THE ANTI-BULLYING ACT OF
2013 (RA 10627)
One who publicly or maliciously imputes to another
a crime, vice, defect, real or imaginary, or any act, omission,
condition, status or circumstance tending to cause the
dishonor, discredit or contempt of a natural or juridical person,
or blacken the memory of one who is dead may be liable for
libel under this code. (Art. 353, RPC) these acts are more
severely punished when done online in addition to the
civil action for damages which may be brought by the
offended party. (Sec. 4(c-4), RA 10 175) cyberlibel holds liable
only the original author of the post (sec. 5(3), implementing
rules of RA 10175). Likers or sharers of a post cannot be held
liable under this law.
Slander may also be applicable to one who, in
heat of anger, utters statements that are highly
defamatory in character. (Art. 358, RPC) Intriguing
Against Honour may also find applicability when the
principal purpose is to blemish the honour or reputation
of a person. (Art. 364, RPC) However, the requirement
is that the post be directed to a specific person. Hence,
a blind item is not as actionable as a named-post in
social media.
Bullying can lead to thoughts about suicide,
sometimes persisting into adulthood. In one study,
adults who were bullied as youth were three times
more likely to have suicidal thoughts or inclinations.

  1. The use of electronic communication to bully a person, typically by sending messages of an intimidating or threatening nature. When a person is tormented, threatened, harassed, humiliated, embarrassed, or otherwise targeted by another person using the internet, interactive or digital technologies or cellphones.
  2. Cyberbullying happens for many of the same reasons as any other type of bullying, but it may be even more appealing because it can be done anonymously. In general, bullies’ behavior usually stems from their own problems. Bullies tend to have less involved parents, to be less excited about school, and to be depressed or anxious. They often have trouble controlling their emotions and impulses and find it hard to follow rules.
  3. Anonymity—Cyberbullying allows bullies to avoid facing their victims, so it requires less courage and provides the illusion that bullies won’t get caught. Ignorance of the consequences—The National Council on Crime Prevention reports that in a survey of teenagers, 81% said they believe others cyberbully because they think it’s funny. Because they don’t see their victims’ reactions in person, cyberbullies may not realize how much damage they are doing. Social pressure—Some cyberbullies may think their behavior is normal and socially acceptable, especially when friends egg them on.
  4. It involves the bully sending offensive and malicious messages to an individual or a group and is often repeated multiple times. Cyberstalking is one form of harassment that involves continual threatening and rude messages, and can lead to physical harassment in the real, offline world.
  5. Flaming is similar to harassment, but it refers to an online fight exchanged via emails, instant messaging or chat rooms. It is a type of public bullying that often directs harsh languages, or images to a specific person.
  6. Exclusion is the act of intentionally singling out and leaving a person out from an online group such as chats and sites. The group then subsequently leave malicious comments and harass the one they singled out.
  7. Outing is when a bully shares personal and private information, pictures, or videos about someone publicly. A person is “outed” when his information has been disseminated throughout the internet.
  8. Masquerading is a situation where a bully creates a fake identity to harass someone anonymously. In addition to creating a fake identity, the bully can impersonate someone else to send malicious messages to the victim.
  9. Youth who are bullied have a higher risk of depression and anxiety. 
  10. Youth who are bullied are more likely to struggle personally and at school. They may: miss, skip or drop out of school receive poor grades have lower self-esteem use alcohol and drugs
  11. Know that it’s not your fault. What people call “bullying” is sometimes an argument between two people. But if someone is repeatedly cruel to you, that’s bullying and you mustn’t blame yourself. No one deserves to be treated cruelly. Don’t respond or retaliate. Sometimes a reaction is exactly what aggressors are looking for because they think it gives them power over you, and you don’t want to empower a bully. As for retaliating, getting back at a bully turns you into one – and can turn one mean act into a chain reaction. If you can, remove yourself from the situation. If you can’t, sometimes humor disarms or distracts a person from bullying. Save the evidence. The only good news about bullying online or on phones is that it can usually be captured, saved, and shown to someone who can help. You can save that evidence in case things escalate. Tell the person to stop. This is completely up to you – don’t do it if you don’t feel totally comfortable doing it, because you need to make your position completely clear that you will not stand for this treatment any more. You may need to practice beforehand with someone you trust, like a parent or good friend.
  12. Reach out for help – especially if the behavior’s really getting to you. You deserve backup. See if there’s someone who can listen, help you process what’s going on and work through it – a friend, relative or maybe an adult you trust. Use available tech tools. Most social media apps and services allow you to block the person. Whether the harassment’s in an app, texting, comments or tagged photos, do yourself a favor and block the person. You can also report the problem to the service. That probably won’t end it, but you don’t need the harassment in your face, and you’ll be less tempted to respond. If you’re getting threats of physical harm, you should call your local police (with a parent or guardian’s help) and consider reporting it to school authorities. Protect your accounts. Don’t share your passwords with anyone – even your closest friends, who may not be close forever – and password-protect your phone so no one can use it to impersonate you. You’ll find advice at passwords.connectsafely.org. If someone you know is being bullied, take action. Just standing by can empower an aggressor and does nothing to help. The best thing you can do is try to stop the bullying by taking a stand against it. If you can’t stop it, support the person being bullied. If the person’s a friend, you can listen and see how to help. Consider together whether you should report the bullying. If you’re not already friends, even a kind word can help reduce the pain. At the very least, help by not passing along a mean message and not giving positive attention to the person doing the bullying.
