SUBJECT: Discussion and possible action to amend City Codes Chapter 18, Article VI,
Section 18-152, Schedule G on Patterson Avenue, north side, beginning at
the intersection with Encino Avenue in a westward direction.

SUMMARY
Resident James Rogers, 211 Patterson Avenue, requested an amendment to the City
Codes to create forty feet of available parking along the north curb line of Patterson
Avenue in front of his residence currently restricted “no parking at all times”.
BACKGROUND INFORMATION
The residential property located on the northwest corner of Patterson Avenue where it
intersects Encino Avenue received approval from the City Council to be divided into two
residential lots at the regularly scheduled City Council meeting on December 11, 2017.
New residential structures were developed on each residential lot addressed 201 Patterson
Avenue and 211 Patterson Avenue.
Ordinance No. 1448 was passed on December 13, 1999 to create six new restricted
parking zones on Patterson Avenue. This action was taken as a result of insufficient on-
site parking at Central Market and the United States Post Office located on Broadway,
where it intersects Patterson Avenue.
Ordinance No. 1448 created a new two-hour restricted parking zone on the north side of
Patterson Avenue beginning at Encino Avenue and continuing westward for a distance of
sixty feet. A restricted parking zone “at all times” started at this point continuing
westward along north curb line of Patterson Avenue and terminating where Patterson
Avenue intersects Lagos Avenue. Currently, there are no signage posted identifying the
two-hour restricted zone nor is the red curb clearly visible on the curb line in front of 201
Patterson.
Staff has reviewed the resident’s request for available on-street parking in front of his
property (211 Patterson Avenue) on the north side beginning at the west edge of his
driveway and continuing for a distance of forty feet. This review included street
measurements, traffic accident history, other existing parking restrictions in the
immediate area, and off-street parking opportunities on the properties of 201 and 211
Patterson Avenue.
Recognizing past citizen concerns for the speed of Patterson Avenue traffic, staff
observed Patterson Avenue traffic moving through the curvature of the roadway from
both directions in front of 200 Patterson Avenue. Staff observations and past traffic
studies confirm the curvature of the roadway reduces traffic speeds entering and exiting
the curve sufficiently to off-set concern for the reduction in the restricted parking
distance along the north curb line.
PROPOSAL
Staff proposes the following amendments to Chapter 18, Article VI, Section 18-152,
Schedule G:
• Amend the category titled “no longer than two hours from 8:00 am to 6:00 pm,
except Sunday” on Patterson Avenue, north side, from Encino Avenue westward
for a distance of one-hundred eighty-five feet;
• Amend the category “at all times” Patterson Avenue, north side, commencing at a
point one-hundred eighty-five feet west of the intersection of Patterson Avenue
and Encino Avenue westward to Lagos Avenue.
This proposal leaves in effect the two hour parking restriction along the south curb line of
Patterson Avenue from Encino Avenue westward to the walk-way bridge. This proposal
also leaves in effect a “no parking anytime” distance of one-hundred fifty-one feet on the
north side of Patterson Avenue prior to the curve in the roadway.
POLICY ANALYSIS
The request for consideration of new and amended parking restrictions is consistent with
the Texas Transportation Code Section 542.202, “Powers of Local Authorities” and
Section 18-99 of the City Code providing that the City Council may adopt, amend and
rescind parking restrictions on public roadways.
FISCAL IMPACT
Fiscal impact would be limited to the cost of paint or sandblasting and labor to obliterate
the existing red curb and installation of one new sign and pole.
Approximately $190.00 paint and sign installation
Approximately $1,375.00 sandblasting and sign installation
COORDINATION
• The City Manager has reviewed this proposal and the City Attorney prepared the
proposed Ordinance.
• Property owners at 201 Patterson Avenue and 211 Patterson Avenue are agreeable to
the proposed two-hour parking limitation.
• Public Works personnel will assume responsibility for removing the red paint from
the curb and installing one new sign pole.
• The Ordinance will be published in the San Antonio Express & News and on the City
webpage in accordance with applicable law.

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
ALAMO HEIGHTS, TEXAS, AMENDING CHAPTER 18, TRAFFIC,
SECTION 18-152, SCHEDULE G, PARKING PROHIBITED OR
LIMITED ON CERTAIN STREETS BY ADDING PATTERSON
AVENUE NEAR ENCINO AVENUE; PROVIDING FOR A PENALTY;
REPEALING ALL PARTS OF ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; AND OPEN MEETINGS
CLAUSE.
