4. TERMS AND CONDITIONS
1. Every advertisement placed and accepted for publication is subject to the conditions set out hereunder.
2. Subject as hereinafter provided, the advertisement will appear in the Publication indicated, published by OMA (‘the Publisher’), on condition that
the Publisher does not object to publishing the whole or any part of such advertisement.
3. The Advertiser and his advertising agent, if any, to the extent permissible by law, each indemnify the Publisher, Proprietor and employees of
the Publisher against all costs, expenses, claims, demands, damages and losses of any kind wholly or partially attributable to or arising out of
acceptance for publication of any advertising material.
4. The Publisher shall have the right to delete the whole or any part of the advertisement without prior notice to the Advertiser and (on making any
refund as shall in the opinion of the Publisher be equitable in respect of the whole or any proportion of any fee paid hereunder by the Advertiser)
shall have no liability whatsoever to the Advertiser in respect of such deletion.
5. The Advertiser may, at any time, by notifying the Publisher in writing not less than twenty-eight days prior to the copy date, as indicated on the
rate card already furnished, have all or any of the advertisement omitted from the Publication. On the giving of such notice the Publisher will refund
to the Advertiser any fee paid by the Advertiser. Any cancellation received after that date will be charged in full whether or not the advertisement
appears in the Publication for which it was ordered.
6. Without prejudice to the generality of the foregoing, the Publisher shall not be liable to the Advertiser for any damages whatsoever resulting
from failure to include all or any of the advertisements referred to herein in the Publication, nor from any errors whatsoever in the advertisement
printed in the Publication, where such damages would exceed 10% of the fee charged.
7. The Publisher shall not be liable to the Advertiser for any loss of profits or for any other consequential loss, damage, or expenses howsoever
caused, nor shall the Publisher be liable to the Advertiser in respect of any omission from the Publication.
8. The Advertiser shall pay to the Publisher the total price as set out in the rate card already furnished for the advertisement in the Publication. If the
Advertiser should fail to pay any amount due to the Publisher on the due date thereof, the Publisher shall have the right to cancel this agreement
without notice.
9. The Publisher shall have the right to reject all or any advertisements or any entry in the Publication and give no guarantee of any kind
whatsoever as to the position in the Publication of the advertisement.
10. The parties hereby agree that this agreement in writing is the entire agreement that exists between the parties in relation to this matter, and that
all prior representations, warranties, undertakings or understandings of any kind whatsoever are hereby expressly excluded. Neither the Publisher
nor the Advertiser shall be bound by any agreement or understanding not expressed herein.
11. The Publisher shall not be liable to the Advertiser in respect of any failure to carry out or delay in the carrying out any of the Publisher’s
obligations hereunder attributable to any cause of whatever nature outside the Publisher’s reasonable control.
12. With effect from the date of the publication of the next issue of the Publication, this agreement cancels and supersedes all or any previous
agreements between the Advertiser and the Publisher in respect of advertising appearing in the Publication.
13. This Agreement shall not be binding on the Publisher until the same has been accepted and executed for and on behalf of the Publisher.
14. This Agreement shall be deemed to have been made in the Republic of Ireland and shall be governed and construed in accordance with the
laws of the Republic of Ireland. The Advertiser irrevocably and unconditionally submits itself to the jurisdiction of the Courts of the Republic of
Ireland in respect of all disputes arising out of this Agreement. Any claim payable hereunder shall be paid in Ireland in Euro.
15. The provisions of Section 39 of the Sale of Goods and Supply of Services Act 1980 are expressly excluded from this contract.
16. Every advertisement is accepted for publication by the Publisher on the basis that the Advertiser and the advertising agent or any other
person who solicits the advertisement warrants to the Publisher that the advertisement and its contents are true and correct in all respects and
are in no way likely to mislead or deceive and thereby cause loss, damage or injury to members of the public to a material degree so as to be in
contravention of Section 8 of the Consumer Information Act, 1978.
CONTRACT AND COPY REGULATIONS
1. Agency and Advertiser shall indemnify Mac Communications (‘the Publisher’) against any damages and related expenses
(including legal fees) arising from the publication of the advertisement.
2. The Publisher shall have no liability for failure to execute accepted advertising orders.
3. The Publisher reserves the right to cancel any advertising order or reject any advertising copy at any time prior to press date, whether or not the
order or copy has already been accepted or acknowledged.
4. Position cannot be guaranteed.
5. The Publisher is not responsible for errors in advertisements.
6. Every advertisement is accepted for publication by the Publisher on the basis that the Advertiser and the Advertising Agent warrant that the
advertisement and its contents are true and correct and are in no way likely to mislead or deceive and thereby cause loss or damage or injury to
members of the public.
7. A commission will only apply to Advertising Agencies recognised by IAPI.
8. Space costs in Ireland are quoted excluding VAT, which will be charged at the rate applicable on the date of issue.
