formation. Myra Bradwell was a woman who had extensive law training and was qualified to
practice law. However, when she applied for a license to practice law, the court refused. The
court argued that, while she was extremely qualified to practice law, granting her a license would
disrupt the idea that men and women were supposed to occupy different spheres of action, and that
it belonged to men to make, apply, and execute the laws (23) because women were unfit for civil

This court ruling shows contradiction in many ways. First, the fourteenth amendment states that no
State shall make or enforce any law which shall abridge the privileges and immunities of citizens
of the United States (23). The Court acknowledges this, but justifies their ruling by saying that God
had created women and men to have different jobs, and that the law of God was that the paramount
destiny and mission of woman are to fulfil the noble and benign offices of wife and mother (24). In
this argument, the Court bases their refusal of her license on the gender hierarchy that exists
