time.
In the long run besides running a very successful Law
practice and creating a legacy like his father, Mr. Ahluwalia
would like to take up more social causes and even teaching.
In addition to the positive outcomes for their clients, a
lawyer yearns for knowledge, appreciation for his
contribution towards the profession and the society at large.
Hence, he aspires to transform from a good lawyer to a
great lawyer.

leaps and bounds. Nowadays, it appears that
everyone has a profile on various platforms. This
has also become a significant aspect of the legal sector. For
individuals working in the current corporate world,
including the legal profession, social media offers a
plethora of opportunities. As a lawyer, you may use social
media to grow your practise while also building a positive
reputation among potential customers.
In many respects, social networking may help lawyers
progress their careers by allowing them to interact with
peers and local practises in their area. Twitter, Facebook,
LinkedIn, and Google + are some of the most prominent
platforms in the legal business. When these channels are
handled properly, social media may yield significant
returns, making the effort worthwhile. Attorneys can
employ a few social media methods to their advantage.
To begin with, social media is effective at amplifying blogs,
articles, and opinions. It is a fantastic idea to share a new
article on social media platforms when someone publishes a
new piece on his or her legal website. To increase traffic to
the piece itself, lawyers can tweet or publish a link to it on

The Context of Social Media Environment
The concept of social media defies formal definition due to
its ever-evolving nature, although it is often seen as a by-
product of the growth of Web 2.0, which allows all users to
create and apply web content in a participatory and
collaborative manner. A key focal point of the social media
context has been the relative simplicity with which people
with similar personal and/or professional interests can build
an online profile, post information about their interests, and
engage with others on a website. Such interactions could
take the shape of people sharing their thoughts, experiences,
films, and photographs via online tools like blogs, message
boards, podcasts, wikis, and vlogs. The rise of social
networking sites (SNS) such as Facebook, LinkedIn,
Twitter, Myspace, YouTube, Wikipedia, and Google Plus, to
name a few, has been one of the most significant
developments contributing to the ever-changing character
of the social media context.
Here are five guidelines to help you avoid getting into
problems on various social networking platforms:
Online Contests & Promotions
Online contests and promotions are a great way to get your
name out there. Examine the platform's Terms of Service
(TOS) or other equivalent standards. These are the
guidelines that must be followed. Facebook provides some
extremely detailed instructions. “On Facebook, promotions
can be run on Pages or within applications. Personal
Timelines are not permitted to be used to manage
promotions (for example, “share on your Timeline to enter”
or “share on your friend's Timeline to gain more entries”).
Reviews
Users can discuss their experiences and submit ratings for
different businesses on sites like Yelp. Negative reviews can
be damaging to a business, so some owners may be leery of
review sites. However, some companies may have gone too
far in fighting unfavourable reviews by including
restrictions in consumer contracts prohibiting customers
from publishing negative comments about them online.
Consumers' rights to submit negative online reviews were
recently protected by a California legislation. “The bill
prohibits businesses from forcing customers into contracts
in which they waive their right to speak about the service
they receive, and it also prohibits firms from penalising
customers for such statements,” according to a Washington
Post article.
Endorsements
Disclosure is critical when bloggers and others write about
items and services on the internet. If they were paid or
given free things by a firm and then wrote about them, that
relationship must be declared in a way that the reader can
understand. To ensure that endorsements are honest and not
misleading to the public, the Federal Trade Commission
updated its Endorsement Guides to include social media.
Photographs
When it comes to photos that are shared online, social
media and the law frequently conflict. Cute baby animal
photos and elegantly prepared cupcakes can be difficult to
refuse. We want to not only gaze at them, but also share
them with our friends. Before you utilise that photo, do not
assume it's yours just because you found it on the internet.
