The purpose of the study was to analyze the importance given by selected major Indian IT firms to innovation based on their Patent portfolio as a measure. Analysis of the Patenting activity provides an insight into current trends in intellectual property generation apart from providing an account of innovation and technological development taking place in the Information Technology sector. The study summarizes results of the research that was conducted on HCL Technologies Limited, Infosys Technologies Limited, Mahindra Satyam , Tata Consultancy Services Limited and Wipro Limited. This report covers filing trends of the above mentioned companies along with status of Patents, International Patent Classification and Priority Date. The study also provides the filing trends and status with the field of engineering to which they belong, along with details of all Patents filed by these companies since their inception. Our research suggests that after a moderate retrenchment in the years 2008-2009, the IT industry in India is recommitted to pursue innovation. The fact that the said companies consider innovation to be one of their key assets and are committed to boost their spending on Research & Development and innovation is evident from the increase in number of Patents that have been filed by these companies in US Patent Office, European Patent Office and Intellectual Property Office India. The study details the challenges associated with software Patenting in India and postulates that despite the restrictions of obtaining a software Patent per se in India, the IT industry is taking a prominent stand on generating and protecting Intellectual Property in India and abroad. Since the year 2000, awareness about Innovation and Intellectual Property Management has been on the rise in the IT industry. It is evident from the Patent filing statistics of the Intellectual Property Office India that the number of Patent filings in the field of computer science has been on the rise since 2004. Across the world, a large number of organizations are considering innovation as top priority, and consequently raising the investment on innovation. In this study, the trends indicate that innovation has been geared towards minor improvements to existing products and services as against innovation targeting newer products. However, the companies are broadening types of innovation functions they are targeting. The emphasis on product development and idea generation is increasing.

Make in India can be a path breaking campaign provided it is grounded by right policy measures and innovation ecosystem. Technology has a pivotal role in this and the efforts of the nation in promoting technological innovations have so far yielded limited success. Technology transfer requires easing FDI limits and other fiscal incentives. However, the past experience of technology transfers in military indicated failure to deliver by foreign partners. Liberalization as well as stringent conditions is hence important to make technology transfer through collaborations. Indian government has announced some fiscal incentives and welcomed collaborations. In the light of this, the need for developing competences for technology absorption has gained attention. In a latest ruling in the patent battle the Utah federal court has rejected XRoads Networks patent validity challenge over one of its Software Defined Networking patents. In its press release the FatPipe has said “we are pleased to announce that a validity challenge to our patent has been rejected by a Utah federal court in FatPipe Networks, Ltd. v. XRoads Networks, Inc. In its ruling, the federal court denied XRoads' motion for summary judgment of invalidity of FatPipe's patents.”

In a latest legal spat between companies, Kyoto-based Kyocera withdrew its patent infringement lawsuit against Hanwha Q Cells Japan filed earlier in relation to its Solar Technology patent. The move was taken by the company following the conclusion of a technology-licensing agreement between the two companies. The lawsuit was filed b the plaintiff in July 2014 with the Tokyo District Court after negotiations with Hanwha failed to progress, according to Kyocera.

In a new setback, Suntory Holdings Ltd. one of the renowned beverage makers has lost a long-battling patent infringement battle with rival Asahi Breweries Ltd. on Thursday, with the Tokyo District Court rejecting its demand for a halt to production and sales of Asahi’s nonalcoholic beer. Earlier, Suntory filed the lawsuit against Asahi in January after they failed to resolve the dispute through talks. With this patent suit, the plaintiff had sought the suspension of Asahi’s Dry Zero, which was re-launched in September 2013 and in its lawsuit the plaintiff had alleged that Asahi’s Dry Zero products are infringing on patent application filed in November 2012 and approved in October 2013.

In a milestone verdict in the Patent and Trademark arena, one of the renowned Industrial and Marine Ventilation Solution providers, Eldridge, prevails against Jurong Shipyard Pte., over Enjet patent infringement lawsuit. According to verdict, the plaintiff Eldridge will be receiving a hefty sum of $800,000 from Jurong Shipyard Pte., Ltd as a compensatory and monetary injunction in lieu of infringing upon its proprietary patent by the defendant. The verdict came into existence when the U.S. Court of Appeals for the Federal Circuit in Washington, D.C., denied a request by Jurong Shipyard Pte., Ltd., subsidiaries of Atwood Oceanics Inc. and Seadrill Limited, and Azen Manufacturing Pte. Ltd, for a rehearing of the patent suit, reaffirming the court’s decision that the defendants had infringed on Eldridge ENJET’s patent. It is important to underline here that ENJET is a technology that addresses a longstanding problem in the offshore drilling industry and the Houston-based Eldridge originally filed this lawsuit in November 2011.

According to reports from various sources, the patent lawsuit was filed in the U.S. District Court of Massachusetts in which the litigator has sought monetary compensation and injunction for using its technology unlawfully. The patent lawsuit filed by Exergen Corporation alleges that the Taipei based company has made infrared thermometers that infringe its ‘386 patent and caused such thermometers to be used, offered for sale, and sold in various parts of the United States. It is important to underline here that the thermometers which are under the scope of this lawsuit are sold in various parts of the country by Kaz USA, Inc, under the name Braun Forehead Thermometer and Vicks Forehead Thermometer.
