President Biden’s Jan 2021 EO14008: Tackling Climate Change at Home and Abroad created the government-wide Justice40 Initiative, establishing the goal that at least 40% of the benefits of certain federal investments flow to disadvantaged communities. Background on Justice40 P r i o r i t i z e I n v e s t m e n t s What Justice40 means for the U.S. Department of Transportation (U.S. DOT) WHAT is Justice40? Justice40 aims to address decades of systemic inequitable historical policies and underinvestment in disadvantaged communities. The initiative aims to bring resources to communities most impacted by climate change, pollution, and environmental hazards. WHY Justice40? At the cusp of a generational investment in infrastructure through the Bipartisan Infrastructure Law and the Inflation Reduction Act, the Justice40 initiative is an opportunity to address gaps in transportation infrastructure and public services to uplift communities. - Both the Department of Energy and Department of Transportation prioritize the power of community in their Equity Action Plans. One of the outcomes they are seeking to achieve is that individuals nd communities have a greater voice in transportation decisions affecting them. DOE Priority Actions: Expanding strategic Tribal and stakeholder engagement across DOE programs DOT Four Focus Areas – Wealth creation: Building capital, expanding business networks, and attaining new skills and experience through increased USDOT contracts. Power of community: Individuals and communities have a greater voice in transportation decisions affecting them. Interventions: Historically overburdened and underserved communities in urban and rural areas benefit from access to a generational investment in the nation’s infrastructure through direct, hands-on technical support for transportation projects with local impact. and Expanding access: Increase in social and economic opportunity for disadvantaged and underserved communities from the provision of affordable multi-modal transportation options and the development of a transportation cost burden measure. Key Title VI considerations include: Meaningful public participation and engagement Evaluate the impacts and benefits of programs in light of the demographics of communities Avoid disparate impacts Provide equitable access to benefits
- The U.S. Department of Transportation recognizes that past federal transportation investments have too often failed to address inequities, or even made them worse. In light of this, DOT is committed to pursuing a comprehensive approach to advancing equity for all. This is why President Biden created the Justice40 Initiative during his first week in office by signing Executive Order 14008 on Climate. Overall, Justice40 seeks to deliver 40 percent of the benefits of certain Federal investments to disadvantaged communities that face burdens related to climate change, the environment, health, and economic opportunity. It is important to understand that this Initiative is not a one-time investment, nor is it a single pot of money. Rather, it is a government wide initiative that makes a series of changes to certain federal programs to ensure benefits reach communities most in need. U.S. DOT is prioritizing projects that promote meaningful public engagement throughout the project lifecycle and adhere to environmental justice requirements
- Another key aspect of Justice40 is to identify which benefits are of highest priority to DACs and design program implementation accordingly. The 90d guidance and the FAQs provide examples of potential benefits of NEVI deployment Improving clean transportation access through the location of chargers; Contracting with small, disadvantaged businesses such as women-owned, veteran-owned, and minority-owned businesses in disadvantaged communities; Decreasing the transportation energy cost burden by enabling reliable access to affordable charging; Reducing environmental exposures to transportation emissions; Workforce training, such as apprenticeship and pre-apprenticeship programs Partnering with local MSIs Jobs for the full supply chain Increasing energy resilience and the ability for communities to participate in program design and implementation
- Meaningful community engagement process can inform the design, implementation and evaluation of NEVI programs intended to provide benefits to DACs. information on how programs are designed and implemented can also be provided back to communities through out the implementation process.

Nice aspect of the JUST Lab Consortium – is that they can be more methodical, thoughtful, and hold us accountable.