Many, if not all, pictures are copyrighted and belong to the
photographer. Before you utilise something, try to discover
the source and get permission. Owners of protected material
may request that it be removed from sites like Pinterest,
where photographs are shared by Pinning. If you receive
information that a Pin has been removed from Pinterest due
to a copyright violation, it implies that the content of the
Pin has been removed from Pinterest at the request of the
content's owner. According to Pinterest's Copyright website,
"if your account receives too many copyright complaints,
you may lose the ability to Pin new content on Pinterest and
your account may be terminated permanently."
Employee Rights
Employers should think twice before dismissing staff based
on bad social media remarks. Employees may have the right
to vent about their bosses online in the same way that
consumers have the right to write bad evaluations about
businesses online. A recent judgement by the National
Labor Relations Board (NLRB) concerns individuals who
were unlawfully terminated by their employer for Facebook
behaviour, according to a Nixon Peabody blog post. “The
NLRB decided that the two employees did not denigrate
their employer's products or services, rather they used
social media to seek and provide mutual support for a group
activity addressing the terms and circumstances of
employment,” according to the NLRB report.
The only way to avoid walking off that figurative pier is to
keep an eye on how the legislation surrounding social
media grows.

results and perception do matter. Hence, it required a lot of
hard work and dedication to build the practice bit by bit.
Thankfully, our hard work and dedication were equally
matched by the commitment of the team and the staff,
ensuring we remain ahead of the curve despite relatively
being new to the industry as a firm.
Taking into consideration, the current pandemic, and its
impact on global economies, how are you driving your
firm to sustain operations and ensuring the safety of
your employees at the same time?
The lockdowns during Covid-19 have deeply affected the
lawyers, particularly the litigators. Besides, setting up a
fully functional virtual office for our team and the clients,
we have also ensured a regular client engagement program
and a work from home policy for our staff.

What could be the future landscape of the legal sector in
India? Would the adoption of eCourts be successful?
Indian legal sector is going through a sensitive phase, like
any other sector, it is trying to revive from the after-effects
of Covid-19. While lawyers, judiciary and the allied legal
systems are gearing up and slowly embracing technology
and virtual modes of operation, the uncertainty is still there.
Select Key Matters Handled:
• Secured significant relief for the clients before the Supreme Court of India in a loan moratorium issue, whereby compound
interest was arbitrarily charged by banks on those who availed moratoriums on loans during the covid-19 pandemic.
• Secured significant relief for the Home Buyers of Jai Prakash Limited (JAL) on the issue of disbursement of Rs. 750 Crores
(which was deposited by JAL) before the Supreme Court of India.
• Successfully represented a renowned politician of a reputed political party before the Supreme Court of India on the issue of
admissibility of electronic records under Section 65B of the Evidence Act.
• Represented a retired public servant before the Supreme Court of India on the issue of obtaining prior sanction of the
Governor for initiation of departmental inquiry and got the said issue referred to a larger bench for consideration.
• Assisted and represented a major Newspaper Publishing House before the Supreme Court in contempt proceedings arising
out of implementation of the Majithia Wage Board Recommendations for minimum protection of pay and social security to
Journalists throughout India.
• Represented and assisted a major global Chartering Company in Arbitration against its shipping disputes with Steel
Authority of India, a Maharatna Corporation of the Government of India, arising in the wake of the Global Financial Crisis
of 2009.
• Successfully represented and assisted in a matter pertaining to initiation of criminal proceedings for evasion of Stamp Duty
before the Supreme Court of India.
While the corporate lawyers have acquainted themselves to
operate in virtual mode like their clients, it is heartening to
see the progress in the adoption of e-courts.
It is true that despite efforts being made to develop and
enhance the use of technology, challenges related to basic
infrastructure and internet connectivity divide, still persists
across states and district courts. Adequate data speed and
data volume are basic needs that are not uniformly available
across the country. This creates a disparity in accessing
eCourts systems and services. The foundation ode courts
are based on a digital platform to enhance access, amplify
existing capacities, and improve the efficiency of the overall
judicial administration system through simplified
procedures.
Given that most judicial processes and procedures evolved
in the pre-digital age, it is critical to examine whether such
processes continue to remain relevant in a digital age or can
be simplified and transformed to better serve justice.
