Can I Sue My Employer?
Workers’ compensation benefits provide compensation to injured
employees regardless of fault. As a result, in most cases, the law does
not allow employees to sue their employers to recover damages for
negligence. There are, however, limited situations where it may be
possible to sue your employer:
• If your injury was the result of extreme negligence, you may be able
to bring a claim against your employer. For example, if your employer
forced you to work without essential safety equipment, that may be a
case of extreme negligence.
• If your injury was caused by a third party at your workplace, you may
be able to bring a third-party liability claim against that party.

Workers’ Comp After
Termination?
If you have been fired after a workplace injury, you are still entitled to
workers' compensation, regardless of whether you, your employer or a
third party caused your injuries.
If you were fired in retaliation for filing a workers’ comp claim, you may
also have a wrongful termination case against your employer. In
California, it is illegal for employers to terminate workers in retaliation for
filing a claim.
Unfortunately, some employers look for an excuse to terminate injured
workers.
