The “Dirección Divisional de Patentes”
(Patents Division; DDP in Spanish) is in
charge of conducting the procedures for
the concession and registration of patents,
utility models, industrial designs and
integrated circuit layout designs that are
filed at IMPI. The DDP analyzes the possibility
of granting exclusive rights to inventions
by means of patent titles and registrations
(utility models, industrial designs and
integrated circuit layout designs).
During 2008, the DDP received a total of
20,198 invention applications, which
represented an annual average growth
of 3.5% from 2000 to 2008, distributed as
follows:
Invention applications grew by 1.2% if
compared to 2007. Nevertheless, a
decrease of 0.1% and 9.9% was observed
in the number of patent and utility model
applications respectively, which contrasts
with the increase of 10.4% that industrial
design applications had.
The reduction in the number of patent ap-
plications can be explained by the adverse
worldwide economic situation, which has
inhibited the protection of intellectual
property rights. The latter meant, that for
the first time in the last five years, the trend
of growth of patent applications showed
negative values.
La Dirección Divisional de Patentes (DDP),
es el área encargada de gestionar el
trámite, concesión y registro de solicitudes
de patente, modelos de utilidad, diseños
industriales y esquemas de trazado de
circuitos integrados presentados ante el
IMPI. Analiza la posibilidad de concesión
de derechos exclusivos para invenciones,
por medio del otorgamiento de títulos
(patentes) y registros (modelos de utilidad,
diseños industriales y esquemas de
trazado de circuitos integrados).
Durante el 2008 la DDP recibió un total
de 20,198 solicitudes de invenciones, con
una tasa media de crecimiento anual del
3.5% del 2000 al 2008, distribuidas de la
siguiente manera:
Las solicitudes de invenciones crecieron
en 1.2% con respecto al 2007. No obstante
lo anterior, se observa una disminución
en el ingreso de solicitudes de patente
y de modelo de utilidad del 0.1% y 9.9%,
respectivamente, que contrasta con el
incremento de 10.4% que experimentaron
las solicitudes de diseño industrial.
La contracción en el número de
solicitudes de patentes se puede explicar
por la difícil situación por la que atraviesa
la economía mundial, que ha inhibido la
protección de derechos de propiedad
intelectual. Lo anterior significó que, por
primera vez en los últimos cinco años, la
tendencia de crecimiento en el ingreso
de solicitudes de patente haya registrado
números negativos.

En el 2008, los residentes extranjeros
presentaron un total de 17,938 (88.8%)
solicitudes de invenciones, mientras
que los titulares nacionales ingresaron
2,260 (11.2%). Conviene destacar que
de los modelos de utilidad, el 89.2% de
las solicitudes pertenecen a residentes
mexicanos, le siguen los diseños industriales
(37.3%) y por último las patentes (4.1%).
En el campo de las patentes, continuó
un fuerte ingreso de solicitudes por parte
de residentes de países extranjeros,
destacandolaparticipacióndesolicitantes
de Estados Unidos de Norteamérica,
quienes ingresaron un total de 8,210
solicitudes, es decir, casi el 50% del total
de solicitudes de patentes recibidas en
el IMPI. Sin embargo, es necesario hacer
notar que éstas sufrieron un decremento
de 5.4% con respecto al 2007 (8,681).
El país que mostró un incremento
sustancial, en cuanto al número de
solicitudes ingresadas con respecto al año
anterior, fue Japón con 630 solicitudes lo
que representa una variación del 26.3%.
In 2008, foreign residents filed a total of
17,938 (88.8%) invention applications, while
domestic residents filed 2,260 (11.2%). It
is worth mentioning that 89.2% of utility
model applications, 37.3% of industrial
design applications and 4.1% of patent
applications were filed by domestic
residents.
In the field of patents, foreign residents
filed most of the applications at IMPI.
Residents from the United States of
America filed 8,210 patent applications,
which represents nearly 50% of the total
applications received at IMPI. However,
it is necessary to stress that this amount
represented a 5.4% decrease if compared
to 2007 (8,681).
The country which showed the greatest

participación durante el 2008, con más
de 150 solicitudes de patente ingresadas
al IMPI fueron las siguientes: The Procter

AG (260), Kimberly-Clark Worldwide, Inc.
(203), BASF SE (168), F.Hoffmann-La Roche

De los estados de la República Mexicana
que aportaron el mayor número de
solicitudes de patente fueron el Distrito
Federal (219), Nuevo León (97), Jalisco
(63), Estado de México (51) y Guanajuato
(32); representando, solo estos cinco
estados, el 67.4% del total de solicitudes
de patente.
Del total de solicitudes de patente
presentadas por residentes nacionales, el
88.6% corresponde a inventores
independientes (355), empresas (152) y
universidades (100).

Por otro lado, de las 16,581 solicitudes
recibidas en México, 14,160 (85.4%) fueron
solicitudes que ingresaron a través del
Tratado de Cooperación en Materia de
Patentes (PCT).
Las solicitudes PCT han mostrado un
crecimiento promedio anual en el
periodo 2000-2008 del 4.9%, mientras
que las solicitudes por la vía tradicional
disminuyeron casi en la misma proporción
(4.2%).