WHEREAS, the regulation of traffic, motor vehicles and conveyances upon all public streets,
roadway and right-of-ways within the City limits of the City of Alamo Heights (the “City”) is
essential and necessary to protect the traveling public and to preserve and protect the public safety
of the City; and
WHEREAS, sections 311.001 and 542.202(a) (10) of the Texas Transportation Code provides
that a municipality has exclusive control over and under the public highways, streets, and alleys
of the municipality and the authority to designate which streets will have no parking locations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ALAMO HEIGHTS,TEXAS THAT:
SECTION 1: Findings. The recitals are hereby found to be true and correct and are hereby
incorporated as part of this Ordinance.
SECTION 2: Amendments to Chapter 1 8 . Chapter 18 ("Traffic ") Section 18-152 shall be
amended, which is entitled "Schedule G-Parking Prohibited or Limited on Certain Streets" and
which shall be amended to include the following streets and to read as follows:
Sec. 18-151. - Schedule G - Parking Prohibited or Limited on Certain Streets
Under the provisions of section 18-99, parking shall be restricted on the following
designated streets for the indicated time period::
At all times
Patterson Avenue, north side, commencing at a point which is 185 feet west of the
intersection of Patterson Avenue and Encino Avenue westward to Lagos Parkway
No longer than 2 hours, from 8:00 a.m. to 6:00 p.m., except Sunday:
Patterson Avenue, north side, from Encino Avenue westward for a distance
of 185 feet.
SECTION 3. All remaining provisions of Chapter 18 ("Traffic ") Section 18-152, "Schedule
G-Parking Prohibited or Limited on Certain Streets” shall remain unchanged except for the
changes outlined in Section 2 of this Ordinance.
Attachment A
SECTION 4. Conflicting Ordinances or Resolutions. All resolutions or ordinances or parts
thereof conflicting or inconsistent with the provisions of this ordinance as adopted and amended
herein, are hereby REPEALED to the extent of such conflict. In the event of a conflict or
inconsistency between this ordinance and any other resolution, code or ordinance of the City, or
parts thereof, the terms and provisions of this ordinance shall govern.
SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or word of this
ordinance is declared unconstitutional or invalid for any purpose, the remainder of this ordinance
shall not be affected thereby and to this end the provisions of this ordinance are declared to be
severable.
SECTION 6. Open Meetings. It is hereby officially found and determined that the meeting at
which this ordinance is passed was open to the public as required and that public notice of the
time, place, and purpose of said meeting was given as required by the Open Meetings Act.
SECTION 7. Effective Date. This ordinance shall be effective from and after its approval and
passage in accordance with the Texas Local Government Code and the city charter.

CITY OF ALAMO HEIGHTS POLICE DEPARTMENT CITY COUNCIL AGENDA MEMORANDUM TO: Mayor and City Council FROM: Rick Pruitt, Police Chief SUBJECT: Discussion and possible action to amend City Codes Chapter 18, Article VI, Section 18-152, Schedule G on Patterson Avenue, north side, beginning at the intersection with Encino Avenue in a westward direction. DATE: August 24, 2020 SUMMARY Resident James Rogers, 211 Patterson Avenue, requested an amendment to the City Codes to create forty feet of available parking along the north curb line of Patterson Avenue in front of his residence currently restricted “no parking at all times”. BACKGROUND INFORMATION The residential property located on the northwest corner of Patterson Avenue where it intersects Encino Avenue received approval from the City Council to be divided into two residential lots at the regularly scheduled City Council meeting on December 11, 2017. New residential structures were developed on each residential lot addressed 201 Patterson Avenue and 211 Patterson Avenue. Ordinance No. 1448 was passed on December 13, 1999 to create six new restricted parking zones on Patterson Avenue. This action was taken as a result of insufficient on- site parking at Central Market and the United States Post Office located on Broadway, where it intersects Patterson Avenue. Ordinance No. 1448 created a new two-hour restricted parking zone on the north side of Patterson Avenue beginning at Encino Avenue and continuing westward for a distance of sixty feet. A restricted parking zone “at all times” started at this point continuing westward along north curb line of Patterson Avenue and terminating where Patterson Avenue intersects Lagos Avenue. Currently, there are no signage posted identifying the two-hour restricted zone nor is the red curb clearly visible on the curb line in front of 201 Patterson. Staff has reviewed the resident’s request for available on-street parking in front of his property (211 Patterson Avenue) on the north side beginning at the west edge of his driveway and continuing for a distance of forty feet. This review included street
