                      WHAT IS TO BE DONE?

1. 30 से 40 साल पुराने शहरी िबकास कानून को नए िसरे से
बनाना होगा. 1996 UDPFI मागिनदे शो क अनुसार सारे कानून
                          ग        े
सूिित करने होगे, िसतमबर 2004 तक संशोिित.
1. 30 to 40 years old town planning act will have to be re-written. All the
laws will have to be notified in accordance with 1996 UDPFI (Urban
Development Plan Formulation and Implementation Guidelines) updated
September 2004.


2. नगरपािलका को नौकरशाह क काम की िनरीकण का हक दे ना
                         े
होगा. िाहे वह आईएएस है एिसीएस है या बीडीओ, उसक काम
                                              े
की िनरीकण करने का अििकार िसफ और िसफ नगरपािलका का
                            ग      ग
ही होगा.
2. Be it IAS, HCS or BDO, Municipality shall alone have the prerogative of
supervision of the bureaucracy.


3. मुहलला सभा और केतीय सभा - इन दोनो को मुहलला योजना
व केतीय योजना को अिितम रप दे ने का पूरा अििकार होगा.
िजस सतर की योजना नगरपािलका मे बने - उसकी एक सतर
नीिे सममित ली जाए.
3. Ward Sabha and Area Sabha shall only give final shape to the Ward Plan
and Area Plan. Referendum shall be taken one level below the level at which
any Plan is finalized in the Municipality.
4. HUDA, HSIIDC, HUIDB आिद अिििनयम इस पकार
संशोिित हो िक नगर क महकमे नगरपािलका और िसफ
                   े                      ग
नगरपािलका की िनरीकण मे ही पवतन करे .
                             ग
4. HUDA, HSIIDC, HUIDB etc Acts be revamped so that all departments of
the Municipality operate only and only under the supervision of the
Municipality.


5. राजकोष नगरपािलका और िसफ नगरपािलका की िनरीकण मे
                          ग
ही पवतन करे .
      ग
5. Treasury shall operate only and only under the supervision of the
Municipality.


6. नगर-िवषयक पुिलस नगरपािलका और िसफ नगरपािलका की
                                   ग
िनरीकण मे ही पवतन करे .

6. Civic policing shall operate only and only under the supervision of the
Municipality.


7. नगरपािलका सथानीय बस सेवा नगरपािलका और िसफग
नगरपािलका की िनरीकण मे ही पवतन करे .

supervision of the Municipality.


8. िबजली पानी सीवर आिद सेवाएँ, केताििकार-सीमा तक िसफग
और िसफ नगरपािलका की िनरीकण मे ही पवतन करे .

8. Electricity, water, sewerage etc services shall operate only and only under
the supervision of the Municipality within its jurisdictional limits.

शी भू पे ि दर िसं ह हुड डा (रोहतक): शी उपाधयक, महोदय,
मै इस िविेयक का समथन करता हूँ. यह िविेयक 45 साल
                   ग
पहले लाया जाना िािहए था, अब यह गांिीजी का सपना साकार
होने जा रहा है . मुझे नहीं लगता है िक जो इस िविेयक मे
पसतुत िकया गया है , पूरी तरह से पंिायती राज या गाम सवराजय
को लागू करने क िलए पभावी होगा.

SHRI BHUPINDER SINGH HOODA (Rohtak): Mr. Deputy Speaker,
Sir, I rise to support this Bill. This Bill should have been brought 45 years
ago, but now it is going to realise the dream of Gandhiji. I don't think that
the form in which this Bill has been presented, would be effective to
implement Panchayati Raj or Gram Swarajya completely.