PCT applications have shown an annual

Respecto al desempeño de la DDP en la
aplicación de las disposiciones legales
y administrativas relacionadas con los
procedimientos para emitir títulos
de patentes, registros de modelos
de utilidad y diseños industriales, se
concluyeron 19,489 expedientes distribuidos
de la siguiente forma:
•Del total de conclusiones, el 97.6% se
dictaminó durante el examen de fondo
y el 2.4% restante en acciones oficiales
durante el examen de forma.
•Dentro de las 2 etapas de análisis de
solicitudes, la DDP realizó las siguientes
acciones:
Durante el examen de forma, resolvió
22,792 solicitudes, siendo el 98.2%
oficios favorables (22,387); 1.4% de
abandonos (330) y 0.4% restante de
desechamientos (52) y/o desistimientos
(23).
Durante el examen de fondo se
emitieron un total de 19,024
conclusiones, conformadas por 13,800
citas a pago, 5,074 abandonos, 75
negativas y 75 desistimientos.
Regarding the performance of the DDP in
applying legal and administrative orders
related with the procedures to issue
patent titles, utility model and industrial
design registrations, 19,489 files were
concluded in the following way:

During the substantive examinations,
a total of 19,024 conclusions were
issued consisting of 13,800 fee payment
notices; 5,074 corresponded to
abandoned applications, 75 to
rejections and 75 to withdrawals.

Cabe mencionar que, respecto a la
emisión de citas a pago, durante el
ejercicio 2008 (13,800) se observó una
caída del 14.2% con respecto al año
anterior, que fue de 16,094.
Del total de asuntos concluidos (19,489), el
52.5% (10,233) correspondió a solicitudes
consideradas dentro del universo del
rezago; mientras que el resto (9,256) fueron
consideradas como asuntos en tiempo.
Además, la DDP emitió 28,695 oficios
para la subsanación de requisitos (8,227
de forma y 20,468 de fondo), lo que en
adición a los asuntos concluidos significó
la revisión de 48,184 asuntos relacionados
a expedientes durante el 2008 en las
diferentes etapas de examen.
De los 13,800 dictámenes con citas a pago
durante el examen de fondo, el 77.8%
fueron resueltos conforme a los tiempos
establecidos por la DDP.
•El 76% de las citas a pago de patente
cuentan con una antigüedad igual o
menor a 4 años; el 85% de diseños
industriales cuentan con una
antigüedad igual o menor a 1 año y el
82% en el caso de modelos de utilidad
tienen una antigüedad igual o menor a
2 años.
Otorgamiento y Registros.
•Durante el 2008, la DDP emitió un total
de 13,172 títulos de patente o registros
de modelos de utilidad y de diseños
industriales, que representa un
incremento del 2.5% respecto del año
2007, en la emisión de títulos; esto ha
sido posible gracias a la implementación
de procedimientos que han permitido
avanzar para abatir el rezago en la
elaboración y notificación de los títulos
de patente y/o registros.

established by the DDP.

related to industrial designs corresponded

models corresponded to applications

Grants and Registrations.
•During 2008, the DDP issued 13,172
patent titles or utility model and industrial
design registrations; which represented
a 2.5% increase if compared to the year
2007. This is the result of the implementation
of proceedings which have allowed to
reduce the backlog related to the
preparation and notification of patent
titles and/or registrations.

•Se incrementó el número de
patentes concedidas en 4.9% con

cuya distribución por nacionalidad
del titular se presenta a continuación:
•Destaca que los Estados Unidos de
Norteamérica es el país con el mayor
número de títulos de patente otorgados
en México en los últimos 2 años; los
titulares mexicanos representan el 1.9%
del total con 197 títulos de patente
otorgados en el 2008.
•Dentro de otras actividades realizadas
por la DDP, participó en 56 visitas de
inspección y en la emisión de 32
opiniones técnicas en materia de asuntos
contenciosos (infracciones y nulidades)
en patentes y registros.
•Emitió los ejemplares extraordinarios
62 y 65 de la Gaceta de la Propiedad
Industrial denominada “Publicación de
Patentes Vigentes de Medicamentos de
Conformidad con el Artículo 47-Bis del
Reglamento de la Ley de la Propiedad
Industrial”.

issuance of 32 technical opinions regarding
contentious matters (infringements and
nullities) related to patents and registrations.
•Published the extraordinary volumes 62
and 65 of the Industrial Property Gazette
named “Publication of in-force
Pharmaceutical patents in accordance
with article 47-bis of the Regulations
under the Industrial Property Law”.

La Dirección Divisional de Marcas (DDM)
es el área que se encarga de examinar las
solicitudes de signos distintivos presentadas
ante el IMPI, como son las marcas, los avisos
comerciales, la publicación de nombres
comerciales, la declaración de protección
de las denominaciones de origen y sus
autorizaciones de uso, aplicando las
disposiciones legales y administrativas en
el procedimiento de resolución.
Además, realiza actividades relativas a
la inscripción de licencias, transmisiones y
conservación de derechos derivados de
los registros y publicaciones en materia de
signos distintivos.
Durante el año 2008, la DDM realizó las
siguientes actividades:
•Recibió un total de 84,287 solicitudes
de signos distintivos, reportando una
variación anual ascendente de 1.3%
con respecto al año 2007.

as trademarks, slogans, trade names,
declarations for the protection
of appellations of origin and the
corresponding authorizations for their use;

In addition, carries out activities
related with the registration of licenses,
transmissions and preservation of rights
which are derived from the registration
and publication of distinctive signs.
During the year 2008, the DDM executed

annual variation of 1.3% if compared

Del total de solicitudes recibidas, 77,467
corresponde a marcas, 6,713 a avisos
comerciales y 107 a nombres comerciales.
Como se puede observar, las solicitudes
de signos distintivos tuvieron un
comportamiento desigual, dado que se
detectó una variación anual en el periodo
2007-2008 de 0.5% en marcas, de 11.7% en
avisos comerciales y una drástica
reducción del 24.1% en cuanto a las
solicitudes de nombres comerciales.