Existing processes must be re-evaluated and re-designed (if
need be) for conformity and be made more efficient using
technology to enable courts to deliver services not
previously conceivable.

  • 4. Editor’s Note eing the second pillar of the constitution, the Bjudiciary plays a vital role in ensuring that each sector of the government knows and follows the limits of their power. It also protects civil rights. The Supreme Court of India, particularly, has the power to ensure that the laws do not violate the constitution of the country. In case it does, the Supreme Court has the right to cross out such laws. The supreme judicial body of the country, the Supreme Court of India not only shoulders the enormous responsibility of delivering justice but also has the powers of judicial review. The judgements passed by the Supreme Court are followed in all the courts of law. Resultantly, the onus of the lawyers of Supreme Court are also massive. Only lawyers who are registered with the Supreme Court are permitted to appear for cases and plead for their clients in the court. Lawyers who are designated as senior lawyers by the Supreme Court can appear for their client along with a registered lawyer. The Supreme Court takes up verdicts of the High Courts and other courts to settle disputes between governments or people and government. The lawyers serving in such a court of law therefore needs to be well-versed with the uniform laws, the laws of the states, minority and other laws and the case that they would be representing. The most challenging task for lawyers is to have the client’s interest in mind while arguing the case while at the same time following the ethics crafted for lawyers. Maintaining the decorum of the court and presenting himself/herself in a dignified manner irrespective of the case that the lawyer is arguing or the person he is cross-questioning needs lot of patience, self-control, and balance. The lawyer must uphold the dignity of the court, his opponent/colleague, the judge and all the concerned parties. Thus, the lawyer’s duty is not just towards the client or the court but towards himself, the opponent, the accused, and the judge. Through their arguments and findings, they also aid in quick disposal of the case and consequently quicker judgements.   • 14. Overcoming the Pandemic with a Game Face According to Mr Jayprakash, the Supreme Court is efficiently tackling the challenges imposed by the COVID- 19 pandemic. It is working towards providing justice to the right party, in the right way. The court does not remain closed even for a single day. Depending on the seriousness of the case, the court remains open even on Sundays. It also operates during late nights to deliver speedy justice. With the pandemic impacting lives and societies greatly, the Supreme Court has also started functioning virtually. However, speaking of the challenges of virtual courts, Mr Jayprakash states that it becomes difficult to train new lawyers. He says, "It is feasible to attend courts and learn from the senior lawyers face to face is feasible in physical courts. The same cannot be achieved through virtual courts." Accordingly, it becomes difficult for budding lawyers to virtually learn from any ongoing case. However, he states that hybrid court hearings have started, which is a combination of physical and virtual hearings. Advocates will get the opportunity to opt for either physical or virtual hearing, or an amalgamation of both. Mr Jayprakash emphasizes on using both virtual and physical courts for smooth functioning of the legal system. Without a doubt lawyers' time is very valuable and he must work for his clients, yet as one of the important members and custodian of the society, he must act to create a balance to ensure justice and fairness. Therefore, the profession demands putting aside some time for providing legal aid to the deserving one/s who cannot afford legal help. It is with this notion of doing his bit towards the betterment of the society, Mr. Ahluwalia has been associated with the Delhi High Court Legal Aid Services Committee (DHCLSC) providing legal assistance before the Hon'ble High Court. He has been appearing as Amicus Curae before Hon'ble High Court and also as a mediator at the Delhi High Court mediation center. Though it may not be much, but any bit of legal service helps the system of the country. Brief us about yourself and your journey in the legal industry. 'My father repeatedly reminds me that youth of lawyer is lost at his table'. Post his LL.M. from Cardiff University, Mr. Ahluwalia started his career as a corporate lawyer at JSA. Having worked for couple of years and given the growing fondness for litigation (courtesy family practice), started taking interest in adversarial matters. Having understood the commercial interests of clients (as a corporate lawyer), assessing legal risks / potential disputable clauses and charting a way forward for minimum disruptions started getting easier. Having said so, moving from the comforts of corporate lawyer and joining the litigation practice was not easy for Mr. Ahluwalia. As a third-generation lawyer and being the son of senior advocate, the expectation of client has always been very high