Lay Witness or Eyewitness
Ø An individual called to testify about
matters they have observed or
experienced firsthand.
Ø An eyewitness is someone can provide
proof of or attest to a fact or event.
Ø Generally not permitted to provide
opinions as part of testimony.

Ø Federal Rules of Evidence 702 states that,
to be admissible, an expert witness “must
assist the trier of fact to understand the
evidence or determine a fact in issue.”
Ø To be qualified as an expert witness, the
witness must have defined knowledge,
skill, experience, training, or education in

provide testimony.

Ø Preponderance of Evidence: Lowest of three
standards applied mostly in civil actions. “More
likely than not” (51% chance)
Ø Clear and Convincing: Intermediate standard of
proof used in cases where liberty interests are at
stake (e.g. loss of parental rights). Generally
defined as level of certainly (75% chance)
Ø Beyond a Reasonable Doubt: Highest standard
of proof used in cases where loss of liberty is at
stake (e.g. incarceration etc.) Level of certainty

(2) The ability had more to do with being than doing.