Del total de las solicitudes de marcas,
50,680 (65.4%) de ellas corresponden a
solicitantes nacionales. A continuación
se presentan las solicitudes de marcas
clasificadas de acuerdo a la nacionalidad
de los usuarios:
El país que ingresó el mayor número de
solicitudes, después de México, fueron
los Estados Unidos de América con 11,172
solicitudes con una participación de 14.4%
respecto del total.
Por otro lado, la DDM realizó una serie de
acciones encaminadas a dar respuesta a
la demanda de documentos, por lo que
concretó las siguientes tareas:

domestic applicants. The next graph shows

The country that filed the most
applications, after Mexico, was the United
States of America with 11,172 applications
representing 14.4% of the total.
In addition, the DDM carried out several
actions aimed at satisfying the demand
of documents, undertaking the following
tasks:
•Received 173,845 documents for the
renewal of distinctive signs, or to provide
response to voluntary amendments,
requirements and requests for the issuing
of certified copies, among others.
•Handed out at IMPI´s facilities 188,378
documents, of which 148,002 were office

•Emitió 23,923 búsquedas fonéticas
y/o figurativas en la ventanilla de
correspondencia, permitiendo a los
usuarios tomar decisiones relativas a la
susceptibilidad del registro de sus signos
distintivos.
Durante el 2008 la DDM otorgó 63,063
registros de signos distintivos; 57,713
correspondieron a marcas (91.5%), 5,309 a
avisos comerciales (8.4%) y 41 a nombres
comerciales (0.1%), significando todo ello
un incremento de 15.8% con respecto al
año anterior.
En la gráfica siguiente se presentan los
registros de marcas, de acuerdo a la
nacionalidad del titular:

•Cabe señalar que países como Reino
Unido, Suiza, Francia, España y Alemania,
a pesar de tener una baja participación
eneltotalderegistros,hanincrementado
el número de registros en nuestro país;
mientras que si bien los Estados Unidos
de Norteamérica fue el segundo país en
obtener un mayor número de registros,
lo hizo en menor cantidad con respecto
al 2007.
Por otro lado la DDM, durante el periodo
que se reporta, emitió 86,561 resoluciones,
de las cuales 63,063 fueron registros,
14,859 abandonos, 280 desistimientos, 35
desechamientos y 8,324 negativas.
Durante el 2008, por cada diez solicitudes
de signos distintivos presentadas ante
el Instituto, siete fueron susceptibles de
registro y tres no fueron concedidas por
diversos factores.
En materia de procedimientos
administrativos, la DDM:
•Proporcionó 169,617 expedientes para
su consulta, de los cuales 109,161 fueron
para personal incorporado a las
diferentes áreas del Instituto y 60,456 al
público en general.

Spain and Germany, even though they
have a low participation in the total of
trademarks registered, have increased
the number of registrations in our country;
while the United States of America was
the second country in obtaining the
most trademark registrations in 2008, but

During the period informed, the DDM
issued 86,561 resolutions, of which 63,063

Otorgó 9 autorizaciones de uso de
la Denominación de Origen “Tequila”
y 30 autorizaciones de uso de la

Facultó a los usuarios autorizados de
una Denominación de Origen para
hacer uso de su marca a quienes
distribuyan o vendan sus productos,
teniendo un total de 265 inscripciones

diversas empresas envasadoras y/o
distribuidoras.
•En cuanto a Licencias de Uso,
Franquicias, Cesiones de Derechos,
Tomas de Nota y Renovaciones:
Emitió 122,786 dictámenes, en
donde 11,633 fueron inscripciones de
licencias de uso; 13,258 inscripciones
de transmisiones de derechos; 2,649
inscripciones de franquicias; 13,765
renovaciones y 48,229 tomas de
nota. Los 33,252 dictámenes restantes
correspondieron a requisitos, cambios
de nombre del titular, acreditamientos
de apoderado, gravámenes y
cancelaciones voluntarias, entre otros.
•Además, desarrolló diferentes
actividades como:
Realizó el programa de depuración
de expedientes en trámite y detectó
los expedientes abandonados; trabajo
que se vio reflejado en la publicación
de los ejemplares extraordinarios
61, 63, 64 y 66 de la Gaceta de la
Propiedad Industrial, correspondientes

