Ini fakta tentang syarat beramal dengan mafhum dalam kebanyakan kondisi, bahwa mafhum itu diabaikan, jika dinyatakan untuk menyatakan kondisi galibnya. Atau, jika dibatalkan oleh nash, misalnya, Allah berfirman, ]وَلَا تَقْتُلُوا أَوْلَادَكُمْ خَشْيَةَ إِمْلَاقٍ[ _"Dan janganlah kamu membunuh anak-anakmu karena takut kemiskinan." (TQS al-Isra’: 31)_ Takut kemiskinan (khasyyah imlaq) merupakan sifat yang memberikan pemahaman (washfun mufhimun), yaitu khasyyatul faqri (takut kemiskinan). Demikian juga pernyataan itu menunjukkan kondisi pada galibnya. Mereka membunuh anak-anak karena takut miskin. Kemudian bahwa mafhum tersebut telah dibatalkan dengan nash, ]وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ[ _"Dan barangsiapa yang membunuh seorang mukmin dengan sengaja, maka balasannya ialah Jahannam." (TQS an-Nisa’: 93)_ Oleh karena itu, mafhum ini diabaikan. Tidak bisa dikatakan bahwa "yang haram adalah membunuh anak-anak karena takut kemiskinan, dan menjadi halal jika ia membunuhnya karena kaya!" Akan tetapi pembunuhan itu tetap haram dalam dua kondisi itu, baik karena kemiskinan ataupun karena kaya. Demikian juga ayat, ]لَا تَأْكُلُوا الرِّبَا أَضْعَافًا مُضَاعَفَةً[ _"Hai orang-orang yang beriman, janganlah kamu memakan riba dengan berlipat ganda." (TQS Ali Imran: 130)_ Kata adh'afan mudha'afatan (berlipat ganda) merupakan washfun mufhimun (sifat yang memberikan pemahaman), dan demikian juga menyatakan kondisi pada galibnya. Mereka mengambil riba berlipat ganda. Kemudian mafhum ini diabaikan dengan nash, _"Padahal Allah telah menghalalkan jual beli dan mengharamkan riba (TQS al-Baqarah: 275)_ Oleh karena itu, mafhum ini diabaikan. Tidak bisa dikatakan "yang haram adalah riba yang banyak/berlipat ganda, sedangkan riba yang sedikit maka boleh!" Akan tetapi, berapa pun banyaknya riba, adalah haram, sebab mafhum (adh'afan mudha'afatan) diabaikan seperti yang kami katakan. Begitulah. Jadi, mafhum kata "ummiyah" pada hadis di atas diabaikan seperti yang sudah kami jelaskan, yaitu bahwa rukyat hilal jika terhalang mendung atau hujan, maka wajib menggenapkan hitungan bulan menjadi tiga puluh hari, baik kita mengetahui hisab (perhitungan) ataupun tidak mengetahui. *KEDUA,* Pendapat mereka, jika hisab dijadikan sandaran untuk penetapan waktu-waktu shalat, dan jika demikian, maka penetapan waktu puasa juga disandarkan pada hisab, maka jawaban hal itu adalah sebagai berikut. Siapa yang menelaah dalil-dalil yang menyatakan tentang puasa, maka ia akan mendapati hal itu berbeda dari dalil-dalil yang menyatakan tentang shalat. Artinya, dalil yang digunakan untuk penetapan puasa dan shalat itu berbeda. Puasa dikaitkan dengan berbuka dan dengan rukyat. ]مَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ ( _"Karena itu, barangsiapa di antara kamu hadir (di negeri tempat tinggalnya) di bulan itu, maka hendaklah ia berpuasa pada bulan itu." (TQS al-Baqarah: 185)_ Tempat yang di janjikan oleh Allah yaitu surga firdaus