for Mr. Ahluwalia and even the court takes note of performance. Mr. Ahluwalia narrates that as a litigation lawyer one must face the judge, opposite lawyer, and the client. So, lawyer's job is not only to argue the case but also to built-up a case as per law. Evenings are spent in preparation of briefs and updating with legal reporters. He reads seven daily reporters, to remain updated. From his initial days till now, he has more than 50 judgments reported in his name, in a career spanning 17 years. For upcoming lawyers, he advises that the initial years as litigation lawyer are tough. Learning has a cost, and the initial remuneration says it all. However, with experience and knowledge, it does tend to pay off. Since every day is not green, hence one must also learn to save for the rainy days. What were the challenges you came across when you decided to start a venture that catered to the legal services sector? Mr. Ahluwalia's entry to the profession was easy - being a third-generation lawyer; and given that the basic infrastructure and connections were already in place. However, he emphasizes that the biggest challenge and a fundamental requirement for a successful career, is to earn the trust of the client. For building trust, a lawyer needs to deliver desired results for his clients. It can only be earned through hard work, ethics, knowledge gained through experience, and the results achieved for the clients. For Mr. Ahluwalia, the immediate challenge was to first build a client base and then retain them – both took time.   • 24. addition to the above, he believes that in this competitive profession, it is not enough to have high billings; being genuine, compassionate, and approachable is equally important for a more fruitful and longer career. Despite his achievements, he feels that creating a legacy like his father will require him to strike a balance on the above. Taking into consideration, the current pandemic, and its impact on global economies, how are you driving your firm to sustain operations and ensuring safety of your employees at the same time? With a series of lockdowns and non-functional courts, Covid-19 probably presented the biggest challenge to the lawyers, particularly the litigators. All business sectors including the legal sector were deeply impacted. The initial phase was very tough with a complete lockdown, poor cash flows, increasing costs and a lot of uncertainties. Having understood the importance and dependency on technology, Mr. Ahluwalia erected the required infrastructure for virtual office for supporting and seamlessly communicating with clients. Anticipating a possible surge in arbitration works, he further utilized his time to complete an online course on International Arbitration from the Eiden University. Team is very important for running a successful litigation practice and throughout the lockdown, he ensured that the team is engaged (in other knowledge building activities, creating an IT enabled repository of all data/ information available in the office, ensuring its safety, security, and availability) and well taken care of. This period allowed him to concentrate on some thought leadership initiatives including penning down a few articles which got published across legal publications and organizing a few webinars including those on ICSID and Force Majeure. With passage of time and relaxation on the restrictions, Mr. Ahluwalia focused on employment and compliance related advisory work from our existing clients across sectors. He further collaborated with few other firms from south and western India to source work and develop sharable knowledge through online initiatives. No office can function without the effective support of the staff. Despite all hardships he continued to support his junior colleagues and court clerks with sufficient salary and monthly allowance for grocery in order to meet their ends comfortably. The pandemic has helped him to evolve as a more compassionate, accommodating, independent and tech savvy lawyer. What would be your advice to budding entrepreneurs who aspire to venture into the legal services sector? Mr. Ahluwalia echoes his dad's thoughts, which says "Goodwill flows faster than the water". Lawyers willing to make a name for themselves must invest in building their goodwill through hardwork, perseverance, patience, and above all via continued legal education. Money and profits cannot be the focus. The lawyer lives on his goodwill and goodwill lives farther than the lawyer. Every senior lawyer is always known because of his goodwill. Where do you envision your firm to be in the long run and what are your future goals? To Mr. Ahluwalia "Success is both relative and seasonal" – i.e. it is different for different people and changes over time. In the long run besides running a very successful Law practice and creating a legacy like his father, Mr. Ahluwalia would like to take up more social causes and even teaching. The Context of Social Media Environment The concept of social media defies formal definition due to its ever-evolving nature, although it is often seen as a by- product of the growth of Web 2.0, which allows all users to create and apply web content in a participatory and