•Participó, conjuntamente con la
Organización Mundial de la Propiedad
Intelectual (OMPI) en los trabajos
de revisión de terminología para la
publicación de la novena edición
de la Clasificación Internacional de
Productos y Servicios para el Registro
de las Marcas (Clasificación de Niza),
en el idioma español.
•Liberó el Sistema de Asistencia o
Ayuda para el llenado de Solicitudes
de Registro de Marca, Aviso Comercial
y Solicitudes de Publicación de Nombre
Comercial (SOLMARNET), la cual es
una aplicación para ayudar al público
usuario en el llenado e impresión del
formato IMPI-00-006, que se presenta
ante el Instituto.
•En la atención y resolución de
solicitudes de registro de marcas,
avisos comerciales y publicación de
nombres comerciales, se concluyó
con el “Programa de Abatimiento de
Rezago y la Atención de Asuntos en
Trámite de Marcas”, y no se generó
rezago nuevo, por lo que al cierre de
2008 no se reportó rezago alguno y
todas las solicitudes fueron atendidas
cumpliendo con los plazos máximos
establecidos para su respuesta.
•Took part, jointly with the World
Intellectual Property Organization
(WIPO), in the revision of the terminology
for the publication of the 9th Edition
of the “International Classification of
Goods and Services for the Purposes of
the Registration of Marks under the Nice
Agreement” in Spanish.
•Launched the Assistance System for
filing trademark, trade name and slogan
applications (SOLMARNET), which is
intended to help users to fill out and print
IMPI’s form IMPI-00-006, which has to be
presented before the Institute.
•Regarding the attention and resolution
of trademark and trade name
applications for their registration and
the applications for the publication of
slogans, the “Program for the reduction
of backlog and the attention of pending
trademarks” was concluded. At the end
of 2008 no more backlog was generated,
since all applications were attended
within the established reponse times.

Actividades de Protección
a la Propiedad Intelectual

Protection Activities
La Dirección Divisional de Protección
a la Propiedad Intelectual (DDPPI) es
la encargada de tramitar y resolver
procedimientos encaminados a imponer
sanciones por violación a los derechos
de propiedad industrial y derechos de
propiedad intelectual basados en la Ley
Federal del Derecho de Autor; y a declarar
la nulidad, caducidad o cancelación
de los registros de signos distintivos y de
invenciones cuando un tercero se siente
afectado por el otorgamiento de los
mismos.
Durante el 2008 la DDPPI realizó las
siguientes actividades:
•Desarrolló campañas, con diversas
instituciones, para el combate a
la piratería; entre ellas, el Segundo
Concurso de Dibujo Infantil “Los Niños
contra la Piratería”, recibiendo un total
de 2,282 dibujos.
•Realizó 1,350 encuestas a consumi-
dores, con el fin de obtener datos
estadísticos sobre piratería y compe-
tencia desleal.
•Finalizó el proyecto de “Empate de
Fracciones Arancelarias y el Clasificador
de Productos y Servicios para el Registro
de Marcas”, para que en conjunto con
la Administración General de Aduanas,
sea más efectivo el control del ingreso
de mercancías piratas o apócrifas a
nuestro país.
•Recibió 53 denuncias a través del
“Buzón de Piratería” habilitado en la
página web del IMPI; atendiendo 49 de
ellas en un plazo menor a 48 horas.
•Promovió y administró, junto con la
Academia Mundial de la OMPI, las
dos sesiones del año 2008 del curso a
distancia DL-101S: “Curso General de
Enseñanza a Distancia sobre Propiedad
Intelectual” dirigido a todo el público de
habla hispana; para el cual designó a
20 tutores de distintas áreas del Instituto
y a un jefe de tutores registrados ante la
OMPI. Durante estas dos sesiones hubo
un total de 4,331 alumnos inscritos.
•Participó en el Primer Encuentro
de Negocios con Fabricantes y
Comercializadores, que se llevó a cabo
los días 6, 7 y 8 de noviembre en la
ciudad de Puebla, con el fin de buscar
la reconversión del mercado interno.

