Fed Up of Managing Marital Relationships-Take Divorce and Change Your Life
1. Fed Up of Managing Marital Relationships-Take Divorce and Change Your Life
Relationships are very delicate and demanding and if one
is unable to fulfill any of the criteria, this may lead to an
end in the relationships. One such relationship is marital
relationship, which has always been a concern for both-
husband and wife. If they are facing challenges to keep
their marital life alive and are unable to keep the
relationship, then this relationship comes to an end with a
divorce.
Although divorce may look simple but it is not easy for
the husband and wife to take this decision of ending their
marriage and living separately. Not only does it cause
emotional trauma to the couple but also to their family members and sometimes children are also
affected by it.
A divorce is a legal procedure that helps in dissolution of marital relationships, if any of the
individuals is not satisfied with his partner. Divorce can be defined as the termination of a marital
union or reorganization of legal duties and responsibilities of marriage, dissolving the bonds of
marriage between married couples and that too legally.
As divorce is a legal process and every country or state has its own legal system, thus the laws of
divorce also vary accordingly. The legal process of divorce involves issues of alimony (spousal
support), child custody, child visitation or access, parenting time, child support, distribution of
property, and division of debt. There are many types of divorces, some of which have been
described below:
● Contested Divorce: In this case the judge hears one of the
several issues at a trial level. This is a more expensive
procedure and the party has to pay for a lawyer's time and
preparation. In such a divorce the spouses are not able to
agree on issues for instance child custody and division of
marital assets. In such situations, the litigation process takes
much longer time to conclude.
● Uncontested Divorce: In this divorce the two parties come to an agreement (either with or without
lawyers/mediators/collaborative counsels) about the property, children, and support issues. When
the parties can agree and present the court with a fair and equitable agreement, approval of the
divorce is almost guaranteed. If the two parties cannot come to an agreement, they may ask the
court to decide how to split property and deal with the custody of their children.
2. ● Collaborative Divorce: Collaborative divorce is a
method for divorcing couples to come to an agreement
on divorce issues. In a collaborative divorce, the
parties negotiate an agreed resolution with the
assistance of attorneys who are trained in the
collaborative divorce process and in mediation, and
often with the assistance of a neutral financial
specialist and/or divorce coaches.
● Mediated divorce: Divorce mediation is an alternative to traditional divorce litigation. In a divorce
mediation session, a mediator facilitates the discussion between the two parties by assisting with
communication and providing information and suggestions to help resolve differences.
Any of the above divorce types can be chosen to go for a divorce. Before choosing any of the types
it is better to consult a good solicitor, as he/she will guide you throughout the procedure.
Conclusion: Although decision to divorce someone is a personal life decision but it has many lives
associated with this crucial decision. Thus before taking this decision, one must go for proper
counseling by a good solicitor.