collaborative manner. A key focal point of the social media context has been the relative simplicity with which people with similar personal and/or professional interests can build an online profile, post information about their interests, and engage with others on a website. Such interactions could take the shape of people sharing their thoughts, experiences, films, and photographs via online tools like blogs, message boards, podcasts, wikis, and vlogs. The rise of social networking sites (SNS) such as Facebook, LinkedIn, Twitter, Myspace, YouTube, Wikipedia, and Google Plus, to name a few, has been one of the most significant developments contributing to the ever-changing character of the social media context. Here are five guidelines to help you avoid getting into problems on various social networking platforms: Online Contests & Promotions Online contests and promotions are a great way to get your name out there. Examine the platform's Terms of Service (TOS) or other equivalent standards. These are the guidelines that must be followed. Facebook provides some extremely detailed instructions. “On Facebook, promotions can be run on Pages or within applications. Personal Timelines are not permitted to be used to manage promotions (for example, “share on your Timeline to enter” or “share on your friend's Timeline to gain more entries”). Reviews Users can discuss their experiences and submit ratings for different businesses on sites like Yelp. Negative reviews can be damaging to a business, so some owners may be leery of review sites. However, some companies may have gone too far in fighting unfavourable reviews by including restrictions in consumer contracts prohibiting customers from publishing negative comments about them online. Consumers' rights to submit negative online reviews were recently protected by a California legislation. “The bill prohibits businesses from forcing customers into contracts in which they waive their right to speak about the service they receive, and it also prohibits firms from penalising customers for such statements,” according to a Washington Post article. Endorsements Disclosure is critical when bloggers and others write about items and services on the internet. If they were paid or given free things by a firm and then wrote about them, that relationship must be declared in a way that the reader can understand. To ensure that endorsements are honest and not misleading to the public, the Federal Trade Commission updated its Endorsement Guides to include social media. Photographs When it comes to photos that are shared online, social media and the law frequently conflict. Cute baby animal photos and elegantly prepared cupcakes can be difficult to refuse. We want to not only gaze at them, but also share them with our friends. Before you utilise that photo, do not assume it's yours just because you found it on the internet. Many, if not all, pictures are copyrighted and belong to the photographer. Before you utilise something, try to discover the source and get permission. Owners of protected material may request that it be removed from sites like Pinterest, where photographs are shared by Pinning. If you receive information that a Pin has been removed from Pinterest due to a copyright violation, it implies that the content of the Pin has been removed from Pinterest at the request of the content's owner. According to Pinterest's Copyright website, "if your account receives too many copyright complaints, you may lose the ability to Pin new content on Pinterest and your account may be terminated permanently." Employee Rights Employers should think twice before dismissing staff based on bad social media remarks. Employees may have the right to vent about their bosses online in the same way that consumers have the right to write bad evaluations about businesses online. A recent judgement by the National Labor Relations Board (NLRB) concerns individuals who were unlawfully terminated by their employer for Facebook behaviour, according to a Nixon Peabody blog post. “The NLRB decided that the two employees did not denigrate their employer's products or services, rather they used social media to seek and provide mutual support for a group activity addressing the terms and circumstances of employment,” according to the NLRB report. Indian legal sector is going through a sensitive phase, like any other sector, it is trying to revive from the after-effects of Covid-19. While lawyers, judiciary and the allied legal systems are gearing up and slowly embracing technology and virtual modes of operation, the uncertainty is still there. Adequate data speed and data volume are basic needs that are not uniformly available across the country. This creates a disparity in accessing eCourts systems and services. The foundation ode courts are based on a digital platform to enhance access, amplify existing capacities, and improve the efficiency of the overall judicial administration system through simplified procedures. Given that most judicial processes and procedures evolved in the pre-digital age, it is critical to examine whether such processes continue to remain relevant in a digital age or can be simplified and transformed to better serve justice.