हालांिक, यह उस िदशा की ओर एक पहला कदम है . 40 वषग की
अविि क बाद शी राजीव गांिी ने गाम सवराजय और महातमा

गांिी क सपने को साकार करने क िलए सोिा था. अब यह

सपना साकार होने जा रहा है . कसे पंिायतो को बनाना और कया

पद होने िािहएँ इस िविेयक मे शािमल है . जब संिविान सभा मे
संिविान क मसौदे पर िविार कर रहा था, गाम सवराजय का एक

संदभग नहीं था. जब मैने मसौदा सिमित की कायवाही पढी, मुझे
                                         ग
लगा िक कवल एक ही सदसय शी मुशी जो अवसर गामीण केतो मे
        े                  ं
रहे , वहाँ संिविान सभा मे थे. जब मसौदा संिविान, संिविान
सभा मे पेश िकया गया था विरष माननीय सदसय वहाँ संिविान
सभा मे थे, शी HV Kamath, Rangaji, Shibban Lal
Saxena और मेरे िपता Ch. Ranbir Singh. वे सब क सब

माननीय सिहत नारायण िसंह और रणबीर िसंह ने इस पर अपनी
पितििया वयक की है , और उस क बाद ही, यह िनदे शक िसदांतो
                           े
मे शािमल िकया गया था. मै रोहतक मे पंिायत सिमित अधयक
था. इस तरह, मुझे लगता है िक हिरयाणा मे मधयवती सतर पे
पंिायत सिमित कवल पणाली है , हालांिक इस िविेयक को आज
              े
पसतुत िकया जा रहा है . अधयक का पयवेकी अििकार नहीं है .

जब तक िक वहाँ क काम का िनरीकण अधयक दारा नहीं िकया
               े
जाता है , िसफ एक संसथा होने का कोई अथग नहीं है . जैसे शी
             ग
मिण शंकर अययर पहले ही कह िुक है , सभी सतरो का पतयक
                            े
िुनाव िािहए, िाहे वह है पंिायत सिमित, पंिायत या िजला
पिरषद. अचछी नीितयाँ हमारे दे श मे तैयार की गई है , और इस
संबंि मे शी राजीव गांिी क योगदान का भी िविार िकया गया
                         े
है .

However, it is a first step towards that direction. It was after the period of 40
years that Shri Rajiv Gandhi thought of bringing about Gram Swarajya' and
to realise the dream of Mahatma Gandhi and now it is being realised. How to
form Panchayats and what should be its term have been included in this Bill.
When the Constituent Assembly was considering the Draft Constitution, it
did not even make a reference to it. When I read the proceedings of Drafting
Committee, I found that only a single Member Shri Munshi who had got the
opportunity to live in rural areas, was there in the Constituent Assembly.
When the Draft Constitution was introduced in the Constituent Assembly, a
number of senior hon. Member were there in the Constituent Assembly, a
number of senior hon. Members were there in the Constituent Assembly
including Shri H.V. Kamath, Rangaji, Shibban Lal Saxena and my father
Ch. Ranbir Singh. All of them including hon. Narayan Singh and Ranbir
Singh expressed their reactions to it. And only after that, it was included in
the Directive Principles. I have been the Chairman of Panchayat samiti in
Rohtak. As per my experience as such, I may say that it was the only system
existed at intermediate level in Haryana though the Bill is being presented
today. The Chairman has no supervisory powers. So, merely having an
institution is of no meaning unless the work accomplished there is
supervised by Chairman. As Shri Mani Shankar Aiyar has already pointed
out that of all levels direct election is a must whether it is Panchayat
Samiti.Panchayat or Zila Parishad. Good polices have been formulated in
our country and the contribution of Shri Rajiv Gandhi too has been
considered in this respect.


लेिकन उिहोने यह भी कहा िक कल रािश का कवल 15 पितशत

गामीण केतो तक पहुँिता है . कया कारण है ? कारण है , इन
मामलो मे नौकरशाही की पूरी पकड. जब तक िवकास मे
नौकरशाही का हसतकेप गांव सतर पर हटा नहीं िदया जाता है ,
इस िसथित को बदला नहीं जा सकता. कवल आईएएस अििकारी

ही नौकरशाह क रप मे वयिक नहीं है , बिलक गाम सेवक या
            े
सििव, जो पंिायत का सारा काम करता है वह भी नौकरशाह है .
पिान गाम सभा या गाम पंिायत का उन पर कोई िनयंतण नहीं
है . िकसी भी िनवािित वयिक को ऐसे मूलयांकन की समीका का
                 ग
अििकार है , न ही िनवािित वयिक वषग भर मूलयांकन करता है .