•Sostuvo pláticas con el Gobierno del
Estado de Morelos, con la intención de
lograr la firma de un Acuerdo Estatal
contra la Piratería en el que se involucre
tanto a las autoridades Federales y
Estatales, como al sector productivo del
Estado.
•Inició el proyecto para la creación
del padrón aduanero de marcas, que
tiene por objeto facilitar la búsqueda
de registros marcarios, así como de
licenciatariosydistribuidoresautorizados,
por medio de un sistema de registro
electrónico de los titulares que deseen
proteger sus derechos en México, con
el fin de contribuir a la detección de
posibles violaciones a los derechos de
Propiedad Industrial en las aduanas.
•Participó en 14 talleres, durante los
cuales se capacitaron 525 funcionarios
de Aduanas en materia de propiedad
intelectual.
•Firmó un Convenio de Colaboración
con el Centro Mexicano de Protección
y Fomento de los Derechos de Autor,
Sociedad de Gestión Colectiva, con el
fin de promover una cultura de legalidad
y respeto a los derechos de autor en
nuestro país.
•Organizó junto con la Suprema Corte
de Justicia de la Nación (SCJN), el
Colegio de Magistrados de Circuito y
Jueces de Distrito del Poder Judicial de
la Federación, el Instituto Nacional del
Derecho de Autor (INDAUTOR), así como
el sector privado, el Primer Encuentro
Internacional en Propiedad Intelectual,
que se llevó a cabo en Cancún,
Quintana Roo, del 26 al 29 febrero 2008.
•Participó en la tercera y cuarta
reunión de la Alianza para la Seguridad
y Prosperidad de América del Norte
(ASPAN), llevadas a cabo en Canadá
y Estados Unidos, respectivamente. En
esta Alianza se ha desarrollado un grupo
de trabajo especializado en propiedad
intelectual con la participación de varias
autoridades involucradas en el tema de
protección de derechos, entre ellos, la
Procuraduría General de la República
(PGR), la AGA, el INDAUTOR, la Comisión
Federal para la Protección contra
Riesgos Sanitarios (COFEPRIS) y el IMPI.
•Carried out meetings with the
Government of the State of Morelos, with
the intention of signing an Agreement
against piracy involving Federal and
State Authorities, as well as the business
sector.
•Initiated the Project aimed at the
creation of a Trademarks-Customs
register, that has the objective of
facilitating trademark searches, as
well as the identification of authorized
licensees and distributors, by means of
an electronic system containing the
information of the holders that wish
to protect their rights in Mexico. This
project will help the customs office to
detect possible industrial property rights
infringements.
•Participated in 14 workshops, in which
525 customs officers were trained on
intellectual property matters.
•Signed a Collaboration agreement with
the “Centro Mexicano de Protección
y Fomento de los Derechos de Autor,
Sociedad de Gestión Colectiva”
(Mexican Center for the Protection and
Promotion of Copyrights, Collective
Management Society; CEMPRO in
Spanish) with the aim of promoting a
culture of legality and respect towards
copyrights in our country.
•Organized with the “Suprema Corte de
Justicia de la Nación” (Nations Supreme
Court of Justice; SCJN in Spanish), the
“Colegio de Magistrados de Circuito”
(College of Circuit Magistrates), the
“Jueces de Distrito del Poder Judicial
de la Federación” (Federations Judicial
Power District Judges), the “Instituto
Nacional del Derecho de Autor”
(Copyrights National Institute; INDAUTOR
in Spanish), as well as with the business
sector, the First International Intellectual
Property Meeting, that was held in
Cancun, Quintana Roo, on February
26th-29th, 2008.
•Participated in the third and fourth
meeting of the Security and Prosperity
Partnership (SPP), which were held
in Canada and in the United States
of America. Under this alliance, a
specialized workgroup on intellectual
property was developed with the
participation of different authorities
involved in the protection of IPR’s, among
them the “Procuraduría General de la
República” (Attorney General’s Office;
PGR in Spanish), AGA, INDAUTOR, the
“Comisión Federal para la Protección
contra Riesgos Sanitarios” (Federal
Commission for the Protection against
Sanitary Risk; COFEPRIS in Spanish) and
IMPI.

ACTA (por sus siglas en inglés) en
conjunto con otras autoridades
(Secretaría de Economía, PGR, AGA,

entre sus miembros para ofrecer una
fuerte protección de los derechos de
propiedad intelectual.

como objeto analizar los derechos de
Propiedad Industrial, integrándolos a
la Averiguación Previa respectiva, que
sirven como requisito dentro del ejercicio
de la acción penal.
•Participated in the revision of the
content of the Anti-Counterfeiting
Trade Agreement (ACTA) jointly with the
“Secretaría de Economía” (Ministry of
the Economy; SE in Spanish), PGR, AGA
and INDAUTOR. This agreement aims
to offer a legal framework among its
members to promote a strong protection
of intellectual property rights.
•Issued 23,819 official letters related to
procedures, which represented a slight

Visitas de Inspección.
•En cumplimiento con la LPI y la LFDA,
el Instituto efectúa visitas de
inspección con la intención de verificar
las condiciones de uso y explotación de
los derechos de propiedad intelectual
realizando, para ello, las siguientes

Actividades de la Coordinación
de Planeación Estratégica
Strategic Planning
La Coordinación de Planeación
Estratégica (CPE), es el área encargada
de coordinar el establecimiento de las
directrices institucionales del IMPI, para
un óptimo cumplimiento de las facultades
que tiene encomendadas.
En el año 2008 realizó las siguientes
actividades:
•Integró el Programa Estratégico 2008-
2012, el cual contiene los objetivos,
las estrategias y líneas de acción para
afrontar los retos que prevé el Instituto a
mediano y largo plazo.
•Como parte del Sistema de Evaluación
del Desempeño (SED), promovido por
la Secretaría de Hacienda y Crédito
Público (SHCP), integró la matriz de
indicadores de resultado del programa
presupuestario del IMPI denominado,
“ProtecciónyPromocióndelosDerechos
de Propiedad Industrial”, en el que se
establecen los objetivos, las metas y los
indicadores relativos a la conclusión de
trámites relacionados con la protección
de derechos de signos distintivos,
invenciones y solicitudes de declaración
administrativa.
•Dentro de los proyectos institucionales
que requieren inversión financiera, la
CPE actualizó el análisis costo-beneficio
de los siguientes proyectos de inversión
en ejecución y por ejecutar:
Arrendamiento financiero del
inmueble ubicado en Arenal 550.
Adecuaciones a las áreas físicas de
los edificios de Arenal y Pedregal.
Construcción del inmueble para
archivo.