  • 2. measurements, traffic accident history, other existing parking restrictions in the immediate area, and off-street parking opportunities on the properties of 201 and 211 Patterson Avenue. Recognizing past citizen concerns for the speed of Patterson Avenue traffic, staff observed Patterson Avenue traffic moving through the curvature of the roadway from both directions in front of 200 Patterson Avenue. Staff observations and past traffic studies confirm the curvature of the roadway reduces traffic speeds entering and exiting the curve sufficiently to off-set concern for the reduction in the restricted parking distance along the north curb line. PROPOSAL Staff proposes the following amendments to Chapter 18, Article VI, Section 18-152, Schedule G: • Amend the category titled “no longer than two hours from 8:00 am to 6:00 pm, except Sunday” on Patterson Avenue, north side, from Encino Avenue westward for a distance of one-hundred eighty-five feet; • Amend the category “at all times” Patterson Avenue, north side, commencing at a point one-hundred eighty-five feet west of the intersection of Patterson Avenue and Encino Avenue westward to Lagos Avenue. This proposal leaves in effect the two hour parking restriction along the south curb line of Patterson Avenue from Encino Avenue westward to the walk-way bridge. This proposal also leaves in effect a “no parking anytime” distance of one-hundred fifty-one feet on the north side of Patterson Avenue prior to the curve in the roadway. POLICY ANALYSIS The request for consideration of new and amended parking restrictions is consistent with the Texas Transportation Code Section 542.202, “Powers of Local Authorities” and Section 18-99 of the City Code providing that the City Council may adopt, amend and rescind parking restrictions on public roadways. FISCAL IMPACT Fiscal impact would be limited to the cost of paint or sandblasting and labor to obliterate the existing red curb and installation of one new sign and pole. COORDINATION • The City Manager has reviewed this proposal and the City Attorney prepared the proposed Ordinance. • Property owners at 201 Patterson Avenue and 211 Patterson Avenue are agreeable to the proposed two-hour parking limitation. • Public Works personnel will assume responsibility for removing the red paint from the curb and installing one new sign pole. • The Ordinance will be published in the San Antonio Express & News and on the City webpage in accordance with applicable law. Attachment A ORDINANCE NO. ________ AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF ALAMO HEIGHTS, TEXAS, AMENDING CHAPTER 18, TRAFFIC, SECTION 18-152, SCHEDULE G, PARKING PROHIBITED OR LIMITED ON CERTAIN STREETS BY ADDING PATTERSON AVENUE NEAR ENCINO AVENUE; PROVIDING FOR A PENALTY; REPEALING ALL PARTS OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND OPEN MEETINGS CLAUSE. WHEREAS, the regulation of traffic, motor vehicles and conveyances upon all public streets, roadway and right-of-ways within the City limits of the City of Alamo Heights (the “City”) is essential and necessary to protect the traveling public and to preserve and protect the public safety of the City; and WHEREAS, sections 311.001 and 542.202(a) (10) of the Texas Transportation Code provides that a municipality has exclusive control over and under the public highways, streets, and alleys of the municipality and the authority to designate which streets will have no parking locations; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ALAMO HEIGHTS,TEXAS THAT: SECTION 1: Findings. Chapter 18 ("Traffic ") Section 18-152 shall be amended, which is entitled "Schedule G-Parking Prohibited or Limited on Certain Streets" and which shall be amended to include the following streets and to read as follows: Sec. 18-151. - Schedule G - Parking Prohibited or Limited on Certain Streets Under the provisions of section 18-99, parking shall be restricted on the following designated streets for the indicated time period:: At all times Patterson Avenue, north side, commencing at a point which is 185 feet west of the intersection of Patterson Avenue and Encino Avenue westward to Lagos Parkway No longer than 2 hours, from 8:00 a.m. to 6:00 p.m., except Sunday: Patterson Avenue, north side, from Encino Avenue westward for a distance of 185 feet. SECTION 3. All remaining provisions of Chapter 18 ("Traffic ") Section 18-152, "Schedule G-Parking Prohibited or Limited on Certain Streets” shall remain unchanged except for the changes outlined in Section 2 of this Ordinance.
  • 5. Attachment A SECTION 4. Conflicting Ordinances or Resolutions. All resolutions or ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance as adopted and amended herein, are hereby REPEALED to the extent of such conflict. In the event of a conflict or inconsistency between this ordinance and any other resolution, code or ordinance of the City, or parts thereof, the terms and provisions of this ordinance shall govern. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or word of this ordinance is declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby and to this end the provisions of this ordinance are declared to be severable. SECTION 6. Open Meetings. It is hereby officially found and determined that the meeting at which this ordinance is passed was open to the public as required and that public notice of the time, place, and purpose of said meeting was given as required by the Open Meetings Act. SECTION 7. Effective Date. This ordinance shall be effective from and after its approval and passage in accordance with the Texas Local Government Code and the city charter.
