3. Recognition of forest right act 2oo6 schedule
and other traditional forest dewellers that the
forest legislation passed in India at December
18 , 2oo6 this is call the forest right act .
4. Purpose of this acts is that secure individual
or community tenure or both shall be the right
of forest dwelling schedule tribe and other
traditional forest dwellers on the forest land .
5. Right to hold and live in the forest land under the individual
or common occupation for habitation or self- cultivation for
livelihood by a number of a forest dwelling schedule tribes
or other traditional forest dwellers .
Community rights such as nistar by what even name called
including those use in erstwhile princely state , Zamindari
or such as intermediary region .
Right of ownership access to collect use and dispose of
minor forest produce has been traditionally collected
within or outside village boundaries .
6. Other community right of use or entitlement such as fish and
other produce of bodies gazing [ both settled or transhunant]
and traditional seasonal resource access of nomadic or
pastordist communities
Right is over disputed lands under any nomenclature in any
state when claims and disputed .
Right for conversation of Patta or lease or gram issue by any local
authority or any state Govt . on forest lands to titles .
Right of settlement and conversion of all forest -village old
habitation unsurvey village and other village in forest .whether
recorded notified or into revenue village .
7. Right to product regenerate or conserve or manage any
community forest resource which conserving for sustainable
use .
Right which are recognized under any state law or laws of
any autonomous district council or autonomous rigional
council or which are occupied as right of tribal under any
traditional or customary law of concerned tribe of any tribes
of any state .
Right of aces to biodiversity and community rights to
intellectual property and traditional knowledge related to
biodiversity and cultural diversity .
8. Any other traditional right customarily enjoyed by the
forest dwelling schedule tribes or other traditional
forest dwellers as the case may be which are not
mention in clause -1-11 but excluding the traditional
right of hunting or trapping extracting apart of the
body of any species of wild animal .
Right to in-situ rehabilitation including alternation
land case where the scheduled tribe and other
traditional displaced from forest land of any
description without receiving their legal entitlement
to rehabitation .
9. Central government here by recognised and
vests forest right in –
a) The forest dwelling schedule tribes or areas
in state where they are declared as schedule
in respect of all forest right mention in
section 3 .
b) The other traditional forest dweller in
respect of all forest right mention in section
3 .
10. The gram sabha shall be the authority to initiate the
process for determining the nature and existent of
individual or community forest right or both may be
given to the forest dwelling schedule tribes and
other traditional forest dwellers within the local limit
of it juridiction under this act by receving claim
consolidation and veryfying them and preparing a
map deletenating the area of each recommended
claim in such manner may be pescribe for exercise of
such right and gram sabha shall then pass a
resolution to that effect and thereafter forward a
copy of the same to the sub-divisional level
commitee.
11. a) Any authority or commitee officers and member of such
authority or committee contravenes any provision of this
act or any rule made thereunder concerning recognition of
forest right it or they shall be cleaned to be guilty of an
offence under this act and shall be liable to be proceed
against and punished with fine which may extend to one
thousand rupees or simple imprisonment for a period
which may extend to fiften days .
b) No count shall take cognizance of any offence under
section 9 unless any forest dwelling schedule tribe in case
of dispute relating to a resolution of a gram sabha through
a resolution against any higher authority gives a notice of
not less than sixty days to the state level committee has
not proceeded against such authority .
12. This act has been met certain problems from the environmentalist
and wildlife conservationist that the law and distribution scheme
that will lead to the handling over of forest to tribal and forest
deweller . But the most important problem is that law will
impossible space or areas free of human presence for the purpose
of wild life conservation .The tiger conservation has been
mention .
The great misunderstanding of the purpose of this act was that
the law is distribute forest land and forest dweller or tribal often
claimed introduce to be at the rate of 4 hectar per family .The act
is introduce to recognized land that are all ready under cultivation
on December 13-2oo5 no to grant little to any new land .
13. The forest right act is given to all the people live
in the forest area that former they have not
given this right the government official have
power over forest and forest dweller . Now they
have a right to hole and live in forest land under
the individual or common occupation or
habitation or self cultivation for livelihood .This
is very useful to the forest dweller .
