Article II and Washington's Farewell Address Earlier in the semester, we examined Article II of the Constitution which details the Executive Branch. These first few paragraphs are just to refresh your memory of that discussion. Article II of the Constitution describes the Executive Branch. The Executive Branch is led by the president, but he is not the only member of the Executive Branch. Most government agencies, programs, and departments are included in the Executive Branch. Keep in mind, the purpose of the Executive Branch is to implement, or execute, the laws. In order to do that, lots of different government agencies are necessary. Below is a link to the exact text of Article II, which also includes how the article has changed over the years. Article II of the Constitution (Links to an external site.)Links to an external site. Here are a few major highlights from the article: · The President is the head of the executive branch and Commander in Chief of the military · President is elected for 4-year terms · Qualifications for president: must be a natural-born citizen and must be at least 35 years old · President can choose the individuals who will be in charge of the various government agencies/departments (but they must be approved by the Senate) · Has a large role in foreign policy and in dealing with foreign governments · Can be impeached and removed from office by Congress One conclusion we can draw from Article II is that the Founding Fathers wanted a president to have some power, but not total power. They were very fearful of a really powerful president, because they were concerned that he might ultimately want total power and could become a king or dictator. This is why they created a very strong legislative branch. However, they did create a president that had a lot of control in certain parts of the government, particularly relating to foreign policy and national security (this will be VERY important in some of the later pages of the module). We will also examine a few reasons why the power of the president has grown since the writing of the Constitution. One thing to ask yourself, as we study the Presidency, is: does the president have too much power? Or, do we see any "abuses" of his power? George Washington's Farewell Address One of the more interesting addresses given by a president was the 1st president's (George Washington) farewell address. By "farewell" we mean that it was his speech indicating that he would NOT be running for a third term of office. Originally, the Constitution did not have term limits for president, so presidents could serve longer than two terms (Franklin D. Roosevelt served much longer than two terms). Washington served two terms and then voluntarily said he would not seek a third term. This was important and it set the precedent of only serving 2 terms. Chapter Five Constitutional PrinciplesThe Constitution The Constitution provides the legal framework for our nation. The articles of the Constitution set out the basic structure of our government and the respective roles of the state and federal governments. The Amendments to the Constitution, especially the first 10, were primarily designed to establish and protect individual rights.Federalism Underlying the system of government established by the Constitution is the principle of federalism, which means that the authority to govern is divided between two sovereigns or supreme lawmakers. In the United States, these two sovereigns are the state and federal governments. Federalism allocates the power to control local matters to local governments. This allocation is embodied in the U.S. Constitution. Under the Constitution, all powers that are neither given exclusively to the federal government nor taken from the states are reserved to the states. The federal government has only those powers granted to it in the Constitution. Therefore, whenever federal legislation that affects business is passed, the question of the source of authority for that regulation always arises. The Commerce Clause is the predominant source of authority for the federal regulation of business, as we will see later. federalism A system of government in which power is divided between a central authority and constituent political units.Critical Thinking About The Law The Constitution secures numerous rights for U.S. citizens. If we did not have these rights, our lives would be very different. Furthermore, businesses would be forced to alter their practices because they would not enjoy the various constitutional protections. As you will soon learn, various components of the Constitution, such as the Commerce Clause and the Bill of Rights, offer guidance and protection for businesses. The following questions will help sharpen your critical thinking about the effects of the Constitution on business. 1. One of the basic elements in the Constitution is the separation of powers in the government. What ethical norm would guide the framers’ thinking in creating a system with a separation of powers and a system of checks and balances? Clue: Consider what might happen if one branch of government became too strong. 2. If the framers of the Constitution wanted to offer the protection of unrestricted speech to citizens and businesses, what ethical norm would they view as most important? Clue: Return to the list of ethical norms in Chapter 1. Which ethical norm might the framers view as least important in protecting unrestricted speech? 3. Why should you, as a future business manager, be knowledgeable about the basic protections offered by the Constitution? Clue: If you were ignorant of the constitutional protections, how might your business suffer? In some areas, the state and federal governments have concurrent authority; that is, both governments have the power to regulate the matt.

Meaning of Constitution  In broad sense, the term constitution refers to that body of rules and principles in accordance with which the powers of sovereignty are regularly exercised.  It maybe defined as that written instrument by which the fundamental powers of the government are established, limited, and defined and by which these powers are distributed among the several departments or branches for their safe and useful exercise for the benefit of the people. It has the status of a supreme or fundamental law as it speaks for the entire people from whom it derives its claim to obedience.  It is binding on all individual citizens and all organs of the government.  It is the law to which other laws must conform and in accordance with which all private rights must be determined and all public authority administered.  It is a test of the legality of all government action, whether proceeding from the highest official or lowest functionary.
