Sexual harassment claims come in two forms: Quid pro quo Hostile environment
Quid pro QuoA demand for sexual favors in exchange for some job benefit (something for something)Such As:A supervisor demands that an employee have sex with him or her in order to get a promotion.And the Employment benefit is gained or lost based on acceptance or rejection of request

Hostile Work Environment”This form of sexual harassment may include:Offensive language, jokes, gestures, comments or even offensive pictures, calendars, or graffitiIn hostile work environment situations the harassment is based on the individuals perception. So what is offensive to one person may not be offensive to another.Although the law doesn’t prohibit simple teasing, offhand comments, or isolated incidents that are not very serious, But remember it reaches the level of hostile work environment when the activity is unwelcomed weather it be verbal or physical conduct of a sexual nature and when this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance, or creates an intimidating, hostile, or offensive work environment.
Here are a few examples of potential Sexual Harassment
Have you as a supervisor or co-worker every given another co-worker a hug? It may seem incent enough but it could make the other person uncomfortable and lead to a possible sexual harassment claim.So stop and think. It could be perceived as flirtations thus making it inappropriate conduct in the workplace.
Think about this situation- 2 male co-workers talking and telling sexually suggestive jokes and a female worker walks by and they both stare at her making her uncomfortable. Or Have you or someone you know every been in this situation were you are telling jokes of a sexually nature and not really thinking about it and the two of you are perfectly fine with the conversation but it is over heard by a co-worker male or female makes no differences and they find it offensive.These are examples hostile work environment sexual harassment and you could have a claim on your hands.
Here in this situation you have a Supervisor placing his hand on the shoulder of a young woman. It could also as easily be a male co-worker.Have you every walked up to a co-worker and place your hand on their shoulder or try to give him or her a should rub. Well you guest it. If the co-worker is uncomfortable with this it could be sexual harassment that is creating a hostile work environment.
