In a lot of the winters and summers growing up I would walk down the same path through the
northern woods down to the lake. In the summer it was gorgeous, the trees are in full bloom and you
can hear the leaves rustling in the wind and crunching under your feet. Walking down that path was

For this book review, I decided to read A Well Payed Slave. This book describes the controversial
journey of Curt Flood, a former Major League Baseball player and his fight to end the reserve clause
in professional baseball while also endorsing the idea of free agency in the league. Prior to taking this
class, I was unaware of the reserve clause, Curt Flood, or how free agency came along; I had always
assumed free agency had always been a part of professional sports. Curt sought after the freedom of

The claim was that Major League Baseball could not operate with both interstate and intrastate
commerce. If considered interstate commerce, MLB s reserve clause would be a violation of the
Sherman Antitrust Act (1890), which deemed every contract, combination...or conspiracy illegal that
restrained trade or commerce among the several states. The goal was to ban monopolistic practices
that prevented competition (p. 20). In the 1922 court case Federal Baseball Club of Baltimore, Inc v.
National League of Professional Baseball Clubs, MLB and its operational functions were found to be
considered intrastate commerce. This verdict established Major League Baseball s legal monopoly,
which is today known as baseball s antitrust exemption. After a long hard fought battle with the MLB,
the Supreme Court ultimately ruled against Flood.
Although Curt Flood lost his fight for free agency, it was not considered a total loss due to the
development of the 10 and 5 rule. The 10 and 5 rule, is any player with 10 years of major league
service and 5 years with the same team could not be traded without his consent. The 10 and 5 rule
would have prevented Flood s trade and is often referred to as the Curt Flood Rule. (p. 314).
