On September 24, 2014, the Mexican Supreme Court (SCJN) issued a landmark decision in the world of arbitration and class action suits. In summary, SCJN upheld that it is possible to file a class action suit, even though an arbitration clause is included in the agreement that governs the business relationship. SCJN reached the conclusion that the laws that regulate consumer relationship and class actions suits have a public interest, and; therefore, a Court may not reject a class action suit based on the argument that the parties are subject to arbitration.
The Supreme Court of Mexico recently recognized punitive damages in civil cases, changing how civil liability is perceived. Punitive damages aim to both compensate plaintiffs and deter bad behavior by defendants. This legal concept is meant to guarantee fair compensation and had been implicitly recognized in Mexican civil law. The Court established guidelines for determining punitive damages awards based on the defendant and plaintiff's characteristics and degree of responsibility. This recognition of punitive damages means foreign judgments including them can now be enforced in Mexico.