पंिायत सिमित, जो मधयवती सतर क रप मे कहा जाता है , क
                             े                     े
अधयक की कोई भी ताकत क रप मे वह गाम सेवक या सििव
                     े
की िरपोटग िलख नहीं सकता है , और न ही िजला पिरषद मे िकसी
को भी बीडीओ की समीका करने का अििकार िदया गया है .
But he also admitted that only 15 percent of the total funds reaches the rural
areas. What is the reason? Complete hold of bureaucracy in these matters is
the reasons. The situation cannot be changed unless the interference of
bureaucracy in the development works at village level is removed. An IAS
officer is not the only person to be considered as bureaucrat, rather the
functionary like Gram Sewak or secretary, who looks after the entire work of
Panchayat is also bureaucrat. The Pradhan of Gram Sabha or the gram
Panchayat has got no control over them. He does not put up any appraisal
through out the year nor any elected person is the reviewing authority of
such appraisals. The Chairman of the Panchayat Samiti, which is called as
intermediate level, has got no power as he does not write his report nor BDO
has any reviewing authority in Zila Parishad.

मेरे अपने अनभव से एक घटना वणन: पहले िदन, जब मै पंिायत

सिमित की बैठक मे शािमल होने क िलए गया था, मै कायालय समय

9.00 से पहले पहुँिा था. वहाँ लेखाकार आिद सिहत कछ कमिारी सही
                                               ु   ग
समय मे उपिसथत थे. लेिकन मैने 5-6 कमिािरयो को अनपिसथत पाया.

जब मैने उिहे उनका अनपिसथत िििि लगाया, बीडीओ ने आपिि की.

बीडीओ से मैने कहा जब अधयक मै हूँ, मै यह कर सकता हूँ, बीडीओ ने
कहा, कोई अििकार नहीं है . अगर अधयक को जाँि करने क िलए कोई
                                                 े
अििकार नहीं है , अधयक कमिािरयो दारा काम कसे पाए? िवकास क
                        ग                ै              े
िलए सरकार दारा आवंिटत िन का उपयोग करना कसे संभव हो जाएगा.

I narrate an incidence from my own experience. First day, when I went to
join the meeting of Panchayat Samiti, I was well in time and the office time
was from 9.00 a.m. There were some employees including accountants etc.
who were also supposed to be present there in time. But I found 5-6
employees absent. When I marked them absent, the BDO objected to it. I
told him that since I was supervisor, I could do it, he said that I had no
authority to do that. How is it possible to get work done by the employees if
the supervisor has no authority to check them? How will it be possible to
utilize funds for development works allocated by the Government for the
purpose.