The “Coordinación de Planeación
Estratégica” (Strategic Planning
Coordination; CPE in Spanish), is in charge
of implementing the institutional guidelines
for the adequate fulfillment of IMPI´s
attributions.
In the year 2008 the CPE carried out the
following activities:
•Prepared the Strategic Program 2008-
2012, which contains the objectives,
strategies and courses of action to face
the challenges foreseen by the Institute
in the middle and long term.
•As part of the Performance and
Evaluation System, promoted by the
“Secretaría de Hacienda y Crédito
Público” (Ministry of Finance and Public
Credit; SHCP in Spanish), prepared the
IMPI´s Budget Program indicators called
“Protection and Promotion of IPR’s”,
in which the objectives, goals and the
indicators regarding the conclusion
of procedures for the protection
of distinctive signs, inventions and
administrative declaration applications
were established.
•Within the institutional projects that
require financial investment, the CPE
updated the cost-benefit analysis of
the following investment projects in
execution or about to be executed:
Financial leasing of the Arenal 550
building.
Refurbishment of different areas
located in the Arenal and Periférico
buildings.
Construction of an archives building.
Refurbishment of the Northern
Regional Office (ORN).
Acquisition of the Center Regional
Office (ORC).

de información institucional, dirigidos
a diversas instancias gubernamentales,

Procedimientos, en congruencia con
los objetivos de la Ley de la Propiedad
Industrial y demás ordenamientos
legales.
•Coordinó la operación del Comité de
Mejora Regulatoria Interna (COMERI),
en donde se analizaron disposiciones
normativas internas relacionadas con la
administración de los recursos humanos,
financieros y materiales, revisando el
66% de los casos atendidos.

Income of the SHCP.
•Followed up institutional information
requirements, from different government

Quarterly Reports presented by IMPI’s
Director General to the Governing

•Coordinated the updating of the
Procedures and Organisational Manuals,
in compliance with the objectives of the
LPI and other legal regulations.
•Coordinated the operation of the
“Comité de Mejora Regulatoria Interna”
(Internal Regulatory Improvement
Committee; COMERI in Spanish), where
the internal normative dispositions
related to the management of human,
financial and material resources were
analyzed; checking 66% of the attended
cases.

Programa de Mejora de la Gestión (PMG).
Como parte del Programa Especial de
Mejora de la Gestión en la Administración
Pública Federal 2008-2012 de la Secretaría
de la Función Pública (SFP), el 18 de
septiembre del 2008 el Instituto designó
a la CPE como responsable de cumplir
los objetivos de dicho programa. En ese
contexto, durante el último trimestre
del 2008 se ejecutaron las siguientes
actividades para los 7 sistemas que
componen el PMG:
•Sistema de trámites y servicios de
calidad.
Seleccionó los procesos sustantivos
de alto impacto en la entidad para
análisis y mejora.
Integró los inventarios de trámites y
servicios que presta el Instituto.
•Atención y participación ciudadana.
Creó los formatos para la realización
del diagnóstico de mecanismos de
atención y participación ciudadana.
Creó los formatos de registro de
inventarios de oficinas de atención
al público en trámites y servicios y el
registro integral del personal.
Inició el llenado de formatos por
parte de las áreas responsables de
instrumentación.

Llevó a cabo la aplicación de
encuestas al público usuario para
obtener los costos directos e indirectos
de los diferentes trámites y servicios.
Coordinó la captura de información,
resultado de las encuestas en el sistema
de la Comisión Federal de Mejora

Realizó el catálogo de emisores de
disposiciones normativas internas en el
IMPI.

the “Secretaría de la Función Pública”

conforme a la iniciativa presentada
el 7 de marzo de 2006, ante la

La Coordinación de Proyectos Especiales
(CPESP) es la encargada de la planeación,
programación, presupuestación,
ejecución y control administrativo de las
obras y servicios que requiere el Instituto.
Durante el 2008 desarrolló actividades
encaminadas a la contratación de obras
públicas de servicio para cinco proyectos
de inversión, lo que representó un total de
$83’237,764.22 de los cuales se erogaron
$32’221,276.52. Destaca que 3 contratos
se celebraron de manera plurianual, y la
diferencia se programará para erogarse
durante el 2009.
Los contratos celebrados son los

A continuación se presenta una breve
reseña de los alcances de los proyectos
que conforman la “Construcción de
Inmueble y Equipamiento para el Manejo
de Acervos Documentales de Marcas y
Patentes del IMPI”:
• Asesoría para adquirir licencias
de fusión, de factibilidades y de
construcción. Se logró obtener los
permisos, licencias y certificados
requeridos para iniciar la construcción
del edificio para el archivo de marcas y
patentes, encontrando:

The “Coordinación de Proyectos
Especiales” (Special Projects Coordination;
CPESP, in Spanish) is responsible for

implementation and administrative control
of building works and services required by
the Institute.
During 2008, the CPESP carried out activities
with the purpose of contracting service

correspondientes para la construcción del
inmueble y equipamiento para el manejo
de acervos documentales de marcas y
patentes del IMPI, la Coordinación de
Proyectos Especiales realizó:

La Dirección Divisional de Promoción y
Servicios de Información Tecnológica
(DDPSIT) es la encargada de promover y
difundir el conocimiento de la Propiedad
Industrial en México, así como los servicios
del IMPI, para contribuir al fomento de
una cultura de protección y respeto de los
derechos de propiedad industrial.
Durante el ejercicio 2008, la DDPSIT
emprendió diversos proyectos, cuyos
resultados se presentan a continuación:
•Coordinó 924 actividades de
promoción; entre las que se encuentran
cursos, talleres, conferencias, ciclos
de conferencias, diplomados, ferias y
exposiciones.

