• MAGNA CARTA FOR PUBLIC SCHOOL
TEACHERS
• Approve on June 18,1966
• To promote and improve the social and
economic status of public school teacher,
their living and working conditions, their
employment and career prospects
9. Republic Act No. 4670
• MAGNA CARTA FOR PUBLIC SCHOOL TEACHERS
-It provides the following:
• recruitment qualification for teachers
• Code for professional conduct for teachers
• -teaching hours: 6 houurs of classroom
teaching(maximum load)
• Health and injury benefits (thru GSIS)
• One year study leave after 7 years of continuous
teaching; the teacher should receive 60% of the
monthly salary.
Labor Code of the Philippines
• On may 1, 1974
• Presidential Decree No.442
• By president Marcos
• This law become basis of the rights, duties, and
benefits of the workers in the Philippine private
employment sector.
Art .3
• State shall afford protection to labor and promote
full employment ensure equal work opportunities
regardless of the sex, race, creed and regulate the
regulation of workers and employers.
9. Republic Act No. 4670
Rights of a Teachers
1.COMPESATION (kabayaran,payment)
• Every private school and TVET school /institution
provides for compensation policy .
• No teachers should be given a salary that is below
minimum wage.
• No work no pay principle unless specifically
requires by the law.
• Not more than 8 hours work
Rules on Salary Payment
• The Wages are paid Legally under ,Art 3,
convention no.95 of the international Labor
organization.
• No employer shall pay the wages by means of
– Promissory notes
– Voucher
– Coupon
– token
– Tickets
– chits
Art 102- Labor code of the Philippines
• Payment of wages
• Paid legally by:
– Bank check
– Postal check
– Money orders

• -amount of time employees to pay
• -monthly, every two weeks, twice a month etc.
Salary increase as a result of tuition fee increase
• No law that requires private school use the
tuition fee increment as an increase in salary.
• The only limitation that must go is payment of
salaries, wages, allowances and other benefits
of the school personel.
2. Statutory Monetory Benefits
• Statutory – naayon sa batas.
• Monetory- Ng salapi / value, money.
• Private school teacher who are paid on an annual
basis and are engage in school holidaysshould be paid
at daily rate even during holidays.
• Private school teacher in college are not entitled pay
for regular holidays falling within the semestral
vacation. ( they do not work on these holidays)
– And considered “ No Class Days”

• Statutory – naayon sa batas.
• Monetory- Ng salapi / value, money.
• Private school teacher who are paid on an annual

1,chapter III, art 94 of the labor Code)
• Private school teacher in college are not entitled pay
for regular holidays falling within the semestral
vacation. ( they do not work on these holidays)
– And considered “ No Class Days”

Holidays works
• A . Where an employee is made or permitted of at least
thirty percent(30%) of his regular wage.
• When teachers work more than the regular daily
working hours, they are entitled to overtime pay. (art87
of the labor code)
• Teachers should be given incentives leave or its
equivalent.
• Presidential decree No.851
– Requires the schools to pay their teachers and rank and file
employees a 13th month pay not later than 24 of December.
Overload Pay
-DOLE-DECS-CHED-TESDA Order
No.02, series of 1996
• Overload a temporary arrangement resorted to when
there is no teacher available to teach the
subject/course.
• Overload constitutes overtime work and thus entitle
to overtime pay.
• Every pregnant employee are entitle for maternity
leave with pay.
• And For male employees are entitled for paternity
leaved pay, for seven days.
