Protocol for the Patent & Mark protection against conflicts
potentially arising in the Barcelona Mobile World Congress (GSM
Association) and Professional Exhibitions and Congresses (2016)
Foreseeing the potential conflicts that may arise during the Mobile World Congress
(MWC), involving patents and trademarks, the Business Courts of Barcelona have
implemented a specific protocol that, among others, will include:
1. Preferred, fast-track processing of urgent measures involving patents, and designs
that will be presented at the MWC, breach of trade mark rights, and intellectual
property rights in general, as unfair competition practices and illegal, misleading
advertising relating to products and subjects exhibited during the congress.
2. Court resolution of precautionary measures on these subjects within a 2-day term.
3. Possibility to file preventive writes with the Barcelona Courts to avoid that, on a
potential IP conflict one party files request for precautionary measures without the
other party’s knowledge.
The MWC, held annually in Barcelona city, is the most important congress of mobile
communication, where most innovations and improvements e.g. in wireless and mobile
communication solutions (technology patents), new applications, and new generation
software are presented worldwide (IP rights); new designs, and other
computer/software and communication media - tablets, phablets, laptops, etc.
(industrial designs), and lead computer, electronic, and telecom companies share one
same space during this MWC congress.
Although the protocol is intended solely for the conflicts arising within the MWC, public
and private institutions are requesting to extend it to other exhibitions and congresses
held during the rest of the year in Barcelona where competing intellectual property
rights may encounter and give rise to collision and conflicts. (Source Judiciary Branch).