representando el 21.1% de las
actividades de promoción realizadas
en el Instituto. Cabe mencionar que
a raíz de la apertura de la ORC, la
circunscripción de la DDPSIT se redujo a
tres estados: Distrito Federal, Estado de
México e Hidalgo. Sin embargo, a finales
del ejercicio 2008, la responsabilidad de
la atención del estado de Hidalgo fue
transferida a la ORC.
Del total de actividades programó la
realización de 22 cursos presenciales
por semestre, siendo 44 cursos en el
año, en donde tuvo la participación
de 1,286 personas.
Realizó 151 actividades llevadas a
cabo por el personal de la DDPSIT,
destacando 2 en Estados Unidos,
1 en Panamá y 1 en República
Dominicana.

activities carried out in the Institute. It is

However, at the end of 2008, the state of
Hidalgo was transferred to the ORC for
its coverage.

courses per semester, totaling 44

attended by 1,286 people.
Carried out 151 activities executed by
DDPSIT´s personnel, standing out 2 in
the United States, 1 in Panama and 1 in
the Dominican Republic.
World Intellectual Property Day.
•Organized a commemorative event for
the World Intellectual Property Day in the
“Raúl Ramos Tercero” auditorium from
the Ministry of the Economy (SE).
•RenewedtheCollaborationAgreement
with the “Instituto Mexicano del Petróleo”
(Mexican Petroleum Institute; IMP in
Spanish).
•Collaborated in the award of the
Children’s drawing contest: “children
against piracy” (event coordinated
by the DDPPI) as well as the winners of
the Second Digital Animation Contest
organized by the Business Software
Alliance (BSA); with the participation of
the INDAUTOR.
IMPI´s XV anniversary.
Due to IMPI´s XV anniversary:
•Organized an international seminar
called “Industrial Property Vanguard
Themes”, with the participation of Mr.
Francis Gurry, Director General of the
World Intellectual Property Organization,
as well as of distinguished representatives
from foreign industrial/intellectual
property offices.

Difusión de la Propiedad Industrial.
•Elaboró y coordinó el Programa
Institucional de Comunicación Social
(PCS) 2008, que contempló la realización
de una campaña de radio denominada
“Conoce y protege la Propiedad
Intelectual”.
•Elaboró boletines de prensa para dar a
conocer a los medios de comunicación
las acciones más relevantes realizadas
por el Instituto.
Medallas a la Innovación.
•Otorgó la “Medalla del IMPI a la
Innovación” en diversos certámenes,
como:
El “Premio a las Mujeres Mexicanas
Inventoras e Innovadoras, Emisión Iris
Estrada”, organizado por el Instituto
Nacional de las Mujeres (INMUJERES).
El evento denominado “4a
Convención de Investigación Aplicada
y Desarrollo Tecnológico 2008”,
organizado por el Consejo de Ciencia
y Tecnología del Estado de Puebla

•Actualizó con la colaboración del área
sustantiva correspondiente, los trípticos
y las guías de usuarios de patentes,
modelos de utilidad, diseños industriales,
signos distintivos, infracciones en
materia de comercio, procedimientos
contenciosos ante el IMPI y del Centro
de Información Tecnológica.
•Difundió y envió diversos materiales
informativos a las Oficinas Regionales.
•Elaboró y distribuyó el Informe Anual
de Actividades 2007 de forma impresa
y por medio de un CD. Asimismo, este

•Received 2,045 technical information

(PYMETEC) recibió 234,317 visitas,
realizándose 5´219,532 consultas.
•Digitalizó a través de una empresa
externa, 42,561 documentos de
patentes, lo que significa que dicha
información puede ser consultada de
forma electrónica por los examinadores
de patentes.
•Sole inventors or individuals were the
ones that requested the most technical

Vigilancias Tecnológicas.
•Realizó la propuesta de vigilancia para
“Inyección de dióxido de carbono en
pozos exhaustos”, que servirá como
material de trabajo para la Comisión
Federal de Electricidad (CFE).
•Difundió el Diplomado en Gestión
Tecnológica de la Gerencia de Estudios
de Ingeniería Civil y Ciencias de la Tierra
de la CFE.
Centros de Patentamiento.
•Efectuó dos reuniones de trabajo
con los titulares de los centros de
patentamiento, con el fin de exponer los
logros obtenidos y la problemática a la
que se enfrentan durante la operación
de los mismos, tocando temas como
el “Proyecto de vigilancia competitiva
y desarrollo de negocios basados en
ciencia y tecnología” y “El modelo de
gestión para apoyo de la apropiación y
explotación de la propiedad intelectual
en el IMP.”
•Entró en operación el centro de
patentamiento de INCUBAEMPRESAS-
Asociación de Empresarios de
Iztapalapa, aumentando el número de
centros de patentamiento a cargo de la
DDPSIT a ocho.
Acervos Documentales.
•Fotocopió 25,294 páginas de acervos
de la Subdirección de Servicios de
Información Tecnológica; de las cuales
24,825 fueron copias simples y 469
certificadas.
•Realizó un total de 2,570 préstamos de
acervos documentales para consulta
en sus diferentes soportes: microformato
(30), papel -gaceta, memoria técnica,
libros- (2,283), CD/DVD (130) y formato
electrónico keyfile (127).
Technological Surveillance.
•Prepared the proposal for a
technological surveillance on “carbon
dioxide injection in exhausted wells”. This
will serve as support for the “Comisión
Federal de Electricidad” (Federal
Electricity Commission; CFE in Spanish).
•Disseminated the Diploma Degree
Course on Technological Management
from the Civil Engineering and Earth
Sciences Division of the CFE.
Patent Assistance Centers.
•Carried out two work meetings with
the Heads of the patent assistance
centers, with the aim of showing their
achievements and the operational
problems they face. Issues like the
project “competitive surveillances and
science and technology based business
development”, as well as “Management
model to support intellectual property
appropriation and exploitation at the
IMP” were discussed.
•The patenting center of
INCUBAEMPRESAS-Iztapalapa Managers
Association began operating, increasing
the number of patent assistance centers
assisted by the DDPSIT to eight.
Documental Archives.
•Photocopied 25,294 pages of the
documental archives managed by the
“Subdirección Divisional de Servicios
de Información Tecnológica” (Deputy
Direction of Technological Information
Services; SDSIT in Spanish); of which
24,825 were simple copies and 469 were

