NEW LONDON? -IN 2005 SUSETTE KELO & 8 OTHER PRIVATE HOMEOWNERS SUED THE CITY OF NEW LONDON, CT FOR ENACTING EMINENT DOMAIN ON THEIR PROPERTY WITHOUT PROPER COMPENSATION. -THE LAND WAS TO BE TRANSFERRED TO ANOTHER PRIVATE OWNER AS PART OF A COMPREHENSIVE REDEVELOPMENT PLAN WHICH PROMISED 3,169 NEW JOBS & $1.2 MILLION/YEAR IN TAX REVENUES. -THE US SUPREME COURT RULED IN A 5-4 DECISION THAT THE GENERAL BENEFITS A COMMUNITY ENJOYED FROM ECONOMIC GROWTH QUALIFIED SUCH REDEVELOPMENT PLANS AS A PERMISSIBLE PUBLIC USE.
10) WHAT FACILITY DID TEXAS EXEMPT FROM ITS RESTRICTIVE  ANTI-EMINENT-DOMAIN-FOR-PRIVATE-USE LAW? 11) WHAT MAIN FACTORS ARE PART OF PREPARING A BUILDING SITE? 1) SECURING PROPER ZONING. -A BUILDING CAN ONLY BE CONSTRUCTED IN AN AREA THAT CONFORMS TO ITS USE. 2) MEETING ENVIRONMENTAL CONCERNS. -THESE MAY INVOLVE ENSURING THE NEW CONSTRUCTION WILL NOT HAVE AN ADVERSE EFFECT ON THE SURROUNDING AIR, WATER, & SOIL. 3) CREATING THE PHYSICAL CHARACTERISTICS NECESSARY TO BUILD. -THIS MAY INCLUDE GRADING THE SOIL SO THAT IT IS STABLE, REMOVING TREES & OTHER IMPEDIMENTS, & ESTABLISHING THE INFRASTRUCTURE FOR UTILITIES.

  • 12. 8) WHAT IS EMINENT DOMAIN? -”THE POWER TO TAKE PRIVATE PROPERTY FOR PUBLIC USE BY A STATE, MUNICIPALITY, OR PRIVATE PERSON OR CORPORATION AUTHORIZED TO EXERCISE FUNCTIONS OF PUBLIC CHARACTER, FOLLOWING THE PAYMENT OF JUST COMPENSATION TO THE OWNER OF THAT PROPERTY.” -THE US CONSTITUTION PERMITS THE GOVERNMENT TO FORCIBLY TAKE LAND FROM PRIVATE CITIZENS, BUT IT MUST PROVIDE ADEQUATE COMPENSATION (5 TH AMENDMENT). -THE LAND SECURED FROM PRIVATE CITIZENS MUST BE USED FOR THE PUBLIC GOOD.

NEW LONDON? -IN 2005 SUSETTE KELO & 8 OTHER PRIVATE HOMEOWNERS SUED THE CITY OF NEW LONDON, CT FOR ENACTING EMINENT DOMAIN ON THEIR PROPERTY WITHOUT PROPER COMPENSATION. -THE LAND WAS TO BE TRANSFERRED TO ANOTHER PRIVATE OWNER AS PART OF A COMPREHENSIVE REDEVELOPMENT PLAN WHICH PROMISED 3,169 NEW JOBS & $1.2 MILLION/YEAR IN TAX REVENUES. -THE US SUPREME COURT RULED IN A 5-4 DECISION THAT THE GENERAL BENEFITS A COMMUNITY ENJOYED FROM ECONOMIC GROWTH QUALIFIED SUCH REDEVELOPMENT PLANS AS A PERMISSIBLE PUBLIC USE.

COWBOYS STADIUM -WHEN THE COWBOYS CHOSE THE SITE OF THEIR NEW STADIUM IN ARLINGTON, THERE WERE 19 RESIDENTIAL & COMMERCIAL PROPERTIES IN THE AREA. -THE RULING IN THE KELO CASE ALLOWED THE CITY OF ARLINGTON TO ACQUIRE THE LAND & MOVE THE CURRENT OWNERS.