73 & 74 Constitutional Amendment Act What Is To Be Done

This Bill should have been brought 45 years ago, but now it is going to realise the dream of Gandhiji. How to form Panchayats and what should be its term have been included in this Bill. When the Constituent Assembly was considering the Draft Constitution, it did not even make a reference to it. When I read the proceedings of Drafting Committee, I found that only a single Member Shri Munshi who had got the opportunity to live in rural areas, was there in the Constituent Assembly. When the Draft Constitution was introduced in the Constituent Assembly, a number of senior hon. Member were there in the Constituent Assembly, a number of senior hon. Members were there in the Constituent Assembly including Shri H.V. Kamath, Rangaji, Shibban Lal Saxena and my father
  • 5. Ch. Ranbir Singh. All of them including hon. Narayan Singh and Ranbir Singh expressed their reactions to it. And only after that, it was included in the Directive Principles. I have been the Chairman of Panchayat samiti in Rohtak. As per my experience as such, I may say that it was the only system existed at intermediate level in Haryana though the Bill is being presented today. The Chairman has no supervisory powers. So, merely having an institution is of no meaning unless the work accomplished there is supervised by Chairman. As Shri Mani Shankar Aiyar has already pointed out that of all levels direct election is a must whether it is Panchayat Samiti.Panchayat or Zila Parishad. Good polices have been formulated in our country and the contribution of Shri Rajiv Gandhi too has been considered in this respect. लेिकन उिहोने यह भी कहा िक कल रािश का कवल 15 पितशत ु े गामीण केतो तक पहुँिता है . कया कारण है ? कारण है , इन मामलो मे नौकरशाही की पूरी पकड. जब तक िवकास मे नौकरशाही का हसतकेप गांव सतर पर हटा नहीं िदया जाता है , इस िसथित को बदला नहीं जा सकता. कवल आईएएस अििकारी े ही नौकरशाह क रप मे वयिक नहीं है , बिलक गाम सेवक या े सििव, जो पंिायत का सारा काम करता है वह भी नौकरशाह है . पिान गाम सभा या गाम पंिायत का उन पर कोई िनयंतण नहीं है . िकसी भी िनवािित वयिक को ऐसे मूलयांकन की समीका का ग अििकार है , न ही िनवािित वयिक वषग भर मूलयांकन करता है . ग पंिायत सिमित, जो मधयवती सतर क रप मे कहा जाता है , क े े अधयक की कोई भी ताकत क रप मे वह गाम सेवक या सििव े की िरपोटग िलख नहीं सकता है , और न ही िजला पिरषद मे िकसी को भी बीडीओ की समीका करने का अििकार िदया गया है .
  • 6. But he also admitted that only 15 percent of the total funds reaches the rural areas. What is the reason? Complete hold of bureaucracy in these matters is the reasons. The situation cannot be changed unless the interference of bureaucracy in the development works at village level is removed. An IAS officer is not the only person to be considered as bureaucrat, rather the functionary like Gram Sewak or secretary, who looks after the entire work of Panchayat is also bureaucrat. The Pradhan of Gram Sabha or the gram Panchayat has got no control over them. He does not put up any appraisal through out the year nor any elected person is the reviewing authority of such appraisals. The Chairman of the Panchayat Samiti, which is called as intermediate level, has got no power as he does not write his report nor BDO has any reviewing authority in Zila Parishad. मेरे अपने अनभव से एक घटना वणन: पहले िदन, जब मै पंिायत ु ग सिमित की बैठक मे शािमल होने क िलए गया था, मै कायालय समय े ग 9.00 से पहले पहुँिा था. वहाँ लेखाकार आिद सिहत कछ कमिारी सही ु ग समय मे उपिसथत थे. लेिकन मैने 5-6 कमिािरयो को अनपिसथत पाया. ग ु जब मैने उिहे उनका अनपिसथत िििि लगाया, बीडीओ ने आपिि की. ु बीडीओ से मैने कहा जब अधयक मै हूँ, मै यह कर सकता हूँ, बीडीओ ने कहा, कोई अििकार नहीं है . अगर अधयक को जाँि करने क िलए कोई े अििकार नहीं है , अधयक कमिािरयो दारा काम कसे पाए? िवकास क ग ै े िलए सरकार दारा आवंिटत िन का उपयोग करना कसे संभव हो जाएगा. ै I narrate an incidence from my own experience. First day, when I went to join the meeting of Panchayat Samiti, I was well in time and the office time was from 9.00 a.m. There were some employees including accountants etc. who were also supposed to be present there in time. But I found 5-6 employees absent. When I marked them absent, the BDO objected to it. I told him that since I was supervisor, I could do it, he said that I had no authority to do that. How is it possible to get work done by the employees if the supervisor has no authority to check them? How will it be possible to utilize funds for development works allocated by the Government for the purpose.