Regional Offices Activities
La Dirección Divisional de Oficinas
Regionales (DDOR) es la encargada de
coordinar el funcionamiento de las cinco
oficinas situadas estratégicamente en el
interior del país, las cuales llevan a cabo
las labores de asesoría especializada,
promoción del sistema de propiedad
industrial,recepciónytrámitedesolicitudes
de las diferentes figuras contempladas en
la Ley de la Propiedad Industrial (LPI).
Durante el año 2008, las cinco Oficinas
Regionales del IMPI continuaron con una
labor permanente de promoción de los
servicios que ofrece el Instituto, así como
de los beneficios que ofrece el sistema de
Propiedad Industrial. En el siguiente cuadro
se muestra un resumen de las principales
actividades que se llevaron a cabo:

The “Dirección Divisional de Oficinas
Regionales” (Regional Offices Division;
DDOR in Spanish) is in charge of

IPR´s recognized by the LPI.

Oficina Regional Occidente (ORO).
La Oficina Regional Occidente (ORO)
ubicada en Zapopan, Jalisco, tiene una
circunscripción asignada caracterizada
por una diversidad de sectores
económicos, debido a que cuenta con
actividades agropecuarias, ganaderas,
industriales, comerciales, de turismo,
pesca, etc.
Las actividades más relevantes realizadas
por la ORO fueron las siguientes:
•Llevó a cabo el “Taller Internacional
sobre el Uso de los Sistemas de Patentes
para la Promoción de la Innovación”,
con una asistencia de 120 personas.
•Coordinó el evento conmemorativo
para la celebración del Día Mundial de
la Propiedad Intelectual, llevado a cabo
en la Cámara Nacional de Comercio
(CANACO), ubicada en la ciudad de
Guadalajara, registrando una asistencia
de 200 personas.
•ParticipóeneleventodeEmprendurismo
en el que asistieron 300 personas.
•Realizó el Seminario Internacional para
PYME´s del sector agropecuario en dos
ocasiones, con una asistencia de 200
personas.
•Participó en la Feria Internacional
del Libro (FIL), brindando asesoría
especializada en el Salón de Derechos
a autores y al público en general.
Western Regional Office (ORO in Spanish).
The ORO is located in Zapopan, Jalisco;
covering an area with a great diversity of
economic activities such as: agriculture
andfarming,livestock,industry,commerce,
tourism, fishery, etc.
The most relevant activities undertaken by
the ORO were the following:
•Carried out the “International
Workshop on the use of the Patents

Oficina Regional Norte (ORN).
La Oficina Regional Norte (ORN), ubicada
en Monterrey, Nuevo León, se caracteriza
por encontrarse en una zona con una
importante industria maquiladora,
armadora, ganadera, metalúrgica y
agroindustrial.
Durante el año 2008 emprendió las
siguientes actividades:
•Formó y capacitó recursos humanos
especializados en propiedad industrial,
entre ellos a más de 150 catedráticos,
con lo que incrementó las invenciones
otorgadas a través de dicha Oficina.
•Negoció con los gobiernos estatales y
municipales, en pro de la protección de
los activos de las PYME´s, el pago parcial
o total específico para la protección
de los derechos de signos distintivos
e innovaciones, lo que tuvo como
resultado el desarrollo de 200 signos
distintivos y 70 innovaciones.
•Organizó el evento internacional
denominado “Prácticas Internacionales
de PI: Haciendo Efectiva su Protección”.
Se especializaron 67 empresas.
•Participó en 5 reuniones de foros
consultivos analizando los temas
vinculados con la Propiedad Industrial.
•Colaboró con el Instituto Tecnológico
y de Estudios Superiores de Monterrey
(ITESM), en la formación de recursos
humanos especializados en propiedad
industrial.
Northern Regional Office (ORN in Spanish).
The ORN is located in Monterrey, Nuevo
León; covering an area with an important
manufacturing industry, livestock,
metallurgic and agribusiness activities.
During the year 2008, the ORN undertook
the following activities:
•Trained specialized human resources
on industrial property matters, among
them more than 150 academics, which
resulted in an increase in the innovations
granted through this office.
•Negotiated with the local and
state governments, the partial or
total payment for the protection of
distinctive signs and innovations rights
from SME’s, which resulted in the
development of 200 distinctive signs
and 70 innovations.
•Organized the international event
called “IP International Practices:
making your protection effective”;
specializing 67 enterprises on IP
matters.
•Participated in 5 Consultative Forum
meetings, analyzing subjects related to
industrial property.
•Collaborated with the “Instituto
Tecnológico y de Estudios Superiores
